resolution. Thank you, Mr. Baker. Sure. First of all, I'd like to recognize my colleague, Senator Jason Rapert, that's standing behind my chair over here.
He has also passed the same resolution in the Senate this morning, and so I know he wanted our guests to be aware of that, too. I would also, if Representative Burris wanted to join me in the well, I'd appreciate that. Special Agent Brown works in Representative Burris' district, and he lives in mine.
I'll say this, that we have many good state employees. we have many good state police employees but sometimes the cream just comes to the top and when it does we need to recognize that today we're going to recognize special agent brown who was the 2009 state trooper of the year
he has his wife Leanna with him, his daughter, Caden. He also has his mom and dad, Tom and Elaine Brown, with him. I know they're very proud of him, too. He has his direct supervisor, Lieutenant Bill Beach. He has another guy with him. Not only did Special Agent Brown receive the 2009 State Trooper of the Year Award,
but he also received the Medal of Valor. The reason he received the Medal of Valor was he was in a helicopter that was searching the National Forest for drug patches, and it had mechanical failure and actually crashed into the Buffalo River in 10-foot water. And even though he was injured, he was able to escape the helicopter and get to safety, but he noticed that a gentleman that was with him was struggling.
And he went back into the danger and helped this guy that's with us today. His name is Johnny Sowell. He's with the 20th Judicial District Drug Task Force. So he's standing up here with us today, too. I respectfully ask the speaker to read the entire resolution.

Be it resolved by the House of Representatives of the 88th General Assembly of the State of Arkansas, whereas Special Agent Kevin Brown, 31, of Van Buren County, Arkansas, is a five-year veteran of the Department of Arkansas State Police and is currently assigned to the Criminal Investigation Division, Company E, headquartered in Harrison, Arkansas. And whereas Special Agent Brown was named Arkansas State Police 2009 Trooper of the Year on March 19, 2010 and was also the recipient of the Department's Medal of Valor, presented for extraordinary acts of valor and gallantry
that clearly sets the individual apart from other commissioned personnel. And, whereas, Special Agent Brown was chosen for both awards for his successful recovery and rescue of others while working with a drug task force. And, whereas, Special Agent Brown was a passenger on an Arkansas National Guard OH-58 helicopter on June 4, 2009, when it lost power over the Buffalo National River, and was working with the 20th Judicial District Drug Task Force to identify marijuana farming operation on the boundary between Marion and Searcy counties.

Now, therefore, be it resolved by the Arkansas House of Representatives of the 80th General Assembly of the State of Arkansas that the House of Representatives commends Special Agent Kevin Brown on his service to the State of Arkansas and his selection as the 2009 Arkansas State Trooper of the Year and Medal of Valor recipient. Be it further resolved that upon this resolution, an appropriate copy shall be provided to Special Agent Kevin Brown by the Chief Clerk of the House of Representatives.

come in and have a mock session to actually go through the process, and it's a great learning experience to them. We do it for other organizations such as Girls State, Boys State, Silverhead, Legislature.
We did it on the other end of the Capitol in the Senate last time, And for the first time, matter of fact, we were the first state in the nation to allow a mock session for individuals with disabilities. The only problem we had was the Senate was too small. We actually had to turn some people away because it was not big enough to accommodate all the individuals who wanted to participate. It is of no cost to the state. They raised their own money, and it's a great event.

have a child with a disability I sit on board of directors for a group called Community Connections a nonprofit group in Conway that offers a variety of activities for for children with a wide range of disabilities we have made so many strides over the past few decades so many things that we take for granted The ability to walk, the ability to be able to use our hands and our fingers, to brush our teeth, to have just daily functions that we take for granted that so many people do not have the ability to do.
But the strides that we have made, just in terms of an awareness, access, ramps and sidewalks, doors that can be opened, just simple things, things that, again, so common to each of us, but have become a hindrance to others. But that awareness that has grown through the past few decades, it's growing. I think this is not only a symbolic message, but a substantive step as well, Representative Steele. And again, I

Started out with two members, moved to a different church each time his work as a kingdom builder progressed. Through all those years, he worked his way and became a concentrated bishop of the Church of God in Christ. But for that divine reason, Almighty God called them home this week and would be funeralized this evening.

He's truly a stalwart member of the community. and he will be greatly missed, has created quite a large congregation there at Camden at the New Calvary Church of God in Christ, and as I said, we will greatly miss him, but he's gone on to greater things, and we'd appreciate a good vote in memory of this gentleman. it, Ms. Clerk. Whereas, since World War II, the Pine Bluff arsenal in Jefferson County has safely stored the second largest cache of chemical weapons in the United States, and whereas in 1997 the United States ratified the Chemical Weapons Convention,
an international treaty calling for an end to chemical warfare and the destruction of all chemical weapons stockpiles, And, whereas, state environmental permits authorizing construction of the Pine Bluff Chemical Agent Disposal Facility were issued in January of 1999, and the actual destruction of the chemical weapons at Pine Bluff Arsenal began on March 29, 2005. And, whereas, over the next five years, the Pine Bluff chemical agent disposal facility destroyed more than 110,000 rockets filled with GB or VX nerve agent, more than 9,000 landmines filled with VX nerve agent, more than 3,700 tons of containers filled with mustard blistering agent.
and whereas the storage handling and destruction of the chemical weapons stockpile the pine bluff arsenal was completed on the evening of november 12 2010 and whereas during the course of its construction and operations the pine bluff chemical agent disposal facility won numerous safety awards compiling more than 14 million work hours without a lost workday accident and developed model environmental management procedures adopted by other chemical weapon demilitarization facilities and whereas while the pine bluff chemical agent disposal facility was the last high-volume multi-munition demilitarization facility in the nation to begin construction and operation.
It was the first to finish elimination of all of its stockpile, well ahead of the treaty deadline in saving hundreds of millions of tax dollars. And whereas the Pine Bluff arsenals and the Pine Bluff chemical agent disposal facilities management and eventual destruction of the second-largest U.S. stockpile of some of the most deadly chemicals conceived by mankind was successfully completed without any agent-related exposure to workers or the environment and serves as a model for demilitarization efforts worldwide. Now, therefore, be it resolved by the Senate of the 88th General Assembly,
the House of Representatives concurring therein, that the stakeholders engaged since 1999 in the safe elimination of the chemical weapons stockpile at the Pine Bluff Arsenal are praised for successfully collaborating to eliminate the chemical weapons stockpile at the Pine Bluff Arsenal, making the world the local community in the state of arkansas a more humane and safer place to live be it further resolved that upon adoption of this resolution the chief clerk of the senate shall mail a copy of this resolution to each of the following officials responsible for the successful completion of the pine bluff chemical agent disposal facility mission miss teresa marks director of the arkansas

This is House Bill 1207, and I
got the idea to run it after the tragedy in Arizona about a month ago. So, after that shooting, a group from Kansas said they were going to protest a funeral of a nine-year-old girl.
Just give me a second here, okay? But the Arizona legislature got together, and they pushed a bill through it in one day, through the House, the Senate, and the governor, to put a protective barrier around a funeral. 300 foot, and one hour before and one hour after the funeral. So they gave me an idea to look at what Arkansas had on the books for our law. But because I knew we've had several protests for military funerals in our state.

and 30 minutes prior and 30 minutes after a funeral so i drafted a bill very similar to the one arizona after i'd filed it i found that a representative thompson had filed the exact same bill so he's a co-sponsor on this bill because i
I filed mine earlier than he did, and he agreed to co-sponsor his bill. After we filed it, John Edwards brought to my attention a very recent Eighth Circuit Court of Appeals ruling that caused us to amend this bill to make it better, to make it constitutionally sound. We amended it five times, trying to make the bill better and be able to withstand any possible challenge. this bill still allows freedom of speech with a narrow tailoring of limitations that the courts
have acknowledged that local jurisdictions and states have the right to do you can't yell fire in the theater for example you can't bring a protest sign to the well of the house we have a law against that or we have a rule against that so we don't have absolute freedom of speech this bill is content neutral it protects everybody good guys bad guys whites blacks female male it'll make any difference the bill has a protection there for everybody
what it does is create a 30 or 300 foot buffer between the protesters and the front door of the church of the front front of the cemetery talking to a law enforcement people they think that's a good idea it gives them a little bit better ability to control it that funeral i told you about in bb one of the anti-protesters was arrested because he approached the protesters because we only have 150 foot area between them so this backs them up a little bit and
and respect gives them some protection. At the same time, it protects the family who's trying to grieve. So I want you to put yourself in

I'd like to give it to you from the perspective of one who conducts several funerals as a chaplain. There is not only the need to protect the family, but there's also the need to protect the intent of why we are there, and that is to honor those. In 2009, in the city that I represent, one of the city's Benton, we were unfortunate to have protesters show up at a funeral. And needless to say, it was quite a distraction for why we were all gathered at First Assembly of God Church on Highway 5. It made it not only a safety hazard, but it was a distraction to why we were there,
and that was to honor one of those who had paid the ultimate sacrifice and for the families who were there to honor and to remember one who had paid the ultimate sacrifice. And they deserve better. And yet as I stand here and I understand more fully the role that I hold as a member of this house, we have a duty also to protect those who sometimes go against our grain. But I'm reminded of what the Scripture says, and that is that to everything there is a season and a purpose to everything.
When you are at a funeral, while it is difficult for us to grant the rights of those who come and go against the grain, and we must represent that interest as well, a funeral is not the place to disrespect those who have paid the ultimate price. And I would ask, if you would, please, to vote in favor of this bill and honor all those who have given their lives, but also to honor the families who still mourn their losses today. Thank you. This is a bill that will help small water and wastewater and sewer systems collect the payment for their users and gives them the funds to make loan payments that they have to make to the Arkansas Natural Resources Commission that gave them loans to make these water systems available to them.
This bill authorizes a public water system to terminate water service to a water user who is more than 25 days delinquent, wastewater, or sewer service. This payment may be due to the public water system or to another public entity that provides wastewater or sewer service. Notice of the delinquency and intent to terminate service will be sent by the public water system or the public entity. If the water user fails to pay the balance due on the service,
any late fees will be assessed, and the water system may terminate its service. The current statutory remedy that these small entities have, and we can use many of your rural water systems and things like that. In fact, this system is endorsed by the Arkansas Rural Water Association. and the only remedy they have at this time is to file a judgment, file for a judgment.
That's costly and takes a lot of time. This will allow them to take action more quickly and to save money. I would appreciate a very good vote on the bill. I think it's a good bill. I think it helps the Arkansas Natural Resources maintain a good program that helps many, many people out there have water systems.

This would be to give them the authority to do it. We still have to go through the contract process, and of course that contract will come before the Legislative Council and be reviewed as well. So all this does is gives them the authority to engage in that contract with the subdivision of the state to potentially relieve overcrowding in our prisons, and, as we understand it today, to save significant dollars over what we're paying today for prison costs.

What's happened, the sheriff, of course, also serves as a collector, and he's responsible for that office. And he requested that the quorum court separate the two offices so that both are elected positions. When the quorum court voted to do this, then they were advised by the Association of Arnestown Counties that they needed an act of legislation from the legislature to do this because the sheriff is in an elected position. So this is what the bill does. it actually, although the Quorum Court has authorized it, it will not take effect until
January the 1st, 2013, after the 2012 general election. It is a recommendation from the request of the Sheriff's Office and the Quorum Court in Drew County, and it is sort of an efficiency in office measure, plus it holds the collector more accountable to the public.
