respected family actually County and he is a relative of senator mark Johnson's and that's why I say that Senator Mark Johnson is a very distant relative of this very old and distinguished and respected family but with that Connor is eighteen he's in the twelfth grade he's from Hamburg Arkansas goes to Hamburg high school so just a few things that Connors and I think there's actually more than he does but I was asking him what does he not do but he plays tennis and soccer he volunteers for the first United Methodist
Church he's a volunteer thank gives tennis lessons works on the form he's a member of the National Honor Society member of future future business leaders of America member of the Hamburg Spanish club and also a member of the first priority which is a Christian. Group that was started this year so he's very busy young man very proud to have him here and I think Senator Johnson like to say just a couple words as well. What colleagues say that the I I
claim Conner whether he claims me or not his mother Laurie Switchfoot I don't know she made it back she went out for a little while but her mother his grandmother is my first cousin and his great grand father and my grandfather were brothers so that's how close we are I'm very proud of this young man and and his family I will even add one thing the late over to Switzer who was a senator from Ashley County in the
thirties was his great great grandfather and while the mentors of mine that and someone who I highly respected my whole life so this is a family thing and I'm grateful to Senator Gilmore for for bringing card and I have to say people like this and the other gun wonderful pages we have it gets optimistic about the future so thank you madam president. I'd like to recognize one of our doctors of the day Dr Jeff Kirsch he's from Conway he's with UAMS he's in a letter to Golgi and head and neck surgery and really glad to have a man I know that Senator Tucker has yet another so we're fully covered so if you guys if we start beating each other up we have two doctors take care of this today so thank you doctors and courts are nurse.

my pages was the only person on earth who called me Clark Kerr and handy's family they call me Chuck in there the only family that calls me Chuck so explain that to you all later if you want so welcome welcome Hattie and then we've got a two other young men here who are both very close friends with my son they play all sorts of sports and everything together they're both seventh graders at Pulaski academy we have Jack steed right here and then William Taylor who I like to call Willie T. so if you need to page today and Williams around is called **** T.
his family has that is else is baseball coach so he has to deal with me as a parent so I don't know what they call me in their household but it probably involves some four letter words but now these these are both great boys expense and I'm a house a hundred times and we're very excited to have both Jack and William here today with the so please join me in welcoming them here today. Senate bill two seventy two. Senate bill two seventy two by Senator Petty to create an election integrity review process to amend the duties of the state board of election commissioners and to amend the law concerning election law violations. Senator Petty you're recognized. Thank you Mr president members the state board of election
commissioners brought this bill to us it's a continuation of the and election integrity bills that you've been seeing throughout the session here this particular one the state board of election commissioners board directed the staff to develop strategies to better ensure that the prosecution of criminal Election vote law violations were pursued and to ensure our Kansans have confidence in our election laws that's the purpose between from all of these we've been trying to make some key elements
to this proposal are it establishes a process in the law that would allow the State Board of Election Commission commissioners to conduct a proactive review of election related documents in order to identify possible violations of election or voter registration law there's a post election audit process conducted following the primary election as well as the general election there's an additional felony provision and adding related added relating to the forging of a signature in the absentee voting process and then
associated with the Joint Budget there is an amendment. That is coming and and a lot of the very reasons that we talked about today in the in the earlier we're going to allow that amendment to be attached at the house and and then concurred in on this in but it dealt with staffing they had asked for originally three additional staff through discussions that's now going to be substituted out for basically a a staff position
that is not currently field being required to reclassified to it a staff attorney position so so that's part of that election and basically this is you know how the bill works it clarifies it's a felony to forces for just signature of a voter on documents it adds the election integrity review process to the authorized activities for the agency in the state board of election commissioners enabling statute. It allows the state board of election commissioners to initiate investigation of an
audit finds evidence of criminal activity. it extends the agency's responsibility to conduct post election audit of the machine results for the general election to include an audit of the preferential primary and these audits will be randomly selected within that county at a public meeting so they can't do it in in the back office and and single out certain individuals counties it is flat is establishes election
integrity review process for and for the first time a process which documents related to absentee voting and voter registration are proactively reviewed to ensure that no violations occurred. the board well the idea is that over a ten year period the entire state will have been reviewed in Leicester or others that accelerate that process the the board will submit a review of its findings by the end of the
odd number year to the AG and J. P. R. and then if there's criminal violations or violations found those they'll be required to initiate a full investigation or for the matter to prosecution if there's noncriminal violations of election or procedure we can address those through training and notifying the person or group work or county that supervises that and then if the council refuses to hand over section subsection
after the council refuses to hand over the requested records it will be if the but will form the basis to open an official investigation under section three of the bill and this will allow us to use the subpoena to get the documents are requested and then there's other non codified language in there and and I'm happy to to answer any questions. Thank you madam president members I'll be brief I understand what's center page trying to do here and I'm really supportive of the notion to make sure they elections always run smoothly in the and the way they're supposed to run. Part of the process of the bill is that a county can be audited and no one likes to be on it is going to be a significant undertaking for that county every single time it takes place as Daniel Schultz the exact address the state board of election commissioners said one wearing Committee fifteen counties will be audited every election cycle so over the course of a decade everybody gets audited once that makes sense to me that's not exactly
what the bill says it just says you'll select fifteen counties randomly after every election but Mr Schultz testified in committee that he would make sure that and and the rule making process and and the way that is administered that all seventy five counties will be audited once over the course of a decade and I take Mister fields as what I've got no concern about that the second way that a county can be selected to be audited is if the state board of election commissioners receives reports of some nefarious election activity and they make a two thirds vote for council be
audited I got no problem with that either once again. You have a report that brought something to the attention of the state board of election commissioners and then secondly in a public discussion a public vote the state board has a takes a two thirds vote for that county to be audited then there's a third way for a county be audited this is really where my concern is join performance of you can select any county they want to be audited at any time so there's no restriction on that they don't have to have a basis for conducting the audit and I'm just concerned that J. P. R. will be auditing some
counties more than others and I don't think it takes a rocket scientist to figure out which counties will be the subject of audit more than others of J. P. R.'s making those requests I would go for the bill if that J. P. R. provision was not in there again I'm supportive of the notion but with that I think that subject for abuse and so because of the inclusion of that one J. P. here but is is it random that's that's where I want to understand your understanding or perception of of that process to choose an audit because I knew that as as a random so you sound like you were treated as a potential to target certain counties areas difference is that correct what's your perception of that so there's there's three different ways for county to be selected to be audited and they're totally independent of each other so can be one of any of the three ways the first manner is totally random.
they'll be fifteen counties after every election cycle Mr Sewell says he'll make sure that it's a different fifteen counties every time so that are over the course of a decade each county will be auditor randomly once. I got no problem with that the second manner in which the council can be selected be audited is if there's a report of some problem that occurred in that county like happened in Phillips County this last election cycle is an example that I might think of that's brought to the attention of the state board of election commissioners. Then the state board takes a two thirds vote to audit that county
no that's not random but I also don't have a problem with that because there's a legitimate report being brought to the state board of election commissioners they have a public discussion at a public vote and it takes a two thirds vote and we're select that county to be audited the third manner that a county can be selected totally independent of the first two methods is that J. P. R. can pick whatever county they want for any reason they want to be audited now that's what I have a problem with because I think that's not random that could be subject to abuse and you can the
J. P. R. if they see and this is not particular to the members of JPR do we make laws not for personalities but for institutions and so I have a problem as a matter of principle whoever's on J. P. are now twenty years from now they might pick a county and we're just going to audit this county after every election cycle because we don't like that county we don't like the candidates they elect we don't like the way they vote we're going to audit them every single election cycle to me that subject for abuse I wish that would be stricken from the bill.

Thank you measure just to follow up on a couple points that were made number one the reason why this bill along with some of the other ones is yes we do enjoy a good election integrity in this state right now we will do everything we can to preserve it as we see other things happening in other states we want to be ahead of it so that we can maintain that also number two is being called into question as far as the integrity of the machines one thing that this will do is just to make sure
that there is a fair auditing process too sure right now as of last week there were audits that were done I thank in seven counties and of the fourteen thousand five hundred plus audit should it was a hundred percent accurate we want to maintain that fact one increase that to give voters confidence that the system that we have in place is accurate fair and produces good solid results regardless whatever party you're from with regards to the selection of the counties right now it's done in
a public forum at the state board election announces it's a random draw this is expanding that same process also reminded that last session we expanded the capabilities joint performance review to be able to call in any a county that there was questionable outcomes are questionable accusations whatever gave joint performance review that ability to do it and so this is just plain additional ground work so I just want to point those things out to you in response to some of the things I've said and at the end of the day what we want to be able to
do is make sure that through the election process that everything is done to the satisfaction were vote voters can feel confidence in their in their vote being cast. Is about protecting children Senate bill three fifty eight that's why we're here today. This bill bans. Products that I believe are actually already illegal. In fact a lot of our prosecutors believe there are the illegal because there's four cases pending right now with prosecutors across the state
related to these these products. Delta delta eight in like products are on the shelf today in convenience stores and gas stations across our state across the country and unfortunately that is the reason me say this the reason that I got on this trail and wine so passion about this is because I believe this industry is intentionally marketing to and selling to our children if you look at packaging on these products
there are a lot of them that are multi color cartoon character appealing to our children and to appealing to young people I'm actually surprised or has been trademark violations with a lot of these items as they try to mimic other mainstream candy products but what we're seeing is literally thousands upon thousands of poison control calls across the across the country right now related to delta a products this is synthetic recreational marijuana.
That's what this product is that's that's what the that's what we're talking about enhanced T. H. C. items that are sold across on regulated open to the public and open to our children and that's why I'm so passionate about that I don't want my kids I don't want any of our kids to continue to be hurt by these type products out there. In our state today we're seeing increasing amounts of poison control calls on these products. And that has to stop we have to protect our children.
This does not ban industrial him. This is this does not stop the textiles in the road manufactures in the the home building manufactures this has to do with the consumer products with more than point three percent THC. it does not violate federal law so we have we have a farm bill that is out there today this is in an alignment in agreement with with that. In fact we taken learnings from cases across the country when other states have have gone down
this path of look to this legislation and we've learned an added to make sure that we don't disrupt the inter commerce interstate transportation we related to ten projects. But however if you have any fears of the legality of banning these types of products you're in luck because we have a trigger bill section this law in this bill that kicks into a regulation a trigger.
And so upon injunction if the court rules that at an injection to be placed on this our our Attorney General will move forward with the the trigger portion of this bill. I'm confident this will hold up in court I can tell you this has the support of our Attorney General himself Tim Griffin has the support of our governor and her staff has put support of our secretary of agriculture what's ward in many others we work together with the Department health on the language of this bill.
And courage you to vote for now if you are let's say you you don't care that has all the support of those members those agencies and I just said is mentioned. I will tell you you will care to know that our voters in this state are against this these products we've continue to vote down recreational marijuana in our state and in neighboring states. And so the will of our people have told us they don't want these types of products on the shelf these products are acting
as a synthetic recreational marijuana in their harming our children and I believe they're harming our citizens and so I'm happy to take any questions related this bill. Regulations by the insurance department could be very similar to a self funded plan which is already has the ability to stab us their own plan designs. That purchase this health insurance from farm bureau. Would they not have the ability to go through the insurance department to. These are educational opportunities that help retailers connect with their
customers and help wholesaler's get the word out about new products this bill makes three simple changes it permits wholesaler or manufacturer reps to pour the I'll call where they're conducting the educational testing tasting if they choose to. Current law only allows a store employee to pour the alcohol. The Bill Coates tasting permit fees in half current permit fees are just too high the combination tasting fee which includes spirits wine and beer is a hundred or a thousand
dollars which is more than the annual retail liquor license that's eight hundred fifty dollars this bill would make combination combination tasting permits five hundred dollars in a single alcohol tasting permits two hundred fifty dollars DFAT has scored this bills having no fiscal impact on the budget H. B. thirteen eighty also minimally just serving mounts from everyone else to two ounces for spirits three ounces to six ounces for wine and four ounces to eight ounces for beer.
To be clear only one type of alcohol can be ported a tasting it's either two ounces of spirits six ounces of one or eight ounces of beer. Importantly participants in a tasting are not served enough to become impaired in fact this bill ensures that the tasting is focused on only one L. call type and does not permit a consumer to drink multiple types of alkyl at the tasting. The purpose of adjusting the poor languages to give retailers and wholesalers more flexibility. For example as many eight
