Also seventy forty six representative under way to establish an allowance law to amend the cosmetology Act into exempt certain individuals in the station from licensure by the cosmetology technical advisory committee represent Underwood you're recognized explained the bill. Thank you Mr Speaker members this bill is brought to me I got this idea from a constituent of mine AnnaLynne McCord who's a seventeen year old students who is a student at clover community school he lives in my district to undoubtedly is watching with her mom during this presentation right now it is her dream to work and hopefully one day own and hair salon and actually show so badly wants to enter this field that she recently had a seventeen so long being to birthday party and she also has a committee can that that she's named crystal that she practices her skills on however AnnaLynne also has added challenge of having down syndrome this is not mean that she doesn't have the ability to work or provide shampooing services in a salon but it does mean that our current regulations create unnecessary barriers for her to enter the field so this bill which I titled AnnaLynne law is limited very limited in scope. And only allow shampooing drying and simple hair styling services to be provided without the additional barrier of a cosmetology license here selling services or similar to the practice of natural hair braiding which also is already exempt from license requirements in Arkansas in fact under the natural hair braiding Act one can already provide shampooing services without the licensure requirements. This is safe it does not use dangerous chemicals nor does it use standards devices however we have added a couple of important safeguard provisions provisions for consumer protection first. Individuals who want to provide these hair hair styling services must register with the department of health and must pay a ten dollar fee just to cover minimal administrative costs and if they lose the registration because there have complaints against them then they would no longer be provide be able to provide the services. Secondly they have to do under the supervision of a licensed cosmetologist. Right registered here Silas may only provide the services what when they're being supervised by somebody who can address health and safety concerns. Quickly one address why we need this bill this is a good jobs bill that will create employment opportunities allowing others to provide simple shampooing hair styling services without having to contain a license gives individuals the ability to learn a trade and enter this bill as well recognize another state's over thirty states already exempt hair braiders once injured over a dozen states exemption hooting from licensure and for states exempt the specific services from licensure. And real briefly I'll mention what this bill does not do this bill does not change the scope of cosmetology in any way they can still provide all the current services that they're currently allowed to provide it does not prohibit cosmetology schools from offering limited courses to train on health and sanitary practicing Tatian practices nor does it prevent hair stylists from obtaining private certification to improve their technique. Finally I just wanna say aye aye thanks to the members of public health who worked with me a couple of different meetings to to work through this bill and to get this to be something that I felt was a very solid bill and I'm happy to take a few questions. The basically Titans some the laws and clarifies some of the contradictions as it relates to pay benefits performance bonds those are the bonds that are generally presented. public works in certain even private construction projects these are surety bonds and a deal with performance and payment of claims on a particular project so it is really just those three or four things is fairly technical as it relates to the construction industry but. so for things I'll mention in right now they're conflicting payment bond statutes own limitations and they're reconciled here basically When you can file a payment bond claim there is a statute issued now of what I mean is one statute contradiction one says one year after one CS two years this will make you a form of one year from the date the final payment is made to the contractor or one year from the date the press one the bond ceases work on a contract whichever comes first. Right now there's two statutes on when you can file a claim one is one year and one is two years and this clears that up was given is six months and one year and this is makes it one year. Another thing that this bill would do is a statute of limitations established for performance bond claims so this gives this at the time that you have to make a claim. currently if there is a think a five year a time frame and this is going to bring it to two years from the date it works commence I mean from the date of work completion or substantially complete you can file a claim up to two years. For performance bond this is the work on the contract thirteen. Isn't forced mechanism. In an incentive to file bonds on public record now typically what we have a bond we supposed to go in filed that it County see the county courthouse to register. It's not always done so therefore some have done this and I've not done it this say yes but you must do it and this incentivize that if you don't do it To the owner can withhold payments. From you if you have not properly filed this at the courthouse if you would hope paid this is not a new statute only thing new about this is that now they can withhold payments if they check and see that you have not filed. K.. The last thing on. It is a significant revision is a notice of payment bond claim in the past the thirty day notice that you would have to give for that you're going to file a claim on the bond that this takes to seventy five days notice to make sure that the surety bond and a contractor has ample time to respond to your nose. Okay seventy five days instead of thirty days so that's the four things that this brings together it strengthens a couple things that were already in statute and it clarifies to that war and big US and contradictory I'll be glad to answer any questions if you have an. Centered around new nuclear power generation technology that uses spent nuclear fuel rods to generate power and was much safer than traditional nuclear power generation. This new technology has been proven in the Argonne national laboratory in Illinois working through the university of Illinois at Chicago. What has not been proven is the feasibility of commercial applications of this technology. Here in Arkansas we have the nuclear one power generation plant that has operated safely for more than thirty years. Nuclear one and many other nuclear plants around the nation. Have simply stored there spent fuel rods in a designated area of their parking lot. If you don't believe me on that go to the nuclear one you can see on their parking lot they have their spent rods out there this new technology. If proven commercially feasible could solve a nuclear waste problem that currently has no solution. What this bill does is to create an interim study to be run by the public health welfare and labor committee in cooperation with the university of Arkansas Fayetteville national argon national labs and the department of energy and environment. The goal of the study would be to prove the feasibility of re purposing nuclear fuel waste. Federal grants are available for this project and the University of Arkansas has agreed to develop a program utilizing these grants to reach this goal. We have strong data to show that physical activity improves attention cognitive activity and test scores it also shows it decreases depression we know the healthy diet can decrease obesity and the early onset of diabetes. For asthma respiratory gastric tube gastrointestinal illnesses let's use of prescription meds for your mercy and six doctor visits and which translates into fewer missed days of school and work for parents. Pregnancy causes a dramatic change in a woman's metabolic function as a body provides excess nutrition such as sugars and fats to develop a growing infant this because what we call a metabolically six state unfortunately these alterations or metabolic state did not immediately reverse following birth requires breast feeding for seven months to reverses metabolic alterations women to do not breast feed after pregnancy have a much higher rate of stroke heart attack coronary artery disease diabetes metabolic dysfunction. Thank you Mr Speaker this is a transparency bill that says if you're going to spend money to influence our appellate judicial elections which are Supreme Court and court of appeals you have to say who you are. It's the same principles when people give to our campaigns or pacs or make independent expenditures as with all of those the public has a right to know who's spending money on elections so we can prevent corruption prevent the appearance of corruption provide valuable information to voters and help ensure compliance with other campaign finance laws like the ban on foreign money. With transparency comes accountability with no transparency there's no accountability. Before I get into the bill I do want to acknowledge that there are some groups that have been contacting members saying that this bill would force disclosure of donors who didn't donate for the purpose of the appellate judicial races and that the bill would restrain and regulate the types of things people can say neither is true I will get into why that is not true in this bill in a little bit if the bill that I wouldn't vote for it and I certainly wouldn't bring it to. the Bill focuses on intelligence races because that's the main players we've seen massive anonymous spending particular in recent years and because the stakes are so high in those races millions of dollars of outside spending has been pouring into our Supreme Court and court of appeals races from unidentified unaccountable mostly out of state probably foreign funded special interest groups from twenty fourteen to twenty eighteen those groups spent three million dollars on our Supreme Court court of appeals races and the campaigns themselves only spent one million dollars so it's completely dominating the discourse drowning out our Kansans voices and often with nasty and misleading ads and mailers that no one ever has to answer for. The way the bill works is that it requires disclosure of spending in the county where we're calling nine candidate expenditures non candidate expenditures or communications that name or provide a photograph or other image of a specific candidate or Senate candidates within a hundred twenty days the election and they're targeted two thousand or more people or otherwise expected to be received by a thousand more people basically what a reasonable person would think of as an election expenditure. There are exceptions for news reports I pads ensure organizational communications and informational publications like voter guides we work with the family council specifically on these exclusions and they are neutral on the bill. As far as how the disclosure works it's similar to what we ask of everyone else makes expenditures on these races candidates pacs independent expenditure committees it consists of registration and for reports if you raise more than a thousand dollars in the calendar year for the purpose of spending on these races then you register and if you spend more than a thousand dollars again for the purpose of these races then you file the for reports so registration for reports and it's very important to note that contributions to a non candidate is running for committee only be need to be reported if they're over two fifty. And if there contributed for the purpose of being spent on a Supreme Court court of appeals rex no other contributions to an organization have to be disclosed and I want to emphasize that because I think there's been some misunderstanding. First of all small dollar donors never have to be disclosed because of that two hundred fifty dollar floor second only the money that someone gives for the purpose of spending on an Arkansas Supreme Court court of appeals race triggers any disclosure requirement at all so last session there is a version of this bill that was brought in right to life was concerned that they have to disclose all their donors so we specifically made sure this version that only donations that are then spent on the specific elections have to be disclosed C. ng give a thousand dollars ten thousand dollars whatever to right to live in unless it's for these Arkansas appellate judicial elections you have no disclosure requirements under this bill. Furthermore it requires the contributions be reserved in a separate segregated account if there for the purpose of these Palo elections so there's no confusion arrested people who want to remain anonymous with their donations they're not going to these rest. No group or individual by the way spoke against this bill in committee I know there's been chatter as I've referenced but they didn't show up and they didn't feel it was important enough to argue about it in committee I will say with the old version the ethics commission was opposed and they spoke about it in committee than this session they're neutral on the bill they work through the issues extensively last session there were constitutional questions even though I didn't agree with them the sponsors did agree with them then we still tied this version up no one again as cost question constitutionality I really do believe it's constitutionally sound not gonna get into that if you like. Bottom line this is important for Arkansas we can have clean transparent elections for the Supreme Court and court of appeals about half the states have passed similar measures and one more thing if you're of the view that we're conservative state which that conservative judges I think this is the bill for you because the way you find out someone's ideological leanings in a nonpartisan race is to follow the money you can't follow the money without knowing where the money's coming from and that's what this bill does I like the bill because the government but if you like it because it allows voters to figure out which judges match them more closely vote accordingly then that's a valid reason a vote for as well. Last thing I'll say the legislature has the power of the purse executive has the power of the sword was enforcement but the judiciary can only derive its power from the public trust judges are expected to be impartial nonpolitical and committed to interpreting the law citizens have to be able to trust as the case. The concert Judiciary depends on public trust our whole democracy depends on the public trust in these elections it's been shaken by dark money we have the chance to rebuild that trust and preserve the integrity of our judiciary but this bill I have a second questions. Could compel you or your group to turn over the names and addresses of your supporters to the government. What are some of those levers that might trip those reporting requirements well if you just simply use the name or even a photograph of somebody who's on the ballot for one of these races. If your communication is seen or sent to over a thousand people what some of you I'm sure members of congregations that are at least that larger neighborhood associations that are at least that large if you spend a thousand dollars or more which is really a very small sum of money when you're talking about. Communicating with the public a very low threshold. There's a time window if you speak within a hundred and twenty days of an election it would trip this level a completely arbitrary number. Then this bill empowers the ethics commission to issue fines and powers prosecuting attorneys to go after those who don't comply. It allows the ethics commission to lay out all the rules for how this is going to be implemented. Good thing they never issued Vice it's confusing or contradictory. Then the bill empowers citizens if you read the bill empowers citizens to enforce the law the a lawsuit. Which will undoubtedly lead to frivolous and politically motivated lawsuits against groups of people just don't like. And then taxpayers would be on the hook to pay for expenses and attorney's fees if the plaintiff for to be successful. This bill regulates free speech in Arkansas in a way that is never been regulated before. And it relies it regulates on the basis of a vague on vague and essentially standardless criteria. I know the sponsor mention that this bill was constitutional I disagree wholeheartedly with that I think this bill very likely would be unconstitutional I'll share with you a quick section from Buckley versus the layer which is one of the landmark cases in Supreme Court history on campaign finance it says quote political speech enjoys the highest constitutional protection discussion of public issues and debate on the qualifications of candidates or intervals to our constitution the first amendment affords the broadest protection to such political expression in order to assure the unfettered interchange of ideas there is practically universal agreement that a major purpose of the amendment was to protect the free discussion of governmental affairs of course including discussions of candidates. I would also remind everyone that the eighth circuit whose jurisdiction we are under. His explains the campaign laws like this are subject to what's called exacting scrutiny which is an extremely high threshold. It's the reason they struck down one of Arkansas's unconstitutional campaign finance laws just last year. It requires there to be a substantial relation between the requirement and a sufficiently important government interest. There is no way in my mind that this bill meets that test. And I want to be very specific about this bill because under this bill. If an organization if a nonprofit group created a nonpartisan voter guide. Comparing the positions of candidates and their records and then included language just asking voters to contact those candidates about their positions and records it would be subject to government regulation under this bill. Arkansas right to life is opposed to this bill they are vehemently opposed to this bill and they're opposed to it because like other groups it will inhibit their ability to speak freely. To communicate with the public about issues that are important to them issues that sometimes yes may be controversial. And but we live in a day and age unfortunately where people view politics as sort of a blood sport as sort of a win at all costs typing Demmer. And so the instances you've seen where people are threatened and harassed and intimidated and cancel. Simply because they support a cause that they believe in those instances will proliferate if more legislation like this is passed. The sponsor said that this bill is about transparency. I think that you know that the bottom line with this is that it is absolutely a transparency bill democrat-gazette said as much this morning in their lead editorial which endorsed the bill. We've been. Using this form of notary for the last twelve months just to say it's a flawed method we haven't seen any evidence of that time I'll go ahead and step by the wheel for a few minutes. Title companies in the banking lending industry are against this bill because it does not protect the consumer. It is easy to make the argument that purchasing a house is the single largest investment committee will make. And it is our job to protect them from potential fraud and forgery during this transaction. My company and banks rely on sign mortgages and deeds signed before a notary. It is how we make sure customers like you and like our constituents have clear title to their properties they purchase our businesses have been targets for many fraud attempts and that has exponentially grown in recent years. This will be an ex enabling force for those who seek to defraud others to do it even more my business is already lost money due to fraud that this legislation would make it easier. I represent a small business and we can't handle many losses like this or else we go out of business I'm just one of many small businesses that this will negatively impact. The argument has been made that we can choose between the two notary bill's being run as to which one to use that's great but we cannot control everyone getting real estate document signed. We ask for real estate documents and transactions to be excluded from this bill that was not granted the consumer and businesses like mine are at risk if this bill passes well we appreciate the governor's governor Hutchinson issuing executive orders allowing for the temporary notarization of documents utilizing the methods contemplated in this bill they were never meant to be made permanent as they do not contain necessary security features to protect our citizens identity data and property. This bill would allow notaries who qualified to witness the execution of documents via face time or soon as if the signer were physically in their presence anyone with the computer color image of someone else's ID and a color printer could print a fake ID on card stock that would look real on camera. Because this bill contains zero requirements related to identity verification and credentials analysis the notary on one end of a facetime or zoom session would be unable to tell whether the ID held up by the person on the other end is real or not allowing a criminal to easily defraud an unsuspecting citizen the notary and all those relying on the authenticity of the document sign including businesses like mine. As the comments that there has been no evidence of fraud over the past year frankly there simply hasn't been enough time for any fraudulent acts using this process to be discovered. It's not like a fraudulent act occurs. And a siren goes off or it's otherwise immediately discover. Something else usually triggers the discovery of the broad sometime later in the victim is then left holding the bag. Say someone uses a fake ID to take out a mortgage on someone else's property and walk away with the cash it may not be until that note goes into the fall and works its way through the process before close. Where the real owner gets notified of the fraud and it's discovered. There are multiple foreclosure moratorium that are in place view the pandemic that could prevent lenders from commercial commencing those proceedings further delaying discovered. The cost of this and you have to register with secretary of state get expensive software which small title companies can't do which small law firms are going to be able to for this software. If I if I'm a if I'm an attorney and I have a client I know who that Klein is if I can notarized document by looking at him on facetime. I mean you can show both sides of an ID on facetime you can. Let him see a sign the papers there's no different than doing it online or doing it in person. As long as you have a good connection there shouldn't be any issue with it. Seems to me like it's a case of you know protectionism there was uh one one person that you mentioned to me well what if we don't have the choice and I said sure you've got the choice every time I go into a closing you know I sell real estate and I have hundreds of transactions over the years. The bank sends over. A packet of requiring certain things to be done if if it's not to a T.. They don't send the money over. So the banks can require that all documents. Use the Senate bill version. The title companies have the option one of the title company company said will what if another title company doesn't mean we have to and we require this of our real estate agents then a real estate agent might get upset with this and go elsewhere okay so you're it's not a concern of whether or not it works it's a concern of I'm afraid I might lose clients if if I use the more secure method will if the more secure method is what you're requiring and what your banks requiring with the title company is required it can be done so the Senate bill in this house bill or for two different people this house bill is for the small gas together can't afford expensive software. Thank you Mr Speaker colleagues at this bill seeks to bring Arkansas on the twenty first century with regard to the request of electronic medical records currently at the request is made for medical records and that those are produced by paper and we their third party vendors out there that do this pretty routinely they can charge pretty exorbitant amounts to do that and so what this bill says that there's a records request is made for a electronic records that the medical provider has to provide those electronically we all know that we have the ability to do that now on a thumb drive and that saves a lot of money for the patients and those who need need these records if that request is made to provide the records electronically they have to do that within thirty days and then they can charge a fee of twenty dollars to do that which is actually more than the federal law says has to be required which the federal law says is six dollars and fifty cents so that's essentially what the bill does it also make some distinctions about who can request these records obviously a patient can request their records the current law says a patient or their attorney this bill will also add any person authorized by the patient doesn't have to be an attorney but that's what the bill does I'm happy to answer any questions. I don't know that will have any effect I mean I really think it helps the patients more than anything because these costs typically get passed on there's no reason why the these records can't be provided electronically if they can be provided in paper they can be provided electronically but if they can be provided electronically they should be because it cost everybody less money and it's a lot more efficient if they're done electronically follows so is there a problem getting these medical records today or is there a cost it's outrageous today so really the cost my understanding of it comes from third party vendors Some medical providers contract with third party vendors to produce the records it's not the medical providers who are would really be standing to lose a lot of money it's these third party vendors that print these records really for the purpose of making money when they could just a minimalist tronic Lee by thumb drive and save everybody money in the process but it would be cheaper and again a lot more efficient if we did it this way. In Arkansas currently when someone leaves prison we we have ten thousand prisoners that we present every year that and they have a fifty percent recidivism rate that's a fifty percent recidivism rate. This pilot program aims to start to tackle that problem this is a small program about a thousand people will participate and we'll find out if we can start to curve that recidivism rate in Arkansas basically what it does is any year reign beginning in January of twenty twenty the first person will enter that program and hopefully a year later a business will get a tax credit for hiring and make an in year two first year three thousand dollars the second year two thousand dollar tax credit and then the third year a thousand dollar tax credit the reason for three years is because that three years is the critical three years for an inmate and with that I would appreciate a good vote. President Dalby for purpose question you're recognized what's the fiscal impact to the state there's zero impact in twenty twenty two zero impact in twenty twenty two and twenty twenty three total all total will be three million dollars but here's the big thing it's only a thousand. Folks can participate so it will fluctuate but it's capped at a thousand capped at three million. But there was no physical impact this year or next year they've got to graduate get their first year under their belt first if they do not. Maintain a job for the first year. They don't get that the business doesn't get that tax credit so the business is actually taking all the risk. If the inmate doesn't complete that first year the business the business doesn't get that tax credit and that's a critical thing so the business is taking all the risk working with that inmate which we need that happening right now in Northwest Arkansas we have sixty two thousand jobs open. Still together will his we always attracted NO a a try to be consistent I'm sure there are times where I'm not gonna sit right here in this very place not too long ago and one of my things that I said was and when I was talking about our homes is you can't we're not going to treat everyone the same anymore we're not going to take that cookie cutter approach and that to me is what this bill is doing is it saying if you've got a child who's been suspended or expelled and you're reaching ten days are about to go beyond there's obviously some behavioral issue that needs to be dealt with and you can't treat them all the same now this bill doesn't say discipline the many different you can discipline them exactly the same but what it does say is let's look at the issues that are causing that behavior to start with and see if we can't change those issues because changing those issues at ten twelve even six will affect who they are as they're an adult so not too long ago my daughter she's twelve were driving home when she was talking about a kid in her class and she wears the same clothes all the time and she's always afraid that this kid doesn't have enough to eat and he's always getting in trouble and her her comment to me at twelve was why do they keep sending him to the office if they figure out why he's getting in trouble they can actually help stop it so coming from a twelve year old it made me stop and think maybe these are actual things that we need to address it to the other thing that that comes to mind on this is representative ought not have a bill that we passed out it's going to it is essentially directs public health to do a behavioral health study across the spectrum to see what we can do as a state to address behavioral health right and that's from early until the late stages of life and so to me Senator Dismang did explain that there was about twenty million and cares Act money to help develop this model it's not mandatory no where does it say it's mandatory I think it. Does say that the board of directors shall develop a policy but then that policy is very Flexible in how it's applied or not applied right but there's twenty million dollars to help establish this model and once this model is created then we can actually use it to help what I call social determinants of health in my world right in healthcare you try and address the social determinants of health and so I'd like to try to address the essentially the social behaviors and the things that are that are bothering these children so any help long story to say I have changed my mind it's sort bill and and appreciate a yes vote thank you. We consider earlier in the session I can frankly I can't remember whether we pass or not I believe we did where we recognizes students who were in foster care need that extra look if there is a disciplinary charge against them because of the circumstances of of which they find themselves what this is along those same lines we recognize that there are there are issues where. We really don't know what's going on in that students home life now I I still have some concerns is is was pointed out the other day about the extra time that has to be taken. In doing the interviewing of the student maybe even going and interviewing the parents if you can find the parents and I understand that that's a lot of extra work but you know when it comes to. Taking care of our kids and making sure that they have they're given the best opportunity possible that extra time is necessary. And so I I and I know I'm totally of Wardlaw doesn't know what to do he says you know I'm speaking for it and he thinks he's got to be against it but I will get you on my side this time and I I think it is a good bill I think the elements of it are a positive and I'd I'd ask that you would vote vote for this motion and then for the bill.
