Thank you Mr Speaker colleagues this bill does not do a whole lot it's not necessarily simple it's somewhat complex but it's a very good bill this bill will allow for the creation of a domestic asset protection trust so this type of trust to allow an individual to set up a trust
and protect those assets from creditors which I think we all know is important this day and age due to no the litigious manner of our system today But seriously this bill cannot be this trust cannot be used to defraud existing creditors so that is something I do want to point out. Tennessee Missouri Oklahoma Mississippi all allow for this type of trust they're using at this trust will allow us to be more competitive with those
states so what we have happening now and what we don't want to have happen is people who are using these types of trust having to use these and other areas and then they have to move those assets to other states which in all seriousness does hurt our economy our to our banks hurt our financial planners purchase those things so this will give us more competitive this bill was thoroughly vetted in the judiciary committee of the House and there's no known opposition to it and I would be glad to take a question

To me it's spiraling out of control and we need to be able to use every resource that we have at our disposal to combat. This crisis. A few years ago I should say a few sessions ago there was legislation that was passed that took one of those resources off the table. That bill said that if you'd never committed a crime that involved violence you could not
serve as a peer support specialist in our drug treatment programs. I think most of us would agree that that bill didn't say if you've never been convicted of a crime is it if you'd ever committed a crime that involved in that involved violence and I've got the I think representative Gazaway would agree with me as a former prosecutor that probably most crimes that are committed have some degree of violence attached
to some degree we're not talking about a motor we're not talking about a bank robbery we can tell the B. B. talk about the needs of the others where someone stands up in a room and takes an object and throws it across the room and I am here. That's a crime of violence. Someone driving an automobile accident runs a stop sign and hit another vehicle because of property damage or even bodily injury. That's an act of violence somebody could even verbally get aggressive with someone even to the point they threatened me
even though no contacts made that's an active calendar. Colleagues a peer support specialist is someone. That has been through a certified drug abuse treatment program. That individual has overcome those struggles they fall back they made that journey and they came out the other side with victory over their addiction. Many of them now role models
they're living a full and productive lives they have set the example. But because of this bill we passed a few sessions ago they cannot go back into those drug treatment programs and help those that are struggling with those same addictions that they were able to overcome. This bill here will strike that were violence. And it will allow DHS to review each applicant and DHS will submit a set of rules and
regulations to our admin supplemental committee and there will go to a L. C. for a vote by that committee. What college I encourage you today to vote for this bill because we need to be able to utilize that resource I can't think of anyone else better. To go into those drug treatment programs and be able to communicate with those folks that are trying to overcome their addiction because these
folks have made that journey they fought that battle and they can communicate with those individuals that are experiencing the same struggles that the idea this will put that resource back in the play and with that I'll take any questions. behavior analysts do because I'm sure many of us don't know behavior analysis is an evidence based practice that is used to increase life and social and communication skills and decrease challenging behaviors in children and adults it has been proven especially successful in individuals with autism as well as those with other intellectual and developmental disabilities I'm as part of our mental and behavioral health working group over the summer and early fall
we heard from behavior analysts in Arkansas about their desire to be licensed by the state and they have two primary reasons for wanting this the first is that currently and behavior analysts to practice in our state are certified by a national board which means that if our Kansans have an issue an ethical complaint or something they have to take that to a National Board state licensure would allow our Kansans who have complaints about a provider who has provided services to them or their you know one of their loved ones they could take those
complaints to Arkansas Kansans to hear those complaints and issue a decision on that and so that's one benefit of state licensure the other is that currently and people who practice behavior analysis in the State of Arkansas are not required to pass a criminal background check before doing so and a lot of recipients of the services are children or individuals with disabilities as one of our populations I think they deserve those protections and we're the only state all of our surrounding states issue state licenses for this field
the bill before you and everybody on today would place that license under the psychology board so existing board but in new license and this bill is the result of months and months of collaboration between that psychology board and many many relevant stakeholders DDS DHS department of health and more than I'll stand here in list but I'm happy to answer any. page five the bill it references fees that are that will be paid as part of the licensure process can you tell me how much those fees are going to be because some of our licensors require literally thousands of dollars in fees of those will be worked out on the rules that it would not settled on on a number yet another the department of health and behavior analysts and psychologists are working on that now. Follow up. the other thing that I noticed is there's a criminal background check required what sorts of offenses would preclude you from being able to be licensed I
don't see that addressed in the bill again these are things that are going to have to be addressed in the rule in the rules promulgation process and so we're we're taking an input right now has in this morning where we did that talking about what those rules will look like going forward from folks who practice now. Okay so that's not in the bill no okay thanks. I actually don't know the answer to that the state of Arkansas you can hold yourself out as a behavior analyst in practice right now we simply the national board certification you don't
need supervision get national follow up. National board certification so it's the same in all fifty states. I don't know if all fifty states I don't know if the states that have licensure sort of tie it to that national certification I just know that it's a it's an entity that issues the certification to all fifty states if they want to thank you thanks represent Gonzales for what purpose question you're recognized so you said that that there are people out there like speech path. with that person and have to be duel licensed.
