Thank you, Mr. Chair. Thank you for allowing me to come back and to answer questions. Cindy Crawford, District 51. We were talking about perpetual care cemeteries and the problems that they are having across our communities with not being able to take care of the grounds, the drainage, infrastructure issues. I had proposed an appropriation to create a grant program where these perpetual cemeteries could seek funding to be able to take care of their properties.
And I will start with, Senator Payton had asked how many perpetual care cemeteries, which I replied 104. He wanted to know how many were in physical distress. All 104 perpetual care cemeteries in Arkansas are regulated by the Arkansas Insurance Department Funeral Services Division. Perpetual care cemeteries segment. Annual reports, trustee reports are kept on file at the AID. A full listing of perpetual care cemeteries are on that website.
That's another thing that Senator Payton asked was a list, so they're on that website. The Permanent Maintenance Trust Fund is not necessarily an indicator of perpetual care cemetery company's financial stability or physical distress. The amount in the trust is based on a percentage of the cemetery contracts executed between the perpetual care cemetery and consumers planning on being interured there. Now, we had talked about, I don't know if you remember, but the perpetual care cemeteries have to have a trust fund.
And I ran, in 2021, a bill which became Act 343. And prior to that becoming law, perpetual care cemetery companies could not withdraw any of their principal portion of the Permanent Maintenance Trust Fund for any reason. All repairs to the replacement of roads, drainage systems, tree removal, roof repairs, business office, fence gate, installation or replacement, etc. had to be paid for by and through the cemetery company's general operating finances.
A sizable number of perpetual care cemeteries are not generating enough income to budget in a significant repair replacement expenditure. So many properties are not addressing degrading road, driveway conditions, flooding due to poor or non-existent drainage systems. Dead trees that are posing an injury or death hazard to cemetery visitors and our staff. These trees need to be cut down, removed from the premises.
Repaid or replacement of damage, mausoleums, et cetera. Even with Act 343 of 2021 becoming law, most perpetual care cemeteries in need of infrastructure, capital improvements, have a principal balance in their permanent maintenance trust fund that is so small that 20 percent of the principal amount is not enough to pay for most or all of the needed repairs to the cemetery property and then I was asked about if there were any that went into receivership
historically there have been two perpetual care cemeteries in 20 plus years that were put into receivership. Rest in Peace Cemetery in Hensley, Haven Rest Cemetery in Little Rock. The old cemetery board put them into receivership after the prior owner defaulted and went out of business. Individuals were appointed to take care of that. If a perpetual care cemetery company ends up filing for bankruptcy or being put into receivership, it will not be initiated by the Arkansas State
Board of Embalmers, Funeral Directors, Cemeteries, or Burial Services. It will be done through the court systems. And then Representative Johnson had asked, I don't have his question down enough for me to read. I apologize. Tired. As of April 25, there are no perpetual cemeteries that are state-owned or state-managed. the Arkansas Insurance Department Funeral Services Division,
Perpetual Care Cemeteries has neither the staffing nor the resources to own or operate any Perpetual Care Cemeteries, regardless of size or locations. Since the 104 cemetery properties that are licensed as Perpetual Care Cemeteries have executed contracts between themselves and consumers, that the state, the cemetery property, will be maintained and cared for in perpetuity. And since there is an Arkansas code on rules regarding perpetual care cemeteries
that define what things constitute properly maintained cemetery, a number of these cemeteries are in violation of the laws, and they cannot afford to come up. HB 1577 is essential, another option for perpetual care cemeteries that are in need of infrastructure, repairs, capital improvements to obtain funding to pay for said repairs. So you've learned all you want to know about perpetual care cemeteries, I'm sure.
And I have a list, if anyone's interested, Senator Hickey had asked questions, Blake Johnson, Denise Innett is now on this, of the perpetual care cemeteries that are in your districts. So if you want any information, I would be glad to share this. I know in Fort Smith, we have had a problem. A board has been brought together to try to take care of the issues, but they need money.
So once again, I'm just asking for an appropriation if the monies are available to where these perpetual care cemeteries can ask for grant funds. We would put money aside for that. I originally wanted a fund, but since that didn't happen, I've gone to an appropriation. All right,

amendment Thank you. Representative Diana Gonzales-Werthin, District 9, Springdale. I am here to ask for an increase in the ESSA matching grant fund. This is the Enhanced Student Achievement matching grant. and the way this came about is that this particular grant,
these are unrestricted funds for school districts to help the most vulnerable populations, those who need additional assistance in reading, writing, math, science, if they're in an after-school program, for example, for that. It also assists in tutoring, one-on-one tutoring, small group tutoring, again, to increase their knowledge and proficiency
in English language arts, math and reading, and readiness, school readiness. Early intervention can take place if you have additional preschool classrooms, pre-K special needs, and early childhood programs. In looking at the appropriation the last three years, The appropriation in 21-22 was 5.3 million. In 22-23, it was 5.3 million.
In 23-24, it was 5.5 million. And currently, it is 5.6 million. However, when you look overall in these last three years, the school districts in the matching grants, they have spent in '21-'22, 24.2 million, in '22-'23, 20.6 million, and in '23-'24, 21.8 million.
So for example, the line item is about 5.5 million, but the school districts, they're spending over $20 million every year. In looking further, the two areas, pre-K, tutoring, and before-school, after-school programs, the majority of the money, 54%, is going towards pre-K. School districts understand the importance of kindergarten readiness and getting students into pre-K programs so that they will be ready for kindergarten.
And they're more likely to be reading on grade level and doing math and understanding math, science, et cetera, if they're exposed to preschool, pre-K classrooms earlier, earlier than just starting kindergarten without pre-K. The second largest expenditure at 34% was tutoring, and that's one-on-one during the school day or after school or before school. And then the before school, after school program that targets those subject areas as well.
so that was about 12 percent so when we look at what school districts are doing with their unrestricted funds they are really maxing out and then spending additional money in these three programs pre-k tutoring and before school after school I am simply asking with your permission for an increase in the ESSA matching grant appropriation to give schools additional monies to help with their most vulnerable populations and to get more kids into pre-K
so that they are ready and they have a better chance of reading on grade level, being able to do math, reading, and the like. That is my request. All right, members, we have any questions.
