Senate memorial resolution three by Senator Leding tree member deck Harlan into recognizes contributions to the state of Arkansas. Senator Leding you're recognized. Thank you Mr president. Colleagues Chief Doug Harlan was a firefighter here in Little Rock he retired a few years ago of the leftist on December tenth of twenty twenty I learned just this morning that actually through the gentleman who work here in the Senate to keep this chamber secure served with chief Harlan Mr Lowe Mr Floyd Mr Bowers those are the three I know of but today we also here in the east gallery have members of his family and some friends of his including his wife of forty one years Renee. His son captain Jake apartment in the bin fire department his wife Madison their three children Bentley Payton and violet and captain bill what's in Little Rock fire department who served with Chief Harlon and so I just ask for your presence as we read through this resolution. Whereas Mr Brian Douglas Doug Harlan was born in Little Rock Arkansas on July tenth nineteen fifty six to Fred Willard and Sonia Mildred Harlan and died on December tenth twenty twenty and whereas after graduating from Sheridan high school in nineteen seventy five Doug spent his career in service to the citizens of the State retiring as a battalion chief after thirty one years with the Little Rock fire department rising through the ranks of the Department first as a firefighter from nineteen eighty three to nineteen ninety that is fire apparatus engineer from nineteen ninety to nineteen ninety four that is fire captain from nineteen ninety four to two thousand and retiring after nearly fourteen years as battalion chief in two thousand fourteen. Whereas Chief Harlan to exceptional service was documented throughout his career by administrators of the Department his selection to attend leadership trainings and his recommendation for multiple promotion promotions and whereas after barely one year on the job Chief Harlem is recognized for his to ROIC efforts in saving a four year old girl from a burning second story apartment. And whereas chief Harlan service included serving as acting battalion chief at what was then known as the Little Rock national airport during the terrorist attacks of September eleventh two thousand one and where as chief Carl is remembered by colleagues friends and family as a larger than life personality living up to his nickname of two tall a towering the con man who exuded his love of life and care for others his humor and his devotion to his wife children and grandchildren and where as chief Harlan was a dedicated sportsmen and steward of the Arkansas outdoors is consummate sportsmanship extending to hunting for deer duck and Turkey across the state is appreciation for the natural environment by fishing for bass and crappie across Arkansas and his love for golfing with family and friends to join him and whereas in retirement that was a loving grandfather who had only begun to enjoy spending time on lake Ouachita with his three grandchildren Bentley Payton inviolate fishing and swimming in the beautiful waters and the out watch Tom mountains and whereas Douglas behind his wife of forty one years Rene Simpson Harlan children Jacob and Carol Harlan brother Gary Quinlan and numerous loved ones family friends and co workers who left with and benefited from the joy of knowing Chief Harlan now therefore be it resolved by the Senate of the ninety third General Assembly of the State of Arkansas that the Senate remember Doug Harlan for his service and dedication to the city of little rock and the state of Arkansas and extend sincere condolences to the family be it further resolved that upon adoption a copy of this resolution be provided to the family by the Secretary of State. Senate bill three oh seven by Senator Hendren concerning the penalties for the offence of fleeing in a vehicle or conveyance you're recognized. The Committee president members this is state police building had a significant increase in people attempting to flee from police officers of the last three four years and this is an attempt to rectify that. To give an example the number has has increased from two hundred ninety six in two thousand seventeen to four hundred and fifty in two thousand twenty the number that have involved injuries is nineteen now and two thousand twenty so over one month we're having somebody hurt because of people attempting to flee so it's become more more of a problem this bill does two three things the first thing it does is anybody who's attempting to flee right now it is a misdemeanor the original bill change that to sell only after some discussions or negotiations we change that leave a misdemeanor but do make it a minimum of thirty days in jail if they are speeding and it's clearly not tempt the fever of fully verses somebody just trying to look for a safe place there's confusion the other thing it does is somebody who is using extreme indifference to the value of human life which we've had some of these go over a hundred forty miles an hour it makes a from a Class D. to a Class C. felony and then if there's fear serious injury it changes the. From a Class C. to a Class D. felony so again I don't think there's any opposition after we went to committee be happy to answer any questions all right senator Chesterfield and then senator garner you're recognized for a question yes thank you madam chair Senator Hendren the only thing that puzzles me is line twenty five. Which says that a person convicted under this subdivision under subdivision the one a of this section shall serve a minimum of two days in jail but then right under that C. C. as a person convicted they're different subdivisions but why that different other same subdivision why the difference in two days to thirty days is that yes ma'am the the difference is the in in category C. it is clear that they're speeding in a breaking under additional laws as they're trying to flee as opposed to just refusing to yield but not necessarily first pull over but not necessarily an unsafe for speeding manner. All right thank you senator garner you're recognized for a question thank you managers so my issue with this is. If you have a bunch of eighteen year old kids at a college party and the cops come I think we can all know what's going to happen within two seconds that they're all going to do to run away now I'm not saying that that's a great thing to happen but under this those kids if they spoke to speed limit one mile per hour over would all be serving thirty days in jail is that correct. I don't think so now they're in their vehicles and a police officer turned on his lights and they refused to pull over the intentional. This is being by means of a vehicle or conveyance yeah I member read a definition for fully and I don't think it's necessarily the cops are behind you with your lights on it if that's the case I'll be fine without the just if there's a lawful could be arrested situation and then they laugh then later on they could have that put on I don't think it's quite what the blue light wine is consideration. Am I misreading that well I mean again it was clear to the defense attorneys when they when they negotiate this compromise this is talking about clean by means of a vehicle or conveyance or a motorcycle or something is not talking about running from a party. Thank you members I guess I should start off by thanking many of you for being co sponsors of this bill and I thank you for that as well as several folks who are co sponsors in the in the house but this bill has come out of three years of work that was the brain child as much as anybody else of our Kansans for the arts and it's appealing to me and appealing to many others in that they have that research the creative energy and the knowledge to help us understand our which is one thing that representative Les Warren and I I came to understand is that rather than chasing the next big company which has its place to be are economic drivers there is such a thing that I first learned about in two thousand five when I read the first book by Richard Florida that placed based economic development is so possible through the arts and that every place in this state where we don't a mansion anything because we so narrowly define what we mean by economic development and we so narrowly a match and what is meant by the arts and so what C. R. Kansas for the artists helped us to do is look at what's possible look at what can be done so this build is the result of years of those three years of work with them and with the legislative caucus as well what it does is during the interim we will be a part of what they wanted to call the arts and boot camp and for the rest of us is like any other kind of working group but they really wanted to put a flavor on it to let people know this is something different from what we normally do to take the arts and look at it every arts district in the state and there are eight of them. So we can creatively look at and imagine and discover what's there but we never imagined seeing it like this before and help people create economic opportunity right there where they all are and not have to chase something else all the time and have the possibility of our our for a kids and grandkids being a part of growing something they will want to remain here and help our state have a better quality of life and economic development model that is sustainable that is embedded. And that's what this bill is going to do by looking at the arts industries I've been looking at all of the businesses that can be created by those industries and it will fundamentally change the way we look at the arts I'm fundamentally give us a way to think about economic opportunity and economic development away we have never imagined I'd done before. So that's the quick thing to say about it and the quick summary and I will entertain any questions that you might have. Senate bill four seventy three by Senator Irvin to establish a state park restaurant private club permit and authorize the state park restaurant private harm a club permit holder to serve alcoholic beverages. Thanks members what this bill does it creates a new private club permit for state park operations which is based on the current restaurant private club permit after the initial review of application goes to the secretary of the Arkansas department of parks heritage and tourism it also still goes through the ABC process it also does require local control through a county approval by ordinance and the reason for this bill is at to allow them to incorporate and have a streamlined process for their permitting process and for their accounting processes and and just to provide the I have a consistent bility throughout the state. Looking at this bill what is troubling to me is when you establish a private club on public property there's no provision in here to make sure that there's not discrimination against up against phones and by definition a private club can lead in whomever it chooses but is there something in here that says you on federal land or state land that you cannot discriminate against folks because of race gender disability. I don't. Now this follows the same current process that you would do through ABC so. And I don't think I can necessarily answer your question I mean it it's basically you know to streamline the accounting processes within the State Parks so there's already have the ability to have private clubs yes yes they already have their serve and that's another part of the bill there some that do you have a private club license permit already so so what is this allowing the it's just it's just basically to streamline the process because of there are some it there's timing issues there's there's all kinds of different things that allows for them this is the same processor ABC as it is and it and it requires that local control and that approval but it it would allow for those to be on a certain time frame so that they can streamline their accounting processes well there's there's not it's going to say is gonna follow the same A. B. C. permitting so I mean there's not going to be any discrimination all right now if you have a private club you get to determine your membership. And if you determine your membership and you choose not to say for instance allow women to come in a woman is excluded I mean that's why you got a private but this private institution is on state lands and so that's why I was wondering as I read the bill we're is a provision that it the ease on state property that discrimination cannot take place based on gender or race or disability that was that's why I was concerned about this one which is a little different than your regular. A private class. Well I know I understand but I mean that definitely can be addressed and rules of how we deal with that but there's no I've never been discriminated against a woman trying to get a drink at a private club permit at chili's so I'm with the assistance of his or different right that's why I'm asking the questions of the state land is there a provision that you cannot discriminate I would like a private club can we'll yeah the discipline is on state land that makes it to me a little bit different Sturch totally understand not in favor of discriminating against anybody so. Yes they in the nonprofit that part of the languages is absolutely what already exists with the current ABC process so we we didn't change any of that. And it would have to be approval by the council and by ordinance. That again would you would have to be there has to be an approval by the council by ordinance not by the judges don't get to vote on it but the county by the court to do it it would be by the quorum court who are representative of the people it would have to be by ordinance or we discuss circumvent the law on private clubs with this no I don't believe I don't believe to get a private club right by the people. Senator Teague did little work on that about the private private club in terms of the dry counties I also saw that to the fee on here's fifteen hundred dollars if I'm not mistaken but if it is in a dry county that there's an extra fee of fifty nine dollars is that correct have to be approved by the done matter whether it's a wake county or a dry county it has to be approved by the council by ordinance right but I was stating that in the bill it states there's a fifteen hundred dollars the if you are in a in a county that voted itself dry at any point there is an extra fifteen hundred dollars see in here. Well again we try to make sure that we we lowered the different fees said that because these are state parks and tourism is a huge part of our industry and they have been hurt had three covid we tried to we try to make its where it's it's a little bit easier for our state parks but I mean again we follow the same process so I would need to get back with you on the fees and the amount okay were referring to is actually Page three and four at the bottom of three top four and that answers it I think that answers it pretty quick staff cation for state park restaurants private clubs should be submitted with the fifteen hundred dollar fee right in an area in which the sale of alcoholic beverages has not been authorized by local option the application for state park club shall be submitted to the division and accompanied by an additional application fee of one thousand five hundred dollars shall. In in this place like Senator Teague this state or the dry County I think that's what that's referring to right there's an extra fifteen hundred okay I think and and that which we try to make sure that was consistent you could you. Office could you tell me how it is that those other state parks are already doing this. As you mentioned I I I. They went through the permitting process I mean they went through the permitting process and was able to be approved through the current process I I again you know this make sure that there's and it's only on king on site consumption you can't sell and leave or it's only on the site of the property so you know we try to be very very strict with this that try to give them the ability to have more of a streamlined process through the permit but we didn't want to water down any of the permitting process. Last last part of the question you're recognized for mischief so who is this I mean is it well specific Rask from the department or from a particular Parker tourism is really important to me I mean and I think it should be for everybody in our state it's a huge driver and so part of the issues are consistencies you know for state parks and also trying to be efficient and effective but being efficient within agencies and them going through this you know process that we have is a is a little inefficient for them and so I started you know we kind of started talking about it and then I thought well why don't we allow for process to where that we can streamline it for state parks at the date but we don't want anything down but we can have a process for them to try to streamline it for them for their internal accounting purposes. That and state parks supports the bill because it does they are focusing on kind of like the dynamics pricing Bill it it kind of all that Senator Dismang Kerry it kind of falls in line with what they're trying to do to update their procedures in order to be more effective with taxpayers dollars because at the end of the day they're responsible for their books and if you're trying to get them to operate more like a business to be effective with taxpayer dollars then we need to give them the tools to do that and that's what we're trying to do. I know I missed this in the committee meeting us I heard most of discussion about this bill I know what I did not realize in I am trying to understand now because I'm into these restaurants in these bars and given the business there at all I did was I was there for a meeting but I just want to do what you do now so for example that you do you is private is there is a price to close. Yes yes yes they have they have to go through the private club permitting process so I wanted to what I'm trying to figure out if it's private if I just wanted to drive up to packaging and get a drink or whatever. Do I need to be a member or something I'm not guess I'm not getting what private needs exactly. Senator Elliot I mean I I I don't know if I can answer that question because of I can only speak to my experience with that I mean you know it's similar to like if you're in Conway Arkansas you have a lot of private performance for restaurants right and so are state parks have to do that same process what I'm trying to do is just create a new state park permit I would still have to go through the ABC that an orders that allows them to have more of a streamlined process and so you know I a it needs to be on site consumption they can't sell you know as six pack or whatever it's only for a drink per consumption not person because a lot of people at the end they cannot advertise you know for alcohol the issue is when you have people that come in from other states they go to any of our state parks there I think there should be some consistency so they don't they come and they have an expectation and then they may not understand why they can't order a drink there are not and so there's there's then becomes a concern an inconsistency and that sometimes will drive tourism away from our state so you know or you may have a golf course that's attached like I think late two gray house at a golf course that's attached and said this would allow them not just to have that permit at their at their restaurant B. L. also be able to sell you know an alcoholic beverage on the golf course that's attached to the resort so again we're just trying to look at the processes within that agency and what they're responsible for and what they're responsible for is really what we ask our businesses to be good business progresses will we have to give them the tools I think to try to give them the tools to to run those state parks and technically question that I was just trying to get information for myself so I. I would understand I did not realize because I've been doing everyone of those establishments that you mention and maybe that's what I what I don't know but I went. I never realized I just didn't realize it was a what it means that they are private club in fact I didn't know their private club yeah this is just down station to me to help me understand that I mean now I will say that if if we have something within our permitting process that would be just over all right that would be discriminatory towards somebody I think we need to change that like my bill doesn't do that but if if there is you know a discriminatory and you know within the permitting process whether it's the current one that exist for this one then that would need to be addressed in my perspective because I've not had that same experience so and I would be a separate bill that. Very much supportive of that and of making sure that somebody's not denied and of course unless they're you know under twenty one. You had to buy a membership to a private club to. To be a member of that club to get in the right direction so are you can make in this are are you changing the relations so I I know what you're talking about and and it I I think that may have changed at some point because I know that I am no longer have to quote by membership in order to I just have to fill out a name and the name and phone number okay so I but yes no that's we don't want people to have to by members you know at at the state parks for sure okay one thing I think that's changed reserve changed because I'd just had that experience the other day. The rate review of a follow up question yes in center I'm sorry the further I read the more. Page six of the bill. Talks about and I'm sorry hope you can hear me. Page six of the bill states that there be a ten percent tax levied right that is existing that's the existing on these current situations so this would include a ten percent tax. Correct there is no need to that is not new that is what I'm saying is existing within the permit process those taxes currently exists we're just transferring whatever is existing and that the current permitting process would then also apply to determining what I'm what I'm reading says in addition there's liberty supplemental tax of ten percent upon the gross proceeds derived by the state park restaurant private club from the charges to members for the preparation serving of mixed drinks the filing and serving beer and wine drawn from the private stocks of the members and then underneath that it says in addition to the tax levied there's a supplemental tax of four percent levied on the gross proceeds or gross receipts derived the state park restaurant private club from the charges to members for the same preparation so that's that's current tax statute that's existing for alcohol that would then also apply to this new process we're not trying to create a tax exemption in other words for them they have to pay the same taxes that everybody else thank you yeah. But it is a kind of a strange set up but I want to clarify that this is not anything that anyway discriminatory and certainly anything in this state park would be prohibited from any kind of discrimination under other laws of. Service be commended for. Trying to help get the the folk center and other areas other parks our state at least be on an even keel and to set up a understandable process we used to joke and some of these private clubs the first one I ever went in like this was in Northwest Arkansas and it was literally act the joke was you put a mere under your nose to clogged up and you're eligible to be a member I ask that let's not try to take this particular occasion to. try to re write recall defy our rather strange alcohol laws in Arkansas which have been evolving since the repeal of prohibition in nineteen thirty three but but let our are parts of put a facility and that when a visitor visits of a state park and Senator just feel left take you as my guest Petty gene will go up to my other large and if you want a little tidy I'll be glad to vote for you but it's it's something that we ought to do and take care take care of Of the of this particular situation that Senator was trying to clean up we listen to the details of the bill in city county local I think it's a good bill I appreciate you voting for it thank you. But what is troubling is when not being honest with the folks who really oppose it in their neighborhoods. And so you have you have counties that have said we do not want. Alcohol served in our particular County. And I think they ought to have a right under local control to do that. Now we have already voted to have liquor delivered to your house. And that's fine. We voted several other things having to do with alcohol which is just fine. But we begin to manipulate so much that we forget that there are citizens who would like some local control over what happens in their own community and I'm glad to know you know the dean of history of the chamber of the honorable mark Johnson has told me that this is been around since prohibition and that may very well be but I would hate to think that he would be able to escort me into paging and I couldn't get in there by myself. See that's why I have a problem. I've been escorted into many places but I'd like to be able to walk in there on my own. And if I cannot do that I have a distinct problem with this bill what the voted up or down I understand both sides of the issue but let's stop playing games I stopped calling these things private clubs if anybody can walk in and get a drink cut it out. Just say we're going to establish some parks and in these parts we're going to have some clubs and we will be able to have a good time and drink a little bit. She amended it for us to say that the local quorum court would decide whether they could get a permit or not the local quorum court I used to be on the quorum court answers to the voters and will answer to the local restaurants of who also may or may not have. may or may not be a private club or be able to be a private club so of I don't drink I have no whether people come to some of these places and dry counties and expect to drink or not as tourists are offered no opinion but it cannot happen except the local quorum court voted so so the are you still have local control of which was very important to our committee that's of you do what you want. I believe circling back is anybody's want to speak against this bill. Senator Rapert you're recognized. Members until Senator Irvin I'm I'm just being consistent on where I'm at on some of these issues. I think it's a public policy issue. I mean. Why is it that we need the State Parks. To get in competition with businesses now again. I said this the other day on an issue I mean how many more businesses and how many more things. Is Arkansas going to start competing with everybody else. I mean the next thing you know we're gonna open barbecue restaurant. I mean that seriously were read. I just I just don't think that we have a financial crisis on any public park in Arkansas not being able to sell blues. Especially not make mixed drinks. So what my my situation is is that again and maybe I've maybe I've talked to too many people with their homes ravaged by people of addicted to alcohol and alcohol abuse maybe maybe that's what it is and if it is like the other day I guess Senator Chesterfield I get a little closer closer all the time. It's scary. But but I just say this isn't it is nothing at all against what Senator Irvin in her personnel what bush's down the bill. But the policy of it is where I just wanna pause a little bit here why do we continue to do this the next thing you know it's going to be just name it. State parks can do a better job selling tires I mean what are we going to do I just wants to stop expanding all this stuff and I think that there's a real issue in the dry counties. People voted them that way for purpose there is a there is a process in place in the state of Arkansas if you want to drink and you want your county to be with the go out and raise the signatures and get you a petition have your vote and you've got will control and I'd ask members to not vote for this bill thank. Thank you thank you members I just want to be able to close for this bill to say that tourism is one of our number one industry is in the State of Arkansas and we have fifty two state parks in the State Parks and their presence actually generates revenue and business for the local private businesses that are around the State Parks it's important you have to understand what these state parks are not competing against her businesses are actually helping our businesses in that area because they're driving tourism how many tourism probably is been driven because crystal bridges up in northwest Arkansas you don't think for one second that's helping your local gas station sell gas or your local restaurants sell food or or whatever they sell beverages there I'm sure to Petty gene that tribes tourism to that area not magazine it drives tourism to that area our state parks are an important part of our tourism landscape they're not there to try to compete or put people out of business they're there to try to help supplement those businesses and a lot of the restaurants are actually there and run by a private enterprises they work with private industries and and people to run and manage those those restaurants and so you know when you have that ability for a restaurant to be able to work with a private vendor then you're helping the private industry you're not taking anything away from them. Restaurant sales are four point eight million dollars in state parks we say part total visitation is seven point five million dollars per year seven point five million people come to our state parks every year that's seven point five million people coming into the state of Arkansas participating in creating the fact that tourism is one of the number one industries in the state of Arkansas. We have to have some consistency we have to be efficient with state tax payers dollars that's what we're doing and again this is a local control issue which has been put into the bill to require county ordinances to approve yes or no that is perfectly acceptable and we do have state parks that have current permit within dry counties and I think that permitting process is established for a good reason you can live in a dry county but it's okay for a restaurant to be able to sell alcohol gives those people that balance if if they so choose which is what they've done in Faulkner County and many of your businesses in Faulkner county where you reside in represent are beneficiaries of the permit process Senator Rapert so I appreciate those abilities for those businesses to be able to make some money as well so again I just would I underline the fact that this streamlines the permit processes by eliminating these needs and it provides the State Parks provides a very important service to the public and to that I area where it resides this is a narrow and limited passed it aligns operations under the state park it streamlines the accounting processes and it standardizes these approaches to the requirements and it enables our state parks to be more effective and efficient with taxpayer dollars as our operating those and then use at State Parks so I would appreciate a good vote thank you. They don't want that mug shot out because it affects our ability to get a job get housing that sort of thing the reach out to this website to ask for the mugshot to be taken down and the website will essentially say you have to pay us five hundred dollars in order for us to take your mug shot down with this is effectively extortion. and it's just a bad bad practice so what this bill does is if you are website that accepts request requires payment in order to take your mug shot down then you have to do three things one is put your contact information on the website the second is if someone emails your contacts you asking them ask you to read to remove their mugshot then you have to provide a receipt so they can't just linger forever and the third thing is once you receive the request for the mugshot to be taken down that has to be removed within five business days the police chiefs in the state police are both supportive of this the press association is okay with it because again it doesn't affect any legitimate media doesn't affect law enforcement or even a neighborhood association that wants to post some alert about someone in the neighborhood or anything like that it's just these really extortion based websites other states like Georgia South Carolina Wyoming we're gonna pass similar legislation so that's what the bill does I'd be happy to take any questions.
