Senate bill one ninety eight by Senator Dismang to amend the frequency at which each county is required to appraise all real estate at its full fair market value Senator Dismang you're recognized members currently the way that the reassessment works it's either three or five that's at the discretion of the county creates a lot of confusion for both the taxpayer and the county so what is going to do is make it so that everybody is on a four year reappraisal cycle we staggered in the beginning between three and five and they go there is true grade eight equal number of counties in the state it's going to hit so we don't have a reappraisal it across the entire state at one time that's gonna allow for folks that do this type of work that to have the manpower needed to be able to finish the job but again it should be something is beneficial to both counties and to taxpayers alike. Members this is a once in this change this makes a really good bill. A better bill when I read this bill two years ago. Studies have shown is that. Individuals who had been sexually abused. Really had a struggle talking about this until they were delays around the age of fifty five. So we picked the number of age fifty five. It was great law people really happy but afterwards we had individuals coming and saying Hey I'm a. Fifty eight age fifty nine what about me. So this bill changes it and to. But to to the that. But the when the being is. This is already in the law that they have. To fall. Six months after this bill goes becomes law it. To a period of thirty months so they're still with the. Of about forty twenty four months. But it just removes the age limit of fifty five it allows folks that were fifty seven fifty eight fifty nine or older the chance to seek justice one last time. I. P. gallery heather Stevens please stand up heather where are you know she's here somewhere. Heather and heather is one of the toughest ways you'll ever known in your entire life and she is one of our our county officials and anyway she's a chuckwagon racer and she's amazing so heather thank you for your work and number Senate bill two twelve add this bill removes the requirement for notarization for requests of criminal background checks that are required for the licensing of child welfare agencies since twenty twenty one DHS's implemented an electronic criminal code criminal background check process for employees of child care centers and Medicaid providers so this change has made the process faster and more efficient for employers which is why we are eliminating the requirement for a notarization the current law still requires one part of the process to be on paper and the law requires a notarized signature on paper from every background check applicants this paper based requirement creates unnecessary delay forcing the employees and employers to what additional days for the results of a background check said this bill repeals that requirement and allows us to be more efficient I'm using the electronic process which is going to get us through the process to get employers or employees in place faster. So this is a great deal to save time and money for our child care and facilities and Medicaid providers and their employees be happy to answer any questions. Anyone had questions for Senator Irvin. Thank you members this bill expands the availability for these screened out reports to be shared with a provider who employs a direct care worker and and any agency that licenses the worker it allows them to be notified after the screened out allegation of adult male treatments there is a process that is followed in order to and when an allegation of adult maltreatment is reported to the hotline that allegation can be screened out for a variety of reasons some of those right and we're not changing that and most common reason for screened out is that the behavior that was alleged does not meet the legal definition of mount treatments or that it occurred in another state so when those screened out allegations are are occurring that the agency as a law is now cannot share that screened out and report with the employer or the provider for the agencies so what this bill does is allows DHS to inform and employer that the allegation that the that was reported to the hotline has been screened out this allows the employer to take any final action they feel is necessary regarding not worker it also allows DHS to share a screen to allegation with the licensing board or agency and that's that's what the the bill does. Senator Solomon you're recognized thank you governor folks just hit a couple of highlights on eleven fifty six a couple of questions that came up yesterday I'll try to answer in committee but I'll call your attention to Page one line thirty three shall ensure that the public school students attend an overnight trip if required to share sleeping quarters with a member of the same sex this issue actually came up in Arkansas schools this year the school board address that policy and change your policy to meet that requirement are about the requirement but this would codify that on page two line six public school restrooms designated based on sex line thirteen multi occupancy restrooms are changing areas includes without limitation the following so it lists those with the supplies of sex means the physical condition of being male or female based on genetics and physiology as on line nineteen and twenty on twenty three this came up in committee yesterday I will schools deal with this how will they know well every student when they enroll has an original birth certificate issued at or near the time of his or her birth so again schools would have the opportunity to not only do staff development and training in that area and their policy mentions that line thirty two to provide a reasonable accommodation to an individual who is unwilling or unable to use a multi occupancy restroom are changing area designated for that individual sex so has to be a provision for that in school policy. And I'll reference page for line eight a parent legal guardian or person standing in loco parentis of a public school student shall have a cause of action against the public school and that cause of action is listed below and then on line twenty six the Division of elementary and secondary education so promulgate rules to implement this section then the school administration will adjust their policies and staff development as appropriate I'll be glad to take any questions. I may I see your point but I I think the state would pay accommodations when the state department of education Promulgates their rules I think they'll clarify that I don't think this language doesn't. Can you just tell me what that means I just wanna make sure that the school teacher didn't know I think that's the concern that they didn't know or should have known the specifically non compliant means that they're basically being you know stiff necked about rather just not going to comply even though they they clearly have the. Are we gonna say well it's in a file in the principal's office and you should have known for. I mean can you just clarify that and I think that's going to come up to the school policy and I mentioned staff development so I think schools will develop department of education will develop the the guidance for the the issues you're describing and Senator Hickey is describing they'll develop that guidance and Yeah I think the incident we had in one of our state schools kind of pointed that out when they determine that that was the case and it was specific that the the person who made those decisions. New the judge the sex of the students and that was corrected just by saying this is where we're going to do it within of often do it state of the school board local school board making that decision well being a policy and that's for this policy came from but I think it's going to be up to the state board of education and the department of education to make those rules it agreed thank you bring this bill. Thank you Mr president I know it might not seem like it to the new members but I don't make a habit of coming down here I really only come down here to speak when I feel that it's absolutely necessary and I'm gonna ask you again today to think about who is going to help and who it's gonna hurt because once again we're being presented with legislation that claims it's going to protect kids when in reality it's going to put more kids in harm's way as acceptance of the trans community has grown in recent years we begin to see more attempts to control and limit their lives outside their homes we saw this a few years ago with the push to pass bathroom bills all across the country in the name of public safety and is those efforts failed to restrict out we begin to see a lot of conversations if the schools and we begin to see supporters of this legislation use kids more widely in order to win support I know everybody in here I said it last time I genuinely believe everybody in here wants to protect kids. and I know other people in here who also resent being accused of targeting the trans community because of their support for this legislation because they believe this legislation provides privacy and safety for everybody I know that's easy to believe that's been another shift in this fight to control and limit people's lives it's no longer about public safety it's about privacy and safety for everybody and that's in part because we know we have data that there is no link between trans inclusive policies and public safety there was a study twenty eighteen by the Williams institute at the UCLA school of law they love to communities all across the country that had similar characteristics they look at the ones that had transit because the policies those that do not and they found no link between the policies and crime there is no link and so now it's not about public safety it's about privacy and safety for everybody but it's still about trying to control and limit the lives of trans people outside their homes so who's going to help and who's going to hurt who is going to hurt or the kids are gonna have to walk in the restrooms and locker rooms that don't conform with their identity we're going to have boys walking into girls locker rooms girls walking the boys locker rooms it's going to be destructive and it is going to be dangerous there was a two thousand nineteen study at Harvard that looks at the trans kids all across the country and they found that twenty six percent of them had suffered some kind of twenty percent of kids in middle school and high school transcripts had suffered some kind of sexual abuse in the previous twelve months and in places where the laws like this in place that number jumped to thirty five percent that's an almost ten percent increase in sexual assault where these kinds of policies were in place. so this bill will put more kids at risk and not just from bowling in sexual assault suicide is now the second leading cause of death of kids in this country right behind firearms the LGBTQ community is a higher risk not because their orientation or identity because of bullying and stigmatisation and laws like these this bill will put more kids at risk I ask that you vote no or don't vote and you can truthfully tell people that you want more time to look at data talk to trans kids and their families to talk to students before you make a decision on this bill thank you. Where there's a debatable swimming lessons whether where that wherever there's water safety courses available are in their area so that they can take advantage of this the school districts whether it's a a public school or open enrollment public charter school would be required to provide that information to parents if you look at the end of the bill if the student is above eighteen years of age up to twenty one years of age provided directly to the student so that they know where they can get something lessons and that sort of thing more than happy to try to answer any questions. With that being said the calling we have a bill in front of you senator vault and myself. Basically it's taking or veterinarian tech specialist the keyboard only users specialist is not just a bit take it's a special similar to a to a nurse practitioner these people some have a two year degree so I'm actually have a four year degree they have continuing education. Every every year and for them to be able to get to this position they must work for five years under someone's directly under someone so they're actually looking at seven to nine years experience as what these specialist help in so with that with that when you're looking at the bill it basically says that the main thing that this different is they will be able to establish. They contact the client relationship still be able to go out and do that heard some pretty compelling stories up in in committee today about a young lady graduate from Purdue University for four year degrees when the business now for fourteen years have to go out to make a call for new new client of theirs she is a staff writer ship and she could not work on the animal and the animal died because she didn't the veterinarian have not been out there first. Into it and had to step back in which a is not the. Not not in the realm of that type of work if you're if you're willing to help animals. Arkansas had the shortage of veterinarians. There's actually. Roughly according to money money business up four hundred twenty roughly vets in the State of Arkansas right now. And we're talking about currently we have a hundred and fifty seven bit text. We don't have the first one it is actually a specialist they will be taking the first two will be this this year start this program in twenty nineteen so it's seven works way through. We have to veterinarian schools that are coming on line hopefully here in the state pretty soon but we're looking at eighteen years after his release state of Arkansas is in in the state of emergency as far as in the permit Merriam's we need it if you look at the figures people don't realize this that we have we're looking at roughly. Every hundred twenty six miles in the state of Arkansas we have a veterinarian if you go from little rock to Memphis you have three. If you go from Hazen the Memphis you have one. This bill will actually help the poor areas of the state the economically challenged areas to get some veterinarian services in there this bill is not just for the veterinarians at which they are totally against or wherever they should like this because water down to meet their approval even the committee yesterday was changed and then they still spoke out against but this bill is not for them this bill is for the people of Arkansas for the animals of Arkansas this is the humane thing for us to do we can and should not have and was there in bad health because we have a lack of veterinarians like a service we have available. When you look at the number of it that a civil ago ever hundred twenty six miles if you take out Pulaski County in northwest Arkansas that number will grow drastically just call the number of bits in those areas. We have one million seven hundred thousand cattle in Arkansas. Roughly a hundred sixty eight thousand horses. A million ninety five thousand dollars. Roughly eight hundred ten thousand caps. And we have roughly four hundred twenty vets in the State. That is fourteen for every hundred thousand people. That was the reason why we should do this bill folks. There's a veterinarian shortage when a state of emergency in the state of Arkansas. We're under served in areas especially in East Arkansas and South Arkansas in southwest Arkansas. Even in central Arkansas for large animal vets we are under served this is a this is far mainly is for the large animal vets to give them some assistance and help. It's a great opportunity for consumers and for animals in the state of Arkansas to improve their health and well being. This also will allow veterinarian services to move into the twenty first century. Where they can actually utilize the availability of help these specialists are not going to be competition within they cannot hang a shingle in a veterinarians office in running for a they have to work directly under the veterinarian working with the they fall under his insurance policy they can have an insurance policy of their own if they choose with the box office of it and they work in collaboration with them this is not a competitor for the veterinarians this is a companion they work together with the consumer the veterans are so booked up. That they maybe a day or two after they can even see someone he can send this person out to the farm this person can't make the diagnosis then the but the veterinarian say this is what we're looking at this temperature I think we can do to do this or that to to for the betterment of the animal with that being said I'll take any questions from the for the body. So I guess what I'm saying is that that's currently being done in this and and this is going to allow what is currently being done Jean need to be done except for under a collaborative agreement if I'm understanding right what's the objection from those who are opposed to this bill specifically that that's a very good question because everything they were speaking about a committee is in this bill. Where they have the training and here in the state he in the state were trading may issue baby that's the only only one in the other was getting their degrees out of state all these people could it be that tax how many are we talking about. I believe it is trying to solve a problem that we we really do have which is a shortage of of the Arians and. And the time it takes to help farmers. However I I do feel like this is not the right solution to that problem. I'm so thankful for the Minnesota that were made that that was my biggest concern around prescription of the board the ex I think there still is a concern around the timing of establishing. For a bit of this establish a a client relationship and the fifteen days between there I think about a about a restaurant a food supply food chain that work is is there any concern help me with the concern of a potential misdiagnosis in the time of day and national relationship client relation this is that. Between that gap of fifteen days there's a can you help me with that concern of potential an outbreak or what the bad diagnosis from our food chain. As for the for the food chain goes the the state of Texas and the state of Oklahoma which have a lot more livestock than we do and a lot more directly. Now as far as the state of Arkansas goes is for the misdiagnosis you know yes that could happen I would assume that if it's been a misdiagnosis whoever the owner is of the livestock there will be back in touch with that veterinarian pretty fascinated my livestock not get any better I'm I need I need you out here. Just a quick question on page two and so this is that merry tech technicians special of five different than a veterinarian tax yes so can you so I'm Page two line thirty two through thirty five can you describe how many of that tax specialist do we have in Arkansas zero right now we have to be testing this year thanks to our testing as that tech's specials this year descrito this legislation is for those two individuals will be for the rest and coming up this is a start up so that we're just getting started is going to the cycle so so where does of that tax where to where how do they become a veterinarian technician specialist like at what institution or is that online or can you describe that process to become of that tax specialist a issue maybe has a program to sign up for their you have to be accepted into that so yes a issue may be the only one in the state of Arkansas and then the additional eight hours of advance continuing that. That is after you become a specialist that's after you become officials and that's that's just gonna be up to the Arkansas veterinary. Board that is correct. The same five to be a discouragement to The students or young people who are pursuing a profession as a veterinarian if they can. For the process and then just do a collaborative agreement. Discouraging someone from being a veterinarian no I don't think I think this feels a void for those who don't want to go to school there's a long. Those people who want to work out in the field go out and do an essayist just like just like a nurse we have not discouraged nurses. From becoming nurses instead of doctors we feel that Boyd in there and that this person is going to be an aide to the the veterinarian to allow them to see more animals. For all. What would you prefer scripted authority that was again there that we took it out it is no different than being in there because it said if federal law changes in federal law this decides that and so it's taken out now but has the same effect as it would have been a. The the individuals that would be allowed to do what you're letting them do could not do it without a collaborative practice of that area is that correct that is correct so if a veterinarian. For the veterinarians don't like this bill all they have to do is just not doing a collaborative agreement and it shut down is that correct that is correct and that's that's a good thing about this bill is if a veterinarian as opposed to it they don't like it they don't have to do it. Pretty simple they don't have participate and they and they they're all the liability and malpractice and everything that would happen including the handling of drugs I mean say say you got a technician the proper term goes and does something illegal what the drug is that is that translate back to that area under whose collaborative agreement that individual practicing for that rest with the individual themselves but some of some of these will have actually a liability insurance policy himself to be totally up to the amount between them and of a veterinary but ultimately the Buck stops with the veterinarian he is the boss and had a veterinarian who are in favor of this bill because they want to have this ability that's not currently there through a collaborative agreement have you had a veterinarian said have spoken in favor of the bill yes I have the alarm of it to work here in central Arkansas we work two hours in every direction of his location is begging for this because he is over worked thank you. Concerns in that area but for example the return rate of small animals if if if they send one home and it passes away for it. It's better they're not gonna come back for a follow up and so the concern was fifteen days was too long in that regard because they may come back and they would be technically and non compliance with the requirements with the date was consideration of making it shorter to address some of those concerns so you had two days or three days or something a little closer to a manageable for those that are opposed to for that reason that actually follow up on related the openly answer this one for you yeah actually when you start out and go shaking was the veterinarian's wanted two days the the tax wanted thirty days so we picked fifteen of the twenty. That's how that was come up with and and I think from the food supply standpoint the sooner the better from a technical in compliance or non compliance standpoint that that's a different. Desire there but still dealing with the conflict the other one. Right now I have I have to be licensed in the state of Arkansas correct with rich with this. And what about and I'm I'm not an attorney I know there's representatives here but If someone is in California they can get license to do work in Arkansas correct this. In as opposed to an Arkansas litigation there provision in the bill it is a provision here says they are that they must be a residence in Lassen in Arkansas residents in Arkansas and licensed in Arkansas so due process and service would have to do this is to work directly in conjunction work with our state veterinarians and and just again to emphasize that for and against the most everybody is. Or horse you do a C. section one woman cannot take that care for other users you cannot do it physically it takes two or more people and there's a lot of procedures like that displays that but my son's C. sections prolapse is where it takes a lot of strength that women just can't do that then they don't want to do most women now specialize in either horses or small animals because they can make more money we're losing all of our large animal vets and let me tell you what is what it's doing. Because I live in a part of the state where there's still quite a few candles. And I and I've had a done a lot of work for neighbors because they don't know how to do it we we bought most of our drugs at the local co ops like everybody else I would go to a veterinarian and with an activist group which is fighting for the drug when needed would go home. But of. A lot of the farmers had to resort to doing things on the farm they were not qualified to do. And into suffered as a result. Not only farmer but the animals. I want over what form of berry and berry I have a backhoe. I buried a lot of animals for farmers who tried to doctor them themselves because they could not find the vet. They've all got out of the business and and one of the clinics is closed up nobody will take it. And it's just harder and harder to get a large animal vet because of dollars much money in it is there is a doctor in cats and dogs and horses. So It would it would be nice if you have someone who knew the basics there there are Vance I'm major to prevent their medicine in college there are vested candy cannot do a displaced advice on. It's a it's a very complicated procedure when you get to some of the room and back to the wall of your accounts for some action here to so what I'm back to the to the side wall of the castle a lot of its can do that. You get a cut to four layers of of tissue and and a lot of times you get him also back together that can't live. So we need people that you know are being at least talk but these vets. And I think it would be a good good first of these is having all of the United States. We're getting less and less large animal vets. one graduate for the college was to vet school in the whole United States. Elihu home state and the in illinois' L. as she was in the. She is strong wonderful young lady who wants to come back to rule Arkansas and practice large animal and small animal and there are so many things that we've done as a state to try to open up and find state representative Jeremy Gillam ran legislation to increase our slots at Mississippi state veterinary medicine school it's a fabulous school I visited it but we've never as a state funded those slots that's on us we should fund those slots we should fund more sought some veterinarian schools we should have been addressing this representative Gillam try to do that especially for the people in East Arkansas we have two schools that are stepping up and providing that merry medicine I think that's great so I want to say in response to that that you know I have been so proud of my daughter he was trying to do what she can to become a veterinarian and come back to the state of Arkansas and practice on cattle which she grew up showing and raising it through FFA and was an officer and showed cal's all through her high school career and she's in veterinary medicine veterinarian school trying to make a difference in coming back to our state and I'm proud of her because she's a young woman doing it my concerns on the bill on page five when it talks about performing minor dental and surgical procedures on animal patients excluding abdominal thoracic in orthopedics or orthopedic surgery and neurosurgery my issue is when you start to make lists like that you may unintentionally or intentionally leave something off that list so I secretary Sobeys neuter is those types of things. Because you started a list of exclusions of surgeries you're gonna leave something out and I just think that could have been written a little bit better and tighter and and I think there's some other areas where the prescriptive authority is included but it depends on federal law and I would have preferred to have that all of that stricken out in my opinion that thank you. But what's happening because a lot of this as we do this in different areas that we we lower a standard for the certification first things that can be done. There's always this thing that will you don't you're not respected professionals and that's just not true. It's not that we don't respect professionals is not that the people that we represent and that's the important thing don't respect professionals it's that they're just hard of not being able to get services a decade that I've been here that we've that we've known and we knew way before that we've known about this problem with the shortage of veterinarians and we said you know we need what we can't get any more slots there are any more slots to get in these colleges. And I'm told that five out of a hundred of the students who apply from Arkansas we have to worry about it being discouraged they're already discouraged five out of a hundred that apply getting. That's how many want to work and you come out of those schools with debt and you can make three times as much money working with dogs and cats. And so people just want an answer. They don't you know it and we see this all over you know representative McGrew is working on a property management bill I have two houses that my wife and I have to manage. Language that we didn't want to manage. But there's not anybody in Senator Hickey. Can't do it I mean he's too far away from me but I guarantee you he knows what he's doing. He can do it for himself but he can't do it for me representing the group has has more rentals posted anybody hot springs he can do from self can't do for me. So many people have commented to me this session about my weight loss well I've been losing ten pounds a year for the last four years. But it's because I went to a nurse practitioner but doctor who a lot of Hester's practitioners but nurse practitioners who specialize in this area I exercise less than I ever have. I eat what I want to eat. And I'm not in danger right now. Nearly in danger of having a heart attack or stroke. And I was doing everything that people tell me to do until I went to somebody there by said was dangerous survived if we did that. But it's the difference between protecting me for good health care or may not get in any health care and that's that is exactly what we're looking at here is from protecting the I'm not gonna say that some bad things can happen. But the fact is right now AS one count producer told me today very eloquently to say I would trust the average farmer out there not the average with the former the cattle producer who has given. This makes a lot of sense to me and so we've got people who want to go into this field this is something that they can do. There's a a committee called the code revision commission that takes a look at all the legislation that got passed and they identify places where there are inconsistencies and the Commission consenso can consist of two senators two representatives and some members of the public they take a look at all these bills and they put forth what's called technical corrections bills if there's something that requires a substantive change it does not come out of the code revision commission because at some matter for the legislature to determine on its own but if there's just a technical correction it comes it's recommended by the code revision commission and then there's one bill per title of the code that needs revision so we're going to have about twenty technical corrections bills come through the process over the next week or two what we have here today is the first four so with that pre amble I will turn to House Bill twelve seventy eight.
