This bill once amended or former laws by allowing any food that is not a potentially hazardous the to be classified as a cottage food. This bill will give us significant needed reform in a way that still insurers the health and safety of both producers and consumers while lifting unnecessary government regulations. The witness in our local food supply chain was never more exposed than it has been the past year because of because of it we need to ensure that this never happens again in our state. Additionally this bill support small business a national survey recently found that cottage food producers are problem primarily women who live in rural areas you have a below average income their median sales or two thousand dollars a year and their median gross is five hundred dollars. We talked yesterday about farmers markets and how little they're regulated people could be spring the products with various chemicals that we don't know anything about could you speak to that just briefly yeah I mean there's there are many foods that are already currently allowed under law and that she will sold hall at farmers markets things like that so those are already not regulated by the department of health so we have a list of non potentially hazardous foods but very limited in scope and not really for any good or specific reason and quite honestly the department of health has had the authority for the past several years as you'll see on page two of this bill that they can add similar products specified in rules adopted by the department of health that can be and qualified as cottage fades but they've not taken the initiative over the several years include any other and non potentially hazardous foods in our cottage food laws so to me it doesn't make any sense for us to say some non potentially hazardous foods were allowed to sell but not others and for arbitrary reasons there are no reasons to speak at asked why only some but not others are allowed there states across this country that have a wide list of potential non potentially hazardous foods that they're allowed to cells cottage fades Arkansas is just one of the most restrictive states we have the food that we have and we refuse to expand over the years there's no reason for that like I said we saw a huge weakness in our local food supply chain this past year due to covid and there's no reason for that we don't need to let that happen again I think it's perfectly fair and reasonable to say if it's a non potentially hazardous foods. Thank you members this bill I worked on with the department of corrections in the board of corrections and add the problem that we're trying to addresses that first and foremost victims should always I we should always work to try to get restitution to our victims but it's very difficult to do that when the offender has different fines in different counties and there's no right now there's no system to actually pull all that data and information together in one place so that they understand where their debt is and also hinders the people in the department of community corrections or supervising these released prisoners from being able to help them pay their debts and understand where they're debts are and how they're collected it's a big problem and it there's it's going to require some solutions that's why we couldn't do everything right now in this bill and we created the ability to have this task force with those in law enforcement and corrections because we need to be able to upload that information wherever it exists in all the different counties so that were real clear about what the debt is owed and get them on the path of paying that off and then also trying to reduce those fines so that they don't end up in what's called what I call a debtors prison prison they serve their time in prison let's not let them serve their time in debts and that president as well so this is an effort to address that and I'll be happy to answer any questions any questions for Senator Irvin. And they cannot take out more than twenty percent of the gross wages per pay period to rip to recoup their money and they also have to specify the amount the method that was used to calculate and the cause of the overpayment there are exemptions and if it's caught before the next pay period if they accidentally you know write your check for over a thousand dollars and it should be but they catch it immediately before the next pay period they are exempt from this and also if it's a grant funded position if I later the and if any of these sections are violated the employer will have to return the deductions and also pay the amount and that they deducted and quite honestly this just protects workers from that employers and there's not any process or anything out of place so if and so bad employers can really abuse this and if an employee has been unintentionally overpaid for long periods of time which I've seen before and when I was on school board it happened with one of our employees and it was to the amount of thousands of dollars but because then the school district was a good employer and they worked out a plan of a repayment plan for that employee but you have some employers he refused to do that they don't tell the employee how the overpayment was made how much they owe or anything and they just garnish wages from their check entire taken tire checks pay period after pay period and and obviously this leads a lot of issues like the employee being able to pay bills or pay rent and so this is just a good I think senate bill that protects employees and in a way that they're able to repay the employer for overpayment but do in a way that's fair and allows them to still keep a roof over their heads happy to take any questions any questions for Senator Davis Senator Hickey you're recognized for a question. If the credit is awarded a can only be carried forward for three years these credits will be awarded on a first come first serve basis and DFA will manage the application of the credits like they do other credits in the state. The scholarships will be administered by scholarship granting organization in exempt students that are currently participating in a similar program and students that are currently at a private institution the scholarships cannot exceed eighty percent of the foundation funding for students applying for kindergarten to eighth grade or ninety percent of the foundation funding for ninety three graduation through the oversight of both scholarship granting organization and the institutions accepting the students this oversight includes annual audits and required annual testing of the participating students further it requires annual disclosure of those testing results. I don't want to get lost in the weeds on this bill this is really not all that complicated I'm simply presenting a bill that allows parents to make decisions that are in the best interest of the children. I'm not presenting this bill to get them public education quite the opposite I am the product of public education I graduated from the high school my mom is a kindergarten teacher my dad was a school principal. I believe that in most cases public schools are the best place for a child however I do know that it that is not always the case and one thing to keep in mind if everything is going well and every students needs are being met at a public school there will not be a single kid leave. It creates huge efficiencies for county clerks currently and the DMV if your answer to that they're they send it over in a file to our county clerks and their not checked for accuracy or anything so you have people who think that they register to vote and filled out their form incorrectly checked the wrong box and they are never and registered to vote because there form was incorrect and no one called to let him know so this ensure that that doesn't happen and then it ensures that are seventy five county clerks are not and going through incomplete incorrect voter registration forms. Once registered it does not automatically approve your voter registration form it says that it is still pending and it will be pending for thirty days for address verification that's exactly what we do with mail and paper voter registration ballots there's a thirty day waiting period for address verification this does the exact same thing nothing is automatically approved. It also cleans the voter rolls before every election it and matches with that master death file with the Social Security Administration and can also use other means and to match to ensure that our voter rolls are updated and and clean that. This bill has joined an integrated system with other states that compares voter histories voter registration lists and other states to ensure the accuracy of our roles to identify any address changes to prevent duplications of voter registration in one or more other states and to determine voter eligibility of the people who are on our roles. This bill prevents the Secretary state from promulgating rules a hundred and an within a hundred eighty days of a federal election so they cannot promise promulgate emergency rules before an election this means that if you want to register to vote online two weeks out before the election there's nothing that can go on where the secretary state can say you're automatically registered to vote they are not allowed to do that under this bill. It allows a statute of limitations to be revived in the case of crimes of domestic violence the reason is because unlike virtually any other crime a victim of domestic violence is frequently still under the control of the their abuser. and they're frequently in a position where they're too afraid to come forward to report their crime and in many cases a victim of domestic violence The only sensually get free of their abuser and feel comfortable coming for to report their crime after the statute of limitations has already expired so what this bill does is in the case of a felony it allows a statue limitations to be revived for up to five years after the original statute has expired and it's the same process for misdemeanor but three years instead of five years under certain circumstances the first condition for any of it is. That the alleged crime cannot have been reported to law enforcement or prosecuting attorney before if that's the case the statute cannot be revived because in that case the crime was already reported the first time in it defeats the purpose of what we're trying to do here so the condition for all of it is it hasn't been reported to law enforcement or prosecuting attorney previously and then the second piece is one of four circumstances has to be present. One is DNA evidence sufficient to charge the defendant the second is the state becomes aware of audio video recording other written or electronic communication like a text message that proves OR is at least sufficient to charge a defendant of a domestic violence crime the third circumstances if the defendant confesses and the fourth is if three or more persons also victimized by the defendant a president consistent and similar evidence of of other types of domestic crime so so that's what it does we're aware of a case another state where a victim came forward after the statute had expired and she did so because she learned that there were several other victims by the same perpetrator. and so that this is seeking to address this unique problem with crimes of domestic violence where the victims are often under the influence and control of those who are abusing them give them a period of time to break free of that abuse control before they have to come forward to report crimes so that's what the bill does that be happy to answer any questions enquire.
