Two years ago the treasurer's office did not give raise to key personnel. This year they did. This has been through much back-and-forth. It creates two new positions to help Ed Garner on investments and then also gives six

And at the time, the federal government was debating repealing the Affordable Care Act. And so you were asked what happens if that were to occur, if Congress takes any action. And you responded that you would talk to the governor's office, that they had concerns about the funding going down the road, but they were going to be applying for some waivers and we might have a fiscal session or a special session to deal with that. And you said that you know we have obligations, but we've got to do something because we cannot sustain this budget without raising taxes but that's a fight for another day
but the governor's office is well aware of that so now that we're two years removed we've gotten the waiver and lost the waiver at least for now it's is that day here the fight for another day or is it sometime still in the future and do you still stand by your position that we can't afford the Medicaid budget as

we were told that you know we would have tremendous savings. That will save us definitely $20 million that we're going to have to add on top of this. And by the way, if our increase was $61 million for this year's budget, with the waiver gone,
and if it stays gone, it'll be $81 million. So that'll be an increase. But saying that, we still have our traditional Medicaid people in here. That has to be funded. Yeah, I think it might be helpful information for people particularly that haven't been here from the beginning when we did the private option, to understand that even though we owe now, we've actually made money on the Arkansas Works program because a lot of those groups that we were getting a 70-30 FMAP on, we actually moved to 100% reimbursement from the federal government.
I believe, if I remember John Burris' pie graph at the time, that by 2021, we actually would have made $640 million by participating in the private option. So we're owing money now, but we have been getting money on the front end to pay for this. And when we started the private option, you might remind me, I think Medicaid was headed for a $70 million deficit that
was made up by private option. And pulling a lot of these people into the private option, Representative, helped then

Thank you, Mr. Speaker. Colleagues, I didn't want to come down to the well today, But I felt like I had to, and I told Speaker Shepard and Chairman Gene in advance that I would if this bill was run today. And so that's what I'm doing. My issue really is that we're being asked to vote on a more than $8 billion Medicaid budget, less than 48 hours after a court decision that has a pretty significant effect on the Medicaid budget.
And I cannot support that. Last night, as I was kind of stewing about the fact that this bill was going to be run today with such short notice, I decided to go back and look at what was said when we ran the same appropriation a year and two years ago, just to see what we were told, because this is my fifth session, and those of you that have been around, they all sort of blur together and you just kind of forget all the specifics. So I wanted to go back and hear what was said about this a year ago and two years ago.
And also I know that almost a fourth of you weren't here a year and two years ago. And so for one thing, like I mentioned in my question to Chairman Gene, I went back and watched him present the bill two years ago, and he said in there that we can't sustain this budget as is if we don't do something. In addition, I went back and looked at what the governor had said, and I went through a lot of his press releases. And I want to talk about a few things he said last year when we ran this budget in the fiscal session.
The first one is from February in his State of the State address, before the fiscal session started last year. He said, and I quote, as for the future, I expect approval from Washington before the legislative session ends on our request to implement a work requirement for the Arkansas Works program. If you are able-bodied and of working age with no dependents, you should be working or in training. The only long-lasting solution to lowering the cost of Medicaid is to help more people earn their way off. The only long-lasting solution to lowering the cost of Medicaid
is to help more people earn their way off. My question is, if this is no longer a solution because we no longer have the work requirement, are there other solutions that we can consider before we vote for this appropriation? Because I know there's at least one representative who has a bill to help lower the cost of Medicaid, specifically for the expansion population that we're really all talking about here. Could we not discuss some of that before we vote on this bill? The next statement was on March 6th, a few weeks later.
It was a press release that said, Governor Hutchinson issues statement in response to the passage of Senate Bill 30, the Division of Medical Services Appropriation, same appropriation as we have here today. This was last year. Quote, I'm very grateful for the senators that were able to support Arkansas Works and the DHS appropriation. Obviously, the work requirement was a significant factor in showing the reform that we're accomplishing, and I appreciate the Senate's leadership in passing this on the first vote. Obviously, the work requirement was a significant factor.
A few days later, and this will be the last one, a press release titled Turning Point for Healthcare in Arkansas. The governor said, the work requirement is not intended as a punishment, but as a way for Arkansas to actively engage, for Arkansans to actively engage in their community and to enjoy the dignity that comes with earning a paycheck and providing for a family. The fact is, we would not have been able to sustain Medicaid without the type of reform included in the waiver. We needed the flexibility to best address the needs of Arkansas, and that is what this waiver allows.
The fact is we would not have been able to sustain Medicaid without the type of reform included in the waiver, which as of today, as we are voting on this bill, we do not have. So my question is, is that statement true? If it's true that we can't sustain Medicaid without this waiver, then aren't we being asked today to vote for an appropriation for an unsustainable Medicaid program? It seems to follow up to me. So really, I'm going to end with a lot of questions that I came up last night as I watched what I was told over the last two years about this same appropriation.
My first question was, why was this appropriation passed out of budget during a recess from our session on Tuesday? I talked to several members who didn't even realize that had happened, but this bill was passed out of joint budget on Tuesday afternoon. why was it then passed out of the senate with a minimum of 27 votes just minutes before the district court's decision was released on wednesday according to the legislature's website that bill passed out at 3 36 p.m and our ap reporter andrew de millo tweeted at 403 p.m
that the work requirement was struck down so less than 30 minutes before we get the decision the Senate passed the bill. Why was this appropriation then put before the House for a final vote less than 48 hours after the court's decision? I got texts about this about four o'clock, two days ago. It's less than 48 hours, and now we're being asked to make an $8 billion decision. Why is this appropriation not being amended at all now that the work requirement piece is out of it?
This appropriation was filed when the work requirement was in effect, and it has not been amended since. Does the work requirement not affect the Medicaid budget? Either the work requirement has no effect, which Chairman Jean said it has about a $20 million effect by his calculation, or the appropriation bill is intentionally inflated for DHS. And I listened to the Senate debate, and Senator Teague, the Senate budget chairman, said that there's plenty of appropriation either way.
And Chairman Jean said a similar thing today. So then, that begs the question to me, what is the point of this appropriation at all if DHS can just do whatever they want anyway? Why do we even bother with the appropriation if DHS and the executive branch can just do whatever they want anyway? Does the governor still hold his prior positions that the work requirement is the only long-lasting solution for lowering the cost of Medicaid, that it was a significant factor in passing this appropriation last year, and that the Medicaid program is unsustainable without
it? And lastly, since we currently don't know if this case will be appealed, because just to clarify, the federal government is the defendant in this case, not the state of Arkansas. So this is not Attorney General Leslie Rutledge's decision to appeal this case or not. That is a federal government decision, which as we're being asked to vote on this bill today, we have no indication that it for sure will be appealed. What if the case isn't appealed?
Can we at least wait to pass this appropriation until after we know that it will be appealed? If it is appealed, how long is that going to take to resolve? Could it take years? Is it going to go to the Supreme Court? What happens to Medicaid between now and then? I think the House deserves to have our questions answered, to be given adequate time to consider the ramifications of the Court's decision and the path forward, and to be included as a co-equal in these decisions rather than being run over with an $8 billion decision in less than 48 hours.

of our Constitution when the Founders got together over a big problem and they argued and they debated. Different people brought ideas to the table. They got mad at each other. There is a mechanism to do that called the committee of the whole, and I've spoken to the speaker about that. We don't have to do that today, but we can have a committee of the whole where we come up with an agenda, we come back prepared, and we sit here
in front of the cameras, in front of the people, and have an open discussion about what the opportunities are, what the risks are, and where we go from here. And my recommendation, and would ask that you today vote no, that we talk about what a committee of the whole would look like and come back at a later date and pass this. I'm not saying we don't want to pass it. I think we need to pass this at some point, but we don't have to do it today. And that we come back and talk about what we as a body can do together. You know, the other day in the Senate again, the comment was
made that we shouldn't use the appropriation process to set policy. Well, folks, that's the only power you have. It's the only power you have is to get 26 or 27 of us together of a like mind and talk about what the appropriation looks like. We learned that the other day when one of our colleagues wanted to pass a bill or run a bill to help some of the poorest people in the state. And we decided as a group that we would vote no and come back and see if there were solutions.
And that's all I would ask of you today is we vote no today. We figure out how we can come back as a body and have a debate. Thank you.

and colleagues. Today is the last step in getting much-needed legislation to the governor to sign into law. For those of you who are not in the Insurance and Commerce Committee meeting this week. I'm sorry you failed to hear the
testimony they did. This bill will lead to insurance coverage being provided for those who suffer from PANS and PANDAS. We're talking about an autoimmune issue that attacks and causes inflammation of the brain. It stems from streptococcal infection and other viral infections that you believe have been resolved after you take your medicine or part of your medicine. They have not. They come back with a vengeance.
I want to tell you about a young man that during my 20, 25 years of working with youth, I had the opportunity to work with. His name is Cameron Puckett. Cameron was an outstanding young man. Everybody that knew Cameron loved Cameron. Cameron was an outstanding student, an outstanding athlete. He made great grades. Teachers loved him.
He was involved in all sorts of things just like any great student would be. Cameron's life was on track to go to college and be something special. One day, things started turning down for Cameron. Cameron started pulling back from school, athletics, classrooms, and then he started pulling away from family.
Nobody could explain what was going on with Cameron. He was misdiagnosed over and over and over, all sorts of neurological diseases. He'd be treated for everything from depression to schizophrenia. He had a family that was watching a downward spiral that would not stop. as many of you can appreciate a mother who would fight with everything she had for her child
she said this isn't right there's something else happening with my child she kept researching and she found something called pans and pandas she found a doctor out of state they went for the first time cameron was properly diagnosed cameron got an iv ig treatment and the old cameron was back after spiraling down
for four to five years at 21 years old the old cameron was back cameron went to the university of central arkansas and was getting to enjoy life of a college student making excellent grades got involved with campus life was leading a bible study the old Cameron was back and as is the case with this disease
sometimes it comes back this time when the disease came back there was no doctor who was willing to recommend the treatment because it wasn't covered by insurance so Cameron began to spiral again and all his family could do was sit there and watch a guy that had come back was now going back
down like he did before today we're fortunate to have two sets of parents with us Kathy and Jason Puckett which are Cameron's parents and I want you to stand and they also brought extended family with them. The whole family, please stand. And then, Becky and Bradley Wallace, Max's parents. I'm also going to refer to another gentleman down here, Matt Brumley, if you would go ahead and stand.
These are incredible people who have fought to get us to this point today. because of them there is hope. Max is no longer with us. He took his life because he thought there was no hope for him. Today we can bring we can't bring Max back but we can honor his memory by passing this piece of legislation so that no other child including Cameron can have their

you, Mr. Speaker. Members, I'm going to ask you to look basically at the last two lines of this bill because this summarizes what this is. Maybe three lines. Four lines. Maybe I need to get my glasses working here. A public school student who participates in an extracurricular activity, interscholastic activity, or organized physical activity shall not be required to pay for individual or group instruction in order to participate in the extracurricular activity, interscholastic activity, or organized physical activity.
I have been made aware that in some school districts we are seeing that a coach of a team, whether that's a ball team or a dance or cheer or track or whatever it is, that they're requiring students who want to participate mandating that they take private or group lessons from a specific center or person or something like that as a requirement to
participate in that public school activity. If you have kids in public school, you probably know that public school is becoming pretty expensive for families. I feel like every day I'm being asked to send a little bit more money for this and a little bit more money for that. In this situation, I'm being asked, if you are a parent in this situation, to pay someone outside of school privately for that instruction
at maybe $60 a month in order for your child to participate in that activity. We asked the Attorney General to give us some information, and I'm going to read to you a little bit of this. It says, the imposition of school activity fees is bounded by the principle that the state shall ever maintain a general, suitable, and efficient system of free public schools. School districts, therefore, are generally prohibited from charging fees that might compromise students' equal access to the system of free public schools. The Arkansas Supreme Court
has held in this regard that registration or tuition fees for attending public school are unlawful. I believe it reasonably follows that the court's pronouncement regarding registration or tuition fees that the right to a free public education includes the right to goods or services that are not necessary or integral parts of the required system of free public schools. It goes on to explain some other information as well. I want to make it clear that this bill does not say that the school has to pay for someone's athletic shoes
or the school has to pay for art supplies or the school has to pay for dance costumes. That's not at all in this bill. All that it addresses is that the parent, the student, would not be required to pay for individual or group instruction. It is public education and we want to keep it that way. So what I'm thinking though as I read this, and I'm thinking about basketball camps and all these different things, and I'm wondering why maybe when we see these problems, is the answer always in the code or is it maybe with local control? Because I know we remedied it, you know, and a lot of schools do, saying if you can't, we'll do this fundraiser, but I'm worried this is going to get a lot of activities.

There's nothing in this that says that you can't participate in those activities. But what it's saying is that as a requirement to be a part of that activity, you can't say that they have to. So if you have a student who comes from a family that can't afford that basketball camp, and it's mandated that they have to attend that basketball camp, they won't be
able to go and so all this bill is doing is saying that the school can organize that basketball camp can encourage that basketball camp but if they can't pay for it that student should still be allowed to participate in basketball during the year or the school perhaps might say we'll pay for it or we'll do fundraising I know a lot of the organizations they have you know separate little booster clubs and might be able to pay for it. So that's what I'm trying to address. It does not
say that you can't encourage that activity. I'll give you an example. My daughter is in seventh grade and wants to do track and wants to do pole vaulting, okay? The track coach at our school is not an expert at pole vaulting, okay? There is a coach that we're aware of that is excellent at teaching that and so we want and and so our local coach is saying if you want to get better i might suggest you look into that but he's not mandating it he's not telling me we have to

highly advanced and trained in some of these areas and when you mentioned that maybe the schools can raise money um like force force hikes elementary here they do have a booster where they can raise like a hundred some thousand dollars to the shortfall so that the students can attend camps but I represent a district that has a lot of different schools and some of those parents don't have the means to even know how to fundraise because there's a lot of poverty so I guess I'm concerned on camps if you're a cheerleader or a dance team you're saying the schools can pay for it but if
the schools already can't pay for educators I'm thinking of the additional financial burden that might be put on them to host some of these extracurricular trainings and activities where the kids come in during the summer and they have the camp. So who's going to pay for that? What's your vision of what that looks like?
My vision is to make this to where everybody can afford it so it doesn't cost the parents, it doesn't cost the families. I think somehow we've gotten it kind of confused.

You might have to rephrase the question for me. Okay, I'm just saying, so a student makes a team, and that summer they're going to, the team goes to some camps or they require some kind of special stuff like this, and this student doesn't do this. Even though they never said you have to, but then when tryouts come around again, the coach cuts the student from the team.
It could be for that reason, but how will we ever know it's that reason?
Well, the way I look at it is if the student couldn't afford for the parent to pay for it, they wouldn't be able to participate at all anyway. So I think this, again, opens up more opportunities for more people to participate. Obviously, if you can afford to put your child into private pay classes, you know, that's just the way it is. But I'm trying to make it to where everybody can participate and we get more participation.

House bill 1892 is to amend the franchise act and to clarify a choice of law clauses in the franchise agreement a couple of points I wanted to make with regards to this bill is the goal of the bill is to
further clarify and strengthen the legislative intent of current law. Under A-1 of the law, the franchisor cannot require a franchisee to waive or release their rights under the Arkansas Franchise Act. While the law already says that someone's rights under the Franchise Act cannot be waived, companies have attempted to avoid application of this law by stating that another state's law applies. If the rights as an Arkansas franchise and small business owner cannot be waived, then companies should not be allowed to
choose the law of another state that makes this act inapplicable. At least ten other states have amended their franchise acts to include similar provisions. The changes identified in this bill are identical to the language in Iowa. This bill protects the rights of Arkansas franchisees and upholds the legislative intent already found in the current version of the law. the bill. Thank You Mr. Speaker. Today I bring to you House Bill 1563. And before I get into the exact details of the bill, I'd like to just kind of
rehash some quick state history. We passed Amendment 100 this November, and it passed to establish four casinos here in Arkansas, one of which being in Pope County. I, being a legislator who represents Pope County, knew that the local people were not happy with that. It failed on the County of Pope 6040, and I know the constituents in my area that I represent were adamantly against it when I was door knocking. Interestingly enough, when I crossed the county line when I was door knocking, the people
in Johnson County were actually very supportive of it. And so when it passed and the letters were sent out, there was some confusion about the leaving county judge and the leaving mayor not being the ones to make a decision. And rightfully so, Representative Cloud passed some great legislation to allow us to make sure that it is the current representatives of the county and the city who are the ones who need to send those letters out. And I'm very proud that he did that. That was good legislation.
So, unfortunately, though, we're put in an odd situation. We're trying to fulfill Amendment 100, which is to create a fourth casino, which is the will of the people of Arkansas. all. And at the same time, we also want to make sure that we're not railroading a county that has shown that they don't want it. So I originally had a bill to move it from Pope County to Johnson County. My city council voted in favor of it. My mayor supported it. My quorum court voted in favor of it. My county judge supported it. And for those who are on the rule committee, you heard his
testimony. Herman Houston, he loves Johnson County, and he's trying to do everything he can to help it, as am I. And as I'm sure a lot of you are known, we had a lot of business leaders there who also showed their support of it, from the hospital CEO to the, to realtors. And so, unfortunately, though, there were some other people who thought, we're picking winners and losers here in the states. We're taking something from one county who, you know, 40% of the people there actually did support it, and we're giving it to another county. So, what we decided was, this is a River
Valley issue, and so it needs to be decided by the people in the River Valley. So we came up with a great compromise bill. What we're doing is we're still only establishing four casinos in Arkansas, but the one in the River Valley gets to be chosen by the people in the River Valley. So Conway County, Pope County, and Johnson County, if this bill passes, we'll be able to submit applications to the Racing Commission and then have the Racing Commission decide which one is the best for the state of Arkansas. This way, the county that wants it can put an application in.
A county that doesn't want it doesn't have to put an application in, and they don't feel that they're getting pressured by the rest of the state to help fill a $20 million gap in GR. Now, some people say we can't do this, but I would say if you crack open your Arkansas Constitution, look at Article 5, Section 1, it says that we can with a two-thirds vote, And that's what I'm asking for today. I'm asking for a two-thirds vote so that we can restore local control to the River Valley, let the community that wants it put an application in,
and the ones who don't want it not put an application in. So that, in essence, is what the bill is. I'm more than happy to stand down here and take

the Health Department reached out to me. They had some concerns about some of the language, and they wanted to make sure there was no confusion between human cloning and animal cloning and that there would be no confusion or conflict between laws governing in vitro fertilization. That is, we just included clarifying, inserted a clarifying word in about three or four places.
I don't have my highlighted copy with me today, so I can tell you exactly where those changes were made, but that is the gist of it. The purpose of the bill has not changed. These procedures are already not allowed by law in Arkansas, and this just prohibits the funding of these types of procedures with Arkansas money in other states or state money in other states. This is an act concerning the investigation into a missing or unidentified persons concerning the National Missing and Unidentified Persons System. For more than 30 years, the family of Francine Ford had no idea what had happened to her. In 1981, Frost, age 44, vanished from the parking lot of a Tulsa, Oklahoma grocery store. Her keys were left hanging in the car door. There were no clues, absolutely nothing.
But in 2014, 33 years later, the family got the miracle they'd been hoping for. Francine Frost's grandson, Corey Curl, entered and searched the National Missing and Unidentified Persons System, NamUs, which was created to maximize the use of DNA technology to the criminal justice system, including in the investigation of missing and unidentified person cases. By entering his missing grandmother's case into the NamUs system, Mr. Curl located the remains of his own grandmother, Francine Frost, who had been missing for 33 years.
And there are many, many cases such as this. NamUs is a missing person database that is available for public search and data input. The goal of this proposed legislation is to help law enforcement agencies and investigators solve cases that have gone cold or involve missing or unidentified persons in the state. NamUs was connected for automatic case comparisons to make associations between missing persons and unidentified persons to solve crime.
In essence, it brings missing persons information and connects them to unidentified remains. The NamUs program is based out of the University of North Texas Health Science Center with continued oversight by the National Institute of Justice and offers criminal justice professionals additional resources to locate information on missing persons, locate family members for DNA sample collections and next-of-kin death notifications. It brings cold cases
and missing person cases together for comparison to solve recent crime cases or decades-old crimes. The goal of this proposed legislation is to help law enforcement agencies and investigators solve cases that have gone cold or involve missing or unidentified persons. In Arkansas, right now, there are 111 unidentified remains in the Arkansas Crime Lab. With this legislation, law enforcement agencies shall input the following data into the NamUs system, copies of fingerprints,
forensic dental report or radiology imaging, detailed DNA information, and all other identifying data, including the date and place of death within 30 days. In the case of a missing child, law enforcement shall enter this information into the NamUs system within two hours from the time the child is reported missing to the law enforcement agencies. This information is already being entered into the FBI's NCIC, and it only takes an additional 15 minutes to enter it into
the NamUs. This provides a fresh look at evidence in new and old cases that can lead to arrest, prosecution, and conviction of perpetrators. Public safety is and always should remain the first priority for Arkansans. As state officials, I feel we must do everything in our power to solve crimes and give families closure. I know from personal experience that the not knowing destroys families and destroys lives. NamUs is a federally funded and no agency or
family will ever be billed for a NamUs resource or training. NamUs is a collaborative platform to tie jurisdiction, agencies, technologies, and states together. Legislation has already been passed in Tennessee, Michigan, Illinois, New York, New Mexico, and currently Oklahoma's Francine's law has passed the House unopposed and is currently in the Senate. Like the title suggests, it's merely to streamline the state employee grievance process, and we had an amendment on it, which was passed in committee, and that just brings back the whistleblower process that was a concern. In essence, what it does is it makes sure that the grievance process only deals with terminations and suspensions, and then we have a stricter standard for review for hearings
of appeal. Thank you, Mr. Chair, fellow legislators. The flaw in this bill is the lack of definition of what is serious. In the absence of a definition of seriousness, any decision-maker may determine that one's grievance is insufficiently serious, however serious it may be for it to be considered. So, for anything that the state does, there should be a grievance procedure, and if it's
going to be limited in any way, there should be definition that is clear and not left to discretion of the person who made an adverse decision against an employee. That is, I think, a fair position and a fair reading of the law as it now stands. The law has worked for years in the state of Arkansas, and there is no particular reason to change it so that a new set of undefined possibilities may be used to limit the rights
of employees to be heard without having to go to court. The grievance procedure is there to try to make sure that matters stay in-house and are resolved. that's why we are here to try to see to it that things have a capacity and potential for being resolved without unnecessary litigation but negotiation in-house is the present expectation and desire of the law and that's the way it

House Bill 1622 makes it easier for families with teenagers to apply for a driver's license for their young first-time drivers. Currently, when a minor applies for a driver's license, A parent or guardian signs and authorizes the application on site at the Office of Driver
Services. This bill would simply allow the application to be signed by the parent and notarized up to 30 days beforehand anywhere and brought to the Office of Driver Services for the application of the driver's license. This would allow grandparents or other family members or family friends who care for the minors during work hours to take them to get their driver's license without the parent being physically present as long as the application was signed and notarized by the parent beforehand. Working families all across the state could benefit from this change that would expand access and reduce barriers to getting a driver's license for a minor.
This bill is supported by Arkansas State Police and was amended in collaboration with staff from the Office of Driver Services who were helpful and flexible throughout our time working on this bill, and I'd be happy to answer any questions. DF&A recently has taken a different view or a slightly different interpretation on the law that has been in place since 1967, and what this bill seeks to do is to clarify that it means what it originally meant, and that is when you come in to register, I'm sorry, to renew your registration on your vehicle, if you attest that you have not driven it on public roads, you don't have to pay for the years that you were not driving it on public roads. I didn't think that this was really
necessary, but again, DF&A has taken a slightly different reading to our current law, so this clarifies DFNA doesn't have to do anything different than they've been doing before. Our citizens don't have to do anything different than they've been doing before. Zero cost at all whatsoever and passing this will actually prevent DFNA from starting a new process that will be cumbersome and costly to our citizens. I'll be happy to take any questions. It allows a person with a disability to save money without losing their other sources of income, such as Social Security or Medicaid. As it was in the past, if they saved over a certain amount, for example, $2,500, they would lose their Social Security or Medicaid, and that would be detrimental. So it prevents people from providing to meet their own needs. So thank you, legislative body.
You have allowed this program to get off the floor in November. And we started with the treasurer's office our first set of ABLE plans. When we did that, we realized there were a few things that would make that plan more successful. states have allowed already, and two are pending, for a deposit to be made into that and be tax deductible. So let's just say there's a generous person who wants to give up to $5,000 to this person
with a developmental disability or just a disability into this account. They could then use it as a deduction on their taxes, which will encourage more people to help individuals with disabilities. And right now, the average size account that we have in our program is $547. So we hope that with this, there might be some other people who would be generous and would be able to donate money to these folks so that they can have a little bit more in their account

But it says, currently, schools have two options of presenting financial audits, regulatory basis, or alternative basis. However, schools presenting financial audits under the regulatory basis can no longer be considered as a low-risk auditee because of recent interpretation of federal guidance. This legislation would give schools only one option, regulatory basis. Two of the 235 school districts use the alternative basis for audits. straightforward. It started four years ago. I took legislation to think it went before aging children and youth at that time, for Arkansas to transition from the traditional child support guidelines to something that 35 states were already doing at that time, which is income shares, where they look at the incomes of both parents, basically the concept of income shares is based on the concept that the child should receive the same proportion
of parental income that he or she would have received if the parents lived together. I was asked at that time by a member of the committee that had been appointed by the Supreme Court, Judge Mackey Pierce, if I would pull the bill down because they were well on their way towards adopting that. That was four years ago. That process has still not taken place, and now 40 states are already doing this. So Judge Pierce, who's no longer on that committee, told me, well, maybe something
needs to be filed. Something needs to be done to light a fire under the committee. I filed this. Justice Womack came to me, who is now the liaison for the Supreme Court. He said he likes seeing this. He just asked for one thing. The implementation date that I had was January 1, 2020. He asked that it be changed to March 1, 2020. And I've been assured by he and the Judicial Council which supports this bill that they are well on their way

Thank you, Mr. Speaker. Children are being bought and sold in Arkansas. One Arkansas resident was just arrested in the Republic of the Marshall Islands last week on charges of trafficking in persons. He could not be arrested here because in Arkansas his actions were not illegal. This bill will bring the trafficking of children and women for the purpose of adoption into the scope of the Human Trafficking Act of 2013.
There can be conflicts of interest in adoption. Adoption practitioners are often working with both the biological and adoptive parents. This creates an environment that can lead to conflicts of interest. This bill would hold adoption practitioners to a higher standard of care when they work with both sets of parents. When money flows in secret, it's a breeding ground for corruption. This bill will require itemized accounting of expenses paid from adoptive parents to biological
parents while maintaining the confidentiality of the adoption proceedings. This bill will hold adoption practitioners accountable for their payments of monies that are unrelated to the adoption or pregnancy or for the negligent or causing harm with the practitioners when they work with both the adoptive and biological parents. This bill will beef up the jurisdiction pleading requirements. It does not change the jurisdictional standards, but we have out-of-state parents meeting out-of-state
couples to perfect an adoption. need to strengthen the pleading requirements as to jurisdiction to help stop that as well. DHS also believes this will help make Arkansans more compliant with interstate compact of placement of children. This bill is necessary to end the use of adoption procedures to traffic children. When I ran this bill the other day I told you I was going to amend it. This is the
amended version we've amended this bill multiple times and discussed with different organizations that handle adoptions nonprofits worked with you know input from DHS from different communities within my district and we finally got this down to where we've got a very good bill in my opinion I would be happy to take any questions if anybody has any questions if not I'd

trusts in Arkansas. Representative Penzo, you recognize to explain the bill. House Bill 1810 sets up what's referred to as a spousal trust. This bill gives married couples the same amount of asset protection after a trust is set up
estate plan as before. Prior to creating a joint trust most spouses hold a property jointly. This type of ownership is called joint tenancy by the entirety. Under Arkansas current law if a married couple owns a property jointly and one of the spouses is sued the creditor cannot seize assets that are owned jointly. However if a married couple puts their assets inside a joint trust they currently lose the same level of asset protection, meaning that if a married couple puts their joint property into a trust
and only one of the spouses is sued, that creditor can come after the property in the trust. This statute simply allows assets that married couples transfer to a joint trust to maintain the same level of asset protection that those assets had when the married couple owned such assets in their joint names. Out of the 26 states that recognize tenancy by its entirety, ownership for married couples, 10 of those states have adopted similar statutes allowing qualified spousal trusts.
