business agenda. Senator Wallace. Senate Bill 21 by Senator Wallace. To exclude mill scale and slag from the definition of solid waste in the Arkansas Solid Waste Management Act and the Solid Waste Management and Recycling Fund Act,
and to add a definition for mill, scale, and slag. Senator Walsh.
Speaker 53
14:41
Thank you, Governor. This is slag. I've showed it to most of you. I may have missed a few. It's a natural product. It looks a lot like lava, and it is a byproduct from our steel mills when we produce steel. It's basically the impurity and what's left over after we produce quality steel. Now, in Mississippi County, we use this on our gravel roads, well, our real roads,
as a replacement for gravel because it's so much cheaper for us. We can do this for about $3 a ton. The problem we have and the reason we're running this bill is we all agree in Arkansas and ADEQ supports us on this, that slag is considered a byproduct. But in two northern states, environmental groups have convinced them that it should be considered a waste product.
If that happened in Arkansas, Mississippi County wouldn't have any roads, first of all, but it would also cost us $50 million a year for our steel mill business to take that over to our county landfill. ADQ agrees that it's a byproduct, and what we're just trying to do with this bill is to codify what we're already doing. And with that, I'm closer.

emergency. Senator Hill. Thank you, Governor. This bill, in a nutshell, just kind of expands what we've done in the past legislative sessions. We're expanding our broadband capabilities in the state of Arkansas. It's going to reduce regulatory restrictions that we have. The main thing that it does, it allows cities, counties, municipalities to partner with a company that produces broadband and services it.
It allows the cities and the counties the option to do a bond or other indebtedness to expand the partnership with the company that's going to be operating it. What we need to ask ourselves about this bill is the five W's that it covers. Who, what, when, where, and why. Who does it cover? It covers all citizens of the state of Arkansas. It covers education or expansion in the medical facilities and retail shops. It affects every aspect that we do today. What does it do?
It reduces restrictions and increases competition. When do we need it? We need it now because Arkansas is ranked number 48 in the country in broadband. Why do we need this? Broadband is a new electricity of the 21st century. We need to provide this to our students for the future

and I apologize in advance for taking too much calendar time, but several of these bills are going to be cleanup bills from the Division of Higher Ed. The first one, Senate Bill 125, if you'll look on that first page, this hasn't been changed since 1991,
so several of these references no longer exist, if you'll look through it. SmartCore is not used anymore. We've moved on to ACT, Aspire, and so forth. And so what we're trying to do then is try to get rid of some reporting requirements that are in code elsewhere. So it's not getting rid of reporting or anything like that. It's just trying to clean up to where we know where it's coming from and we know what time. And so it's not two different sections of code. I appreciate a good vote. Any

clarifying some language. There was some ambiguity about stacking when a student qualifies for both the Governor's Distinguished Scholarship as well as the Academic Challenge Scholarship, so this would clarify we're not changing the amounts, we're not changing any of the awards or anything like that. we're just clarifying that when you qualified for both, the maximum that you could get is what would be under Governor's Distinguished. So if you'll recall, the way that works is if you make a 32
or higher, it's a $10,000 a year max. If you make a 32 or lower from your county, then it's a partial amount. So this would allow students then to get the full $10,000 amount if they qualified for both. So that's what this bill does in the first part. The second part then, as I said before, it takes away some reporting requirements that are in elsewhere. So if you look at the bottom in section for that code section of 219, all that demographic data is recorded in 216. So it's already being reported and housed at ADHE. I appreciate a good vote.

let me explain this in its entirety. The Academic Challenge Scholarship existed before the lottery ever funded it. My class of 2009 was the last one to qualify for that scholarship. So 12 years later, I'm proud to say anybody who qualified under that has now graduated from college or quit trying. And so we need then to repeal the old language because now we have the lottery-funded scholarship. It has its own section of law and everything else.
So this is not getting rid of the entire academic challenge. This is the original program that was still on the books. We're just

Thank you, Mr. President. Colleagues, if you'll recall, two years ago, this was my bill that created the concurrent credit challenge scholarship. We had originally put in the bill that in order to maintain eligibility, you would have to get a C or better. Higher ed has asked us to come back and revise that. With academic challenge regularly, in your sophomore, junior, or senior year of college, you have to maintain a 2.5 GPA. They don't go by a strict letter grade. They go by an overall GPA. We're just asking that to be changed from a C letter grade to a 2.5 GPA in the language. I appreciate a good vote. Any questions?

Can you explain that? Why on a national standard
Speaker 130
33:41
you would change that vital and needed part of our republic?
Speaker 111

I have no rebuttal to that, Senator. Senator Caldwell. I have a problem with someone that's under 30 years old saying, I can't hear you. I'm sorry, what was that, Senator? They don't look like me. What'd you

Thank you, Mr. President. This bill does two or three simple things. Number one, it establishes the county clerk as the one that will determine that the signatures on the petition are actually original signatures. It removes the option of being able to simply submit a letter to the quorum court in order to convert a fire district, it keeps in place that you have to have what was currently in law 10% or more of the total qualified electors. And also, per the clerk's request, it removed the word certified and inserted the word return.
This is a bill that is supported by the county clerks and also by the county judges, and I'll be glad to answer any questions. Senator Desvane, recognize. Thank you. I'm sorry. Sorry,
Senator Jonathan Dismang
Unverified
40:46
I went to catch you earlier, and then we got sidetracked there for a second. The only thing I saw that it changed that I had a little question on was the public hearing. It moved it until after certification. So there is no public hearing about the drawing of the lines prior to them actually being drawn. Did I read that wrong, or is that pretty well how it's written?
Senator Kim Hammer
Unverified
41:06
If I heard your question right, let me tell you what the bill does. So if a fire department wants to convert, they have to go out and get, which was the already current existing 10%. They submit that petition to the quorum court, and within 60 days, the quorum court shall call for a public hearing so that the public can have input on the decision, and then the quorum court awards it after that. Okay. I think I read
Speaker 181
41:33
it differently, but I'm sure that's the place that I was scanning on my phone.
Senator Gary Stubblefield
Unverified
41:40
Senator Stubblefield. Thank you, Governor. Senator Hammer, who authenticated these signatures before this bill?
Senator Kim Hammer
Unverified
41:50
If I heard your question right, it used to be that the fire board could just submit a letter to the quorum court. But what this is doing is removing that option and restoring it to what it was originally, which was they have to get 10 percent of the electorate from within that fire district petition to get 10 percent of those,
then submit it to the county, to the quorum
Senator Gary Stubblefield

court to be considered. So the clerk
Speaker 177
42:20
would be the one that authenticated the

We have positions that we need to fill that are temporary positions. And right now, we need people that have specialized education or have worked in
this field for a while. And so all this does is say, if you've got a member that is retired but hasn't retired over 180 days to let them come back to work on a temporary basis. It does not cost anyone anything. They don't get any more benefits. There is an actuarial study here to attest to that. While they're here, they have to pay into the system, but they don't get any more benefits from that system, and it's for temporary session workers only.
