the following measure from the regular session of the 93rd general assembly house concurrent resolution 1013 sincerely asa hutchinson march 22nd 2021 dear president hickey speaker shepherd and members of the general assembly pertinent to article 6 section 15 of the arkansas constitution i inform you today that i vetoed senate bill 301 the bill is an infringement on the executive's power to enforce the law and it is unwise and unconstitutional precedent for the future if the the rationale of Senate Bill 301 is accepted, then it is equivalent to giving the General
Assembly veto power over the executive branch in the faithful execution of the laws. The General Assembly defines a law and penalties, but the legislative branch is not constitutionally empowered to change after the fact how a law enforcement is carried out. During the COVID-19 pandemic, the Arkansas Department of Health adopted and enforced directives to mitigate and prevent the spread of a contagious and deadly disease. The department acted within it the authority granted to it by the General Assembly the alcohol beverage control took enforcement actions based on decades old health and safety law and
policy the actions by the Department of Health and alcohol beverage control were consistent with legislative authority authorization and thus far have with withstood two legal challenges brought by members of the General Assembly and permittees of the alcohol beverage control additionally every person or business assessed with a fine had the opportunity to avail themselves of of administrative and judicial appeal without paying the fee or hiring an attorney. The only message sent by this bill is that the rule of law does not matter. It is an affront to the citizens who diligently followed health and safety directives
to protect themselves and fellow Arkansans. During the legislative session, two bills have gone into law that were filed in response to the executive action taken during the pandemic. Senate Bill 254, altering the methods by which the Arkansas Department of Health and Alcoholic Beverage Control may enforce directives, went into law without my signature. I signed Senate Bill 379, a bill that makes sweeping changes to the implementation of the Emergency Services Act during a public health emergency. While I may disagree with aspects of these bills, they are not appropriate exercise of legislative power.
It is in contrast to Senate Bill 301, which directs a refund of penalties assessed and violates the separation of powers between the legislative and executive branches of government. I look forward to continuing to work with the legislative branch as we navigate this unprecedented time.

youth of Arkansas. Along with our other guests here today, we have several 4-H members up here in the audience. Kids, wave at us. We also have two volunteer 4-H leaders up there, and we thank you for your service to our kids. The roots
of the 4-H program began back in 1908 in my home county with the White County Corn and Cotton Club. 65 youth formed a group as a way to learn the latest
in agriculture technology. This club eventually became the Arkansas 4-H program and it now serves thousands of young people across the state. 4-H is the premier youth development program conducted by the U of A Cooperative Extension Service. Through various activities, young people gain knowledge and enhance life skills. These skills enable them to become positive, productive, capable, and compassionate members of society. 4-H provides the opportunity to learn civic and leadership skills,
and it prepares youth to become the leaders of tomorrow. During the 2019 legislative session, there was a 4-H day here at the Capitol. Several hundred youth from all 75 counties came to the capitol that day and we ran a resolution declaring that day the 4-H day at the capitol. Unfortunately as a result of COVID-19 a 4-H day could not be scheduled this year but it's important that we continue to recognize and celebrate the contributions of the program. members here also are homeschool students they're members of the homeschool 4-h club in White County, which I believe might be the biggest 4-H club in White County or one of the biggest. In our state, families are
empowered to direct the education of their children
by choosing the best educational environment for their child's specific needs, whether that be public school, private school, or home school. Homeschooling was officially recognized in Arkansas by Act 40 of 1985, after many years of families advocating to have this opportunity the number of homeschool students has grown over the years and today we have approximately 26 000 homeschooled students in arkansas if we wanted to look at
it in terms of school districts the number of homeschool students would be the biggest school district
in arkansas the effects of covet 19 have increased the number of families
who have chosen to home school the national home education research institute estimates a 10 percent increase nationally. The Arkansas Department of Education reports a 17 percent increase in our state this school year. With all of these new homeschooled students we just want to let families know that they're supported in the decisions they've made. There are many resources available that will provide the assistance they need to guarantee a quality education for their children.
Much like 4-H Day at the Capitol in the 2019 session there was a homeschool day at the Capitol, with several hundred students visiting here from every one of our districts. Unfortunately, this year, again, as a result of COVID-19, there couldn't be a homeschool day scheduled, but it's important that we still recognize the opportunity Arkansas families have to homeschool and to offer support and encouragement to all the new families who have recently made that choice. Choosing the best educational environment for the student,
whether that be public school, private school, or homeschool, leads to better outcomes for students and those better outcomes lead to responsible young men and women who will be the future leaders of a strong state. In Arkansas, capital murder trials are split into two stages, the guilty phase and the sentencing phase. Recently, the Arkansas Supreme Court found that under our current law, if a mistrial occurs in the sentencing phase, even if it doesn't affect the guilty phase, an entire new trial is necessary. And so in a dissenting opinion, it was suggested that the General Assembly fix this problem, and so that's what this bill does. If a mistrial occurs in the sentencing stage, this bill would permit the guilty verdict to remain and not require a new trial for the entire proceeding, but just affects the sentencing proceeding.
The value of this is that it would protect the defendant's right to a fair trial without invalidating the work the jury did on the guilty phase. It shields against unnecessary delays and a waste of judicial resources, and it helps ensure the public sees that the judicial system is fair. I'm happy to take any questions if there are any. If a person elects to go on drop at the end of 28 years, their benefit stops accruing at that time. That is, pay raises and service after the person goes on drop do not add to their retirement benefit. When the person eventually retires, they receive the balance of the drop account, usually paid as a lump sum. Also, 100% of their frozen monthly benefit

There are a lot of people who will likely, there are not a lot of people who will likely choose to stay this long, but there are some who are not ready to quit and are valuable employees. After the 2019 general session, Senator Sample and I worked along with the other committee members for retirement on a plan to go out across the state and connect with members of the various retirement systems. Many of you that were there are here today. One common theme in every city we visited was APERS members feeling as though they did not have representation or a good way to ascertain information or get questions answered.
The more we talked, the more legislators talked, and this idea was born. The four new members that we're proposing to include on the board will cover a wide cross-section of APERS members. The four appointments are as follows. one retired former state employee appointed by the executive director of the Arkansas State Employee Association, one retired former county employee appointed by the executive director of the Association of Arkansas Counties,
one retired former municipal employee appointed by the executive director of the Arkansas Municipal League, and then lastly, one retired certified law enforcement officer appointed by the President Pro Tem of the Senate and the Speaker of the House of Representatives. There is no direct cost to a system due to board composition and therefore due to the passage of this bill. I would appreciate a good vote. Representative Warren has

Thank you, Mr. Speaker. Colleagues, there have been several good bills come out of the Retirement Committee this session, and I have been proud to vote for them and lend my support to them. This bill, however, is not one of those. This bill gives private lobbying groups permanent seats on the APERS board. It gives private lobbying groups a fiduciary seat on a state board that manages $10 billion
dollars in assets. I'm not even sure that this is constitutional. To me, this looks like Plant Board 2.0. These private lobbying groups are not elected. They are not accountable to the voters. This bill is not a small policy tweak. This adds four seats to the APERS board. There are only nine seats in total in the first place. The purported reason that this bill is necessary is because APERS members felt like they were not receiving good enough communication or having questions answered.
If the problem is communication, we should solve that problem by improving communication. That's easy. There can be newsletters, teletown halls, emails, texts, events in person around the state, better outreach. Communication can be solved without giving seats to private lobbying groups. Yesterday, we voted to remove the ability of public employees to collectively bargain. But if we pass this bill, that measure would be kind of pointless.
us. Why would you need to collectively bargain when you could put folks directly on the board that would determine retirement benefits? It's sort of like negotiating with yourself. This bill could be done in a better way. I believe that we could add, instead of adding private lobbying groups, we could give the legislature a voice instead. We could give appointments to the auditor, to the treasurer, to the lieutenant governor, people who are elected, to people who are accountable to the voters.
So I asked you and join me to voting no against this bill because it gives private lobbying groups a fiduciary seat on a state board that manages $10 billion. Thank you. Representative

ALC Executive Subcommittee has voted to hire a consultant and study the situation and get it right before we bring legislation forward to the body on what we should do with that insurance to make sure that we can keep all the benefits possible to our public employees, our teachers, and our retirees of the state.

So this bill is an agency bill brought to me by the Office of Internal Audit, which is part of the Office of Inspector General. They were moved several years back from DF&A over to the internal audit from DF&A over to the over to OIG and they have statute in one section of the code section 19 currently.
So what we're doing is striking all language that's in Section 19 of the bill, and we're moving it to its own new section under Title 25. So that's the first thing that the bill does. The second thing is it kind of expands on what their—and gives more detail about what their job functions and duties were. You'll notice in the bill that there was an amendment to the bill. That amendment was given to us by a legislative audit. But legislative audit was very clear to me that they did not want me to say that they were in favor of the bill or they were against the bill.
I guess they're neutral on the bill, but that was their amendment, their requested amendment that we put on it. A couple of new things that this or changes that this bill does do is it does grant internal audit subpoena power, which they have not had in the past. That was the biggest contention, I think, of the bill was allowing them to do that. some of the questions that we got is why do you need that well in the past they had no way to compel someone especially like vendors that aren't part or employees of the state
it compelled them to provide documentation so this would allow them a way to actually compel them to provide that information I've also gotten a question well why can't you just let leg audit do the subpoena well but to my understanding leg audit can't request a subpoena for work they're not doing and they don't want to do. They're two separate things. This is not an area that leg audit gets into with what internal audit does. One other thing that this bill does is last session we passed, I believe it was Senator Dismang's bill, I know it was because I've spoken with him
about it, but Senator Dismang's bill that a majority of us voted on to provide like a process review for the Department of Transportation and that was to be done through the Office of Internal audit. They only have seven employees, and so what they're trying to do is either they're going to have to have other employees or figure out a way to actually do the audit with the number of employees they have. So that report was due to us next year, well this year actually. So what we've
done is extended it out two more years to give them time to get through a fiscal cycle, see if they can get some more employees hired, what exactly it is we need to do to get that review done. Representative Fite, you're recognized to explain the bill. Thank you, Mr. Speaker. Colleagues, many of you have heard a lot about this bill over the last several weeks. It's a good bill, and it will move us forward in our response efforts to child abuse in this state. Let me give you a little bit of history. Children's Advocacy Centers were established in Arkansas over 25 years ago. They were under the auspices of UAMS and were then placed under the UAMS Commission on Child Abuse, Rape, and Domestic Violence.
In most other states, Children's Advocacy Centers, from now on I'm going to say CACs, are independent. Dr. Cam Patterson from UAMS does not oppose moving us out from under their auspices. This will put us in line with national standards, with the national CAC director supporting this bill, and by the way, he's an Arkansas native. Right now, only Arkansas and Oklahoma are under a commission of some sort, and Oklahoma is moving away from this model as well.
the shortened suite of house bill 1499 is that it will strengthen and enhance what we are currently able to provide as far as services and response time for the children who so desperately need it some have asked why we need this legislation if it's not broken don't fix it for those counties who are doing things well they will not see much of a change at all otherwise my answer to that question is easy. I believe our children, the ones who have experienced the truly worst part
of this dark world, deserve the absolute best approach to treatment, along with every available resource that will help them heal. Currently, child abuse response in Arkansas does not meet the national standards for best practice. We should constantly be seeking improvement in this field, but the current model and protocols have not changed for 14 years. We can do better. We must do better, and this legislation will help us do that. This is a transformative plan for
child abuse in Arkansas. The current multidisciplinary team model, or MDT, facilitated by the Arkansas Commission on Child Abuse, Rape, and Domestic Violence, focuses on case review with a strong emphasis on the investigation. While this is certainly an important aspect, the majority of cases, unfortunately, never make it to prosecution. House Bill 1499 would place an equal importance on quality victim support services for children.
In fact, with a CAC MDT model, all child victims can have access to the recovery services they deserve. We want a stronger approach to child abuse in our state, in every county, from access to quality services and resources to quality investigations and prosecution. This bill does that. Our CACs and MDT have been under UAMS at the top, been under the Commission of Child Abuse, Rape, Domestic Violence, and we want to move away from that.
This is not a good model. UAMS does not oppose this move. And our CACs will now be under DF&A. Local MDTs will absolutely be involved in decision-making for their team's local response, including choosing the coordinator, creating the coordinator job description, identifying gaps in services, and creating team goals. Also, this bill creates an MDT oversight committee made up of state-level stakeholders
from all agency partners that will assist local teams in carrying out their plans. Additionally, since the commission has provided very little oversight to the CACs, the Children's Advocacy Centers of Arkansas's board developed a compliance committee of board members, non-directors, to monitor the CACs with funding, best practices, reporting, et cetera, and they will report to the legislature. Okay, I know there's been a lot of information, so I'm going to tell you what this bill does not do.
This bill will not establish local MDTs. This bill does not move MDTs to a larger city. Each MDT will stay in the individual county. There are no regional models, and no resources will be taken away from the counties. Rural MDTs will continue, even if that county does not have a CAC physically located there. If MDTs are going well, they would see little to no change, but they will benefit from additional resources and training opportunities.
The CACs and MDTs will have state oversight through DF&A. CACs will not act as a buffer or gatekeeper between victims and prosecutors, as some have stated. Yesterday in committee, we heard a lot of testimony from a lot of people. In support of this bill, we heard from sheriffs. We heard from Major Drew with the Arkansas State Police Division of Child Abuse.
and we heard from CACs, we heard from CAC staff in support of this bill. There are 38 MDT coordinators in the state. There are 13 who have signed on as fully supporting this bill. Another seven are neutral. So despite emails and noise from the few MDTs that oppose this legislation, it's important to remember that a majority either support or are neutral on this bill.
And I would be remiss at this point if I did not thank our First Lady for all of her support that she has given through the years to the Children's Advocacy Centers of Arkansas for her support and hard work on this bill and for her being here today to show her support. So thank you, First Lady. I also thank the governor for his full support of this bill, and I will appreciate a good vote from all of you.

Thank you, Mr. Speaker. Members, as I indicated to Representative Feit on yesterday and she agreed that this is not personal, but you all should be aware of what actually this bill is about. The bill is about CACs or child-focused facilities for law enforcement, child protective services, prosecutors, medical professionals, mental health providers, and victim advocates coordinate
efforts to investigate and prosecute child abuse while holding offenders accountable for offering recovery services to these victims. So basically, this is about prosecutors being able to do their job. And I initially had a position where I thought this was a pretty good bill until the prosecutors came forth and stated that they were opposed to the bill,
and the Prosecutors Association came and said that they were opposed to it, and they offered to work with the committee here to try and make it a better bill. So with that being said, I think that we should vote no on this to show that there's a need for the persons involved in this to go back and make this a better bill because we're talking about the lives of children victims here, and this bill does not completely address that
because the prosecutors indicate that the people within their districts work real well with the persons who have this responsibility. So they're very concerned that this will not take place. today. I started out against the bill just because I didn't understand the bill. And so that's what I would like to do today is just bring some understanding. I'm a CEO, so I work off of organizational charts and schematics, and that was one of my main questions. And to me, when it looked like we were moving everything totally away. I was a little concerned with that. But then as I
heard more and did more research and understood the process of where CAC came from, how it started, the history of it, then it began to make more sense to me. As far as the prosecutors go, it's interesting that my sheriff is for it and my prosecutor is against it. So that in itself tells me there's some misunderstanding because they're both very strong, good people for children and for
our whole community. Here's where I think the misunderstanding is. And they've talked about it, But I really believe that most of these MDTs, not all, but a majority work under the prosecutors. And I really think they're concerned about losing that person who takes care of child advocacy. But my understanding is, as long as they're doing a good job, they won't lose that.
So as a CEO, that's where I go back to. That's the only place that I see that there's discrepancy, misunderstanding. It always goes back to money. You can say it's about children, and I would like to think that. But today I'm going to tell you, I think it's about money. Please vote for $14.99. Thank you. this is just a Johnny come lately bill and I will tell you all last summer and I can't remember the date we started working on several different bills but I was in these meetings and I tell has probably been going on a year ago. Representative Fyde and myself said at these meetings we try to get the prosecutors, the state police, the MDTs, the CAC folks, all these folks in the same room. We try to do that two or three times. So the emails you're getting, if you get an email from somebody, a prosecutor, whoever it might be,
that tells you that this has just started here recently and they did not know about this, that's not true. These meetings have been going on about this and trying to put this thing together, Representative Fiedt has worked extremely hard on this bill. Change is never easy, and what I mostly heard in committee was fear of change.
It's never comfortable to make a change, but sometimes it is necessary. Doing something for the same way for so long, sometimes we have to look at a new way to do it. Remember, if we are not moving forward, we are moving backwards. House Bill 1499 moves us forward as a state in our response to child abuse. you Mr. Speaker. Colleagues, it gives me no great pleasure to present this reconsideration of Senate Bill 301 to you today, but we've come to a place where the Senate passed 301, The House passed 301 with 67 votes out of this body.
The governor didn't like the bill, and so yesterday morning at 1030, I met with the governor along with Senator Dan Sullivan, and he explained that he would veto the bill because he felt like it was an infringement on executive powers or the separation of powers. But you and I both know that we requested many meetings, even special sessions last summer,
where we could come together and sit at the table to help make Arkansas feel better about some of the pandemic issues, the executive orders. Well, you know that Senate Bill 301 basically returns the fines collected during the public health emergency for a failure to comply with rules, orders, or directives. The problem with that is many, if not all, of the fines levied against our small businesses across the state were your mom-and-pop cafes and the corner markets.
markets. But to my knowledge, these overzealous public health inspectors bypassed the big box stores and focused their attention on the little guy. And so we passed this bill out of here and it landed on the governor's desk and he vetoed it. So what I'm asking you to do today is override that veto not to poke your finger in the governor's eye not to embarrass him but
to stand up for the business owners across our state they deserve better than what they got and we can remedy that and so with that I'll take questions if anyone has a question Seeing none, I would ask for
