Senate bill seven by Senator king to add the criminal offense of prescription drug harm or homicide. Senator Teague you're recognized thank you madam president members what Senate bill is about is about the produce farm an oxy cotton in the damage that they did And misleading and lying to people. Oxy cotton was approved by the FDA in nineteen ninety five and first opiates before that mostly dealt with into the lock cases oxy cotton was the brain child of Purdue pharma and the Sackler family with the primary owners
of that and they're based in Connecticut the promotion and sales arms was out of the corporate tax saving of Delaware in nineteen ninety six a training video for doctors showed it said It diction rates were exceedingly rare in fact Purdue pharma lied and misled when they said the drug addiction rates of less than one percent. Produ we give higher bonuses for sales people for selling higher milligrams of oxy cotton and from the state from the start produce farmer hand pick doctors
and gave incredible bonuses luxury vehicles and vacations to sales reps early alarm ringers of the dangers of oxycontin appellation mountains consistently were labeled as troublemakers coach rebel rousers are really good people like Dr art van C. and sister Beth Davies from this is from the Appalachian region raise concerns and we're consistently labeled as those troublemakers Purdue pharma tried to buy off people or the early ringers with grants but they refuse by those
people. In one case reporters were pressured not to write anything critical of oxy cotton we did go on the media sometimes we its immediate people trying to expose those things early and felt pressured to you subdue those stories that were critical of. Get critical sometimes the federal government the US attorney John Braun Brownlee has been praised for his work and not quitting and going after oxy cotton and Perdue pharma and holding them accountable other people like Greg ward for art fraud investigator for with the
US attorney's office people like Randy ram singer and Richemont castle were U. S. attorneys at cap after this and even back with lawyers brought cases that help to get the case and get oxy cotton exposed to the point in the civil penalties that we are to do here today. Make no mistake the pretty formoterol to do other things in the former US attorney the John McClusky push proxy caught many of his office to to drop doctor junkets in the hundred sixty Mr Graham milligram pill he later
left his work to go to work for produce farmer the reason I tell you about these people that stood up and everything is because now we have the benefit of millions of dollars in settlements to deal with the crisis caused by the opioid epidemic. SB seven is pretty simple it's just about holding currently responsible standard to the damage and harm people did buy those drugs the same way we would to street drug dealer or country drug dealer it's no different they should be protected just because they have money and power and influence
and able to by politicians are justice should be equal to those people because they're just is criminal and probably more evil than the people that we see out here that we think a regular drug dealers because they told this was a good drug and was going to help people when in reality they knew something different. So what I want to do with this bill it is number one it sunsets in four years this will be a big task to do something if it's prosecuted and I want to say this will a lot of work to the people in the media that wrote books on this if you've ever
watched the series dope sick on Hulu with Beth Macy and it's a it's a be fearing government it is a must read book about how oxy cotton got approved and went through the process and did the damage there's probably not anybody in this room or anybody I know existing rule areas that don't have the danger of oxy cotton in the destruction that it caused to them and remember we're dealing with it in all today because of oxy cotton and how it was misled and prescribed to people which later turned her one which later turned offense law.
So members I think this is a good bill and I think this is one thing that like I said it's going to be a big task but if you look at the task before us is very small in comparison to the damage it did it did to people out here and that reality is a mention the names before of the people that did a lot of work with the US attorney's office the people that wrote books the reporters they did a lot of work exposing this in taking this on and face a great adversity many have had their jobs threatened had their credibility threatened to make sure the trees got out anyone to
treat got that we got the civil penalties today that once again that we're gonna be spending an appropriation bills the money from their work so this is about holding the drug dissected executives criminally responsible the same way we would a country drug dealer or street drug dealer and with that I'd answer any questions. Any questions for Senator T. centre Dotson you're recognized for a question thank you madam president I'm sorry if I missed it in
presentation but on the the last section do not covered by it says it expires. In December of twenty twenty six yeah and the reason we did four years is because it would give us four years out and it's one of the things there's a lot of bills I think the quite frankly we need to sunset and see what happens this is going to be a big task I mean there's going to have to be a case found there's going to have to be money that's given enough gave an Avenue given avenues that money can be funded to prosecute such a criminal case because it would be the case but if it's
something that we can't do then the bill goes away. How do you see our new big pharma that spot in this bill in the halls but won't come testify said well there's laws that already deal with this Watson why you spend so much money to fight it in. Any other questions for Senator T.. Anyone would speak against four four. Senate close.
Proverbs twenty one aces we could fully if when none pursuing this bill is about pursuing the people that mislead and lot of people and cause destruction and harm all because millionaires wanted become billionaires and they use the pain and suffering of people and lied about it to make sure that they became billionaires in this is about holding him criminally responsible in making sure our justice system applies to everybody it's that simple. Senator has close any objection to roll.

Wallace any senators wish to change your vote. Sandline please cast a ballot. But thirty four ENE is zero nine Senate bill seven passes please transmit to the House. Senate bill eight Senate bill eight by Senator king to correct the criminal offense of vaccine harm. Senator Teague you're recognized thank you Mr president I will go through the same spill again for everything in this bill but this deals with vaccines and I don't want to get in the vaccine debate that's not what this bill
is really about it's about the same thing with the executives holding them currently responsible if you look on the next page the big key to making sure that if this case can be prosecuted or should be prosecuted is it the person of the key executives CEO knowingly hides conceals omits or otherwise withholds evidence documentation information that the vaccine does dangerous it has dangerous effects it's once again it's just about blind and misleading people.
With that I take any questions. For any questions. Senator Mark Johnson you're recognized for a question. Thank you Mr president Senator Teague this is limited to that I can executive for pharmaceutical company wouldn't be a executive of some government agency it is the same type of. Offense correct no it would not it's about the executives of the company would not apply to a
pharmacist it would not apply would only apply like I gave the previous case in the case of oxy cotton with the executives that lied to misled and develop the drug this is not anybody in the middle of that. So if there was a. Government official I'll just say that way that was input it complicit in such a cover up of some information like that this would be able to be applied to him no it would not in the me and six against the question of like people get hit with the FDA
approved the drug well that is true but yet on the other hand if you look at the money situation FTA represent us in a great video that I've shared with some members where they did a study in certain drug assessors with the FDA fifty eight percent I'm left to go to work for big pharma so once again that they're approving the drug in my saying that's the case and and that no I'm not I'm saying as we know with money situation changes things so it's possible thank you senator thank
you Mr president. Senate bill you're recognized. Thank you Matt you to or exactly what we're trying to accomplish by this bill what were you trying to go out what we're trying to actually do with this you know you're trying to protect people we sit there and and Republicans want to sit there and say what we need to hold concurrent people criminally accountable if they murder somebody. Okay well what if they're a big drug executive misleading people and they could they harm someone just hold on to the same standard if we continue with the drug with amount of money that were spoken into tax dollars whether it's for vaccine
prescription drug whatever it is if these executives know they're only going to be civilly responsible for it and all they can do is write a check and get off of it well then that's what they're gonna do they make a billion dollars off the drug and in turn around and pay a two hundred fifty million dollar fine that's not consequence enough to the people that had destruction Harmon were killed by their drugs quite frankly because they lied to misled people and knew they were lying to mislead people. Senator Clark you're recognized
for a question. Yes. Under this bill. Requires two things if I understood it correctly. The. They have to knowingly mislead. And there has to be proven hall is that correct that's correct thank you. Let me just say about the proven hard part with a made a settlement like they did if they had no harm people on the civil side of course not so.

Senator Rapert you're recognized. Thank you madam president. Senate bill one twenty five this bill. Builds on the form act that was passed in twenty nineteen to create the free speech standards on college universities and campuses.
in in includes eliminating free speech zones and designating outdoor. the form Act eliminated free speech zones and. Designating outdoor campuses outdoor areas of campus is public forms for free expression free expression activities. An art I'm speaking today since that time there's been a desire to expand the form the public forms to include indoor non academic areas that are open to the public and traditionally used for free expression this
bill accomplishes that while still allowing universities reasonable time place and manner restrictions to help avoid disruptions to the learning environment. this bill is consistent with the first amendment case law and requires the colleges and universities to update their policies to comply with legislation I've worked with as many people as I can find on this and there's no known opposition to it at this time. Senator board required disclosure by an insurance company the monetary amount of a deductible based on a percentage of the insured by you under an insurance policy. Senator Boyd you're recognized thank you madam president colleagues we passed Senate bill three sixty eight at two or three weeks ago after I've been passed out here the there were some concerns brought actually after problem passed out of committee there were some concerns brought up so we send it back to committee and rectify
those concerns the State Farm and chill the shelter had and so this bill simply requires an insurer of a residential property which sells a policy using a percent duck deductible to include a monetary amount for the deductible on the declaration page a renewal notice so if you if you have a million dollar house and you got a ten percent deductible then yeah that be a hundred thousand dollar deductible and so that and then you know so you yeah you're like will someone million dollar house I'm I'm sorry for
them but that works its way down to to all of us right and so this is just about transparency there's no known opposition at this point in time it does clarify earthquake policies which have historically been sewn it sold as a percentage deductible can still be so that way that said I'd be happy to take any questions any questions for Senator Boyd. Senator Chesterfield you're recognized for a question thank you thank you madam chair and thank you senator thank you my question on page two. My greatest concern with all the change is that you have removed representation for rehabilitation services. And I have services to me represent a very unique group of individuals who are disabled. Mentally sometimes physically and we've taken that representative representational
what will they do that basically these are industry people these are not people with disabilities on this board their industry people will understand that but the industry was considered the rehab folks were part of the industry before they're still part of all this but they're just not the industry representatives on the board. SO we also took all financial image of the hospitality so to smaller board.
I guess what I'm. In this environment we call work there are individuals with disabilities by and yet they're not represent industry in this bill and I need to know why. Senate dismaying recognized all right members this was an agreement that we reached after the bill had already made it out of our chamber and and was on his way to the governor's office but essentially we knew that there was most likely a problem with the bond language that we had in place under the consumer protections the solar industry
propose this as a fix to that and so we're just going to run as quick as we can to get it back down the governor's operate or so that they continue operations but essentially sets out a single ten thousand dollar bond obtained under a particular code section and that they are a commercial generalizations limit of at least one million dollars in it and also have a applicable contractor's license issued by the contractors board again just to help with the protections in this was brought by the solar industry.

Trying to a dog treat and transport to an alternative destination act and to mandate insurance coverage for ambulance service retirees treat and transport patients to an alternative this of this nation. Centreboard you're recognized. Thank you madam president colleagues this is a very innovative approach to a problem that we have it so like if you're in an ambulance and you're called out to a scene and you get there and you're like well I understand why you call but I'm really not needed you
know you really I don't think you need to go somewhere with this bill does is it allows the EMS to be paid for non transport and transported to alternative destinations for lower negotiated payment or treat in place it could you know this legislation could help prevent someone from being transported to jail if the E. R. is an appropriate there is. I do have a question but overall there's no no no opposition it
we expect long term this will reduce costs by reducing ER visits and this I just wanna say this is thinking outside the box solution to a more efficient use of ambulance services happy to answer any questions. Question for Senator boy Dotson you're recognized. Thank you madam president Senator board we we kind of talked about this I would like to hear your explanation on. With regards to set Page two
line twenty eight twenty nine. Also on. Another page page Page five lines thirteen and fourteen where it's defining telemedicine and it says it does not include the use of audio only electronic technology I know we we have discussed a lot with regards to telemedicine in the last session and
Just nervous about. Defining it any differently than what we went back and forth on and of course that was a scope of practice change you can you can you dress how you view this as not being a coach scope of practice change so it needs to be amended in the future you would not have to go through a scope of practice in. Senator Dotson that is an outstanding question I appreciate you bringing it to my attention and in this change so right now this is about an EMT
working with a physician so the physician already has the ability to to do telemedicine so. This is telemedicine in a school very specific defined situation where an EMT has come to your home has come to your business come to you on the side of the road maybe you've got a cut on your arm and the anti looks at and says well I don't think it would require transport but this is beyond my scope so I need to put you in touch with the physician who can who is
qualified to make that decision and so in those circumstances specifically the you need to be able to have the audio visual component because we're talking about emergencies so. So this is only in reference to the M. T. onsite with the patient communicating with the position off site that they have to have the audio visual. Themselves not the patient calling the physician trying to
that the tenements that is my understanding in the weights strapped in that it is based on the specific area code regarding ambulances and EMTs thank you. Any other questions Senator Hammer. Thank you ma'am chair just up in a scenario where. Somebody called Sammy once they arrive at the scene and it is that the determination of the medic the physician whose
telemedicine or the patient that makes the determination that they don't need to go I would say that the intent of the bill is to make it between the physician and the patient I mean there's nothing in here that forces you know the like the patient says I don't want to go with the patient's still saying I don't want to go but the physician that's where you're bringing in the telemedicine is the physician can make a triage decisions that the EMT doesn't have the scope of practice to
make okay so say the physician determines that the patient. Doesn't need to go with the patient the bill for the service will be the insurance company who's going to be paying the bill if the physician makes the termination for patient doesn't need to go so that this will this allows for non transport and transported to alternative destinations for looking lower negotiated payments with insurance that's what this is
set up to do because I know a religious show of all a lot of times there's transport their stuff without the bill but this is intended to help reimburse the ambulance service for those calls where they don't actually transport yes senator Hammer so the way I understand it I believe it was in committee a third of the time they show up in the transport so that's like it is what I recall from committees two thirds of the time they're just showing up there doing something and there's no mechanism in this is really an innovative approach to keep people out of the emergency departments that don't need to
be there and to help triage people to the right place it's a good use for EMTs last question if the patient calls and maybe there Pitsch will call or that just rather call anyone should have to get up and go the R. is there any way in this bill that the patient could be charged for the services patient term not to not to go. I. I don't I think we're getting
beyond the scope of the the bill and the technicality but it's a great question thank you. Senator Murdock you're recognized yes. The the. The. Four of the. Another great question again. People working within their scope of practice have liability for what they do so if the physician is the one that makes
the ultimate determination then I would see that the physician would be the one that would have the the liability if the physicians never brought in then the of the then it be the anti working within his or her scope of practice where I would think it would would live but that's the point is what this bill does is it facilitates being able to bring a physician to that point of accident to the home where ever that call comes in it brings the physician into the to the situation and it would work just like any other situation if
there is a doctor and a nurse or anybody else. Any other questions. Anyone wish to speak against or for. Senator proposed hi appreciate the questions out the again I want to reiterate I think this is a real thinking outside the box solution a more efficient use of ambulance services and I appreciate a good vote thank you. victims of crime and to provide that victims of misdemeanor crimes have rights. Senator Irvin you're recognized. Thank you members and this is a small change that will really have a big big impacts and it's a simple bill but it does a lot what this bill does is it extends the victims rights at especially in cases of domestic battery to all victims of domestic violence this will provide victims of class A. misdemeanors them which are the
most serious of misdemeanors the same victims rights as afforded to felony victims which include now that will if this bill passes this victims will be entitled to know where the defendant is confined information about the defendant the Victor of the defendant's release furlough or X. gate have the op and then it gives victims the opportunity to testify or submit a written statement to the parole board and most importantly it have it there is a right to protect their
personal information so if we pass this bill and extend the victims rights acts this gives approximately three thousand survivors of domestic violence the same rights that other survivors currently have under the victims rights at. I'd be happy to answer any questions and I will say to M. women's own worth as an organization that supports them survivors of domestic violence also stop diem stop TV in Faulkner County and so it's important to these organizations
that we do everything that we can to give victims the ability to protect themselves and to know when their violators are up for parole or at four release or for low M. as that might be the case and to have that opportunity to testify or come before the parole board. I'll be happy to answer any questions any questions for Senator Irvin. Anyone wish to speak against or for.
Senator you're pretty close I'm close I just as I as I close so I think it's important for us to use these voices in these opportunities just to talk about how important it is for us to continue to work for the victims of domestic violence and divest the mystic violence is one of the hardest crime sometimes to prosecute it's also one of the most dangerous calls that a police officer or law enforcement officer will take is a domestic violence call and I had a good friend sergeant Mike Stephen that was killed in the
line of duty in response to a domestic violence call so just wanted to give that opportunity for us to talk about how bad domestic violence is and and I appreciate that represent a fight her work on this bill and I'm closed thank you. Richardson and senator Dotson to create Charlie's law and to require an electronic child safety alarm system to be installed in a school bus. Senator Dotson you're recognized. Thank you madam president Senate bill fifteen eleven. if you may or may not have seen news in Northwest Arkansas last
year when a student was stuck on a school bus for several hours because. It was a I believe is actually kindergarten or made in first grade but it's stuck on the school bus for several hours left on there in the in the the the bus barn parking lot area. Because when they got back the driver didn't go through the school bus and check fortunately he survived was very
dehydrated and that's our thing the Charlie. Charlie's law is named after him and this would require the the safety alarm system. To be put installed on every school bus by statute currently the rule but this would codified at ten make sure that every school bus has that to where a school bus driver once they parked the bus they have to go through turn off the safety device the back of
the bus and make sure and check first for students as they're going through their more happy try to answer the questions. I have a recognized. sorry and just look at this you're saying that law schools already complying with this financial impact so it's a hundred and seventy five dollar piece of equipment how much overall for the ones that don't
have. They should all have it but. Whether or not they're complying with the rule or not I can't say for sure this codifying. Did you have a financial impact that they have with this well it won't be any additional financial impact of the state but it's one hundred the the financial impact statement was no impact it's it's worn by the district and it's a hundred seventy five dollar device per school bus if it's not already installed in overall figure of
what many school buses now again in the state. If the bus driver would have done its job job. This wouldn't have happened. If the bus driver doesn't turn left right and there's going to be an impact. So. I'm. These kind of bills probably when people were do the job we K. Michael do their job the required to do the job. Is this gonna.
Wells malfunctions is not going to work well like anything if if there's a malfunction or there's a You know someone I guess is part of hearing they don't hear the the device going off when they shut off the school bus they have to go back to the back to turn it off We all will safety for kids there's only so far you can go back thank you. Senator Hammer yes ma'am thank you madam chair the title is
pretty self explanatory note school district just a few points no school district should be required to have his own elections less voters of the district or school board decide that the voting rights act does not require zone election no city council is required to have zone or wards and with twelve hundred thirteen her school board positions Arkansas talent should be empowered to serve regardless of address majority minority school districts would no longer be forces on and left unchanged many districts in Arkansas have to rezone elect
all new boards following each senses this bill is a hundred percent permissive of and local control in that no district would be required to zone appreciate a good vote. You're recognized for a question thank.
Many years ago. Make sure that we have. It is very small in the community and to all of our. Of voting the.
Part of the wise. With minority. Possibly. Right so as I was told in this is a the answer they'll give you is that when this was established back in two thousand which was twenty twenty three it was a different scenario different different setting at
that time the one thing people also need to realize about this as far as I'm doing a the federal requirements those federal requirements remain the same remain in place and so what we are doing as I pointed out awhile ago is that were opened up to allow for the local area to decide how they would like to handle the rezoning instead of being forced to do it after each census and share with all due respect I know there's others your come up behind me that will probably speak to point so more yield to them to let them speak what your concerns are thank you. Anyone wish to speak against the center field you're recognized
to speak against. Thank you madam president Senator thank you for that gracious introduction. We appreciate it. You know amendment into the constitution says that the powers not delegated to the United States by the constitution. Not prohibited by it to the states are reserved to the states respectively or to the people we are here to amendment ten in the constitution all the time in this state. And we express our dismay when the federal government comes in and tells us what we have to do. This legislation went into effect in nineteen ninety three.
And since then we have been able to elect boards. By zones. We have been able to draw those owns up we have used hopefully a better price than we did when we do of our own but we have been able to draw up in these zones and the cities and the school districts have done it and they have done it in an objective manner. You and I represent various areas of the state we don't all
come from the same area we are not elected at large. Because our voices matter and the people that we represent matter. I don't represent the same area Senator Rice. He then represent the area I represent. We agree that government is important and the participation of all citizens is important that's why we're redirected by districts. And now all of a sudden we're
saying that the same thing should not be applicable at the local level. All the voices of the people in the local governments should matter. Their representation shouldn't matter. And when we do away with that we're trying that a particular group of people will have more power than the folks. Folks I ask us to look at our sales. Look at Dave Wallace was up in
northeast Arkansas he didn't represent Central Arkansas. Fortune is not Jonesborough. What Stubblefield come from is not where I come from but I'm voices matter because we represent unique interest in the state of Arkansas. And I submit to you today that the people who are on our school boards should represent unique entities as well. And that they ought to be able to vote on those persons.
In zones. In some school districts we have a combination of both zone and at large but when we have built at large members we also have people elected in zones represent you in the constituencies those constituencies you steal matter and we should vote against this bill because it takes away the power of the individuals in those unique areas. Then school districts. Just as if we were elected all at large.
Would we be represented. How would have folks bill Senate Linda Chesterfield making decisions but the representation that they elected Blake Johnson for. It matters that we are unique it matters that we represent particular areas of our state it shouldn't matter that we represent particular interest and individuals within our school zones that's why this
legislation is important and I would appreciate a no vote and I'd be happy to take any questions. Questions for center Chesterfield Senator Tucker you're recognized. Thank you Mr president Senator is it true that this bill will strike language from the codes that we passed a law to be consistent with the federal the federal voting rights act of nineteen sixty five is it will it will thank you. Any other questions.
Anyone wish to speak for anyone else wish to speak against or for. Senator you're free to close. I apologize Senator Clark. Sometimes you stand quietly and sometimes you get paid motions I apologize for not recognizing you. Senator Clark you're recognized. I'm not sure the purpose of this bill.
But. Senator Chesterfield has many times. Brought up issues. whether it had to do with education whether it had to do with discipline whatever and and how it was affecting minority students. and with good reason. whenever we look at our scores that we are costly trying to bring up.
our minority scores are going to be the lowest. Shouldn't be. There there's no reason that they should pay. We'll get a graduation rates we're gonna find the same. Our minority. Representatives and senators bring these things up. Because their constituents are concerned as they should be and I know you are.
I don't understand why at the school board level this will of the effect many schools because not that many schools have ten percent. Or more population before they do. The ability to have someone. Who you believe. If elected. Is hearing you and hearing your concerns about your kids. Is so so important. And I can understand why we wouldn't do it I'd appreciate to
know what. Anyone wish to speak for anyone else wish to speak against. Senate. Thank you Mr president couple things point on closing for small districts may still choose to be zoned at large for a combination thereof so puts it down to the district to make the decision second one no one should be forced to be on these owned and then a majority
minority districts benefit from not having to be is owned and with regards to the voting rights act it does not require zones so want to bring those points of clarification I would just close on this point I have full faith and confidence that the best qualified candidates will win regardless of whatever their differences are whatever their backgrounds are whatever the races are the best qualified candidate should be the ones that we want on the school board not being forced because of something that we do so I appreciate a good vote.
