The title, frankly, of 1964 basically says everything that it does. So it's moving child welfare ombudsman from the Arkansas Child Abuse Radio-Static Violence Commission and juvenile ombudsman division to the office of the inspector general and to rename it as division of ombudsman so basically the uams is supportive of this office of inspector general support of this basically what we're trying to do is is just as you co-locate these two functions it's going to create independent oversight over dcfs dys build different positions to cross train and work together and just create more efficiencies in the system. Their normal course of business is to do internal investigations and also to be a third-party objective representation in that process. They already have a relationship with our Medicaid team. They have the Medicaid fraud unit, Medicaid Inspector General, and we believe that putting all of the same functions where we want an external party to look into concerns that are raised by constituents, stakeholders, and staff would be the most appropriate place

So, I just wondered if, and then also the experiences, the minimum qualifications for an ombudsman, that's also found on page two. And so it's not reflected, I'm not seeing the educational background mirroring along the way. So I just wanted to know about what the educational experiences background would be for this person.

and members the the members may not know but i signed up on this bill and i didn't put for or against uh but i know that the juvenile ombudsman who is under the public defender commission needed to be heard on this and she is under my supervision and so I like to show up when I have an employee that's testifying so if there's questions for me but just for a background I just want to give you a little background the juvenile ombudsman and the child welfare ombudsman are two different entities the juvenile ombudsman falls under the branch of the Arkansas Public Defender Commission agency. It is funded to us through the Department of Human Services. So it gets a little bit convoluted. Our funding for this position comes from the department. And so while we supervise Ms. Digby and cover her expenses out of our budget, there is no budget for her expenses. That's what the commission does. And that's how she reports to us. And her necessity to the defense bar, especially public defenders, is being able to testify in hearings where there may be a motion to transfer to juvenile court, where we're looking for what is available as far as rehabilitation for a juvenile to keep that juvenile in juvenile court or to move that juvenile to juvenile court as opposed to an adult court. where the main goal in juvenile proceedings is rehabilitation. While that is part of the goal in adult court, it also includes retribution and punishment as well. Now, you will also see in this bill a reference to parent counsel. And I don't mean to insult anybody if they already know this, but the parent counsel falls under the umbrella of the Public Defender Commission, but as the director I have no involvement over their day-to-day activities I do not supervise them they have their own director they just fall up under our umbrella so I think that I just point that out because I know that's in the bill if anybody had a question I don't think it's pertinent to what we're doing here today but I know it's referenced in the bill and so I wanted to be here I know Ms. Digby wanted to be here to answer any questions and I am open to any questions as I know she is

the limited information that I have, putting both ombudsman offices together definitely makes sense in my head. We sometimes work together. The Child Welfare Office has the ability to investigate maltreatment investigations, and I make a lot of hotline calls in my position so sometimes we will work together in that capacity or sometimes they DYS might hold a child that is in DCFS custody and that is considered a dual custody youth so there may be times where I would have to reach out to the child welfare ombudsman about that particular youth and we work together to resolve any complaints or concerns but we are doing that right now in our independent offices so I hope that answers your question. And she has supported that function for a number of years. You know, as to the positions themselves, though, you know, there's no intent to terminate anyone.
