Speaker 2

There's going to run one today where we can just get an idea of what each one looks like as they
Representative Clark Hall

talk compared to one another. Is anyone here running a bill that would like to provide Mr. Cowling
or other members with a map? They are. Representative Cowling, we're not going to pass out the amendments until
the sponsor is ready to run it. Is that okay? Is that okay with the sponsors?
Speaker 8
0:32
Can we just look at the map? Can we get the map from them before we look at the map? That
Representative Clark Hall
Unverified
0:41
appears to be what the wishes of the committee is. Is there any objections? Without Without objections, we will allow that. All right.
I don't have a clue. This is not ours. I don't know. How many are they? Mr. Chair, I don't know if it's possible.
Representative Ann V. Clemmer

today but if we don't conclude this today would there be any way the staff could get us a map of the existing district I would think so yes ma'am
Speaker 26
2:03
that would be helpful that's there seems to be the will of the committee so we can have. Please. Or send someone after it. We'll put it somewhere.
Representative Clark Hall

2:19
We are going to make that current map available now, Reverend Clemmer. They're going to go They'll get the one map. We have one large map we can bring up and hang up for everyone to look at. We do
Speaker 33
2:35
not have individual smaller ones. Thank you.
Representative Ann V. Clemmer
Unverified
2:39
Okay. That'll be some help. But if we don't finish today, could we get smaller ones? If we discuss maps in the future, could we get something approaching this size?
Representative Clark Hall
Unverified
2:50
If we don't get finished in this hour, we're going to adjourn and come back after we get through
Representative Larry Cowling

in the session. Okay. Thank you, Mr. Chair. Mr. Speaker and all, I would like to request, I don't know whether we was on the agenda a while ago or not and all, but to accommodate my good friend, Ms. Lee and all, I'd like to bring her bill up to consideration and start off with this more than this. So House Bill 1885.
Representative Clark Hall
Unverified
3:24
Representative Cowling, that would be up to the sponsor when they
want to run their bill. You can certainly ask, Representative Lee, but that is up to her for her decision, not the committee. So be. This is not a constitutional amendment issue. This is a normal
process of running a bill.
Representative Lee. Representative Cowling made a request. Do you want to run yours first? If you take the end of this table and you will be permitted to present your bill? bill. I remind the members
of this gift here in this room, do not approach the committee room table nor talk to committee people while they're in their seat. Representative Bernard.
Representative Tracy Pennartz

4:32
Thank you, Mr. Chair. I just want to make sure that I have the maps. I have three maps, one of them Representative Lee's map, Representative Hall's map, and Representative Baird's map. Now, am I in possession of three of three, or is there any other map that I don't have? I'm
Representative Clark Hall
Unverified
4:50
not aware of any maps other than...
Representative Tracy Pennartz
Unverified
4:53
Okay. So we should have three maps, and those are
Representative Clark Hall
Unverified
4:56
the three maps we have. I'm understanding there are three maps available for today's meeting.
Thank you, Mr. Chair. Representative Lee, you're ready to
Speaker 51
5:11
present your bill. Thank you, Mr. Chairman. I'm a, my map is labeled C to
Speaker 53
5:16
make sure everyone's got their, I think that's a C. L for Lee. Okay, that's an L. I'll go with that. That's an L. As we know, the target number for Congressional Redistricting was 728,980.
My map is in a zero deviation All four of the areas The major changes It split two counties And moved four And the map you can look at speaks for itself I'll take any questions Do we need to adopt
Representative Clark Hall
Unverified
6:03
your amendment You had this bill already in the House, right?
You had an amendment zone? Yes, sir. It ran on a member
Speaker 52
6:17
zone this morning. It's in gross. Thank you,
Representative Ann V. Clemmer
Unverified
6:21
sir. Any questions from the committee? Representative Clemmer? Representative Lee, because we don't have the existing map, and my memory fails me, would you tell us the counties that are moved? Yes, ma'am. Franklin Logan and John wait slow down so Franklin moves from the third to the fourth correct okay Logan from the
Speaker 65
6:44
third to the fourth okay yell from the second
Speaker 53
6:48
to the fourth half of Johnson from the third to the fourth okay and Boone
Speaker 65
6:58
from the third to the first and I if anyone can correct me on that I'd
Speaker 69
7:07
take corrections I want to make sure Arkansas did you mention Arkansas please excuse me but
Speaker 53
7:23
but representative Hopper can you correct me on that what else have I
Speaker 72
7:27
missed oh Marion let's see was in the Marion third
Speaker 70
7:33
and it would be going to the first correct thank you represent robot
Speaker 74
7:39
did you have a question yes sir mr. chair representative Lee
Representative Johnnie J. Roebuck
Unverified
7:44
you talked about your deviation being zero you're talking about your percent of deviation is zero correct on all four yes ma'am and what's your total deviation I you know
Speaker 53
7:59
what I did not write that down I'm
sorry I wrote down actual numbers and just the deviation for the four districts I do not have my
Representative Johnnie J. Roebuck
Unverified
8:08
total deviation I'm sorry okay and one more question if I may mr. chair what's what's the population now in one two three four on your map do you have your
Speaker 53
8:19
population numbers I you know what I bet they're in my bill I'm sorry I just brought my map down thank you what I wrote down are the actual numbers for the deviation so the first district has
nine more second district is 213 more third district has 201 less and the fourth district is 22 less so one in two
Representative Johnnie J. Roebuck
Unverified
8:47
plus in the three and four matters okay thank you thank you mr.
Representative Clark Hall
Unverified
8:54
chair represent recently question when you started off what is your target number you said 720
Speaker 53
9:02
8,980 that was my understanding of the
starting number target number okay thank you seven two eight nine eight zero also the of course being a border county as Pope County is was still is I spoke with my city council my quorum court and my chamber and they gave me four guidelines that were important to them and so that was something that I addressed as well and that was that Pope County would stay intact that Pope County would stay in
the third and that if possible it would say with Yale County if it did have to be moved and it wouldn't be gerrymandered over to the first rest of Cali well I see
Representative Larry Cowling
Unverified
9:55
it Polk County survived in all three of them in because they stay in this in the third and all three of them so everybody was
Speaker 57
10:04
working Well, that's who I represent, sir.
Speaker 53
10:12
I'm sure Representative Burris might have other opinions of this map. Any questions? Representative Hopper. Thank
Speaker 90
10:26
regard to the counties that were split. Are you simply looking for numbers? Are there natural boundaries involved, or can you give us some insight on that? They're not natural boundaries. It was going for numbers.
Representative Clark Hall
Unverified
10:42
Thank you. Thank you, Mr. Chair. Any other questions? We might,
when Mr. Wilson comes back, he may have. Would Mr. Wilson have your numbers, your population numbers, or do you have them? He probably
Speaker 55
10:57
does. No, it's not in this that was handed to me. Is it not in your bill? No, it's not in what was handed to me. Mr. Wilson can have it. I can get that for you. Representative Klammer. I
Representative Ann V. Clemmer
Unverified
11:09
was going to see, Mr. Chairman, if she would repeat the deviation for the 2nd District.
I got all the numbers down, but I missed the 2nd District. Plus 213. And
you're talking about on these numbers? We're talking about 213 people. Dude, that is so close. Yes,
Speaker 94
11:25
that's what I'm saying. No, I meant the
Speaker 96
11:27
camera, not you. Well, I was about to say, dude, that's so close. These numbers, the numbers you came up with were very
Speaker 87
11:39
close. Yes, ma'am, that is what I aimed for.
Speaker 55
11:44
I thought you were feeding me my wine. No. I gotta get up This guy's killing me guys
Representative Ann V. Clemmer

12:03
my presentation Thank you very much This deviation was nine more people For the first The fourth The second had 22 less 213 more in the fourth
and 201 less in the third.
Speaker 110
12:24
right. Yeah, I like yours too. You don't split
Speaker 114
12:38
any counties? We're sharing. Thanks for having me.
Representative Clark Hall

13:14
Mr. Wilson is going to hang up the current maps as they exist today. This
is the existing current, the 2,000 census.
Representative Clark Hall

14:27
We need questions if you want to go back to the end. Have we got the numbers that they asked for? Have you got the numbers? Thank you.
Okay, well, Representative Roebuck, she does not have the definitive numbers. Is that over? Is there any other questions, Representative Lee? Would you
go back to the end of the table then
Speaker 88
15:49
and let's finish this up? okay representative lee please excuse me representative roebuck
Speaker 53
15:54
um if you uh do the
math then you will get the actual numbers of the congressional districts so yes i did have it i'm i'm not i'm not up on
Representative Tracy Pennartz
Unverified
16:20
math very well thank you Representative Leigh, I don't pretend to be
any expert on this stuff, but I was trying
remember the slide presentation they made to us on this about natural variables, and I believe your map, do you think that your map addresses natural variables? MS.
When you're describing variables. Well, like, is there any particular distinctive geographical feature, like a road, like highway
and highway or a river? Because I noticed, I noticed, I believe I have the right map. You split a county and then you split another county. Correct. And so could you address for me that issue, please? I could,
Speaker 51
17:19
if a variable is what you're calling a river, a road, something like that. You know, I can't remember the, it's been two months ago
Representative Tracy Pennartz
Unverified
17:27
now, and I can't remember the exact terms they used. You know what I'm talking about. I remember the description.
Speaker 53
17:37
wanted to go for the lowest variable. I wanted to follow what the people in my county asked for, being a border county, and I wanted to go with the lowest deviation, not variable, pardon me. And so in the breakup of that, that's what I looked at. I did
Representative Tracy Pennartz
Unverified
18:00
not look at what you're describing, which are rivers, a natural road, things like that. Okay. Okay. So is your map, would you characterize your map as basically trying to split the population
terms of four separate geographic areas, then. You're saying that your driving criterion was population only, so that you had four districts equal in population. That was not my driving. That is what I wanted to
Speaker 53
18:36
achieve. My driving was to do what the people in Polk County asked me to do
Representative Tracy Pennartz
Unverified
18:47
That was my driving motivation. Well, you know, when – and I understand that. I understand you're trying to do what your county wanted you to do, and I – you know. But this is not a county issue. I agree. There are issues that rise above our own self-interest of where we come from. Absolutely. And this is one of them.
And what's driving me on this is a concern on any of these maps. I don't care which map it is. Whether that is what's most productive for the state. And I assume, since this is the map that you put forward, please correct me if I'm wrong, that it's beyond just what Pope County wanted. This is the map that you feel that meets the state's best interest.
Speaker 55
19:52
Absolutely. But you asked me a very specific question, and I gave you a specific answer, what drove me. I didn't have to file
Speaker 53
20:01
any shell bill. I did. I did because Pope County is a bordering county, and that is what motivated me to be one of the people that brings forth a map. However, it was very important to me to keep like areas together, and I think this map achieves that. And it was important to me to keep the deviation as close to nothing as possible, and I think I achieved that.
Representative Tracy Pennartz
Unverified
20:27
i appreciate your responses representative dude lee dude lee that's what i'll go at thank you mr chair rep garner thank you mr chairman
Representative Ed Garner
Unverified
20:45
uh miss lee i i get the over the overall impression and and i don't want it to sound like i don't care about pope county but i didn't realize that was the driving force behind this. My impression, and I'm getting the right, I'm asking you, am I getting the right impression
of this, is that you're trying to maintain as much as possible counties without being split, and it looks to me like you change four counties, and correct me if I'm wrong, it's Boone, Marion, Franklin, and Yale. Yes, sir. Are those the counties that, in their entirety, within their entire borders, you're not splitting those counties, and you're splitting only two counties, and that is Arkansas and Johnson?
And the boundaries, it would seem to me, to be as contiguous as possible to the district you're moving them next to.
Speaker 55
21:46
That's exactly right, and that was my attempt. Okay. So, essentially,
Speaker 134
21:52
the greatest difficulty would be, in terms of
Representative Ed Garner
Unverified
21:58
the voters knowing where they are and who they would be, those two split counties, you've reduced your map to splitting two counties, and the other voters would simply be informed, there's four counties here, you are now part of a different district.
Speaker 53
22:19
Yes, sir. Splitting counties is never a great idea. I agree with that. But the deviation was what I
Representative Mary L. Slinkard
Unverified
22:32
you very much. Representative Lanker. Thank you, Mr. Chair. Representative Lee, it looks like the south part of Pope County, on your map, there's a little piece there. I can't tell if that's a county boundary or a certain boundary. that goes into the 4th district.
Would you just clarify that? Is that a voting precinct or? That's
Speaker 52
23:00
part of Yale County. Oh, thank you very much.
Representative Ann V. Clemmer
Unverified
23:10
Any other questions from the committee? Representative Klammer. Because I'm sitting next to my esteemed colleague, Representative Rogers, who has concerns about Arkansas County being split. Do you remember when you split that county what it would have done to the numbers
if you had left all of Arkansas County in the
first? No. I could not tell you that. Just curious. Thank
Speaker 69
23:41
you. Do you know if it divides Stuttgart? No, I don't think it does. Representative Rogers? I mean, no, it does not.
Speaker 141
23:52
Okay, thank you. Questions from the committee? Representative Hutchison.
Representative Donna Hutchinson
Unverified
23:59
Attorney Mike County, there you are. Just pointing out that Pope County apparently didn't have much to worry about. All of these maps kept Pope County in the third, and they must have instructed the others and not just
Speaker 53
24:17
yourself. We're pretty brave people. We have no problem expressing
Representative Donna Hutchinson
Unverified
24:20
our opinions. I'm impressed at how you've worked the deviation, and it will be interesting to see if
the others can match splitting two and moving four and having the least change.
I think that's what we need to move toward is the least amount of change as we
Representative Clark Hall
Unverified
24:46
draw these congressional maps. Thank you. Anyone, any committee member,
any more questions? If not, is anyone in the audience like to speak against this proposal or on this proposal?
Representative Walker, would you like to speak on it? If you may,
Representative John W. Walker
Unverified
25:07
you can go down to the end of the table, sir. I wanted to ask,
Representative Clark Hall
Unverified
25:13
as a visiting member of the legislature to the committee, a question. Sir, Rep. Walker, I appreciate your position, but you are not a member of this committee. And this committee will certainly accommodate you if you go to the end of the table and state whatever you'd like to. That's fine. But this committee is the voting committee, and we're going to handle it like that.
Any person is willing to go to the end of this table and speak for or against any proposal. But in this case, you
can go down there and ask the questions, and maybe Representative Lee, when she
Representative John W. Walker
Unverified
25:48
closes, will answer them. Well, that's all right. I didn't know that the committee structure
Representative Clark Hall
Unverified
25:53
worked that way, but thank you. Anyone in the committee in the room would like to speak for or against? What's the pleasure of the committee? Representative Garner.
Move, do pass. We have a motion, do pass. Representative Lee, would you like to close for
Speaker 88
26:13
your... Could I ask a question? I thought we were going to see them all before we voted. That's not how this works. This is a bill. You're running your bill. I'm sorry, sir. I thought the committee voted for that earlier. This is a bill. You can run your bill or not run your bill.
Speaker 136
26:38
Do you want to close for your bill? I'm closed, sir. Thank you. Do I have a
Speaker 84
26:48
question or have our area made by motion? You
Representative Ed Garner
Unverified
26:52
made your motion, but what is it? I recall the committee saying that we would like to see
all the maps. The maps are out there on the table. The maps are out there, and so if I'm at the point where I think this, hers is absolutely the best one, then it's time for me to make a motion. That's
Speaker 154
27:07
what I would do, and you made a motion.
I think it's the best one. I move

You may go to the end of the table. Barrett, I'm sorry. Duncan Barrett, I'm sorry. Well, they call me Representative Clark all the time. You have an amendment we're going to Pass out as you go down.
Speaker 52
29:57
Representative Barrett, are you ready to present your proposal? I
Representative Duncan Baird
Unverified
30:11
am. You have the mic. Thank you, Mr. Chairman. This is House Bill 1890,
and it's a second proposal. It would move six counties and split two counties. would move Cleburne from the first to the second, and Van Buren from the second to the
first. It would move Franklin, Johnson, and Marion, or actually Franklin and Johnson from the third to the fourth, Marion from the third to the first, and Yale from the second to the fourth. And it would split Boone between the third and the first, and split Perry between the fourth, and the second, and the deviation.
Representative Clark Hall
Unverified
30:54
Representative Barrett, is this on your amendment that you have?
Are we adopting your amendment? Are you explaining your amendment, or are
you just wanting us to adopt your amendment? Those are the details of the amendment, not food for adoption. I need a motion to adopt the amendment, Representative
Representative Tracy Pennartz
Unverified
31:17
Bernard. I reckon. I'm sorry. You have a question, Representative
Representative Clark Hall
Unverified
31:20
Bernard? No, I was going to give him the motion. Okay. We have a motion from the sponsor to adopt the amendment.
All in favor say aye. Aye. Any opposed? Now you can speak on the contents of your proposal.
Representative Duncan Baird
Unverified
31:31
Okay. Well, that is the amendment that we just added. It was a shale bill,
and so we actually added the meat of the proposal. The deviation among these districts, the largest deviation would be in the first and the third. The first would be under the target by 359 people, which is, by my calculation, about 0.05 of a percent. And the third would be 318 people above the target.
The second would be 43 below, and the fourth would be 84 above. And so it's a very small deviation from the target that we're seeking. And with
that, I'd be happy to take any questions. Is there any questions for the
Representative Clark Hall
Unverified
32:24
committee? They're all kind of digesting this a minute.
Representative Ann V. Clemmer
Unverified
32:29
Let's give them a second. Representative Klemmer. I'll start. Perry is
split and Boone is split, but very small portions, are those, do you know if
those represent population areas? I mean, obviously represent high population areas. Do you know? I don't know. I
Representative Duncan Baird
Unverified
32:52
don't know. You just pulled out a couple
Representative Ann V. Clemmer
Unverified
32:59
of precincts? Yeah, basically just took small parts of those
counties. So those counties remain 90% intact with about, I'm looking
Representative Clark Hall
Unverified
33:12
at just geography. Thank you. Representative Beard, you're taking Yale County and most of Perry out, and
you've switched Van Buren with Cleburne.
Representative Duncan Baird
Unverified
33:23
Is that correct? That's correct, and I believe those were switched so that when we took – when we split the other two counties, it was a smaller split. But, you know, Van Buren and Cleburne have different populations, and so when you change those, I think it
helped us where we were splitting on the other two counties. Okay.
Representative Tracy Pennartz
Unverified
33:48
Representative Penari. Thank you, Mr. Chair. I was trying to look at the map on the column up here, my compariors.
was Perry was it in the second and now it's in the fourth or can you help me out on there did you split Perry or what's going on there
Representative Duncan Baird
Unverified
34:12
and now only a portion of Perry would be in the in the second and so originally the the full county was in the second oh okay
Representative Tracy Pennartz
Unverified
34:23
so it used to be the whole county. Correct. Does Conway County, these maps are sort of hard to read, but what's that
little piece there that looks like Oklahoma to the left? Is that in Perry County? Yes, that's
Representative Duncan Baird
Unverified
34:38
the part of Perry County that would be in the second. And so, yeah. What's in that? Is there a big city
Representative Tracy Pennartz
Unverified
34:44
in that? I don't know. What about the other
little piece that to the right, what's in that area? Because you've dipped down to take those, apparently. I'm not sure. I'm not sure what's in there. You don't know what city is in there, in that little bitty area there? Okay.
Okay. Well, thank you. Was there any driving criterion that you
used in the formation of your map? To me, this is along the lines
Representative Duncan Baird
Unverified
35:17
of the progression over the
years. You know, I think as, you know, the first has taken in Baxter, and this map would have it taken Marion and Boone, which I think is a natural progression, and the fourth has been moving north, and I think that's also maybe the natural
progression there. So, you know, to me, you know, Arkansas County wanted to keep that complete, not split that. And so really, I just wanted to make as few changes as possible, split as few counties as possible, and this is what we came up with. Thank you, Representative. I
Representative Tracy Pennartz
Unverified
35:56
appreciate it. Thank you, Mr. Chair. Representative Roebuck. Thank you,
Representative Johnnie J. Roebuck
Unverified
36:03
Mr. Chair. Mr. Barrett, forgive me if you've already told us, but did you tell us your total deviations?
Representative Duncan Baird
Unverified
36:11
Yes, the target is 728,980. It's the same, obviously, for all of them. The highest population would be in the third district, 729,297. So it would be 318 over the target. The lowest population would be 728,621 in the first, which would be 359 below the target. And just by my calculation, it's about five one-hundredths of a percent.
So, you know, if you just divide it out, it's .0005. So it's a very small deviation, and that's, you know, that's why we're splitting counties is to
Representative Johnnie J. Roebuck
Unverified
37:00
get that deviation extremely small. And
Representative Duncan Baird
Unverified
37:02
for the fourth and the second, what was your deviation? For the fourth, $729,063, and for the second, $728,937. Okay. Thank you.
Speaker 91
37:12
Thank you, Mr. Chair. Representative Klammer.
Representative Ann V. Clemmer
Unverified
37:20
Representative Barrett, as I look at the map on the wall and go from memory, If you start at the Mississippi River, DeShea County, the boundary there between the 1st
and the 4th remains the same until you get over to Perry County. Is that correct? It sort of looks like it. Saline County is still in the 2nd. So that border, to me, you may be at a disadvantage because you can't see the map on the wall. But it looks like to me, until you reach the western tip of Saline County,
that whole dividing line stays the same. So I guess I applaud your ability to make these changes. But if that was correct, I'm asking you, but I guess you may get a disadvantage there. But a good bit of that remains exactly the same. From what I can
Representative Duncan Baird
Unverified
38:09
tell, it does remain the same. That's
Speaker 52
38:18
a big thing. Are you through, Representative Klemmer? Yes, sir. I'm sorry. Thank
Representative Clark Hall
Unverified
38:22
you, Mr. Chair. Are there any other questions from the committee?
Does anyone in the audience like to speak against this proposal? For this proposal, are you closed for your proposal, Representative? I'm
closed. Thank you. What's the will of the committee? Representative Klemmer? Move, do
pass. We have a do-passed motion as amended.
As amended. As amended on House Bill 1890. All in favor say aye. All opposed? No.

of the committee, I'm sorry, we're getting ready to go back
into session, and we're not going to have time to listen to the other
proposal. We will take it up, we're going to recess and take it up on adjournment when we get through in the assembly. We'll be back here as soon as the speaker lets us go.
