you may begin. Thank you, Mr. Chairman. Uh, Les Horn, District 84. Uh, House Bill 7, 1272 addresses property rights to any street or alley abandoned by a city or municipality. When a street or alley is abandoned, the adjoining property owners take title to the center line of that abandoned street or alley. When those adjoining owners later sell their property, they often forget, forget to include the portion of the street or alley which vested in them when it was abandoned. This bill will make it so that the applicable portion. Of the abandoned street or alley automatically flows, follows the conveyance of the adjoining property. This bill is retroactive to 1945, which is when the Arkansas code section that is being amended was codified and will aid in the clearing title to portions of abandoned streets and alleys that the adjoining owners and their successors inadvertently failed to include and conveyances often decades ago. So we're just clearing up something that has not been, uh, addressed in statute. I'd be glad to take

Committee currently at county tax collector must receive payment for any delinquent personal property taxes owed by a seller or real on real property. Before they are obligated to accept the real property tax payments. In conjunction with the sale of real property. Some tax collectors have refused to accept real property tax payments when settlement agents comply with payments based on information accessible online or at other payments for taxpayers who are in some fashion related to the seller. The Arkansas Land Title Association has worked closely with the association of Arkansas counties and the tax collector's leadership group to arrive at the solution we are presenting in this bill. Essentially a settlement agent may request an amount from the tax collector that must be paid and the tax collector has 3 business days to provide that information. The tax collector is then obligated to accept the amount tendered that agrees with their statement. If the tax collector fails to supply the written statement within the allotted time frame. They are obligated to accept the real property tax payment without payment of any delinquent personal property taxes. I'll be glad to take

We have people that come in for a closing we collect the real estate taxes if we don't know that there are delinquent personal property taxes, we closed that transaction, collect the money, pay out, pay off liens, uh, give the, uh, seller their monies. We have 0 money left and we've sent that, uh, payment of personal, I mean, real estate taxes to the tax collector, and then they send it back going we can't accept that. You haven't paid the personal property taxes we're like. You didn't have it online. How are we supposed to know that? So in some counties, they do it that way. I've been fortunate to have people that work with me, but we're trying to put it in statute and the tax collectors have all worked with us saying, OK, we agree, we gotta get some, uh, procedures in place so that here's how it's handled. John Wilkerson, Arkansas Municipal League. Mr. Chair, committee, uh, today we bring you House Bill 1618, and that's to amend the law concerning the election appointment and contracting of a municipal attorney. If you remember correctly, uh, last session I brought this bill and at the time we did it for cities with 30,000 people or less because we were finding that there were either nobody running for the city attorney position or there was nobody that lived inside the city lines, the, the boundary lines, and so the mayor was gonna have to appoint somebody or you know, they want to go find outside legal representation and couldn't do it at the time and so, uh, back when we passed this bill last year, it passed with 98 votes. Well, since that time, um, other cities have contacted the municipal league, uh, contacted me about being included if they were more than 30,000. I'll let Mr. Wilkerson talk about that. Yeah,

so right now the, the law is, is split up between having Cesar the first class, less than 5000 have a different rule, but. There's also a statute that says less than 10,000 have a different rule. And there's a statute that says less than 50,000 have a different rule, but less than 5000 is less than 10,000 and less than 50,000. So we try to clarify this that the same rule applies in less than 50,000. And then of course on the 2nd class cities and incorporated towns, they do not have to have the office of city attorney, but we want to clarify that that's really more, um, you know, making it clear they don't have to, they don't have to have the office, which is already the case and establishing the procedures by which they fill the, fill that role, whether it's, you know, have the officer have a legal representation through contract and then also section 3 just sort of um re doesn't reauthorized, it's already authorized, but highlights that small cities and small towns can can go in together for legal representation, um, because a lot of cities were a lot of cities and a lot of small towns, there's not a lot of, you know, lawyers in these small towns, and so they need help and they can go in together with other towns to come together and, uh, make that, uh, finite legal representation. So it's more, it's more consistency than anything because again, 5, 1050 was all, um, um, you know, sort of all mucked up together. It does not touch over over 50,000,

Basically in the subtitle to allow a municipal port authority to establish a police force and to establish the powers and duties of municipal Port Authority law enforcement officer. Uh, this came. This idea came from my visit to the port of Little Rock about 2 years ago. If you haven't been out there, I would really encourage you to go because I gotta tell you, it's a crown jewel of the region beyond just a, a good freshwater port for the, uh, tow boats and barges to pull into. It's 5000 acres. It's really a big industrial park, connecting river road and rail. And so it's really special, uh, currently 5000 acres host to 0. 10000 jobs. But it needs some protection. It needs some aggressive protection. Uh, currently, the Little Rock Police Department will come out there, but as we know, the Little Rock Police Department is pretty undermanned. The director of the port, Brian Day, uh, wishes the highway police who patrol the highway police do come out to the gate, but they don't go in the gate. Uh, you know, in my career in the Navy, saltwater ports in the United States are very well protected. If you go to some place like Baltimore or Tampa or Long Beach or whatever. You've got city, county, state, and the Coast Guard. Freshwater ports are pretty much unprotected. And, uh, So currently there's a country, there's a company out there, Derek, I hope I'm saying that right, has a multi-million gallon ethanol tank. Uh, North Little Rock Energy has a large propane tank. There is a uh. Che, check, uh, Republic munitions manufacturer that's coming. Ferrari for Sharchi, I'm not sure, I can't pronounce that right. Uh, they're coming and what they'll be making out there is stuff that actually explodes. Safety Keen has a large tank farm here. And that's not counting the rail cars, um. The tractor trailers for the interstate and the barges. In judiciary yesterday we passed through Senate Bill 301, which is an act to amend the law concerning theft of property, and basically it was addressing the just the reality of how much organized crime in the cartels are breaking into cargo and transit. I modeled this bill off of the XNA police force. And they will, they, and the port. The municipal ports in Arkansas are currently Pine Bluff, Little Rock, Morton. And Fort Smith, the most developed is Little Rock. When this gets actually kicked into gear and there was nothing in there that say that they have to do it.
