who was calling us in the special session and I think it's also just get to know that thirty six other states already do this they have the ability to call themselves into special session and eight of those states do it by majority signatures in both chambers seven of the states do it by three force or three fifths majority in each chamber and seventeen of the states do it by two thirds which is exactly what we're doing so and we're certainly not paving the way here and a majority of the
states already allow for this and it's important to me and I think to many of the members to ensure that special session remains special that's why we have a higher threshold of signatures it's not a simple majority and but I think many of us believe that it's also important for the legislative branch to be able to call ourselves into a special session and not just the executive branch have the authority to do so and with that I'm happy to answer any questions or. Senate bill five forty by Senator Davis to specified terms regarding termination about agreements that con tract of employment for a public school district superintendent shall include. Sir Davis thank you members this bill simply states that a superintendent contract shall include Sanders standards for which the superintendent may be terminated it also states that a contract buyout may not exceed more than twelve months of state funds to compensate and it can not the amount paid out in a buyout agreement cannot exceed more than the amount of money that is owed on the contract and it can also and not exceed the
amount of money remaining from the current fiscal year and this is very sad actually almost exactly similar to the bill that we ran regarding presidents and chancellors not being able to you and have a bite out of their contract to exceed more than twelve months for the state funds superintendents currently operate on a three year rolling contract so they're protected for three years and we don't even for teachers this opportunity we in my opinion should not be affording it to administration to superintendents if you have a superintendent that is not
performing their job well then they should be able to be terminated and school districts across the state should have to pay out hundreds of thousands of dollars in that state funds that should actually be going to educate kids in that district rather than paying out superintendents are unable to do their job well and with that I'll take any questions any questions. years you think they have no priors when they may actually have so we changed a couple lines of code if you look it up on the on page two line two this is a new uniform petition to seal a misdemeanor violation of driving or boating while intoxicated until after the applicables look back period has elapsed so that gives us some flexibility in this section of code as well so that if there's ever any other change again and that look back period this would just coincide with that makes you sick is a code match up and I would appreciate a good vote any questions they always speak

Senator thank you Mr president colleagues this bill deals with companies that are doing business on the property of our airports here in the state of Arkansas is an opportunity Morris the level playing field sometimes we have new business models that are disruptive in the coming in and they bring great new ideas but sometimes then also then it gives them an unfair advantage against those existing businesses all kinds of different levels that work with our airports so what this bill does is it allows them to be able to treat these companies the same as they are any other existing company whether be a
car carrier parking provider anybody who a taxi service uber left we sing the same kinds of things happen when those companies have started to grow and they're playing on the same level playing field now as well so we're just going to ask that everybody uses the airport property be put under the same rules and allows them to have a partnership with the airport to be able to charge the same levels of fees and things like that they do everybody else and I'll be happy to take any questions.

Multiple companies going head to head with each other both in the insurance and commerce and then I got moved over to transportation as parts of the bill got removed. Help us understand how this isn't a large company. Rental car stored doing the same thing they tried to do to uber and left and now there's a new technology this peer to peer out. That they are just trying to use state legislation to prevent a
new innovative technology from happenings because that's the question of that at hand this bill is actually brought to me by the airports and I believe what this what their desire is to do is business with many different groups as possible to make sure that they're all treated equally you give a gift perfect example of uber and left when they first came into business they had a little bit of an unfair advantage against some of the other businesses they accepted that level playing field eventually and they've continued to grow because of the advantages of their business model and the desire of the public in the consumer to be able to want to use that service
same thing as we see with Airbnb nowadays or you have them coming into communities and and playing it at times there they had an unfair advantage against your local hotels and other resorts and stuff because they do have to pay a local actor call taxes they in P. textiles kinds of things they are on the same level playing field in most communities now because the new model they have that people have an interest in they continue to grow I think we'll see the same type of thing with this type of model.

Thank you Mr president This legislation is exactly what Senator Pitsch said it's to stifle competition and new technology and new ideas and we've seen this in so many areas he mentioned uber and lift that's good example of. Too often governmental entity see somebody came up with the internet the innovative way to serve the public and it's not the one they already have their hands in the pockets of the business so they got to come up
with a new way to get into consumers pockets we don't need to be discouraging innovative businesses we need to be encouraged and one of the things that I really want to point out is that there's one company's doing this all over the country and we need to stay out of this debate let the market decide now in call I found out Senator Rapert has model peer to peer rental legislation in this bill isn't even part of that model
the the group question is that it's it's not about airports is not about you know protecting exist it's about stifling competition this is a good bill I mean I'm sorry this is a bad bill because it goes after the good people who goes after people that are trying to do something innovative that new baby help help consumer save a few Bucks. Senator Hendren recognized for a question thank you governor I get that I think that's a compelling argument it seems like we heard this when we put
the original ability for airports to regulate uber and left and there was the same discussion but now are we basically is saying that we're going to do to this new company the same thing that we did to uber and lift to level the playing field in other words if you're gonna take advantage of this huge customer base that we have we're going to make you all play by the same rules. Senator hunter I think you have some good points there but I'm opposed to the kind of regulation that we've done to uber lift I think that they were
outside that normal taxicab licensing I've seen so many times that to in and to use your analogy the taxi cabs you try to go to the rather than compete with uber and left with or at based technology based they just wanted to stop well the the taxi companies and now learn they have to have an apt to the complete they didn't complete until they were forced to so this is a good example of of those things can be worked out in the free market I just don't think it's a place for the
government to do that thanks so I appreciate and I will take Senator Clark question Clark's recognized. The. But I think there's compelling arguments on both sides senator Johnson and. But. The I don't see anything here where the airport is going to be offering anything I would addresses questions of Senator Eads I was recognized. Of for the airport offering
anything to this company or other companies as the you know to be on property eccentric sector it seems to only be a mechanism for taxing I would understand more if the bill was brought from a different. Our perspective maybe but I do is there anything in here besides. Of the taxing and being able to the people. What they what they can't do driving through. Sir Clark I think bring some
great questions it I think it's totally unclear about this here we are at the end of the session kind of writing blank check to these airports to to maybe do things you're talking about maybe do something contrary and I'm just not comfortable doing that let the market decide we may come back in two years and say gosh and we need to do something on this but but to do this very one sided bill I think is a big mistake I appreciate a no vote thank thank you Mr president.

Yes I I want to say that we serve I support this bill because these airports have to have a say and they have to also these companies have to work with our airports and they're refusing to work with our airports and so these airports have to maintain safety for the passengers that come in and out of that airports one of the demands was we want curbside spaces while the Little Rock airport and even have curbside spaces I don't want to be able to drop my own daughter off
without a rental car sitting there taking up the curbside space at the airport so this is reasonable piece of legislation to allow for the airport to maintain that property who understand the safety aspects of that property and who are trying to abide by the safety aspects for their patrons that come in and out of that airport so I think it absolutely creates a level playing field with the other companies that come into our state to do business just like Senator Hendren said and I would appreciate a good vote for the bill.
Senator Rapert that will go to for Senator Chesterfield. I just think one of my colleagues for pointing out to me that since the airport wants us to actually get into the business at the airport. Their opening opportunity for us to handle a situation that we want to handle for a long time. I wish that I could do an oral amendment so that we can change the name of the airport from bill and Hillary Clinton back to Adams field I think that be great amendment thank you senator.
Thank you miss your ladies and gentleman the Senate for me this is a safety issue. If you have individuals that are coming into the airport. And they are relying upon this act. And they have no way of knowing whether it is legitimate or not legitimate. Then we need to be able to say. Where they will park. How many slots they will have and if you want to use this company you will be able to go
to the slot that's all they're asking is is not a huge generator of money. But if we continue to have people who are able to come on to the airport site regardless of its nine. And pick up passengers who come into this area they pick them up at the curb sometimes with the driver and drive them off we don't know what's going to happen to those individuals who come into this state. This for me is about safety in these two slots to set aside or the reason these three slots a set aside specifically for this
company. Then you know to where to go you have a better idea of whether or not you're dealing with the company. That is. Because you're dealing with individuals who are using their own personal vehicles there's also no commercial insurance that is required so if something happens to the to that passenger who's in that automobile whose insurance will pay for it will the company that's providing the
app or will the individual who has allowed his or her automobile to be used so what we're asking is that the commercial insurance be applied that there be specific select set aside so that the individuals who come into the airport we'll know specifically where to go to take advantage of those that that is available. well that those companies pace which kind of apples and oranges but as far as outside the numbers seem to be pretty similar what they were trying to look for between all these different types of companies that use the airport's property. five ten one oh five person also includes an unborn child in utero at any stage of development. In section five ten one oh one this section the criminal code deals with capital murder section five ten one oh five is the section of criminal code that deals with negligent homicide House Bill sixteen forty six adds five dash four dash six oh four to the already existing code and here's the wine I'll give you the punch line first we had a situation
where someone was sentenced to death in that death sentence was overturned Simpson simply because the legislature had not placed this particular definition that appears in the other sections in this section as an aggravating circumstance and here's what happened in honor of the mother of this young lady and her story that was retold I will give you a brief synopsis in November of twenty fifteen cherish faith Albright inform her boyfriend
Brad Smith that she was pregnant with his child. Mr Smith immediately begin to plan the murder of chair shall Bryant enlisted the help of two colleagues to carry out the gruesome murder of cherishing December less than a month after he had been for but informed that she was pregnant. She was lured to a field where Smith and another accomplice were hiding behind trees waiting to ambush cherish as she exited the vehicle Smith shot in the back with a crossbow bolt and it this point she was still alive
and attempted to skate Smith instructor twice in the back of the head with a baseball bat killing her and the trio transported cherish to an area behind Smith Sullivan proceeded to bury her in a shallow grave December the tenth of twenty fifteen her body was recovered by investigators in the resulting trial Mr Smith was convicted of kidnapping and abuse of a corpse in capital murder and he was sentenced to death in twenty eighteen Smith made an appeal regarding some of
the aggravating factors that were presented during the trial in the appeal was decided December the tenth of twenty twenty less than just a few months ago the death sentence was overturned. For miss Smith. In writing the opinion writing for the majority justice stated that the unborn child could not be used as an aggravating so aggravating circumstances it did not meet the Arkansas General Assembly definition of a person. She stated that justice stated
The question presented to the court is not whether Smith committed a particularly heinous crime or whether he deserves death for his transgressions rather the question we must answer is whether the General Assembly properly provided for the unborn child definition of a person to be applied when an aggravating factor in capital murder sentences being considered the answer is no the legislature did not permit section five one dash one zero two thirteen B. definition of a person to apply to the determination of an aggravating factor for Capital murder
sentencing in fact the General Assembly specifically restricted the use of the definition the bottom line is that H. B. sixteen forty six clarifies this law stating the person in the commission of a capital murder knowingly created a great risk of death to a person other than the victim or cause the death of more than one person the same criminal episode the bill is not about the definition of a person but rather as stated in the trial the placement of the already existing legal definition into aggravated
aggravating circumstances this simply clarifies the law the attorney general's office also came and testified for this bill I don't know of any opposition and I appreciate representive cloud for bringing this important bill especially appreciate appreciate Mrs Ashcraft the mother for coming and standing in testifying be happy to answer questions and appreciate a good vote. Arkansas Medicaid doesn't audit to determine what that lowest wholesale prices and by a year that amount is to whom was two hundred and thirty seven million dollars in rebates to state Medicaid. We're just trying to pass that kind of a rebate on to the consumer if you noticed in the bill of Medicaid is exempted from this on September that is that rebate is already going the bill doesn't take effect until
January first of twenty twenty two so the manufacturers have plenty of time to figure out the best way to give that are provide that rebate they can do it to rebate cards copays any combination there are other states doing this now in different forms this allows the manufacturer and others to figure out the best way rather than to return return that rebate rather than us doing that

This bill will make Arkansas safer for our children disabled individuals and give victims of sexual abuse more time to access justice. We're currently our statue of limitations for a minor to report. Sexual abuse. Is age twenty one and ends at age twenty one. This bill would extend that to age fifty five and what we have found in studies is that.
Children who are victims of sexual abuse. Are not ready not willing to talk about their experience when they turn age twenty one. And so they lose the right to. S. for. Help. The average age based on studies is. Fifty five years. It takes fifty five years sometimes of age were person
want to come forward and I will tell you when I. President this bill in committee beforehand I had three adult men come up to me. The individually. Shaking because they could not work up the. Right to be able to go into. The Committee road. It has affected their lives for ever. One of every five females.
And one of every thirteen boys are sexually abused before their eighteenth. And I told you that studies show that the average age of disclosure of child sex abuse is H. S. fifty two years. Opponents will say. This is going to flood. The Courts. Studies which will show you the it's not. New York City. Our New York instead of eight million.
Had only five thousand claims less than one half of percent. California. With a population of forty. Only had eleven hundred. Victims come forth. This is not a bill about trial lawyers. That's not exactly right because it's only figure in a ten percent reserve because in the self insured plans normally you would keep us something for catastrophic. Which would normally be twenty percent so if you do that that jumped up to ninety nine million so that's why you've been hearing me round up to a hundred so. and the legislature has hired a consultant that in the in between now and the end of the fiscal year they're going to have to be working to see how we're going to balance this because as you know with those numbers weren't right there is going to have to be you know probably some state money putting in and also some Changes in the the plan itself you know for the members are involved so we're going to work through all that.
