Dear Mr all dear president Hickey Speaker Shepherd and members of the General Assembly pursuant to our article six session section fifteen of the Arkansas because constitution I inform you today I have vetoed Senate bill two ninety eight Arkansas sovereignty ACT Senate bill two ninety eight imposes criminal penalties on state and
local law enforcement officers assist federal agencies are officers in the enforcement of the national firearms act which includes limitations on the possession of machine guns grenades bombs and land mines the bill also prohibits assisting in the enforcement of the gun control act of nineteen sixty eight which prohibits certain felons from possession of firearms the partnership between state and federal law enforcement officers is essential for the safety of Arkansas citizens this bill will
break that partnership and put the safety of our our cancer risks. On a daily basis our state law enforcement officers assist federal agents in the apprehension of violent criminals in possession of illegal firearms this bill will not only jeopardize future law enforcement endeavors but also it will jeopardize hundreds of federal cases against violent criminals the testimony of Arkansas law enforcement officers assisting federal officers in the percent of
violent criminals is critical in those cases that testimony would be barred and criminalize bass Senate bill two ninety eight additionally Senate bill two ninety eight would allow those violent criminals to suit Arkansas law enforcement officers for six fifteen their federal law enforcement counterparts this is unacceptable I am committed to protecting the sovereignty of the State of Arkansas in the constitution constitutional rights of Arkansas citizens I will continue to push back
against federal overreach and regulation that criminalizing cooperation with the federal government is not the solution I understand the intent of the bill is to provide citizens with confidence that law enforcement officers of this state will not participate in the enforcement of on and constitutional laws I fully support that intention but this bill does not accomplish that go instead it creates ambiguity and uncertainty and R. state firearms laws and it jeopardizes the essential partnership between state and
federal law enforcement agencies on some critical missions that ensure the safety of our Kansans. Senate bill two ninety eight specifically states that federal laws and regulations including the national firearms act and gun control act of nineteen sixty eight are not on board the bill does not provide any exception for provisions of those laws concerning unlawful possession back violent criminals those laws have been declared constitutional and have been enforced by the courts for
decades in addition the laws of the state of Arkansas concerning the regulation of firearms reference both the national firearms act and the gun control act of nineteen sixty eight. Senate bill two ninety eight does not repeal or amend those Arkansas loss nor have they been repealed by any other act of the General Assembly if the General Assembly says those laws are no longer recognized it is unclear what impact that has on our on the Arkansas laws that reference

Senate bill seventy five by Senator Mark Johnson to amend the provisions of Arkansas constitution's Amendment ninety one and one oh one provide that proceeds may be applied to multilane highway improvements engines Klarna merchants C.. Thank you Mr president. This is something I've been working on for a long time and let me assure you a little history because you won't understand it if I don't. About the turn of the twentieth century there was a movement
across the country to allow initiative and referendum where people could initiate amendments and that the General Assembly is in different states could refer items to the people to vote on directly. In Arkansas it took about six years to enact what eventually became amendment seven to the Arkansas constitution. And the call amendment seven is very clear it says that that any measure.
Approved by a vote of the people shall be amended or repealed by the General Assembly. Except. On a yeah in a roll call vote of two thirds of all members elected to each house of the General Assembly now most of you all are familiar with that process on initiated acts that person initiated act. Then if we need to amend it Well it takes two thirds vote to do that in in both houses of the
constitution defines measure to include any bill law resolution ordinance charter constitutional amendment or legislative proposal or Nachman of any character. Now the plain language of the constitution in article five section one clearly includes amendments to the constitution. Despite that. Clear definition in nineteen fifty one the Arkansas Supreme Court in the case called game and fish commission V. Edgemont
declined to construe the language literally in hell the General Assembly lack the power to amend or repeal amendments to the constitution by two thirds vote of each house. So let's come back to twenty twenty one. A since that was seventy years ago let's let's talk about today. three years ago the Supreme Court overturned years of precedent by saying that the General Assembly
cannot waive the state's sovereign immunity. Movement. And they more or less said the same thing last year on the one on Toby Gibson case that said when the Amendment ninety one at a later amendment one oh one said. Four lane highways. They meant very clearly that it didn't mean six lane highways are eight lane highways it meant four lane highways in other words the Supreme Court ruled
that words mean things now I think that those of us that supported they have sent. A highway the headset sales taxes for highways two years ago we're very much in favor of it meaning multi lane highways but this was an instance where the absolute plain language was interpreted very strictly by the Supreme Court to say that didn't say six line it said for lie.
So the real guts of this bill is to change that language the word is consistent with what I think most of us agree was our intent this is for multi lane highways what we often use call freeway. But. We get into an interesting thing when you talk about something being precisely as it reads we have to have a way to fix things now my view of history and I want to thank some people that have helped me interpret this including our chief counsel
Steve cook and Matthew Miller at the bureau as well as doctor Bobby Roberts former of his central Arkansas library system who has studied this as a historian. The. This this needs to be done thanks we've done for two reasons we need to clean up the language for line six line that needs to be done but we also need to set a precedent that when the General Assembly around nineteen twenty one.
A past finally pass this and gave the people that ride they put in it a safety valve that is if there's some language that is wrong then we by an extraordinary majority and I think it's a important point this is not a **** nilly thing I don't think it'll ever be looked at is something we do **** nilly can can fix errors and omissions and and and change things now let me give you yet another example. In the early nineteen eighties
some of you remember we had very very high interest rates in Arkansas was sitting here with a ten percent constitutional usury ceiling. Because of that money wasn't being borrowed money wasn't being along a lot of people needed credit but because of that constitutional provide a prohibition of interest rates over ten percent there was a lot of work needed to be done so amendment was drafted and it changed the
use re write in Arkansas in into tears one was for business loans it would be no more than five points above what at that time was called the federal discount rate and for consumer loans it would be limited to seventeen percent. That amendment passed became part of the constitution but there are lawsuits filed over the language one of the the ultimate result was spring court ended up saying now it's both it's seventeen percent and it's
five points above the federal discount rate. Yet another example hal if the plain language in Amendment seven was followed this could have been tweaks could have been fixed clarified and allowed us to get interest rates where people could fit seventeen percent could by car and people businesses could get credit at five points above the discount right uh we muddle along for a few years and finally Congress did a I move that essentially
overrode our state usury limit in the constitution. Now again on its face all this bill would do is. Allow. R. dot to spend this money on multi lane highways not just four lane highways but the most important thing we do here is a precedent that we. Stand up for the General Assembly is right to do what the General Assembly. Sent to the people and was ratified for the by the people
around nineteen twenty two of the late not quite a hundred years ago that gives the right to initiative and referendum but has a safety valve with an extraordinary majority where we can fix problems that crop up much as the four lane highway six lane highway or the usury law about forty years ago now are not is made it clear that they can move money around and they can not use money that came from I have sent tax to pay for anything it was more than than
four lines so that they could do that. But this is an important precedent that we place forward. It's not going to change any projects. That I was authorized to say that are dot was neutral on the bill they don't have feeling one way the other on it. But you could see how this could be this president can be put in place to where when we see a problem much is this in the future rather than it be subject
to endless litigation. Actually on issues may be a little bit more complicated than this one laws that we can as the General Assembly step four clarify the law allows state to move forward I'll be happy to answer any questions. attention because it's that it's been around so long I would assume And so notwithstanding what's in the bill. Is there a reason that is taking you so long to maybe present this bill to us because I understand it was signed out of committee which I don't I'm not that bad I to shape. But since is Senate bill seventy five it's been around a long time I know people asking about it originally but I thought it was going on. What and people didn't have a
chance to weigh in on it so just talk me through why we're just hearing it I'm asking you about it because you know we have some issues here in especially in central Arkansas why we haven't heard. All this time if you don't mind. Well. Rather than beat around the bush center we're talking about thirty crossing I believe about and I this was not done against or for thirty crossing it that
seem to be the test case but again that that was not how it is to answer questions about the timing to avoid confusion with the Constitutional amendments are presented in state agencies as joint resolution I waited until we had or at least one on the way to having those are two in this house is one resolved now Senator Rapert can verify he's not in the room at the moment but here it comes he can verify that I've tried to have this on
his committee agenda for several meetings I don't know how many center but least what about ten days perhaps been trying to get this bill or but to there were pressing matters and I referred to in more than one saying take care of the important things that you've got on your calendar of your committee will do this later that's why we it didn't take long I was certainly not trying to bury it anywhere but I knew it was relatively complicated and the rest was a long calendar and state agencies and I was
simply deferring to some of my colleagues including couple I had very important bills that need to come out when did you file this and in January was pretty early center is Senate bill seventy five yes ma'am and I put it out there so everyone could could read it in a lot of people haven't came and asked me questions and and the answers were basically the presentation I made a few minutes ago but not my to my concern that I wanted to address too is you know as I said when we had the issue with
senator Clarksville not my issue was not fitted signed out yes in the case was in the Clarksville I don't it was a matter of the committee asking for amendment amendment he was responding to them so I don't want you to think that's my issue is not Did you have to make any amendments did you make an amendment to the bill looks like you did not as far as I can tell so what I would like you to think about and speak to is. early January I think and people not having a chance to come and speak on the bill thanks to seems on it to people. I tried Senator who's as I've Senator Rapert can verify it and I've tried to have it heard. At least four times center that's I think I'd be fair in saying that but it was down the list and I simply just deferred to people I went to committee the one there was one evening that I left after eight o'clock

Thank you Mr president when the tax passed and are not figured out that they couldn't use it on the six land they said oops and now I'm hearing that we will not take money to go fix that
problem even though they came out publicly and said we've got to fix this and now they're willing to say we're not going to use money for that project now for in the future. Let me. Answer this way Senator this is my best understanding of our dots position they have multiple pots of money is just being one of them and they can get the projects they anticipate done. Using the if it's a four lane exclusively for land shall we
say project then they can use amendment one oh one or I guess we're still under Amendment ninety one but the the one half cent sales tax month plan they can use that and then on other projects that are bigger than. For line in they can you will use other funds that is my understanding of of what they're doing and it's. Ask personally think that's rather silly but that they should even have to do that but that's their answer how they're doing and again. We're trying to set a precedent
here that will allow. Future problems such as that as they may have to be addressed in regular order by the General Assembly thank you I hope I answered your questions Senator so thank. Thank you governor by Senator Johnson I understand I just wanna make sure that I'm clear you're basically advocating for the General Assembly to be able to amend any constitutional amendment by two thirds vote.
Any amendment that was voted on by the people this will not you can't touch the corpus of the constitution except by the. Either of the initiated a constitutional amendment for one like the three that we tend to refer every Two years right but the yes it would allow us five of this this process And on extraordinary majority two thirds of each house to amend the constitution I don't I don't consider that
something that will be taken or even done anyway frivolously if we look at very seriously because amending the constitution even for something that's an oculus or or truly believe it was a mistake like this for line six line issue and I know people can differ not the last thing I want this to be is a referendum on the thirty crossing it's gonna be built in and that the process that I described to Senator Solomon is hats going to be built but lawsuits not withstanding I'm
not touching anything related to litigation except for the fact that. This is a power that. Was. It took six years to get initiative referendum on. The ballot and passed Arkansas simply because in my opinion I didn't just make this up by a doctor Roberts gave me a very thick file of the history this thing it's fascinating because you can imagine the people sitting in this chamber a
hundred years ago had to decide to share powers they had with the people. And they wanted to do it but they also wanted in my opinion a safety valve of a way where if it was something that was not right it could be corrected because in those days you didn't have lawsuits about ballot titles and secretaries of state certifying it if someone got the signatures it went on the ballot even if it was pardon my expression goofy
or ill ill written so this was there to to clean up language in the law we know we do this with statutes and it is my honest opinion that the General Assembly in those days wanted to have a way to fix something that came up by initiated constitutional amendment that needed to be fixed and that was why this was in the law of clearly there until nineteen fifty one point it in an opinion that if you read it there wasn't
a whole lot of of logic or this is why we reach this conclusion it was just sort of a summarily all they didn't mean that well I believe they did mean it and I believe it's important that we get that issue clarified much as the issue of this two line four or four lane six line issue which was at spring court last year and the sovereign immunity ruling a few years ago which we all been kind of bopping along thinking that we could make certain exceptions until the
Supreme Court slapped their hands and said no the plain language of the constitution means what it says words mean things. Okay my real question did the follow up on that is that some constitutional amendments include in the language that the General Assembly can amend by two thirds and others don't and so you're advocating that that language is essentially irrelevant because the General Assembly ought to be able to amend all of the amendments is that what you're saying that's what I believe that amendment seven actually did okay and everyone there and and and to go
bit further we just talked about this amendment fifty one the other day on your bills just a few days ago there is little difference in when it's it's explicit but it is implicit in Amendment seven that that is the case but only on measures that have been voted on by the people not anything it's in the Corpus of the constitution right but one potential impact of that is that people could vote to adopt a constitutional amendment by ninety percent the polls in
November and in January conceivably under your interpretation we come in here and an overturned that that could happen. The radically could I personally believe that that is a hi. Our and that none of us in this chamber would in anyway not take that very very seriously not just a two thirds part but the fact that we're amending the constitution I think I think it's the burden of proof would truly be on those that would say we need to make this change and
unless it was something just you know an outrageous thing I think we would defer to the will of the voters specially it was ninety percent thank you thank you senator. I was supposed to bring it up last week and I as you know we were here for nine thirty Thursday night at it's it's just it is what it is I wish it were we were two weeks away two weeks ago now but yes I plan on taking it to the house and have yet presented in state agencies Committee and if in the they voted out I hope it goes to four pass. amendments to the constitution with two thirds or just amend current amendments only amend something that is occurring like men select a homestead exemption that we put in in the twenty five mil that mandatory property taxes school districts we could amend that with two thirds vote. If it were a voted by the people as opposed to something in the original constitution it could be amended this way although as you. A no Senator Hendren is
mentioned by Senator Tucker. there are certain provisions that specifically outline the fact that by an extraordinary majority we can make those changes term limits even though is that it passed by eighty or ninety percent supposedly it could be amended with a two thirds vote of the legislature. Theoretically yes Sir I don't again it's subject to the same political pressures that we we have now but again it's not a it's not a low bar if if there's
that kind of opposition out there I think it would as a practical matter be impossible but is it a technical matter two thirds is again is is my position this is in the constitution right now this is not no it hasn't been used there was a court case that said no no no no no you can't do that but up until that time it was this was an active it's in the constitution and I encourage all of you just read amendment seven to use it for yourself. And see what conclusion you draw
because it uses the term met measure any measure. It doesn't say yes initiated act but not Constitutional amendments it doesn't say that it says any measure thank you thank you Sir. Well. It might be pretty simple only yes or no so with that with this if we vote for this we're saying that twenty four members this body can over ride the will of the people the state of Arkansas.

We can do a lot of things here that override the will of the people and and I hate to say it was a few times even this session but when we do that we know full well what we're doing and we hear from and we let them
let them know of two years ago. Some constitutional amendments passed we know about some of the things that went on with the petition circulators I we've had some wonderful legislation trying to clean that up because some of the canvassers were from out of state they're getting paid by the by the signature and there's there was a lot of the things that I think we're propose that people have gotten in the habit of voting for initiated
constitutional amendments even though they might not be a great idea in the long run I'm one comes to my under a lot of people people voted for the gambling amendment but people in Polk County overwhelmingly are opposed to it but because they had for five million dollars to run a campaign they were able to pass it and I'm not going to speak for against any amendment that's already been adopted however. This gives a sloppy if this had been in place we could have
tweaked amendment one hundred and said that's fine they can be a casino in Polk County but the people Polk County have to by referendum approve it and so yes to say with the you can turn it that way and say it would override the vote of the people on the other hand I think if you hold the people of Arkansas everyone of them that went in that poll not everyone of them but many of probably a vast majority when the poll voted for amendment one hundred if you'd said what do you want to force
this on some county that really really overwhelmingly doesn't want it I bet you'll most of would say now I don't want to force it given away at this is that kind of safety valve that can potentially. Angeli fix the problem and stop loss it It I want to get into much litigation it might say but it would stop. What I consider unintended consequences. I have not taken a formal scientific poll but my gut tells me that most people this chamber if they were asked or not hundred percent happy with the online electronic reporting system for campaign finance as operated by the secretary of state's office so this bill does three things to address that number one it takes away the need to have the excuse that you don't have a broadband connection or other technology necessary to be able
to file a paper report. Second it allows and mandates that the secretary of state develop electronic reporting forms including without limitation a cover sheet for the reporting period campaign contribution reports and campaign expenditure reports and. To somebody so what does that mean it means that they would have likened a. PDF form you could fill out or an excel spreadsheet template that you could fill out and save
in a read only format and either delivered by paper or delivered by electronic means that means tax to an email or take it to them on some kind of a flash drive recruitment thing in file your quarterly campaign or all your campaign reports the third thing it does it to. He has the Secretary of State develop a better and you. campaign finance online reporting system now of I've
talked to the secretary of state's office at length about this Sir Clark have a similar bill and he chose not to pursue it but. They want to have in the system they dislike it as much as we do as matter of fact I was told by people that have worked in the elections division secretary of state's office for some time that when they got this system that was the only one vendor the company country they could actually offer it now there's like least seven that offer competing product that I pray is
much better but but again it does three things it let you file on paper. It lets you file with a. What I will call an electronic paper that is something that can be a searchable and machine readable or and also mandates that they go find go fix the system and we have a funded that and we've also made everything given them everything they need to get that accomplished as soon as possible

that related to out of state travel in on official meeting and when reimbursed by The folks at the O. R. and and miss Cornwell that give us our expatriate's I paid one to pay my carryover count back it would not let me do it so it basically showed that I had a deficit when I didn't have one so this is this is even will improve transparency at least by making
what we file accurate and would this bill allow for the backup system that's currently not there that if the software system fails we would at least be able to be able to show that we got to report in on time or had it ready to be in time yes Sir thank you. I'm concerned that we're changing the law rather than doing a study to get the right software I like the idea of one of our colleagues who said let's put two people in secretary of state's office and do what you're talking about and give it to them to keep a man because and the reason I'm for that is because our constituents want to see that. Statistics show they look at those campaign filing reports and if we get into PDF files they're not going to see those PDF or they're not gonna read the handwriting or the whatever
they can't do the math that is associated with numbers that are readable have you looked at this I mean we're changing a law to do away with what's banned probably to be fair of a more transparent than the hand written submittals. None of us like that software and I'd like to fix the problem rather than go back to an old method that had a lot of problems for constituents. Senator Pitsch you you bring out a very good point and let me address it. yes someone could file with
paper but if we make it easier for them to use a PDF basically a template and electronic template which would simplify the process you just tab to the next field fill in the blanks and then when you're through with it you say that in a read only format and upload it and that uploaded file is the equivalent of what we have now which can be searchable by keyword or by name or by a mount
and allow someone to to read it it it it hence is a transparency I think rather than. Herding transparency which is what our present system half and again this is a stopgap measure until such time as they fix the system. Quick follow the problem of the PDF is it's a picture display format PDF it is not allowing for mass to take place the numbers on that picture and that's what the software does when you key and when we as members Kian.
Two hundred dollars that's a number that can be added subtracted totaled do whatever the software tells yes two hundred dollars on a PDF isn't capable of doing mathematical functions sent pictures two kinds of PDS and I I work with the the bureau on this matter of fact one of the bureau staff mention to me that their spouse actually created these types of PDS that would allow the kind of searching that you just talked about that some PDF's are nothing but a
photograph of something that was hand written on the other hand PDS can also be documents that are as searchable as Microsoft Word document or Microsoft excel document as far as the numbers and I'm sure that that actually can be done it would not preclude someone from having a a PDF that permits just a photograph of a page as I described but by doing it this
way making it easy for people to comply I think we'll get more accuracy and in the meantime the secretary of state's office can up date the system which I think will be more accurate more transparent and a whole lot easier to use both for the those of us that are presenting their ports and those that are reading the reports. So opposed to a question any other questions anyone wishing to speak again at four Senator

state's office they asked me not to run it that they're they know their software problem they're trying to deal with it in the next two years in the mean time. friend who retired as a chief financial officer of a very successful company and she had the same problems and offered to meet with the up secretary of state's office turns out they knew about their problems then I turned it over to the CPA who is my treasure for by campaign who had the same problems and talking to you I know that many of you if not most of you are the same problems until it's fixed this is providing an alternative our way we would all like for the data to be easier to get to any

pending the cases that you reference to that the issues that the prosecuting attorney's office U. S. prosecutors office and your meeting with Cody Hiland that those issues you're saying it's going to be addressed in this new bill that is drafted but not filed yet I've been contacted by a gun shop owners and who are concerned page four of the bill the language on page four that talks about the taxes. And. Under lines twelve through
fifteen gun owners that gun shop owners have been contacted contacted me about the language on page four lines twelve through fifteen that if they. The way they read this is that if they do not collect those taxes then they're federal firearms license could be in jeopardy and that they would not be able to sell firearm accessories or ammunition or firearms and that they would perhaps lose their license we're we're looking into that to make
sure that's accurate I'm not sure that's accurate. So we are looking into that and if that needs to be fixed we will fix that thank you you're welcome. So basically we at that point we would have two pieces of
legislation that would be in place so the original that you're trying to. Trying to do away with that's still going to be there. The original bill will be there until the total of ninety days runs out we all know this bill did not have an emergency clause it will go into effect ninety days after which could take this almost to the extended session of special session where we take up taxes and we take a redistricting. And then the I I'm pretty sure
the governor is going to put this on the the special session call. To to fix these problems. Follows no Sir that's not the case. That's not the case at all how do you know the answer to because you would have had those discussions in this morning. This morning what was supposed to happen is we're going to take the bill that you had. Wired so called agreement if you were gonna take the bill that you had we were going to
incorporate that into the into the what's called the Montana wall and that you're not going to walk down here and ask for the override Bacall's. Everybody or or a large part of the people there in this chamber or definitely second amendment type people however this is about guns this is about those eight hundred these this is about those eight hundred. People that we have on trial. And we've all agreed that since those people are on trial.
That if we were to pass this law that could allow for either the case to be. Not for evidence not to be presented and that type of stuff and that was why you and I had that agreement this morning this is one hundred percent totally against that a good cause dire consequences for our citizens. Well I don't I don't entirely agree with that because Tony Holland told us he's told me all weekend we had seven eight hundred cases that were backlog because of covid those cases
most of those now the court to make again most of those cases are going to be tried in the rest will plead out before you come to the court date so that's not entirely true Senator Hickey. If. So what what you're saying is is we're thinking that most of these cases may be done before this law goes into that forty to come hell if if I'm a defense attorney if I'm a defense attorney why do I not do everything to delay this thing until it goes into effect my
client has covid. My court has some other deals I need I need to wait a while so that we can wait to that goes into effect so that they can get all that's the reality of this Sir. And here's why that's a big deal. We we had a multi year investigation that led to the thirty three indictments in
White County. My understanding is twenty eight of those were on weapons charges. That puts all of those that in jeopardy. That was a big deal that got people off our streets admit need to be there they got folks that were dealing drugs to our kids. Off the streets and out of White County. Look look. I am. Pro second amendment. But I am not for sending these kids but are these folks back
out on to the streets because we don't have the prosecutor will tools that we need to ensure that they find their place to print away to prison. I hate the situation we're in I really don't understand the situation that we're in. When we agreed that we're going to do something that we can agree I think even you Senator because you have a bill that I haven't seen I don't know what it looks like but I'm on faith. Supposed to say you know what I'm going to override this in whole.
That will fix it through another bill you yourself acknowledging that there's a problem in this bill. But we are not doing what we need to do to fix it. There's no guarantee I don't have the bill it's not even been filed and we're going to say that Hey we're just going to go on in faith and we're going to pass that in the next forty eight hours. You wouldn't take one of mine.

there's a backlog because of covid that the possibility exists that some of those individuals get all. Since those individuals are there for a variety of circumstances they may be there because of drug charges they may be there of. Because of firearm charges because they act sexually molested kids but that's what they're there for so if. So. If we have the opportunity to fix this. Which we did this morning.
As you've already heard me say Senator Stubblefield when I posted my office in agreed that this thing had some bad issues and the way that we had done that was going to incorporate parts of his bill and that's separate than what he's talking about this today about this other being the bill that we were going to do that and not overrides the veto because if we override the veto in this bill goes into effect the way it sets. Then it's gonna it'll be sitting there and we'll come wall and
the circumstances that I'm talking about with these potential criminals is going to come into play. This is all just is beyond me why we're even in this situation because of what's transpired today and you in the gallery I want to speak to you because this is the thing this is the way this works down here. If you think that us as your representatives I'm one of the biggest sportsman that there is I guarantee you have had more
guns and I've I've been involved in that more than anyone my life but I cannot let that wine the fact that when there's other issues involved that we have to step forward to fix those and still try to get we're where we need to be. If he has a draft bill that
would address the issues that so many people are starting with the governor's seem to have a problem with. Then the shape of that bill that would amend this act when it becomes an act would say one thing. If we. Do not override this veto he would have to have a bill to accomplish the same thing which would basically be this bill is with amendments that would be a new bill that would amend the language in Senate bill two ninety eight.

bills go I sit in Judiciary with gun bills used to go and we still get things related to that. To try to focus on our second amendment rights. And I stated in our caucus this morning. When are you going to do something. In what are you going to do. Because federal government. In the leadership. That they're listening to as I
said before. A common for guns now I'm not saying you're going to come to your front door and not I'm telling you they're going to do everything they can to will your second amendment rights down. To take away our tax. Until you don't have anything I'm not I'm not scared to die. I'm not scared somebody shoot me but I am scared to death and fearful of my grand kids having to live in a country where they
cannot have their second amendment rights and protect them sales now does this sign and I use it per the term warts quite a bit. The people the sky has not fallen. When you nine potential of eight hundred prosecutions out there. That doesn't mean eight hundred cases are going to be lost. Are there for the conversation outside of the
federal funds that can be withheld. Federal government do about anything they want anymore because they're not following the constitution. At least not very close. There is. When you have serious stuff. This country has not had. What I see coming. In a long time. In the people that tell me. This can happen in the United States were to be a good country when I speak about history.
Read you history. I understand what people stood by it didn't do anything because the just in which up in the morning to get a law. And I had. I want to get. But at some point you've got to make a state. This bill. Was there for a long time. They could come to our committee and the. The governor had this bill for a good while. That troubles me.
We don't. It gets vetoed and were. Basically out of time. Give her run that law. Not saying he did but I'm saying is it didn't leave any time. We're going to recess. This is simply something we had in the not since I've been down here for thirteen years. I don't know what exactly all can be done.
The other bill is a completely different bill. We're talking about the override of the governor's veto of Senate bill two ninety eight that past basically with three quarters of the simply on both lanes. Some people get buyer's remorse you know sometimes they want to bring some of my merchandise back. After the flight. Or after the use the. And after the figure out how much money they didn't. I can't do that.
It used product. This is important to us ask you to override the governor's veto. And we'll do what we. Can down the road thank you. Well this is day one hundred and six of the session and I think it's time to go home this is a this is not the time to file a
new bill to fix a mass and we just clarify a couple things I'm on city county to and I heard the bill presented and the sheriff's did sit at the end of the table and did testify that this would be a real problem for. And in fact I came and spoke against this and I relate that to the chamber and in fact I made I made the comment that the previous bill that we passed even the sponsor said absolutely it's unconstitutional because there was some real questions about whether or not this one was unconstitutional.
I'm just going to tell you that the answer to this problem that we. We worry about. There there's two problems we have one we worry about that we've been told that the federal government is going to come get your guns. I don't think that's going to happen I I I really don't. But here's what I know is going to happen because the federal prosecutors have told told us this cases are going to be endangered our streets are going to be made more dangerous because people that are subject
to prosecution now will not be subject to prosecution this was a bad bill it's not the first bad bill we passed and the last thing we need to do is try to. Refused to to to override this veto out of pride and let a bad bill go into on the books with the hope that in the next forty eight hours we can magically pass another bill to fix it. The over I need to stand and we need to go home. Senator senator we take

Thank you Mr president you know I I fell into the same kind of category as everybody else and once we started hearing about some of the concerns some of them I mean some of the concerns I've heard I've I thought I would have voted for this I said you know what no it's worth it is worth it to vote for so my did you no ongoing prosecutions that's an issue that needs to be fixed and and I got pretty excited about about you know
move real quick try to fix it but you know. We're we're in a position where we're not even going in and the journey. We're going to go into recess. We have months before this law goes into effect we have a bill sponsor who said I'm willing to fix those concerns I've I said M. visit with Cody Hiland he's he's not talking about getting the bill is got very specific you know things like to fix it. You know I'm not honestly I believe I believe in the process I believe that we are in a in a
really good spot to be able to continue with this bill and get it fixed however let me say this if we don't have. I think nothing happens. If there is one issue that I've heard from my constituents coming in is protected me from what's coming from DC. It whether or not you believe that that is X. it is a real legitimate threat or not. It is the health of our
constituents feel. In late I feel this. And so I do think that there is a way to to make this working to fix it and fix all the concerns to make aware where the the bill the super majority of the legislature passed to bill in effect that policy can go in effect and we can also make sure that the bad guys stay stay locked up and and I think that if this if we read the veto I think it's almost guaranteed that if we don't get this done the next two days we'll get it
done next two weeks. And there's nothing to stop. I just think the panic. Maybe part of its intentional because they want to see the the the the override died but I think some of the people just don't really thinking through we think we're gonna cram everything in in the next next forty eight hours twenty four hours whatever and I don't think that's true I think we get all the stuff done we get this override would put the policy in place of regular constituents vastus do why we all voted for the first time and do it in a way that's clean and sharp anti with another another bill that

I want to make sure that I'm not clear exactly what you're saying. What we have. I'm so sorry we said that one yes Sir what what you're saying is what Senator Stubblefield and
myself have worked out this morning and I want to make sure that that I had that I'm able to really really that because that is what we were going to do we were going to take this part out that we were taking the part out as far as these federal cases were involved right we were getting that corrected we were going to go ahead and put the the things that affect that we're going to help our constituents that the worry about about this federal overreach that they've got we had all that worked out and then I'm just Warren cited because we won't be able to do this override which we already
discussed that if we do the override. And this is the whenever we do the override the bill with all of its mistakes going to place. I don't have the in this was some I don't like to do is would you agree but I'm also going to say one other thing this extended recess that we're going into everything stops from that standpoint unless we had listed it is unless we have listed in the resolution itself and the only thing that we could list in the resolution it's itself would
be what could be dangerous unfinished business that that initiative business would have built like you hear on the last day if there was a veto and the governor waited five days we were here that would allow us to come back. The only other issue that they saw which would by this constitutional force to do this is that since we're required to do the redistricting. That were one hundred percent required we have not gotten federal data we have not got the federal data that we could stay open for that
reason that way that the governor would not have to call us into special session the one issue that I have had with all of this. Is that if we were to have to come back even for a code override a veto that does push the time that all of these laws that were passed out so that they would be ninety days from that date so in other words if we waited two weeks to come back in in every other all that we got that we spoke back in ninety days now would be would start from that point forward after we got finished so I just wanna
make sure that that everybody understands that and like safe I guess I'd say is that understandable well I I I would discreet other Senator Flippo see I was right I told you so but but I would be really important we get in and fix it within the next couple weeks and then we're talking about is pushing everything off week and I honestly I don't know what what happened between you and Senator Stubblefield that's not my thing is what's right here in front of us and what I was hoping to to do is say Hey look like guess what guys we're not
this is not life and death nine day this is not we're going to put that policy in place we can fix it I've been around long enough to know that if leadership but I I would agree that I would assume at this point you would agree trying trying to fix the issue is on board and this bodies on board we can do whatever we want to do if we're willing to do it and so from like eight and let me say this if we don't override the veto there's no incentive to get it done there's no energy to get it done then then the constituents or holler at us are
waiting two more years to to be able to get it back to you Sir yeah. But this is not correct because whenever we go into the extended recess it is the same as signing die with the exception of the redistricting after that is done. As far as any other bill that we have in place and and our heroes verified all this because we look into this in detail any of
these bills that are left in place out here. Their own we don't pick those back up. This is what I would say is Senator Hickey. Eighty members of this body along with fifty one members of the House body we can do whatever we want to do if we have the energy and the will to do it and you know that as well as I know that and everybody in this room knows that we can get it done if we want to get it. Constituents back home have talked us intensely about this bill and I appreciate that comment but you also reference that Senator Stubblefield is going very another bill to improve on that bill and I'm not sure I heard that and maybe this is for his clothes that he will reiterate that that's important that we deal with some of these things that clearly aren't right in this bill and I was led to believe we're going to know whether that was a party to the questions but I was told about
an hour and a half before this session by Senator Stubblefield themselves that we weren't going to be dealing with the veto. So I need to kind of hear in the clothes that he is in fact going to improve on the problems we've got that are exposed here before we cast a vote yet yeah that's what I I talked to Senator Stubblefield before I made the comments that I think it would be good for and reiterates that he at the bill he sent me of the draft of the bill I visited with former the prosecutor Cody Hiland about it so I'm confident
that there is a is a bill out there that does the does the fix that makes me feel better about it and it's just going to mean that we're gonna have to have the world in order to do that and improved that what we're doing is responding to our constituents that follow up with you thank you I don't know where there needs to be done in a day and a half or a third so as you say fifty one Hundred Days Senator Hickey is clearly in disagreement with that but it I feel like there needs to be that commitment for side quests I

Or are we operating currently under a resolution and maybe joint resolution I'm not sure but between the house and Senate that our deadline for recess is April thirtieth which is this coming Friday is that correct is that our current. Measure not what's been discussed but what we're operating.

Why because the sheriff who testified for senate bill two ninety eight in the House and I spoke over the weekend and not sure if he supported Senate bill
two ninety eight and I had a discussion and he said to me there are serious concerns and issues in this bill he spoke for the bill in the House Committee. We talked yesterday last night if you say to me that there's no energy to fix this you're wrong I have the energy to fix it because I am a pro second amendment person I believe in the United States constitution and so don't tell me I don't
have energy to fix a bill when I myself went and did the work to draft a piece of legislation that the sheriff who testified for senate bill two ninety eight sent to me last night and said this is what we need to pass because this is will address the issues with the prosecuting attorney and the current active cases. This will address it and this will fix that and so I was told I then was told that Senator Stubblefield was going to run
the bill and for me to withdraw this bill which I'm happy to defer to Senator Stubblefield this is his issue and he's worked hard on it and I appreciate that but I for one am not going to be accused of being somebody who has no passion or no energy or who's not going to put in the work of the time to get a bill passed on an issue that's important to me but you're asking us to be put in a moral dilemma. You're asking us to put in a moral dilemma between second amendment rights to hi I have an
a plus rating with the NRA my grandfather was a gunsmith for Pete's sakes. But you're telling me that criminals to go free if these cases are prosecuted and that's that's a problem because you're putting people in a moral dilemma now because those victims are not going to be able to get their restitution those victims may not see those criminals go to trial and that is a problem in an issue so I
will direct miss corn well if you will follow my bill for me please and I will have it on record that I have been working to address this issue and to correct it and I'm willing to stay here all day and all night twenty four hours a day to get that fixed but I was told to stand down which I respect it but I'm a senator in this body just like each one of you are and it's not. vehicles as a whole you would not have to do this because that's the business that you're in is buying those however when they sell those catalytic converters they are numbered so that when they go out they can be traceable this is narrowing to a very specific group and that would be the group that would only be buying and selling catalytic converters they would have to pay to our fifty dollar a registration fee which would be to the sheriff's department because now the sheriff's department is going to be the ones that are going to be
tracking out there by if a trooper should stop some is got ten catalytic converters in the back of their truck then what would happen is they would ask to see the registration if they didn't have it that would give them cause to look and see if those were stolen or not and so that is part of the reason why the salvage yards are willing to pay the one time to a fifty dollar fee because they know it's a problem and they are willing to pay that to a fifty dollars nor to get this thing started is the reason the scrapyard turned against it because there are any part of

that type of cooperation before they come in to accounting for a share to the chief law enforcement officer of the county. So what have we had any issues. Since twenty thirteen what did we have an issue in twenty thirteen it was initialization twenty third though it was it was an issue of relatively around that time that that
happened is what sparked the original legislation which representative Payton is just stayed on top of since that time so the the the issue is still there right where it's it's possible that you will not have that cooperation and if you don't have the cooperation a lot of times we just contact with people with boots on the ground you will there's a new angle that that can be beneficial most the time they do that this is just encourages. So it would if that would happen with a national park in a park ranger National Forest and their agents so if its federal enclave which included base its Pacific Lee exempted out what about if military police are investigating somebody in off base housing.
At if it is a federal crime that they still would have to but if I were a former military police located in the county in the state I would develop that demo you have and that's not even a question and so to be clear for instance all the investigations that were all imports the aware of that have happened here in Pulaski County in regard to some of the operations here all of that would have to be run through the county sheriff well if they had a demo you in place than it would already be be done a yes man that they would either have to go through the local

Thank you members of the roof I think Senator Ballenger aye very accurately stated what the bill does I just think there's one point that I wanted to emphasize on page four there's a section created by the bill section three oh four this says that if a federal agent conducts any arrest search or seizure in violation of another section created by this bill that federal agent will have committed a crime and they're subject to prosecution for the crime not only that the person who they were arresting who conceivably could be a violent criminal a drug trafficker human trafficker whatever the case may be at that point that person becomes a crime victim and can access state funds maintained for crime victims I just think that is very problematic and and
that's why I'll be voting on a record shall be the same thank you. Senator Rapert you're recognized speak on the bill number someone speak on this bill I have great concerns with the language that is is before us in various Bills and I I didn't get a chance to say this but I'm going to speak about the US. I had a young little girl. In my district that was kidnapped. And she the only way that she was able to be recovered was by cooperation with federal law enforcement agents US marshals and federal law enforcement agents you might be rolling your eyes this is a true story the little girl was kidnapped and
within forty eight hours she was raped she was abused her head was shaved and she was put in a cage like a dog not making this up. Within forty eight hours the only way that we were able to retrieve that young girl was through cyber technology that the federal law enforcement agents had available to them to come in and assess my rule County there was no way that any of the share of scad the ability to pull this off there were multi state raids that had to be coordinated to act to simultaneously so that we would not jeopardize losing that little girl. I don't know if there will be time to ride an MO you.
For the federal agents to come in and to provide cooperation and that little girl could have been sold into sex trafficking industry and disappeared forever. These are real things that we deal with and I am very very concerned I understand I understand where the intent of legislation is coming from but I am concerned that we are not being thorough and thoughtful about these other situations
that are occurring in our state with our kids and with our citizens. It is a big concern of mine it is my obligation to speak on that concern on behalf of my constituents I represent thank you. For.
