And they're placed similar to on their own on page three sections everyone into north digital asset mining in the home is limited to the confines of what your utilities can provide you base that your normal retail rate so this is a harbie this is something you're your personal computer is able to do if you so choose to do it if you choose to buy a two or three in the confines of your home that is a hobby and that's that was the intent of the original language I just cleaned it up to make sure it wasn't about a business it was about home mining if you want to operate a business out of your home with this and declare that then you can you must follow local guidelines and local orders it's been in order to you know just do it as a harvey the interest was that you can you have that permission to do that the so local control additionally on second page like we've struck in any ordinance concerning operations in safety and just put any ordinance which means any dead digital asset mining me opera in the state if the comply with any orders we've also struck in the language regarding the enactment or adoption of any ordinance policy or action at limits of sound as well as generated from home or any other limits that for plus in generally it will also struck impose a different requirement for the last mining business other than the requirement for any other data center and then we struck language resonant area with the intent or effective discriminating against the digital asset mining business now the original intervention fifty one was for the current operators that I have enjoyed operation in our state to be able to be treated like any other business and not get preciously discriminated against in the event somebody just did not like what they were doing now obviously that intent really plays out better in the cities and it as the counties wants to build past we knew that these facilities that were already been built in our counties and coming online. Need to be a basically control so fifty of our counties pass ordinances dealing with sound as opposed with these facilities analysts finance but if we within the wall but what the law did say was once it is an active and these are up and running you can't write to actively income preciously remove them by a discriminating ordinance so the countries that pass these ordinances these facilities operating but those orders were not restrictive enough and so that the notion to repeal the law would not again give these counties just back ability to do this unless they set up that planning regime or is owning routine in which our counties typically do not want to do there's been county washington county critic county I believe in free examples that do have a planning regime and could put these facilities in a functional box the other counties have to do something more broad and more created to regulate these in frankly several work county judges that they they don't want that responsibility they want people to enjoy the counting however quiet enjoyment is a right of property as well and so give me back local control to make sure they can affection their own organizes to control these facilities is the internet the section six of the bill is really for those count- i'm sorry not section six section three page two section three the bill deals with no ways so the industry really knows what the noise is generated from and that's obviously the noise of the servers and the noise of the fans and so as these are both operating in the heat of the summer or you even in the winter as we've seen up in bono noise is obviously less than what the ordinance says but it's still quite debilitating if you're within a certain distance so where we've done is that is what i've recommended we do as a as a. Stay is to apply noise reduction techniques including without limitations a few of these things which is used liquid or some schooling if you play a video of a liquid or some urge cool system they basically generate no noise the second option is the fully and close the envelope of the facility which means basically you're in a four sided roof to building if we flip over into a page one of the amendment to this bill what i've done is i've cleared by some exceptions because you can have a container that has four sides in a roof but one side of it is luvered vaiance in that generates a lot of noise so that deal with that qualify as a foresight enclosure and the answer is no not unless you go into section c which means uhm so basically what we're calling there is it for enclosed envelope does not include utilizing a passively called pre manufacturer container without additionally enclosing envelope that's been to make sure we're not your splitting hairs there section c says hey you can use that if you are two thousand away from the nearest habitable structure or commercial operating a commercial building or if you have an area industrial use or otherwise approved use miniature zoning system so that kind of pushes that out to where the functional decimal level is zero at that two thousand feet which really goes right into who has the the building to confirm standing in that if you're within two thousand p and they're not complained then that person has standing to sue a circuit court to make sure they apply with the law the next section deals with foreign ownership I think senator urban has has gone prevalent detail for an ownership it is zero they've got three hundred and sixty five days to divest in tiger and compliance with the wall to those functionally where we're trying to do this address what who control. There are looking for crypto solving for critical currency they're just keeping a ledger which is on the same level of what these facilities are capable of bringing up thank you I share the exact concerns which is why I wanted to include that language and they are legislative intent on some of the security because of senator subulfield at point terminate given her follow up again not represent centralized your regards for a question thank you either one of you I think maybe a laptop two year actually this question is there anything that you have heard that could be misconstrued our may be used out of the intent beyond the digital asset manning business for noise levels we have current commercial industries running head noise levels in the areas there are is or anything in their situation concern with that that could cause problem to that's outside of the digital mind I guess it uh our can speak to that and i'll let him because we work so closely together on this all week and there's so many people I want to thank for their hard work on this with us and i'll i'll get that back no because we were moved the decibel level in in the my original bill because a that's hard to regulate and be it is specific to the the industry but what we did do as we strengthen the language pass it relates to noise in his legislation because it's easier to regulate to ensure that it's a built properly to prevent that noise from ever reaching um an agree just level. And again that is from industries that we're not getting no it's complied from because where they're zoned and now or whether at even if they were in a rural area I didn't want to get them called yesterday as I have not heard of anything this is house inside a certain title that is for data centers one area that we did strike was obviously comparing these to a traditional battle center that way we make sure we don't lose other operators I would like to enjoy our state's business community I could just all your debt thank you thank you center rice alright central hammer you're recommended for a question thank you let me play devils I have kid for me on the whole ownership side of things I know the economics of it you'd spoke to before about the economic snot really being feasible for some later try to set up but but at what point her house is defined when it transitions from being home ownership or home business to actually fall blown that would fall under regulation where's where's the line I think for for the for an intent of this it is is probably based on nuisance but the line as far as a business would be a I believe it's in their regional language where the consumption of power is a certain level in so if you if you have a home and if if energy wanted to speak to this you know homes typically have four hundred and so really if you want to attach these systems to your home inside in the consume introduce really going to know if you're high user and then I believe that they have the ability to penalize even high users and with additional fees or rates but to me that the the functional level of the business is it goes up into the megalite usage that's where functionally you start having the noise and the nuisance issues and so anywhere inside of its zone you would have basic complaints to the local authorities and they could fluctuate police powers and. He and that investigation if you were out and the county it come down to the two thousand for all and then you be investigated okay so do you anticipate or do you see any road flocks through the rule making processes away this is written that something could be incorporated that would there's gap is some sort of trigger mechanism because if i'm trying to look for end around through the law which is what people do we may splaws and then they figure in around and we come back and fix it we do what we do but do you do you see in the rule making processor if you thought through that maybe in the rule making process there could be something that could be a trigger to identify that I mean just because the utility company may see a high power you see and they may want to penalize them would that necessarily stop somebody from moving to the next level i've proceed it's it's a potential because our idea for the rule making process would be to address energy uses to make sure there is a rate agreement to with the provider make sure there is a water agreement for those facilities that you connect to our water supplier of wellheads to make sure that ownership is sufficient to make sure that that a security or cyber security is addressed so II think with the complaint process there will be a mechanism for energy environment to investigate those complaints as well as local control having the four authority to also investigate and hand pass they could pass their own provisions of what a business looks like to this to this issue which could be done through the county or the minister through zoning processes commercial there's properties subject to for sure through the city of its counties that don't have planning or zoning would have a different challenge but that's also the challenge of living in a world community art thank you sir pretty recognized for a question thank you. Chair just to clarify I think what I heard you were saying in it but I don't want to assume anything you when you return referring to power usage in a home the the powered demand of of of a real new sense as part would probably be prohibited from a normal wiring another home for the same reason you don't have twelve deep freezes in the normal home because of the power demand on the the the two phase or three phase set up is that what you were trying to refer to as well absolutely you know homes they'll have three phase power they have single face power and so you know you're limited to will with the capabilities of the infrastructure are then you're limited to your actually in your home and then you're using your homes air conditioner or you're generating heat in the winter off these things and it's just economically not feasible to really create the nuisance that we're dealing with with mining businesses alright any more questions for members where I see no for questions I don't have anybody signed up to speak for or against this bill alright was to world committee as amended and we have a motion to pass as amended from said for hammer second from central petty all in favor say I opposed congratulations center in your bill passes as amended all right senator urban thank you members and again available for questions as I went through the limit it really is the bill so i'm happy to take any questions with that I want to acknowledge um all the people that helped work on the bill um and and i'm here as representing my folks and bono who have been literally on the front lines of it of an incredible nuisance I really want to thank representative mcclorence and our brian for their diligence and hard work. As well as secretary cory and law and with that department of energy environment representative more representative wing very grateful for you and represent a more representative with um and they have been on the front lines of this as well so on behalf of those citizens and bono and deep with an other places uh is what has motivated us to bring this this bill before you we also want to think mattie miller with AB l r we could not have done what we have done without him and he worked around the car so a really really just appreciate that I also my fault or county judge and faught nor can the administrator are here in the room with us and I just appreciate their also expertise they've been working on the fishy on the front lines and helped both of us with the language in our bills and are here and support those bills so with that I just add it will answer any questions II think important where you need the state regulatory system and oversight provides great legal standing for our citizens and I think our citizens deserve that in the facing this new in emerging industry uhm a and particularly rural areas that don't have the level of capabilities to to enter into any type of an agreement with this type of an industry we want to be able to provide that level of state oversight and protection and regulatory function for them as well so that is the purpose of the bill and again to make sure that this party has fall approval through rules and regulations with the wall and gas commission was also a huge part of that and tracking this industry and providing this good legal standing from for an ownership with the attorney general's office so with that I really am grateful to everybody further do delicious and hard work thanks center even since you were gonna ask for a question. So dervin you are addressed fact that uh when this is this passes and there's not other amendments that do all the gas commission would provide rules and bring those to legislate council uh do you have anything at a timeline we hear their more these coming online and you would expect if they've got one in the works are going to try to push it on through it's quick as possible is there any time when you could give us for the possibility another here in the room but II don't really I couldn't you you probably would be honest that question better as tear of all the than I could but I would just think that we follow normal you would have to have public comment periods and and everything so i'm i'm guessing a six month time frame what is the timeline if this bill passes in governor plans it again we have an emergency clause so we would be able to begin immediately on trying to promulgate rules and regulations I would just say the emergency clowes would be uh critical to the assets were looking at it thank you thank you members anymore questions from members of the committee okay since just a whole bill you're right for questions this is a question as possible for a long time wouldn't china could have destroyed interest in these minds why wouldn't they build them a chance to pull III can address what I my research has will let me to understand and we do have some minor industry representatives here that can probably expand a little better but the big coin bit coin us as crypto currency is decentralised it is a transact it is a commodity that has transactional use amongst its members that government cannot control they can see it they can follow it they can track it but they can't control it. And so you know for a country that generates you know one one power system every five days it's not about an environmental concerns it was about control over a over a committee that can be used as a currency and so they dismiss them from their borders because they didn't have control over there there's another reason to bring challenges on the infrastructure and it's electric read to support these things they put such AAA great power to me the band on the power bridge that really is in the southern united states of the only place exactly tennessee georgia hobama arkansas china will be a while will not let him hear word letting because of the tremendous demand I put on the park here we are morning to turn our country and just solid and which is going to and we're closing the uncle far generate plans we're going to an energy crush ourselves and I think we take one thing for brain we turn on the lots of a morning you know which pictures come on somebody they might not come on it I thank you for the questions that in our second file that's why we want to this to be at the zero percent for an ownership as the definition as it exist we want to kick him out in the following regardless of of who owns them else for his american into it entities I too share that concern I think if we if we don't have our partnerships at the pse and our power providers telling us hey I know we're selling power we're selling it cheap were able to expand our grid but we also want the information when hey we need to pull these back or slow these down because the juices are worth the squeeze. And I think part of the regulations of going underneath energy environment they can actually start to monitor these how those conversations so maybe the future policy is to limit or you know not have any more these within our borders of our state and so III support that ongoing conversation which I think both these bills uh target to continue to have appreciate that central brian II do believe this is a starting point not an indian point in the conversation as it pertains to the overall you know block training crypto data money in industry there is of language in the original right to mind bill and I see you know mister bethlehew with a energy and my last can become up here in a second but if you could explain upon that because there was something in there that I did actually like that reference specifically if there is not a demand on the electronic red that these utility providers in electronic butters would be required to limit how much electricity they could supply so with that senator bryant can if you can kind of touch on that just briefly yes so so part of the rate agreement so accept these things are they not they're not economically viable unless you have a low though weight of monetary conception of electricity so that the rate agreement is he enter g or willing cooperative if you provide an approved by the psy if you can provide this at a lower rate as a wholesale rate we agree to go offline with notification so on these health several days or any time there's AAA load on the on our paragraph crypto miners get the call they have to shut now now parliament and part of the agreement is they put a bond you know a very high balance where they do not shut down and cause an issue power companies and pse can of minister actually fluctuate that bond to recover if they continue to be a bad behavior they lose their rate agreement. And I go from paying five six cents back up to twelve thirteen cents which basically ruins their business model and they can no longer effectuate how it's bad behavior to find there that they don't they don't get off the grid and they cause an issue on the great power companies can see that they monitor it and if they don't comply within the time frame or what that time brain is sector john you and mister berfari which comes thirty minutes or several hours but john if we feel recognized yourself until it's here with for the record yes sir mr chairman members of the committee i'm john bethel director public affairs for entrgy arkansas and we have addressed the the concerns as far as reliability associated with the crypto mining customers through the rate where we serve them it's an interruptable rate so that we can upon uh their two two notice periods in the in the rate schedule one group of customers can have thirty minutes notice before in rupt in the other group of customers has an hours notice before interruption and the company gives them notice and then they are required interrupt if they fail to interrupt they are assessed penalties for failure value to interrupt as well as any other cost that they cause on the system for failure to interrupt and then if they fail to get around more than two uh they can enter they do they fail more than two times in a twelve month period then they are no longer eligible for that service schedule and they go to firm service schedule and the rates for that are more expensive and that's my understanding from the industry is that same both the financial penalty and the lots of the interruptability are strong incentives for those customers to comply with that request and. Based on history with industrial I mean interruptable customers and we've served interruptable customers for a number of years and those customers are responsive when we call upon them direct to interrupt or when my so calls for interruption so I would expect based on the history that this is an an effective way to serve those customers and to protect the reliability for our other customers okay so hammering we're in a question thank you when it when it comes to the priority of interruption where do they fall in relationship to other established businesses or individuals farmers etc would would what's the prior to order as an interruptible customer that served under that schedule they're the first because we will call on those customers in the instance of any need for capacity and energy the interruptible customers of the first customers are getting interrupted because they've taken service with the understanding there that's the the the service arrangement that they've signed up for a and so they are prepared to interrupt most interruptible customers have some level of backup generation to carry some portion of their operations during that interruption and it's my understanding from conversations with the crypto customers that most of them will have some form of back up either a generator or batteries that would carry them through the interruption period is up to four hours upon that thirty minutes notice and so that's so separate and and apart from any other customers on our system those would be interrupted first and they could be interrupted for an issue that entered the identifies or an issue there that the regional transmission organization might so would it in a fab and we call upon them to do that and then they're obligated under the service schedule to to take that action your counterparts in other states were crypto minds are established up and running do you have to know. How many times or if it is a common occurance that they have to shut down maybe that's too big for question based on the variables and different parts when reason curious don't research on the other one II don't have the statistics from other states I do have uh do know their historically with our interruptible customers we have interrupted a few times annually for those customers depending on we have sometimes in the winter sometimes in the summer and so I would expect their these customers like the interruptible customers that we've served for many many years are likely to experience some number of interruptions annually I don't have the data in front of me right now to say what that frequency has been but I do know that that happens some number of interruptions occur each year for that group of customers and now we can trust that with our other customers that's really infrequent for our other customers to be interrupted i'm not aware of the other the last interruption i'm really aware of that of our general body of customers would have been dear in the uh winnerstorm during and in february of twenty twenty one and that was a a also a limited number of customers were affected by there so john is is it up to is it up to the uh the utility provider rather that's energy or a cooper by electricity to shut you know to to shut the crypto that a buying blocking facility up from power during a time or you know increased demand on our electronic red or is it up to the operator themselves to disconnect its uh we give notice to the customer to interrupt in the customer is required to respind to that notice from us to what's a period time thirty minutes a thirty minutes notice for the like I said earlier there with the crypto tear if there are two uh two rate offerings one of them has thirty minutes notice one of them has a one hour notice and so that's we we give him notice at least that foreign and being at. And then would give him notice of of how long the duration of the interruption would be in its under the terms of the right schedule it would be for up to four hours okay and then if if if there's two or more instances per year or every twelve months where they do not disconnect a respond to that thirty minute notice that they would be the could be subject to it enhanced to rate and but at the end of that swammer period it resets if they if they only if they only failed to interrupt twice they would stay on the schedule both times they would be subject to the financial penalties associated with the cost that they cause and then there's a surance that they're going to pay that because to get on the schedule one of the requirements is they have to provide a surely bin that's adequate to cover the level of penalties that you would expect and so that that mind is there if the customers not able to pay out of their own means there's a bind to cover that payment so what the the way we structured the rate schedule is we worked to identify risks that those customers pose to our other customers and that's in terms of reliability and then also financial reason for you to address the reliability risks with the interruptibility and we've addressed the financial risk by the shirty bind to cover any penalties as well as they hit they also pay an additional deposit that's greater than our other customers and so they would our other customers would be insulated because they are if they were to leave or fail to pay their bill we have a deposit sufficient to do that with an ordinary customer would pay AAA two months deposit these customers pay a three month depressed so we've got financial protection and then thirdly they also pay all the cost of of construction of facilities required to serve them on the friend before they take service and so we believe we at least we identify the potential risks that they post to our other customers a. And made sure that the rate schedule under which they're served covers that in the public service commission reviewed an agreed with us on there okay thirty minutes ago I know this is in my opinion this is a big the starting point not an indian point I would say that I think it's obvious that these operators of that at free deposit and then pay into construct you know the facilities of the apparatus that goes when to provide anything with the city they're making some money going on and ask you this a major speak for energy he represent energy but in comparison to the rest of the country were as aukosau in relation to our utility race what we're paying for electricity or we on the high end or we all the cheapened we're on the low and we're very competitive which is good for arkansas economic development states are they the cheers position is that this is something that again members this is the beginning point in all this conversations that say where we end up but what they do you know to look at is when you talk about you know a bad actor in my opinion it's not just a four ownership you know there could be you know a native or cans and whose roots go his family roots go back two hundred years but if they don't you know respond to that thirty minute notice and shut down it is complete blas- disregard in this respect for every other hour kensing in this state and the fact that we're going to do a reset after you know you know twice and twelve months and then it's going to be a third time I mean there's a good chest you may you may not you may not ever get that shut off notice from energy there may not ever be a time where you have that great way and I mean that's unlikely but there is a possibility but to me there and I think this with the citizens of the state are looking at is that what's more important these facilities you know pay an enhanced in electronic you know you know you know enhanced rate on their electrical usage because they refuse to shut down or that we just disconnect them all together and I think when we talk about good actors and good neighbors that's exactly what our candidates are looking at is that you know that that these these operators is not just their bottom line because of fishes are making plenty of money. They wouldn't be going to all these expenses that are without a proper margin there in the back in our opera graduate that's the objective of every business is to make money regardless of what that industry is but when it comes to electricity which is important to our people not just to business in the industry I think there is something that we do need to look at in you know down the road in the next session and during the world provocation period which we are going to be entering into should this build get you know you know pass today and it passed to decent in the house but I just think an operator that gets to chances every twelve months to find them to get back in the compliance seems a little wafty to me it but that is just my own personal opinion you as chairman that that's the same terms and conditions that are other interruptable customers have operated under for a number of years and like how they use it as much electricity is these as is some use more and so I would point out that that's where that rate schedule has worked effectively based on based on the experience in the industry we believe that it we we are extremely concerned reliability is is top priority for us because and that's important for our customers and so we believe that the way we have designed this rate schedule has taken into account the importance of our customers reliability because that's we want to assure that for our customers and we also want to make sure that all of our customers are are shielded from the risks of these customers and we I believe have structured a fair rate scheduled that accomplishes that objective thank you john yes are all in one word on since your hammer had a question about the residential service I wanted to help that up is the the way the rate schedule is defined the language in the rate schedule itself uh limits that to primarily residential use and that would and that's true today uh bad that your home you could operate a. Uh some level of business activity and still be on the residential rate schedule that you know that that's out but the nature of it is it's it's predominantly for residential purpose and then the character of service is hanging on the second i've made ages showing and i'm need to get this big enough to read it is normally sixty cycles approximately one twenty to two hundred and forty volts or such other roles ages adopted by the company and approved by the public service commission three phase service may be made available for residential use as well but the the nature of residential service is clearly established and so there's a clear break between if you were no longer predominantly for residential use you would then be moved to the commercial tariff and that's that's been in place for a long time and we believe that there's as enough delineation and I am in a historic practice that would make sure that you're not doing predominantly business activity on a residential rate that thanks charter petty organized for a question thank you mister chair certain john you articulate it very well what entertains policies were are those pseased uh set or can you say that the other providers of electricity and arkansas are are the same or similar I can say that the our rates are we we propose and they're proved by the public service commission consistent with the the rules and the standards the public service commission establishes and all electric utilities would operate similarly because they're they're all adopted and everybody's requirements may be a little bit different because all of our circumstances are a little bit different but they're all subject to commission review presently to my knowledge entered she is the only utility with a rate schedule for crypto customers and to my knowledge introduced the only utility that currently serves any of the of the crypto customers okay follow up. So I was I was more in interested in the uh uh the bad actors uh shouldn't shut off noticed situations could someone else decide they're going to give them one opportunity when they do have their interruptible service or three or five for or is that is somewhere in the pse says if you have interruptable service to or one or three there's a range there's not a a commit to my knowledge there's not a public service commission rule that would defend that number but the the utility would bring that rate schedule to the commission and I can't imagine that there would be very much latitude to allow a customer to fail to interrupt more than meal significantly differently than than hours and still remain on an interruptable customer rate and that's the customers understand that as well and there may be circumstances that would be on just being a scuff law in not doing what you were asked to do that might cause a customer to fail to interrupt and so that's why they're it's not just AAA one and now requirement thank you channel there was already more questions from the committee center camera thank which cheer john on the bonding side of things is that uh is that a energy policy or that uh by the pse it uh it was part of the rate scheduled we developed and recommended and presented to the public service commission and they approved that and they agreed that we did that to protect our other customers to make sure that that customer had adequate financial resources so that those costs didn't move from that customer to our other customers and so the public service commission recognized that that bonding requirement like the deposit requirement is intended to shield other customers from having to absorb an unpaid balance and so. Which commission agreed that that was a sufficient customer protection thank there weren't going to mind on this thing is if you know we're here because of the bad actors not because of the good ones among other things. But if i'm a you know me it's just like inflation people just raised course they pay a set on you can set him at a higher rate and make sure of their business model that if they find customer but she'll be and i'm not sure this would be more a new pse or maybe it could be addressed to rules but maybe one of the ideas we ought to try to squeeze in here is if they go above to could we prohibit them somewhere from being bonded because which you do business with somebody that can get bonded no because that's a requirement to take service they have to they have to have the bond right so if you if you have to call their bond then that would put a crypto minor out of business if you had to call their bond because they could purchase electricity if they if they let a certain and am based on what you do that if we if a customer failed to interact and we imposed the penalty and they paid it out of pocket the bond wouldn't come in to play but if they fail to inter in the exercise the bin and then if as a result of that they weren't able to renew the bond and present that again then they would not be eligible to be on the rate schedule on the rage schedule or get electricity at they could get electricity but they would move from the interruption will schedule to the firm schedule the standard break schedule and the rates under the standard schedule are are higher because you're getting firm service you're not subject to interruption the cost of the service is different and it's my understanding from the the the crypto industry can't financially is not financially viable at that electricity rate right then then they press herself out of business by virtue of the address it up which was your point but i'm just saying if we want to put a nail in the car for maybe we have to take a look at the bonding and them not build it bond which would basically choose put him out of it and and that would that would function under the requirement as it is now because if they if they weren't able to maintain that mind that they're not eligible for the rate schedule. And there are a resident of arkansas county welcome so thank you very sure i'm an arkansas county resident land owner and I think the committee in the chairman for bringing this thing together and given this and opportunity to speak or I come here today to speak in favor of the urban and more resolution that you're to be in past here today and we'll move on to formulate at least in part will be a bill we thank you more accurately reflects the needs at least in this initial conversation they are necessary to protect the consideration of normally or console county but or can so as a whole I would like to bring to this committee's attention to things or grew with your assessment or concerns regarding you know what happens in the electrical needs of the given area where crypto man it seems to me from yesterday's conversation on the house lower that there may be as many as fifty more of these crypto mines are anticipated located in arkansas and structural my industry have a farmer and orlando and I also run a large socialist water operation in arkansas county we've turned off thirty five for a world's over the past few years and and we preserve approximately thirty two thousand acre feet of drinking water for the future generations and we don't are supplementing surface water we have large electrical letter of driven really of parts stationed in in a surface water in parliament where we are of tributary from the arkansas and we've met all the legal requirements about the state local federal level to to do what we do. It's not uncommon in july in august and even in early september when the tempter shareholder and everyone's air conditioners are running wire open to get notices from energy and the other providers of electricity that that uh brown outsource or stopage may occur and in fact when it does occur if it causes a single phase in it can swap up about a hundred thousand gallons of minute of surface water to gain our farmers crops and I would suggest you that an industry that is a soldiers are concerned we were build energy we are bold cooperative electric system because with their customers and while you may have a thirty minute and I appreciate that or an hour before option notice cause of single phase that occurs in mars system and i've got twelve fifteen thousand acres of rice farmers who reliably hoods are under our responsibility and you shut me off try understop a hundred thousand gallons of minute of water it was like trying to get in favor to buffalo and stop there because we start wash your head pressure the things that have gone to happen in its control at their point came and were at the end of that decision to turn their electricity of because of situation where the demand is hard and the ability to do ever at the end of that in somebody's foreign and operation in if in area if I can back to them because we've bought up a mother we've bought up six motors in its two thousand and twenty four. All solutions because they are coming a new industry that we know nothing about in those cases we don't know the players some of the police they will know about we don't like this as they consumptive industry are concerned has been real discovered you know before it was the natural state was the land of opportunity that's found arkansas and some of it's not so good I think these bills do a fabulous sharp of addressing some of the what I call tier one concerns the noise level senator I will represent and our friend mister brian our trying to address those and I speak in favor of the more early bill in our achieve as a body to think about the unintended consequences but when we have to try to make calmination for a new industry because this is not the only time we're going to have this conversation thank you very much thank you sir would you be open to any questions to him where you're recognized for questions are that this year but little lad to now be really brief yes i'd like to john bethel back up to the table longside him because on a call up john what was I think in dismissing you earlier thank you so if the crypto minds obviously are targeting areas where there's low electrical consumption and path of least resistance which in our probability I could see that they'd be moved into the eastern part where you know your county is if it came down when it comes down to who gets shut off because of of those like the pumps in the rights fields and stuff. And he make the decision did arbitrarily across the board shut i'm all off if they're in that high usage or do you have a priority status as far as the crypto mine would be shut off for before the farmers would be shut off or any other industry as a told you earlier our uh or described earlier power interruptable customers will be the first to be interrupted in any circumstance is a farmer and interruptable customer the only interruptible service i'm aware of is some of our irrigation customers may have the opportunity to subscribe for interruptible service all of our interruptible schedules there other than the crypto schedule have at least four hours notice for the interruption I believe and it's a bit a rate schedule that's approved by the public service commission buyer i'll learn all interruptible customers will be interrupted before any other customer is interrupted and if there is a circumstance where we see the need for capacity and energy on a given day we're going to notify our industry interruptible customers that you're subject to interruptable on this day and and if the circumstances warrant we will tell them you're going to be interrupted in this window of time but we put him on notice when we are aware either based on notification from the regional transmission organization or from our own observation of the the circumstances and we would give them notice such possibility and then if the circumstances continue we would give the motives we are going to interrupt you so that happens before the anything else happens and then we have an established order of curtailment for all other customers in the event of a circumstances it would cause us to she had loader interrupt other customers and so the but the order of of interruption is going to be the interruptible customers first. Any any time and there and in what happens with their is when they're interrupted the the purpose of that is to make sure that we don't be interrupt the other customers and the only circumstance that we cause an interruption of the other customers would be an extreme event that it and I like I said the other the only extreme event that i'm aware of in recent history that has caused an interruption of any customer other than our interruptible customers was during the the winter storm uri during twenty twenty one with the exception of storm events that made damage facilities and take take facilities out and customers interrupted that way but otherwise we're not in a rep that the the incidences of interruptions other than are interruptable customers are rain okay simple answer our farmers on the interruptable list it's my understanding that a farmer or land over my elect to be under a more favorable right structure which could cause them to be on an interruptable schedule correct if if a customer shoes is to be on internet doubles go to schedule when whether it's a farmer or somebody else they choose to do that with the understanding that they will be called upon or can be called about interrupts and otherwise if they're if they've not made the contest choice to be on interruptible service they're not then so they they're treated just like all other customers here so I want to express if it's a pse for stergy whatever coop whatever I would I would be really irked if it came down to a crypto mind versus a farmer even if they're on the interruptable I would i'd be really it it will not be a good day at the capital if that happens and I think that it would warn. Making sure that the crypto minds or at the top of the list even if they're on that system before we do to a farmer they are because the crypto mining customers have shorter notice for interruption they have more frequent interruptions in any other customer the rate schedule they are subject to more interruptions in a twelve month period than any other interruptible customer so that we have in the order of interruption the crypto customers have the shortest notice before they are interrupted they have the most number of interruptions in a twelve month period of any of our interruptable customers in all of our interruptible customers have volunteerly selected that rate schedule because it fits their business operation and it's financially beneficial for them to do that and so yes the crypto customer would be interrupted first and more frequently then the rest of though the body of customers thank you may I respond to serb the only thing that I would suggest this committee is there whenever these rights for negotiated with the energy endowments understand me i'm a consider myself to be a partner with energy because we've been there for a long time and they've been there for a long time for us and we expect for that to continue to happen but a lot of suggests to you goes back to the chairman's community which is you know there's there's a level of profitability saying to take some gravity that the clip claim that they cannot operate financially a successfully unless they ever prefer right uhm what i'm not suggesting is that the rates the rights of electricity will probably negotiate when cryptos was somewhere short of twenty five thousand dollars a bit coin today there somewhere in north of seventy thousand dollars of dead coin.
