Thank you Mr Speaker thank you colleagues I am here today on house bill fourteen eighty six and and the reason I name this actions laws because it is named
after at Arkansas named Ashton ray woods who was a by I have graduate at harvest Bible college in Glasgow Scotland with a degree in missions and theology she service full time missionary and travel to more than twenty four countries and tell COVID forced her home and twenty twenty one. She lost her life on October seventh twenty twenty two and Stone County Arkansas after being struck by a distracted driver while she was driving. Her father and the rest of her family she leaves behind two
sisters and a father and loads and loads of family members who care very deeply about our. After her death her dad reached out to me and asks because he sees all of the signs that say you tax to drive and pay whether there was anything in our current code that addressed issues like this one where texting and driving was not only a potential risk but one that actually resulted in the death
or seek serious injury of another person. And so I looked and I was surprised to discover that there's not while we do have fines for people who are pulled over for texting and driving there's no current enhancement for drivers who are texting or otherwise distracted and you cause accidents resulting in serious physical injury or death. And so from that point just weeks after his daughter was killed her had her dad decided
to take Assens legacy of living a life of service and to try to make her death a service to her community as well. Aston's law will establish a class A. misdemeanor for drivers who are driving while distracted and cause an accident that results in the serious injury or death of another driver. That can result in up to a year of imprisonment a twenty five hundred dollar fine and up to one hundred hours of community service I've spoken with the
state police and the sheriff's association who all assured me that they have the tools needed to make sure that they can investigate these types of accidents to determine whether or not distracted driving was a clause this would likely be added in situations in which there may be an underlying charge that this may be an additional charge in those sort of aggravated circumstances or it could act as a standalone charges depending upon the
individual facts of a particular accidents I looked around to see what other states are doing because this is an area that we're sort of having to play catch up on texting and driving is a relatively new phenomenon and and there are a few states you started adding these additional penalties in situations in which there is a distracted driver so happy to answer any questions I see my friend representative Gonzales already rising. Representative Gonzalez for what
purpose question. Recognized so you mentioned a lot about texting and driving but the bill doesn't specify that it it says the use of any telecommunications device so would that apply to someone who is using a hands free device while they're driving down the highway as well or maybe use their cell phone for to play music for. So that just the distracted driving definition in this part of the bill is is related to the part of the code that we already
have about how you were ticketed for distracted driving offense so we use the same definition that already appears in our code I would say that generally speaking if you're messing with your phone for your Bluetooth their your music that probably would qualify if you're looking down at your phone instead of looking at the road and but it's this is this is compliant with the existing language in the code for the ticketed distracted driving. employee of any utility telecommunications or cable company. I presented Maddox you're recognized to present the bill thank you colleagues so we say this all the time but this really is a very simple bill all this does is allow an employee of one of these companies to operate an ATV on a public street or highway if they're performing direct work duties or during the time of emergency or severe weather and the highway department does approve of this
bill that's all that it does the guys take any questions. Representative hawk for what purpose. Question you're recognized representative Maddox is is this an issue like orders mass because I know we've heard me TV bills saw throughout the session is is this a a problem that they're getting cited by police to to me this I mean I usually of people either lights turned back on we go all sources sums asking is there is a problem across the state I don't I don't know if it's a if it's
necessarily a problem they're just wanting to certainly clarify that in the event of say severe weather or that their perform their duties that they're not violating the law I don't know that that's been a massive problem but it's just a clarification based. all other allterrain vehicle bills. I really cannot speak for them on this bill no I cannot the the highway department is good with this bill I have not heard from anyone else so I presume they're neutral on it I'm certainly interested in pursuing other bills also in regarding ATV so as you know some. The everyone here has had a neighbor or yourself or your church had a catalytic converter so matter of fact the representative flowers was coming to work last session and her mother's car because hers is in the shop part to whom. Five thirty call the record her dad picked her up and for the record to get there the catalytic converter was cut off on set right there on highway five thirty I've got friends that parking commuter parking lots come back get in their
vehicle catkin murders gal that's one of our school districts want to run a bus route one morning all the catalytic converters gone off their vehicles we've got car dealerships hiring security to keep people from cutting off catalytic converters and so we didn't have a bill that had any teeth in it that can help us matter of fact there's over a I think there's over a hundred bills in states around us addressing can active orders giving example of how bad it is
the national insurance crime bureau estimated that the that the increase of catalytic converters increase three hundred and twenty six percent in twenty twenty and three hundred fifty three percent in twenty twenty one so we've taken the bill this is an agreed to bill we met with the with the scrap metal recyclers association Arkansas counties sheriff's association the police chiefs association auto dealers
association so we all got in the same room in which got we had some challenges but we got through it and got a bill that we all agreed on and basically some of the things that were being done if the office if an officer stop someone and catalytic converter one or two or three in the vehicle actually couldn't do anything but now if you have a cat and a covered itself vehicle it has to be legibly marked and something permanent it does have the date it was taken off of the vehicle it also has to have the
identification number of the vehicle which should help us with that enforcement. if you look on the third page of the theft of catalytic converter was increased to a Class C. felony like them help us with our enforcement also in the original bill of. In section three it said that a buyer of use catalytic converter and then it had other than scrap
metal recycler scratched out didn't have to report electronically but now we've added that back to the bills so they have to report to Watson leads online just like they do any other material that the then after you have an ID card identification we take a they take a picture of the catalytic converter to take a thumb print all that goes leads online also the On the the last page of something else they had to do before.
We're Cadillac were scrap dealers were scratched out we added it back in the bill buyers use catalytic converters now everyone has to report read the register with the county sheriff and they can come out and and check I'm so I think with these thing with these new rules and help us won't stop it somebody's going to try to get around it some way this should be black market but at least it'll help up us up maybe slow it down some I'll be glad to answer any questions you might have.

I just I just want to come down to a quick story about how real this is the capitol police contacted me two years ago and they had a video of somebody driving round the back to Capitol Hill in their vehicle pulled up next to my truck somebody got out of the passenger side rolled under my
truck got back in their vehicle on the left State police got a hold of the video they were able to enhance that and consequently they were able to identify the people and they broke up a catalytic converter theft ring so that happened here on our ground so. That's what I thought I thought it was Wardlaw to. I appreciate a good vote on this it is real.

I know I know you look at the bill is going to go assess you marked out to and you put a five there it is not a fee increase in two thousand three and section twenty one six four thirteen eighty four a list a variety of fees things like decision in corporations article corporation minutes articles and when this is amended in two

fourteen ninety four is another bill that Arkansas association of counties asking around for our county clerks again it is not a fee increase what happens often is people come in and ask Hey why is my marriage or why the marriage license costs this much money the county Clerk Senate having to do is independence with a bunch of pages and go back and forth and it takes time to added all up and show somebody Hey this is where the fees the fees what this bill does And amends this particular statute to add the
following C. section which shows all the other costs in one spot and it just makes a county Clerk jobs.
