up there is a handout minor change overnight to include used car sales tax in this manner. No there's but you're not recognized. Seriously of so we had drafted it and if you had reviewed it if it was referring to in section six the twenty twenty four fiscal year we have to push that out to the twenty twenty five fiscal year in order to allow for the rulemaking process but
that's all that the changes so if you'd read it nothing changed other than the time line. So currently the state library system has a set of rules by which they certify libraries and in order to be certified to receive any state or federal funds through the library system they have to pass and maintain a one mill personal property tax of to support the local library well for some libraries that's a serious problem because if
you're in a city of less than five thousand people. Constitutionally it's impossible to pass a millage so one of the libraries in my district cash flat servers three or four different pretty good sized towns but none of them are of of the population of five thousand and nine there are three that were three different counties come together so they wanted to want us to change the constitution with a constitutional amendment to lower that number from five thousand what when I checked into it it's basically just in
the state library rules and rates obviously the spirit of that requirement is to have local skin in the game local by in but anyway this special language would go in the budget for the state library system compel them to change the rule to work in lieu of a one mill tax thank you have a different type of requirement of you know that the libraries funded through the
city council which as flat is and that you know there is local skin in the game and that there is a revenue source to support the library so they're not dependent on whatever grants or aid may be available state or federal through the library system so this compels them to change that rule and put something in there in lieu of the one mill for those smaller cities that cannot pass a millage. And with that I'll take any questions you have. And questions from committee represent Wardlaw.
I got a couple but will start on the On to number three what. What would be the less populated areas I think I totally agree what you're doing I just don't there's no definition here of county less than so many or so what what would that mean so really it's a city of less than five thousand that is prohibited from passing the millage they can't get it on the ballot is that already in this Arkansas constitution and the only way to change that would be Constitutional Amendment.
So explain to me why we need this if we already have that. So what the current state library regulation or rules say for a library to be certified and receive funds their rule three point three says all cities and counties should restore the library tax to the maximum permitted by law by no later than July first nineteen ninety one and then three point four The rules says library should receive additional local
support so the spirit is that we want to receive local support we don't want dependent on the grants and aid that are that might come to the state library system but it's impossible for them to pass and maintain one mill if if they're a city of less than five thousand they cannot. Cannot constitutionally are. Put that on the ballot. And so geographically I don't
know if you're familiar with ash flat Arkansas which have sharpen Izard and Fulton counties all coming together there in a little triangle and you have asked flat Cherokee Village horseshoe bend in three different counties then you have Highland and hearty which are just within a fifteen twenty mile radius those are R. five pretty good size communities and. All of their county libraries are twenty five thirty miles away but actually it has a very
nice city library that most of those citizens from those four five communities use and so it's a very busy and very well maintained and has a certified librarian the city of ash flat has has carried the burden of funding it through the city council and the city budget but you know if they could. Qualify for five or six or ten thousand dollar grant it would
just it means the world to amend their budget has been in the fifty to a hundred thousand dollar range for several years but I have a really nice library serve a lot of citizens in the area and I visited with the. State Library board well not the whole board. Visited with Jennifer Chilcott who visited with board and they're more than willing to change this rule the reason we had to bump it out of your with this amendment is because the
rule making process and public comment period would not be conducive to get it done. For the twenty twenty four timeline they will have to bring the rule change back to A. L. C. and I also you'll have to review and approve the rule. You know. You're recognized so. I like your last statement but it doesn't say that on number six and that was my second part of my question is is it a report
alleging Council or Joint Budget Committee but it doesn't say for the review and approval of that rule so seems like we would need to add that word into number six to make sure that were. Have an approval of that when it comes back. And instead of just port in review yeah that's that was my intent was that they report enter the V. reviewed approved you may want to address that language before we pass this to
make sure that's in there okay Do you have a suggestion on how to address that I understand the word approved in there can we do that here or do I need somebody to run the make a copy and and that's a staff questions. We we do do verbal amendments in here. Some yes you can well I would definitely appreciate the opportunity to. verify that the review and approval be in there.

That the intention is but I want to I want to make sure we're clear on this the intention is that and that a area that is seeking one of these grants they have to provide a source of income that would be equal to the one meal that they otherwise would be required to have available for their funding. I have not worked in my. Communications with staff and and the builder after that that
was not brought up I had said you know that if a when I was talking to the library's system. That you know reconquer requirement that the library would only qualify for a matching grant might be one way that we can guarantee that they have skin in the game if if any grants that they would qualify for would be a matching grant. Then that would be one way to. So I mean I guess when I look at the language says a source of
income in lieu of revenue in lieu of the requirement. of of of to maintain a one mill county or city property tax I guess I would have that concern if we make this change are we if you for not requiring it to match that essentially are we going to incentivize folks to go kind of an alternate route or we actually going to see less local Investment in those libraries
and that's further dependence on the state so that's that would be my question and I think that question which I think if I remember right is your second question basically answers the first so the question about why would we not do this in statute and with the regular bill and then code is right now the regulation for them to maintain pass and maintain the one mill is not in code its in state library rules so the special languages just compelling the state library to come up with an
alternate alternative way of meeting that local skin in the game propose that the A. L. C. in a rule change and we will review and approve it in Nailsea I think there's a lot more flexibility there in how. In what that rule change would look like and you know putting something in code and and making a law It seems to me like a little.
A little less solid ground I mean I know it's law has a heavier weight but we're addressing what's in rules. And I like the fact is not in law. It would they would be in rules but. Resent Jean. Senator you're recognized presenter thank you so what we have a a few couple word changes here and I will leave it up to Dr Childress to explain those. Doctors good morning thank you The Amendment to special language in Senate bill. Of thirty three was initiated by DA W. S. it is to align transfer of funds to the skills development fund with the change the code and house bill fourteen thirty so we have legislation
currently of in the currently in the Senate public health committee house bill fourteen thirty that will add this language up to. Between the words the sum of and to this is existing language and in special of language and the up to will allow us to fund the transfer up to the two point five million that's already established in special language. All right any questions from committee.

obligations that if House Bill fourteen fifty seven is enacted it will require sticking to create a new type of training and to post it online the vision for this as I understand it's kind of like a that the voter safety a person can come take the poll watcher training and get a certificate we have the funds to do this but it's a different way to spend them and were not entirely clear that we have authority under the language as it existed day.
Mr mapp add on to that location one of the things that we're trying to do with the bill when it is passed hopefully is to bring consistency that if somebody's going to be of a poll watcher that they would have a one source to be able to go and get the information to make sure that all poll watcher trained to the same standards that's the bill that we are talking about that references to this because we want things we don't want to have happen we kinda experience a little bit of this last time is some one person may be interpreting the obligations and
you know expectations this way and then another county you might have somebody doing this and what this would do is give one site one stop does all to where they can all be trained and expectations being the same and take his he shared and correct me if I'm wrong this is just a request to be able to have the funding to develop that with no the request is that right. Yes there would be no need for new funds are no appropriation just the authority to spend existing funds in this way.

Is there is there any sort of training that you don't have to provide right now as required by law other than what's pending in this bill before a house agencies. there are other trainings but those trainings are already funded to the same revenue streams of the note change with respect other trainings this this is a little more attenuated from the election expenses we define our training materials like publishing CVC manuals the poll worker guides as election
expenses but is a little bit different I didn't want to get this one is strictly according right the bottom line is you only need this special language if this of the bill passes you don't need it for existing training. Shall Broadway issue system you're recognized okay members are I want to point out here because there's actually two things going on if you look up at the very top there with the seventeen seventeen million in the twelve million if you all remember where we first started session in here there was a request by Henderson that we would transfer appropriation
only from salary expense to operating experience at that time there was a lot of members within the body that had some questions because as most people know that we had to we've done alone for Henderson back whatever they went through. All their financial difficulties and they've been trying to work it out at that time we did not put that on a payment we just put that on like what I would call it a term loan to mature. So with discussions after that meeting what what we come up with is that you know we were
all okay with the doing the appropriation no new funding that's attached to that allowing that transfer. But in talking with them they do feel that due to their you know the way that they've reworked their operations everything that we can put this on a monthly payment the little. I'm sorry a yearly payment you sure you don't want to. I think we tried monthly in there I'm sorry I was one last one last shot at.
Yeah. Anyway it would be an annual payment of the loan originally had been six million they've actually paid it down to five million seven hundred fifty thousand round numbers this would be own Put that on a payment of course it look as you can see that would be around nine hundred fifty eight thousand dollars a year. First will begin on December first of twenty twenty four on or before the. All right any questions from committee.

As thanks Mr insisted on anything about this this is just trying to figure out some way in RSA if there's some way you get a money they can use is that right no Sir not at all the the appropriation on the very top that is current appropriation that they have they actually have it within their salaries. But we're we're transferring that to operations.
The and the money on the loan of course that's something we did to a couple years ago it feels like now maybe three. Twenty nineteen and windows server loans made in twenty nineteen the money was actually spent before we arrived on campus before the issue system became involved with with Henderson sources repaying the loan that came from the revenue stabilization trust fund so it is just we will just be paying

You may proceed thank you have a Adam seven and eight kind of go with each other so that's why we're going to be here and I'm right behind each other. During budget hearings I kept asking about fund balances and what we were doing with fund balances if they were special revenue what restrictions they were on them and how they can be used during that process we
discovered that we had excess money in the tobacco settlement fund that was not being used for anything was just sitting there. Adding an interest but it wasn't actually benefiting the citizens of Arkansas and one of the major problems that the state has is with infant mortality unfortunately we're one of the leading states in the nation for infant death and mortality and mother's death and so working with the department of health I came up with this idea if we
could use part of this tobacco fund settlement to kind of help us address some of that mortality problem. You know we're the Leding when it comes to you know saving babies before they're born but we're failing when it comes to saving babies after they're born. So this is my attempt to try to get the money so that we can get that programs up and going that can actually help hospitals get that you get the supplies that they need to address these problems and several different
things we can do and this first bill is just setting up that language so the Department of Health can do that we've talked about many different things that they might be able to do with the money and you know one of the things that we have talked about is they can help them actually get supplies so that they can take care of these children in NYC use in situations when they need the help other things would be screening equipment there would be a dashboard develop so that people would know where there's Nick use units available beds
available one of the things I hope to look at is a white to find transportation to these Nick units because right now in my part of the state if we have a child that needs to be brought down to little rock for Nick you unit we don't have the transportation available form so what they have to do is call upon out of Tennessee and have them to bribe the baby down to to Little Rock and so that's kind of what my goal is is to try to find a way that we can contact address part of this
issue this does not affect G. R. there's no general revenue going to it sell. That's the quick. Synopsis and be glad take any questions. Art centre Hester. For emergencies but I guess the question always goes is if we're gonna spend that money why this and was there a lot of work that
you work with the health care you know the health committees what why this wife under this item. Well the health department and the department of health already has of a group that deals with the infant mortality and they work on this group all the time and this is one of the things that they've always been trying to find a way that they can get the funds to try to move some of their programs that they think would be beneficial toward this way and this is one of the steps so there is already a it's a work group that actually looks that infant mortality so this
would go hand in hand with that. So Matt with apartment held me if this is what you guys would say this this is. If you guys have asked and said that million dollars this is what you want to do with it yeah I think I think we're supportable she's trying to do I think this is one time money that we can push out there to these local communities into these hospitals to help stand up some other berthing capacity in these local hospitals and other nonprofits grants we may do something with the H. S. as well within the with rule of life
sixty those sorts of things so I think it's a good move and she said there's two committees there's one with paternal mortality one with critical care that we can come alongside the recommendation from those reports they put out every year and kind of push it that direction so I think it's a good idea. Senator Dismang Centerville C. all right thank you and so just a couple of questions on the program so this is one time money for something that will be on going from what I'm hearing
you say and we're saying inside the department of health there's nothing to scrape together to be able to afford to pay for this office I mean this this project there's no outstanding funds means are matching funds available through Medicaid I mean. I guess my question is I remember a time when pulling things out of the tacked back a set amount settlement funds is pretty frowned upon because once you start it's hard to stop and to your point is just sitting there incurring interest not
that's actually kind of point you know the point of the fund I think it's to accrue interest at the end I was I would share the same thoughts mean why this over everything else is there not any funds available why hasn't there been any available and we're just that efficient at the department of health that there there's no way that this can be funded without anything else other than pulling out of tobacco settlement and how do we maintain this ongoing. So couple things this is the
commission's fund this is not out of the tobacco settlement it is to maximum dollars but it's not out of the program fund that is not out of the annual payment that comes every year it is one time funding the next amendment you'll see I think kind of provides a little bit more clarity to what your there will be some additional funding we think as this fun continues to grow at the commission's fund that we can transfer directly from the Commission Fund to the Department of Health a lot of the maternal efforts that the department does a federal grants
and so we depend heavily on those so I think. But I think this is a good way to use this money in a one time thing to help help those those local nonprofits those hospitals others that are trying to make a difference in those outcomes that we're not seeing much moving in the state what kind of answers your so the seven point five would we come up with that number from as well what what's magic about it in in who gets what we're talking about these
nonprofit sure and I'm asking of our program please come up here but seven point five and there's a point three and commissions fund now we want to leave a three year average in the fund for the commission to operate continue to use that that balance the three year average for the operations there so this is the excess from that and then the next I think special language I you'll see that she's gonna president will transfer that money anything above that three year average. To this fund for the for the department to utilize going forward it may not ask the
before we vote on this particular item we also understand what your big picture is then let me let me ask or program of some other. Six. We say your name for the record. are kind of one time things help like hospitals that aren't baby friendly become baby friendly so for one time funds would start up for them the average cost to do that is just cost prohibitive in some instances especially with some of our smaller hospitals so some of this would not need ongoing funds we would just get them to that designation and then they would be I'm kind of done with that part some of the equipment that we would by like for intubation of small babies things like that those would be one time funds spent so that some of these activities we're talking about would not be
on going just to kind of answer some of that question does that help. Some of the units of the projects you I would just be able to talk about seven point five that's a three year average I I still understand that I know what's okay so M.. To number. As far as need I mean it's just a. So going back to budget hearings to represent of capitals stated earlier. This commission had some funds sitting there not being utilized
the I think the thought was when she talked to us was take that money utilized a meaningful way as I said the commission has about eight point three million just sitting there and the commission doesn't need that much there's to operate in this is This Is excess money descent can be utilized I think as you say in and this is what the department of health through the administration is going to prioritize yes okay through the administration I mean I haven't heard opposition from them about this. Okay thank you I will say the only thing that the
administration had asked me about was where we take it away the part where they were going to get their interests from and we clarify that now this did not do that so. Any other questions. Something to say this is what we're going to do like a couple days had to. I mean that's certainly up to the committee what I what I would say is the agenda has been published for several days I think there's ample opportunity to visit with sponsors about the agenda Senator king I'm happy to visit with you after the fact and made her consume up with some some course of action going forward. If you don't mind I would there's a lot of questions about why we want to use this money for this why we're not using it for something else well the reason that I've asked for this is because in my area in particular is a major issue and I'll be honest with the it's a major issue throughout the whole state of Arkansas when we have infant children that are dying. Because we don't have the facility to help them. And as a state it is our obligation to take care of those who can't take care of themselves and that does include
the unborn but it also includes those born with the issues and so for me that's where this came from it's a hard issue is that I see it happening and I see a sitting on funds that is drawing interest. That we don't need at this point. But we have a great need out in their citizenship for this type of help. If anyone has ever had a child that had this topic issue and they need help. And they can't get it in the child dies.
I mean is devastating to a family and that's where this came from successful for me it's a heart issue it was a priority I think that we need to put toward our citizens I'm not trying to take any general revenue I'm not taken interest away from anything is not going to affect the budget in any manner but what it will do is affect the actual citizens of Arkansas in making life better for them. sure stated that the second bill will elaborate more on the spending that what I understood. It deals with the transfer authority and how they get it yes Sir is it going to be more information don't have the actual spending will be. Devided the. I'm looking for more information on the program I want to be supportive of it but but I I I need more information yeah I think miss sellers can provide a little more details what they're
gonna do with the money but the second the second part will be a hail I would just ask could be possible. To listen in present second part committee may not want to do that I'd like to thank the second part is going to help with the program is to transfer language and we can speak more to the different types of programs that were thank you. I'm so besides the baby friendly hospital designations would like to help our birthing hospitals with we did talk a little bit about the supplies are needed so there is a video laryngoscope
state or needed for video integration for small infants we have a lot hospitals that had make use but don't have these and there's complications if you can't get this place tried so this is the kind of help avoid complications after these are placed in that hearing screening equipment a lot of our hospitals borrow infant hearing screening equipment so this allow each hospital to have their own set of equipment there on site we have a level of care designation that we do here in the state for our Nick use we have some hospitals that do not want to participate we like to
incentivize them to participate we like to get a site survey or workforce currently when we do these designations we have to bring people in from out of state we like to train our own Arkansas state staff to be able to do these surveys for us am I think it was briefly touched on about updating that trauma dashboard so that there would always be a number of Nick you bet that were available and high risk OB beds available in the state at any given time we also have a perinatal quality collaborative alliance for
innovation on maternal health incentives this would be incentivizing hospitals to safety bundles for moms we like to do an outreach project especially media that would target maternal warning signs and seat belt safety for pregnant women. I'm sorry at there's a here her campaign mental health for women and things like that those topics we also would like to look into doing maybe or residential program that would to address substance abuse for pregnant women and their
children not only helping mom but the children were services that they need so those are just some of the programs we have already looked at and tried to start budgeting for with some of this money. Right Senator Hickey was and. Yes I mean course we sitting here and I mean this is an emotional type thing but from my standpoint they should with the public health and why said in here minute ago listen to twenty minutes of testimony about promulgating rules on a little a little library thing to do mill millage.
And I don't see anything within this and he says the same thing roll file an annual progress report I mean it looks like to me we got all these programs I heard you say one thing and not be disrespectful to you that no all hospitals are gonna get this everyone of you say all hospitals are coming hospitals every hospital across the state we would like to be able to offer to each birthing hospital across the state and that's kind of my point we would like to be able to but we need to know the plan on that we need to know how these in what they're going to be in grants or if they're going
to be you know how those requests are going to be made just things to that nature so I mean I'm not saying that you've got of a bad program I mean you know of course that you don't want to do it's just. I personally don't understand why this is coming through special languages definitely seems like something to me they should come through of you know the public health committees had all this in place and definitely should have been in in legislation that said specifically and I'm on this with other things obviously that
you know that you go ahead an outline what you want to do and that you'll promulgate rules to that effect but just decided to run to do this and just provide us report I want I will tell you this that's going to be good enough for me thank you. about will run ads for detail all pregnant women to wear their seat belts. I mean if if at this stage in life we're not doing that. You can't you know I don't know how to help people. so I've I've got some concerns I need more information where the money is going more specifics and and I would have to agree with Senator Hickey as a I don't know come into Special line reviews correct part would appreciate the concept what you're trying to do that I might get there. Probably not gonna be today thank you.
And and I and I do want to make sure I understand this is a program that's in place that already has that lines in place there's just never been funded or is this a brand new program that we're starting up so I was a little bit confused because we started when we say we're gonna use it for one time costs that's capital expenditures to me but then we talk about advertising Roshen which one way for that to be effective is to spend a lot of money and to do it repeatedly which could eat into seven point five million dollars pretty quick so I guess you know to the point I'm a little confused on the parameters we first heard about it I thought it was
something was already in place all of its been ironed out and we're just finding something never been funded and I'm gonna hearing well there's a lot of things that have been really worked out yet ready to progress for so which which way is it. I think Senator just when I think will work with our current programs that are already engaged in these efforts through existing staff existing supports with the connections and the partners we have in the expand out into something she's talking about the health well of her electricity add to that.
No I would say that most of the things we're trying to do our things that we have staff in place that also work on our maternal health programs but we don't have funds to do those activities currently. So all the policies procedures everything that we're trying to accomplish is already ironed out somewhere or it's or it's not a minute too to the questions have been asked is this something that you know we would typically see promulgated through an effort in a regular bill I mean
in a in a public health bill because Hey we say we're going to make this a priority in your the standards here's a response would like to see this is what we like to do or we by passing that with the special language me because of the funding is one part of it the program itself is the other and any typically members want to have some oversight involvement in a program you don't need to get me pauses when I hear in the end that yeah we we want to do much of advertising to will because it started out that we're talking about one time capital projects then we moved in on
going being the focus and I'm a little confused about what it is we're doing so I think Senator is mine so as to the advertising I think some of it is awareness and mean Arkansas struggles with some issues with young mothers don't know but to your point about the the program how will work a lot of this will be through grants that will most likely come through here and review that you all will see those frameworks and as far as you know any kind of policies those already kind of established a department with our current programs but as far as any kind of grants that we

You're recognized thank you Mr chair we're here to present special language for each B. twelve sixty eight the raising Arkansas's investment schools and educators or the raise act this is a bill to raise the minimum teacher salary of fifty thousand dollars and ten thousand dollar raise for all teachers of the special language starts on page two section four in this bill. the Arkansas teacher raises
funding the Department of Education fide raises to all full time equivalent teachers in the state in the amount of ten thousand dollars per teacher working in a public school district. Page two three three as section five this is educator compensation reform programmes sub Fund thirty million will come from the educational adequacy funded be kept separate from all other moneys and the Division of elementary and secondary and Education Public School Fund account to be utilized over a one year period effective on July first twenty
twenty three to ensure that all full time equivalent educators in Arkansas public school districts receive a minimum salary. Annual salary of fifty thousand dollars by June thirtieth twenty twenty four. On page three section six this is just gives concerning the definition of what a teacher is. And then on page seven this concerns the minimum teacher compensation schedule which on page five replaces the previous
schedules and begins with a minimum salary of fifty thousand dollars with a bachelor's degree and fifty four thousand six hundred and fifty dollars with a master's degree. We filed this bill several weeks before learns was filed but we do understand that that were in the middle of the learns debate and the timing might may make it. Assembly makes it complicated to move forward but with that we'll take any questions if anybody has any at this point. Any questions from committee.
