And she's the captain of the tennis team she's an investment club interact club mu alpha theta National Honor Society and beta club so she's she's doing pretty well for herself and shall be attending college at the university of Arkansas in the fall and majoring in marketing eva is a freshman at mount St Mary's she also plays tennis golf in the achievers club dance and trap club for college she's planning on joining her sister at the university of Arkansas on majoring in pharmacy or business so as as was the case yesterday living neighbor also my cousins so you'll take it easy on him and don't be too hard on for that and their grandparents are up in the gallery there like a second set of parents to me my and local and then forced their parents my first cousin and his wife we love like a brother and sister up here so please join me in welcoming Libyan eva and and also their parents and grandparents here to the states. We are seeing increased depression anxiety were seen or seen are young you the special are female youth that are going through eating disorders and multiple image issues related to complex issues of exposure and and it a use of social media. Other services show that eighty two percent of youth would change the way that they engage on social media if they knew their parents were involved with with them and in New what they're doing online. We've got kids that are getting cyber bullied we've got kids that are that are. Truly being harmed by what's going on out there today were asking for a reasonable age verification or parents can approve the usage of creating accounts in Arkansas so that's what this bill does is it puts more power back into our parents it protects our children and it's it's our job to help help that happen so I appreciate that happy to answer questions. This has to do with the liability for the social media company that a violates this chapter. And this is the second reason for that and it's damages resulting from a minor accessing the platform without the parent for kids custodian's consent. The way this is worded it appears to me that the social media platform will be liable whether they had any involvement in that or not what what if the juvenile finagle their way on to the platform. Then the platform is responsible not only for any damages that result but also court costs and attorney's fees it seems to me like a platform should have to be negligent. Or have to have done something in order to trigger that liability. And that's my that's my concern tribe I appreciate that question I can tell you the when we constructed this we purposely required a third party agent or fire so that there could be track record of of the social media sites acted in good faith to make sure the age verification process is being happy is happening and so we believe that that would in that would. Cover the social media site from litigation if they have in fact done the proper age verification through through the third party. I should say the. that if the social media company goes through that then they won't be liable because the way this is written is just says if a minor gets on without the parents consent. Then the social media platforms liable period if if if it read differently where the social media platform has a sensor is not able to go through that age verification system that you're talking about I would. Be more comfortable about it but but that's that's nine in their. I I I hear your concerns I don't think that's how it's it's going to be when you read the bill in its into tally I don't believe that that is how a a prosecutor or judge would rule and I can tell you to convey to confirm restraint in that opinion would be that we have we work closely with the AG's office on this language work closely with with the governor's office on the legal team to make sure that this does stand up to the concern that you're you're voicing we the the intent is not to to necessarily go after big tech you know the intent is to protect children and I I believe it does state that I believe it does create the atmosphere where if there is confirm damages that parents have a civil side to be of the tax I also believe. This section protects companies because if if information is leaked. Right there has to be proof of that as well on both sides. Thank you. Other questions. Senator Petty and center Brian. Just following up on that As you know we've we've talked about this numerous times I thank and and you can look at it there has to be a violation. You want to the social media company that violates this subchapter is liable to an individual for a which is the penalty and be damages resulting from a minor accessing social media platform so if a validated that created the damage and they let them go out and look at and I understand from from your legal perspective what you're looking at the way I look at it this is a of a violated that caused the damage because they allow the access not because they weren't at fault because they were all as set. In the C. one above correct it's all it's it is all contingent on a a violation of the previous statements before and and that that would trigger any litigation or any diff any violation of at that point. Senate Brian. The governor so and I'm just not familiar with how. Identification works through online will receive a discount for north with Arkansas got family right over the border always when you go in that border you go in a different IP territory. And so but my my minor child goes and visits his uncle. In law and all laws and that would require him as a resident of Arkansas to do all that even though he's not an R. I. P. net that has anything to do with Arkansas I. P. address sure great question with the way we constructed is is jurisdiction in geographical boundaries at the state line in and also only on the creation of an account from an Arkansas user there's definition Arkansas user the bill and so to your point if a if a minor were outside of the State of Arkansas we don't jurisdiction they could create an account and but what we are controlling is is the mass of the machine everything in Arkansas the state state borders and we do know technology exist and is easily able to put those parameters to where we can control that. No question is why hundred million dollars seems like there's a lot of activity from a lot of bad actors that this will not prevent. just because the company would be a good a good social media platform that has all these provisions that they make the hundred million dollars that's one to be penalized with the one that makes ninety nine million dollars that's just. Sure trash sure that if you answer to that first is we drew the line in the sand because of largest impact so by calendar definition these are the largest impact social media sites the sites that have the most followers the most profiles being being used the most bad actors being drawn to as well and so we started we have started there I can tell you that I had information is going to use the in the closing statements I'll tell you now there are multiple states reviewing this Utah just passed a very similar law they chose in their in their language they chose five million users and so the same question to be asked what why why is there not at four million five hundred users right there's always gonna be a line where you have to pick a line today we are saying this is the line because it has the most impact by definition the more social media accounts gain followers if this pushes people to go to different social media accounts they will gain in revenue streams and and then they will have a larger impact than they'll be under this law. Thank you governor of I have two questions for you the the first one is if someone from the state of Texas or whatever just pass into Arkansas on the way to stop it at a hotel or motel. what we're available they don't have since their user numbers here they're going to have to go in and do all the all the paperwork from there just going through our state. so I would appointee to section talks about the definition of Arkansas user and an account holder and so Arkansas user means an individual who is a resident of the State of Arkansas and who has access or tense access social media site platforms while present in the state by accessing social media platforms so by the by the definition we struck here it's it is the the resident of the state and not necessarily enter commerce track transportation. Okay I think this will be a very difficult to track it and what you will resume get hung up I really use the state of Arkansas on it but there. Their their their numbers in there and everything is going to pop up to being Arkansas at that I guess we very hard on myself I'm not your smart enough for that to monitor the same question if you were we don't really limiting this to the kids trying to be socially correct yes. Dollar sign on the office of the remaining kids what they can do but we're allowing terrifies to be on their own social media we're. I don't see how we're we're being fairly three. Senator hill I appreciate your concern because that is the heart of this bill is to protect children from that files for protection from groomers from from bad actors we're seeing that children are creating accounts are being exposed to advertising being exposed to two groomers in in chat rooms are different in different capacities and what we're saying here is we are involving we're requiring an adult. Parents to be involved with their with their kid online we want them to talk about but this wanted them to know that they have an account a lot of a lot of parents their kids they don't even know they have an account out there on any social media sites so this is the best measure we believe we can do today to make sure that we we protect children and make sure that they are armed to fight against predators online. Senator Tucker Clarke thank you Mr president. Follow us center Petty made an excellent point And I appreciate that but I want to kind of follow up on the same concern I had back on page six. One one one. My my real concern with subsection be online a is it appears to me to be Strickland which is you know legal term for no mental state required no negligence or recklessness no purpose for knowledge and and then if you go up to subsection a one on line one there is a mental state there it says a social media company that knowingly violates this subchapter is liable so there there is a mental state there but in that section. it says there liable if the social media company fails to perform a reasonable a reasonable age verification but it doesn't say what they're liable for or to. And so I don't know if you have an answer to that. What what what low it says yes they're liable for damages resulting costs and attorney's fees and port subsection a on line sixteen they're liable for twenty five hundred dollar violation because an attorney's fees so that subsection a one doesn't spell out what they're liable for who they would be liable to for that and I'm also just kind of curious about the reconciliation of the knowingly violating online one and then it being Strickland bility down in section B. one. We appreciate the concern and I. Respond I will I will Adam Lee admit I'm not a lawyer but not litigated these types of cases what I would say though is if in a court of law when you're when you're session damages not appreciate your feedback on this when a judge it is assessing damages the difference between knowingly and not knowingly would weigh into the amount of damage is probably involved whether there's complete negligence there and so I I believe this does strengthen that if we've got social media sites that after knowingly they are not going to comply with age verification. The harms in a damages should be larger it should be a happier if we've got social media sites are going to say that we don't care about protecting kids we don't care about age verifying if this law passes then the damages should be stronger if they have if they have taken a a a stance of that nature I believe that that should be involved with with the the ruling and I want to make sure we give the ability for the the judgment and the prosecution involved in that nature. Senator Clark. Thank you Sir for these I don't know if you've got all the. The bill or law. And of this much as anybody else lows to. Having restrictions on and freedom of what adults can do. That being said we have been any. Medium major saas city town. Businesses that follow all. Kids can't go in or can't go in with parents or even sections of those that kids can't go with all that we just take for granted that we don't even think about is that correct that's correct and and some of those we don't ever think about because we may not free for those at all but we would never want to child there. The employees for that. With the Hendren said and so what what we also don't see is what. The child's phone. Same business saying top business. No restrictions. Maybe would you not agree. Is this is this a slippery slope. Like we are we are. We're about to insert government into a parental responsibility. And I know for for my my minor children like I I control. And at what point is the question of what point did the parents need the. Need to govern the stuff and they can do their do their duties and if the parent is like there duty to let kids have unfettered access what is the what is the government's role in that. My response to that is we are we are seeing. This technology advancement is relatively new. I mean in the grand scheme of things as parents last fifteen twenty years we've seen an increase in in fact we've got a kids are spending an hour more on screens per day. And they were just last year. So through code we've seen and intensified exposure and consumption and usage of the sites the staff at the statistics that we're seeing harming children. Says this is an important deal we will no longer allow profits of of the social media sites to take property of fears of a slippery slope right to data problem exist today there is an issue today kids are being harmed. And so having fears of slippery slopes I understand that it I do see the concern of are we saying governments involved here. Yes we're saying government is partnering with parents they're arming parents to make sure that they're involved if you don't want to partake the sites that is your rights is not a first amendment right what this is is a coming along side of parents and saying please be involved verify there's an adult involved. And then you are you are and what you are packed in power to have that conversation allow them to be on as much as you would you want them to be involved but I can tell you this is being viewed as not as big but brother or big government come and tell you how to live your lives it's being involved is how can we help you parents how can we partner with you how can we engage with you more. Thank you and I I appreciate your passion I do agree that there is a tremendous amount of issues or bopping around social media however based on those comments that you just talked about with the governor being coming along and being partnership with parents yet the argument went we tried to win a bill came forward to strike the piece of paper to allow or not dont to revisit but I see a lot of similarities between that one piece of paper where government was coming with a partnership with with parents. In order to have permission for them to work. And and and and so I. I guess what's the difference between what you're doing now and that bill that came before it is where you and many others you know one of the government out of the parent life did not want to come between the parent and you know their kids or whatever and so I think that to me I see that this is kind of this act same thing that you there's a position one way here but not here that's my first question and my second question would be why did we not go after pornographic sites. And then why did we select this route versus trying to identify people who are sex offenders who are listed on effectual registry and why do we go that route because we're opening the door regulating the internet when we're going down this path so so that if you can answer that right sure thanks for those I can tell you that there is a difference for me first culturally. The bill you referenced I believe culturally since the wrong message it sends a message that our children should should be allowed should be allowed to are specially from for me as a parent I want to make sure that I encourage my children to work to take responsibility to engage with the work force and not be dependent on on big big government to tell them when and where they can go work right and I believe that bills differently this one is about protecting kids we've you talk about the statistics we seen kids are being damaged. Kids are not being damaged on on what the other bills saying that is about a cultural I believe a cultural mindset this bill is seeded we're we have we have women young women that are having suicidal thoughts because of image issues. At an alarming rate. It's so all we're saying is that we need to make sure that parents are along side to help in the form in mind that is being exposed to some of the things online and I thank you I appreciate that and that but where is that the parents role and the church's role versus the government's role I think that's really what a lot of us are struggling with to be quite Frank and honest I think that the job of the parents it's my job to say no you cannot have a cell phone and so you turn eighteen this is what I did what I did or you can't be on these sites until you reach a certain age that's my job here at and that's what the church should also be teaching as well you know and so. I think there's a struggle there and by but to your point I think it's also important I mean that other one had renters in there but again why not the pornographic sites if we're going to regulate the internet which is kind of what we're doing here opening that door of a policy statement some **** sites we dressing in Senate bill sixty six okay with the same measures to have age verification process if it up to me in my Tyler perfect world I would say kill those things okay completely destroyed however we also believe in a free country and we also believe in not overstepping all we're saying is that we are seeing statistics of kids getting harmed and at the same measure I believe in the social media sites thank. Would you to kind of go into how you're going to regulate if someone and not have a photo ID how will regulate that what are they going to be that personal security number in proof there's number and if they do that I didn't know what we're looking at on that I think that may be the issue we need to approach is that it will open up for a lot more of that and I think that's pretty rampant. The US right now throughout the throughout the world. Great concerns we we worked with the number one identification company in the country Idema who is involved with. Cross the country they they do about eighty percent of all the driver's license across the country they work with TSA precheck work with global entry all around I'd identification all around ID software. They have explained and showed us multiple ways of how they can confirm identity through digital I. ID's also by ship by showing the best way to to not leak data in fact one of the questions was what how do you confirm data heavy confirm H. if you have to dump the data which good news is we are requiring jumping the data right the way they do they have four different ways that they can confirm age verification that took place while also dumping that all the in the personal data. I like that part of it also know that there is someone can dump something someone others want to pick it back up sure I agree with that that's out there you there's always a concern the same concerns exist with online shopping the same concerns could exist with online banking and so in an online world that we have progressive out there there's always those concerns and what's great is if you have those concerns with on social media sites whether online banking you have the right to say I think it's too much risk I'm not gonna partake no one is forcing you to partake in these we're just saying today children are being hurt and this is a reasonable ask just like we have reasonable age for vacation for cigarettes for for alcohol this is another reasonable age verification yeah and we use the word of harmful several several times during this this talk today the can you define that the board harmful for me because what I think maybe Markle you may not think that is going to regulate. Sure so. I can tell you kids are being harmed the statistics that we're seeing. One third of all sexual crimes. Those are crimes harming individuals right that is harmful harmful is is cyber cyberbullying artful Is anxiety and depression. Right there are multiple descriptions of harmful and I believe we have a range of data in fact I believe it's Gretchen surface because it would with the continued exposure and involvement of social media I believe only gonna continue see more and more harmful issues right and there's gonna be a range of different descriptions there this is an effort just like Utah just passed just like Connecticut and in New Jersey are getting ready to pass the way that we could help mitigate and bring a parent because we we do know parents involvement helps mitigate a lot of these issues. How do we mitigate those who do not have a parent that's involved sure guardian whether whether someone the incarcerated have a heart attack or to separate if you have split purchases with us but. How do we know which parent has control of the kid. Sure the information. We have we have guardian's involved for it for all minors. Thank you thank you. Senate. If we do yours as it is in letting the letting it play out here what do you think I would say I don't believe that's exactly the same thing at the I can tell you I I think this is and it says that stopping of a child sexually grooming a child refusing to regular promoting a sexual performance by a child their number of them in this bill that seems to me to speak to a lot of the concerns that you have so I just want to share that thank you Mr thank you senator. To make sure that that everything's going to go along with the state budget now the process the process has been followed because at the beginning of the session the members of the Revenue and Tax did pass their own rules which you all do in your committees and what it does is it allows the chair to put something on active agenda because everything that's been coming to us it's just been going to the deferred agenda if it has a revenue impact actually everything's been going there but I've been having our staff to pull it off and put it put it on the active agenda those members of that committee of course can overrule the chair chair just like they can in any other committee that goes without saying respectfully with the center Payton he's been talking to talking to me about this I appreciate him telling me that he was going to extract the bill it's just been. With everything that we have going on trying to develop RSA and you are going to be hearing about you know a tax cut that is planned to come forward that we were trying to focus on that we all know that we've had the learns bill we've also had the prison a situation that is out there. And so that's it's it's just kind of a macro standpoint that's been the that's been the direction that we want so I would ask you all to please not do this because it's one of those things although his bill has a lot of merit. So do the other twenty or thirty or forty that may be on it and probably also the twenty or thirty or forty or fifty that may be in the House Committee but at some point. You can pass more in tax cuts then you have an revenue so we have to be proactive and we have to look at everything so I would appreciate a no vote.
