Bill 1577. Thank you, Mr. Chair. Thank you for allowing me to come back and to answer questions. Cindy Crawford District 51. Uh, we were talking about perpetual care cemeteries and the problems that they are having across our communities, uh, with not being able to take care of the grounds, the drainage, uh, infrastructure issues. I had proposed an appropriation, uh, to create a grant program where these perpetual cemeteries could, um, seek funding to be able to, um, take care of their properties. Uh, and I will start with, uh, Senator Peyton had asked how many perpetual car cemeteries, which I replied 104. He wanted to know how many were in physical distress. All 104 perpetual care cemeteries in Arkansas are regulated by the Arkansas Insurance Department funeral Services Division. Perpetual care cemetery segment. Annual reports trustee reports are kept on file at the AID a full listing of perpetual Care Cemeteries are on that website. That's another thing that Senator Peyton asked was a list, so they're on that website. The permanent maintenance trust fund is not necessarily an indicator of perpetual care cemetery company's financial stability or physical distress. The amount in the trust is based on a percentage of the cemetery contracts executed between the perpetual care cemetery and consumers planning on being into there. Now we had talked about, I don't know if you remember, but um, the perpetual care cemeteries have to have a trust fund. And, um, I ran, which in 2021, a bill which became Act 343 and prior to that becoming law, perpetual care Cemetery companies could not withdraw any of their principal portion of the permanent maintenance trust fund for any reason. All repairs to the replacement of roads drainage systems, tree removal, roof repairs, business office, fence gate, installation or replacement, etc. had to be paid for. By and through the cemetery companies's general operating finances, a sizable number of perpetual care cemeteries are not generating enough income. To budget in a significant repair replacement expenditure, so many properties are not addressing degrading road, driveway conditions, flooding due to poor or non-existent drainage systems. Dead trees that are posing an injury or death hazard to cemetery visitors and our staff, these trees need to be cut down, removed from the premises. Uh, repaid or replacement of the damage, mausoleums, etc. even with Act 343 of 2021 becoming law most perpetual care cemeteries in need of infrastructure, capital improvements have a principal balance in their permanent maintenance trust fund that is so small that 20% of the principal amount is not enough to pay for most or all of the needed repairs. to the cemetery property. And then I was asked about if there were any that went into receivership, uh, historically there have been two perpetual care cemeteries in 20 plus years that were put into receivership. Rest in peace cemetery in Hensley Haven Rest Cemetery in Little Rock. The old cemetery board put them into receivership after the prior owner defaulted and went out of business. Individuals were appointed to take care of that. If a perpetual care cemetery company ends up. filing for bankruptcy or being put into receivership, it will not be initiated by the Arkansas State Board of Embalmers funeral directors, cemeteries or burial services. It will be done through the court systems. And then, uh, Representative Johnson had asked, um, I don't have this question. Down enough for me to read. I apologize, tired as of April 25, there are no perpetual cemeteries that are state owned or state managed, the Arkansas insurance department funeral Services Division, Perpetual Care Cemeteries has neither the staffing nor the resources to own or operate any perpetual care cemeteries regardless of size or locations. Since the 104 cemetery properties that are licensed as perpetual care cemeteries have executed contracts between themselves and consumers that the state, the cemetery property will be maintained and cared for intuity and since they're um is an Arkansas code on rules regarding perpetual curse cemeteries that define what things constitute properly maintained cemetery. A number of these cemeteries are in violation of the. laws And they cannot afford to come up. HB 1577 is essential, another option for perpetual care cemeteries that are in need of infrastructure repairs capital improvements to obtain funding to pay for said repairs. So you've learned all you wanna know about perpetual Care Cemeteries, I'm sure, um, and I have a list if anyone's interested, uh, Senator Hickey had asked questions Blake Johnson. Uh, Denise in it is now on this of the perpetual care cemeteries that are in your districts. So if you want any information, I would be glad to share this. I know in Fort Smith. Uh, we have had a problem. Uh, a board. Has been Brought together to try to take care of the issues, but they need money, so once again I'm just asking for an appropriation if the monies are available to where these perpetual care cemeteries can ask for grant funds. We would put money aside for that. I originally wanted to fund, but since that didn't happen, I've gone to an appropriation. So, thank you, members. Do

Chair. So I mean, obviously this is under the Department of Commerce and Insurance, state insurance department. I mean this is an insurance, isn't it? that or some sort of a I mean I don't know whether they look at it as an insurance or. Or uh Like a retirement fund, but I mean, the perpetual care. Cemetery business. I it's run like a business they, they sell. plots in the cemetery, they promised that they're going to have perpetual care. I, I assume they set aside monies to do this when it fails, why should the state step in? Why wouldn't the families just take care of it if they've got loved ones there like that's what happens in my neck of the

woods, our cemeteries are taken care of by the families. Right, well, and that's, uh, cemeteries that are normally not perpetual care, perpetual care, they sign a contract when, um, they choose to choose plots there. The reason this is happening is because, um, in their trust funds, they used to make quite a bit of money, but since all of that has dropped, they are not getting the dividends they had gotten before that they could do. The repairs also the other thing that is affecting it are cremations because they received their money from, of course, selling the plots, opening and closing graves, and, um, that money is getting less and less as people choose cremation, right, but that's a business. It's a business that enters into

Representative Justin Gonzales Unverified 13:00
Representative Diana Gonzalezor in District 9, Springdale. I am here to ask for an increase in the SA matching grant fund. This is the enhanced student achievement matching grant. And the way this came about is that this particular grant, these are unrestricted funds for school districts to help the most vulnerable populations, those who need, um, additional, um, assistance in reading, writing, math, science, if they're in an afterschool program, for example, for that, um, it also in it, it also assists in tutoring, uh, one on one tutoring, small group tutoring again to increase the Um, they, um, increase their knowledge and proficiency in English language arts, math and reading. And readiness, um, school readiness, early intervention can take place if you have additional preschool classrooms, um, pre-K special needs, and early childhood programs and looking at the appropriation the last 3 years, um, the appropriation in 2122 was 5.3 million. In 2223, it was 5.3 million. In 2324, it was 5.5 million and currently it is 5.6 million. However, when you look overall in these last 3 years, the school districts in the matching grants, they have spent in 2122, 24.2 million. In 2223, 20.6 million and in 2324, 21.8 million. So for example, the line item is about 5.5 million, but the school districts, they're spending over $20 million every year, um, In looking further, the two areas pre-K tutoring and before school, after school programs, the majority of the money, 54%. is going towards pre-K. School districts understand the importance of kindergarten readiness and getting students into pre-K programs so that they will be ready for kindergarten, and they're more likely to be reading on grade level and doing math and understanding math, science, etc. if they're exposed to preschool, pre-K classrooms earlier, earlier than just starting kindergarten without pre-K. Um, the second largest expenditure at 34% was tutoring and that's one on one during the school day or after school or before school, and then the before school, after school program that targets those subject areas as well. So that was about 12%. So when we look at what school districts are doing with their unrestricted funds. They are really maxing out and then spending additional money in these 3 programs, pre-K tutoring and before school, after school, I am simply asking, uh, with your permission for an increase in the ESA matching grant appropriation to give schools additional monies to help with the most vulnerable, their most vulnerable populations and to get more kids into pre-K, um, so that they are ready and they have a better chance of reading on grade level, being able to do math, um, reading and the like. That is my request. All right, members, we have any questions? I actually, I, I, I apologize. I want to increase and in the, in the amendment, um, I asked for an increase to 21 million. However, I'm not, and that's, that's what the districts have been spending in the last 3 to 4 years. Any amount above that 5.6 million would be greatly appreciated. I placed the 21 million because that's what the schools need and that's what they're spending. Thank you. Is the department here? Mr. Rogers, you get up and identify yourself.

didn't have prior knowledge of this, um, this is the matching grant that's from the ESA program. It's the it's part of the adequacy recommendation, so ESA enhanced student achievement is the money that districts get based off their free or reduced lunch population, they're already getting. This program was started as a match grant. To encourage districts to use that ESA funds for pre-K, uh, tutoring and after and before school care. So this is a Prorated match grant that was started by the adequacy Committee a few years ago to encourage districts to use these funds for those 3 different categories. So that it's, there, there's a reason why it's only the $5.6 million which did increase because of the uh adequacy recommendation to increase that by 2% this past year. That's why you're seeing that increase. OK. Remember, Hold on, members,
