Thirty. So what we'll do is probably take a short recess about ten minutes at that point in time and then bring our meals back in here and then we'll go back in the session will work. Up until we need to go to Regular session The other thing We have a lot of bills on the agenda some of those I've been notified this morning we will have to pass over. So there's a number of them on there there is a possibility that. We could get through this list and maybe even get to a couple of bills that are not on the agenda. So if you have a bill that did not make the agenda today there's one option to get that on to the agenda. The eighteen hour rule in other words you have to have bills to fill eighteen hours before to get it on the agenda but we can suspend that eighteen hour rule in this committee then there's a two hour rule. You can get actually get bills on there within two hours of the meeting but that rule has to be suspended on the floor of the house so that being said right now. we can suspend the rules and add Bills to the bottom of the agenda doesn't mean we'll get to those but they will be on there and there is a possibility we'll get down to that. My child deal. route relies on me now will not have me around for a long time. So she is saving for herself. In the past when she was employed she took a great deal of her earnings and put them into her able accounts and. In some years that exceeded the five thousand dollar limit well it is to do it I believe in grateful. The firm as I think you can only put in fifteen thousand a year. And the entire tire account cannot exceed a hundred thousand. So there's limits to what can be done in a given year. But this helps for which she has a year that she contributes more than five thousand. Allows her to continue to get that tax benefits as opposed to why put five thousand in this year wait till next year and put in another three thousand Sir just go ahead and put in here in the eight thousand letting it continue just grow tax free. And capture that deduction overtime. And I think is this wall said. Right now all. A person can put in money. Into legislation trust and there's there's no fifteen thousand dollar limit on that they can get their five thousand dollar deduction and carry over the access. For up to four years. Another feature of an educational trust is that money can be rolled over tax free to enable account. So all I had in my opinion what this bill is doing is allowing able account owners to do directly but they can already do indirectly I could put money into an educational trust take the deduction spreader rolled over five years or for an extra four years. A rollover to are able account. So bill I'm not I'm sure there is necessarily a. Fiscal impact on this because people can already do essentially what this bill would or would allow. But it's important to to my calendar and others to have these in to have is flexible a program for contributing money. And not having to parcel it out over time if they can build account of early. Answer the question of somebody was put in twenty thousand L.. Good they need to be able to do that. And. Then they can benefit from that contribution over time and again if you if you do the numbers. Maximum of fifteen thousand your contribution up to a hundred thousand dollars total we're not talking about somebody being able to do unlimited amounts of money into this account over a long period of time because after about six years it's fifteen thousand you're you're maxed out. And you will actually even with a four year carry forward you'll be leaving money. On the table because you will never be able to fully utilize. Those deductions in that period of time if you're making a maximum contribution. So I support this I appreciate all the state is done with able Celts. I'm a big supporter of. This bill does not change the scope cosmetology or change the cosmetology lot what cosmetology entails individuals who have commented cosmetology license will not be affected. Let me explain briefly about why this change is important. AnnaLynne McCord is a seventeen year old student at clover community community school he lives in my district. It is analyst dream she's here today by the way it is her dream to hopefully one day work and maybe one day own a hair salon. In order to do so She wants to begin her training as a shampoo assisting in a salon. I come first offer many beauty entrepreneurs. But anyway it also has the added challenge of having down syndrome this does not mean she can't provide shampooing Services and hair salon but it does mean that the current regulations make it much more difficult for her to enter the field. In fact AnnaLynne has started down a path and also don't have already by using a hobby of stitching these hands house which I brought one four yesterday just to see what she's what she's created and she sells these that way she can one day save money so she can open hair salon. I'm here today to ask you to support this bill to create opportunities for those aspiring those aspiring entrepreneurs like Anil and so many others who will he do want to ask to do not want to incur substantial that to become it took for a cosmetology school to work in a field of their choice this bill is a jobs bill it creates employment opportunities allowing others to provide simple shampooing and blow drying services without having to obtain a license gives individuals the ability to learn the trade and enter the industry. In other states do this as well that's what recognized their thirty states that exempt hair braiders from licensure. There are over a dozen states that allow shampoo or to work without a license. Arizona Minnesota Utah Virginia all out individuals who only cleans dry and styled hair to work without a license similarly to what this bill does. In the states individuals can earn a living without having to first spend thousands of dollars on unnecessary and expensive training. And blow dry bars are an emerging trend that has the ability to create many job opportunities for entrepreneurs across Arkansas. I also want to point out that allowing shampoo orders and simple hair styling is safe. The tools and devices used for the services are are just a space that safe as common products we use every day. Samper's and simple hair stylists only use combs brushes blow dryers and other similar devices. I'm license doesn't mean they're untrained. These entrepreneurs have taken the appropriate steps to learn how to safely provide these already safe services. Fax under our current Arkansas law we exempts licenses for similar services those who provide similar services for theater radio television motion picture production industries are exempt from having to have a license to do this. More importantly though this bill simply codifies the Department of Health tree interpretation of the natural hair braiders Act. According to the Department health the natural hair braiders protection act allows individuals to shampoo and condition hair without a license it safer braiders to wash condition dry in a range here then it's safe for other beauty practitioners to do so as well. So I wanna be clear we're not taking anything away from licensed cosmetologists I said we are expanding opportunities for skilled individuals you want into the beauty industry we should get government out of the way so we can help people like Anil and excel in our great state and I'll be happy to take any questions. The Ferguson you're recognized for a question yeah I am very familiar with blowout bars I've used those several states but I guess my question is it would they be at it's my understanding when I've gone to this lawyer or some other states they have a cosmetology license. So I mean that's a bigger concern for me than what you're talking about with which your bill limit these people to working in a salon where there is a cosmetologist so that you can be sure that they're doing the correct sanitation and all that or would they be able to work independently without a cosmetologist present so thank representative I appreciate the question and I would say there are states that permits these type of licensors there these type of services without a license altogether so this block but there's thirteen states that do that I mentioned some of those earlier I would say that there's two contacts that this would really occur and if this was a Kharqan occur one you would have somebody who's probably gonna work in a salon maybe a salon could if they wanted to they may not want to hire somebody but they do want to hire someone to do this it's going to be done in the context under licensed a cosmetologist the other contacts to be if you were opening your own business so you may not need to have a license in that context if you're open your own business but I would argue again I can mention these are very safe services that we do every day and so I think if you're capable of. Opening and running a very successful business I think that consumers are still gonna be protected by just then here ability of what it takes to run those businesses. Follows yes you're recognized what is there a license I mean I've been this lines for someone just washes your hair did are they licensed to some limited degree to do that limited service now in Arkansas it right so like I mentioned earlier it's possible that somebody could be providing shampooing services without a license depending on so like I mentioned the national hearing or act actually doesn't require you to have a license for shampooing purposes now it that's the way it's being interpreted currently that's what I was told that they do but you know they're not providing writing services it's unclear if that real could ever be change is possible under the cosmetology Act currently you're required to have a cosmetology license in order to provide championing services so it's a little unclear there is possibility for somebody to do that yes. And I do want to mention to take to your first question we're not changing the rules regarding sanitation of what requires to sanitise you're shampooing the ball or any that's that those rules are still in place or not changing any of that I guess my question would be I know there's like a limited cosmetology license just to do your nails maybe and so did this said you consider doing maybe a limited license just today the shampooing at. No I think that's a good thought that crossed my mind but the reason why don't they I just don't think it's necessary because I think like I mentioned these are these are very safe services anyway that we do every single day and there's thirteen states that's already doing it and they're not having any problems with that there's not you know major issues concurring in the states. Washing hair without a license so at an I don't know if the my contacts but I will say this this bill allows them to shampoo blow dry and style hair but and that this is a good question so I've got to bring it up it does not allow them to cut here it would not allow them to use chemicals for coloring or or any of those type of things you would still have to have you have to have a full cosmetology license because I think that would present problems and we obviously need licensure for certain aspects of life and that might be an area that you might need to do that so we're not touching any of those type of things so follow hi how will you go about monies in this to make sure. Those other services are not being done. You mean as far as if they're if they're cutting hair and doing all those well all I am somebody who firmly believes in the rule of law right we can't people are going to not break the law I don't I can't tell you if they're going to break the law or not I got down the interstate everyday speed limit seventy five miles an hour see people pass me all the time speeding and they're breaking the law so I would say this law is very clear it's not ambiguous at all it does not allow them to do that if there if they go past that may be violating the law. She enjoys coming and styling hair she supported at her school to learn more about the careers in cosmetology however with the current laws in the state of Arkansas she will not be able to fulfill her dreams shall be heard if she's hired in the salon today she may only get to sweep the floors and folding washed House. AnnaLynne has the capability to do and learn much more than that just these tasks. AnnaLynne is compassionate empathetic schedule driven detail oriented and she enjoys being around people. Her her situation I don't know the proper way to address it and I can't certainly cannot relate to that situation but what I can say is that we cannot lower the standards for everyone else in the entire state let alone the country for a few individuals and I'm and I feel bad saying this because it is very insensitive but in the broader scope of things we have to consider everybody in the state myself I'm a former Air Force military pilot and when you go through pilot training the standards are set. If you don't make it if you can't meet the standards. You don't get to graduate you don't get to fly you don't get this to serve as a pilot DO not negotiable the great and we're not talking about military flying here we're talking about cosmetology barbering and all the other things that go along with that. So we're definitely talking about two different fields but my point is is that it's not fair to everyone else. Who is trained who has the proper skills and sanitation and all these other things that go along with cosmetology and barbering. Basically the country there's few states that I haven't been to but I am opposed to this bill and I have taken a few notes as to why one of the things that was said that. I have a heart for is I have three children all with varying abilities so I can understand wanting your child to be able to do whatever they dream of I also find that my children when they're able to accomplish and earn it would set them on fire even more so I do think that a limited scope license would do a lot of things for the individuals that are trying to do these things as well of this this the lines as well as protecting public health I see a lot of men in the room so I don't know if you've ever been burned by a blow dryer but I have and so even simple tools as blow dryers curling irons all of the tools that come with styling there is a risk to that and as being a school owner I've seen a lot of wild things happen not all of them are reported and if you don't have any oversight they won't be right there's no one to report it to you go to the doctor you get treated you move on about your day so without oversight it would it would cause problems and it does cause problems AS seatac we see a lot of hearings where a lot of nail fungus Murska those types of things that are spread I think also we're doing a disservice to the individuals that aren't trained in public health or sanitation that can just go to shampoo because if they're not trained to recognize some of these things I don't know that we're not they're not getting it is well so that would be a big problem for me I wouldn't put my child in the position not to be able to recognize the disease that then they could take on themselves and I will tell you people get angry when you turn them down for services because I turn people down for now services because of a fungus or something they need to get checked out and they say I'll just go down the street somewhere else your term is a we have a question for you representative Wardlaw you're recognized mmhm Mr my question may be better answered by the health department I see Matt Gilmore said over there but my question is how many these cosmetology schools that we have in the state how many do we have the state I don't know exactly. Grants because of we approach provide accommodations for lots of individuals whether they have IT peas or you know so that they do have assistance in passing these eggs exams so that they can become licensed would would you oppose just allowing someone to shampoo and work under the supervision of cosmetologists without going to school I think they need some type of training so even if it's a smaller scope than three hundred hours that would be much less expensive I don't know what that looks like but I think they need some type of training and then yes they should work under a licensed person for sure. That's the other piece of it that really bothers me is having facilities that aren't license because then an inspector won't go in and check those facilities for public health because they're not under there you know regulation so the only time they'll go in as if there's a complaint made and that's the problem that we're having with the rating bars right now yeah and that it's the it's it's help expansive the bill is is my problem if it were more limited I think I could before I completely agree. And I I don't disagree and don't agree with a lot of the things that were said today. I do commend Annaly in for her drive and her value and her dreams and her goals I do also have a very close a relative that has asked burgers who wanted to cook so he went to Pulaski tech and he obtained a little degree there and he works for Zaxby's and he does preparing food and things like that but he was allowed to go and get an education. It's my understanding that infection control and infection and disease control is one of the most important factors in obtaining a cosmetology license that is a big deal with our industry today our job consist of many things related to the beautification and maintenance of the human body not only not only are these technicians dealing with tools that range anywhere from three hundred and seventy five to four hundred fifty degrees that are touching the hair and the skin but can also damage and burn. We're seeing a lot of allergy and skin related issues right now for people allergies being from products that are made on the market they can touch the skin and if you're not aware of that or you don't know the proper questions to ask a simple shampoo can call someone fifteen seconds the full sulfates and things in something can cause that cause them to break out. The professions that touch that humans can have all required to have some kind of education and our and for keeping our license is were educated in how to touch people how to deal with the questions that come arise such as just a simple shampoo touching your skin I'm sorry your time is up for any questions a representative class you're recognized for a question. Thank you very much Mr so in my other job on the pharmacist and I'm concerned about treatment resistant head lice so what can you tell me about the normal proc protocols you would learn and put in place that the health department would hold you accountable you know to prevent the spread of life so that normally work so first of all we are not allowed to work on anyone that has a communicable issue from disease or head lice is communicable so we it's very easily spread if someone comes into the salon we have to know how to look for that we have to know how to recognize it and what to say to the client in order to have them sent to somewhere that can such as the head last Little Rock has a head lice clinic that kind of thing and if you do not know what you're looking for and you put your fingers into someone's head when you're doing a consultation before you shampoo or before you start of service and they have head lice and you run a comb through that. You put it back in your drawer you have already spread that had less to whoever else that come touches wherever that come ways whether it's on a counter whether it's on the surface if you laid on the ball if you do not take the proper procedures. You can spread have less very easily throughout a someone. Diabase relax and hydrate blacks as if I'm shall appoint is out I have to know the difference between the neutralizer and just a sample which time to employ these samples now I understand they're saying that's not we're not using chemicals but when you say a shampoo with the kind of slippery slope is kind of you need to be regulated okay Another thing it doesn't just say shall point is we have current I was using a lot of thermal heat also and somebody on train on that can cause a lot more problems and like we say head lice and just being able to identify different problems such as ring worms in it has a ring worm been treated or not before I touch it or not you have to really go through hours of education to that I'm for continuing education I think every barber college R. barber and instructor or cosmetology's in because drugs used drugs should go through at least it and eight hours of continuing education so I am very sensitive to anybody with special needs what being able to come to the field but I'm sensitive to the fact that we do need to keep by certain standards involved because it's for the safety of the public different shampoos are are not just simply I'm medicated shampoos and medicated conditioners you know we have to be able to identify these and then when to employ these. Good morning my name is Merriam admin that is piccolo the financially director for Arkansas College of barbering and men's hi so I want to let you know it I'm not against this one technically I'm against the bill but I'm not against people like an island I want to make it clear I invite Mr Underwood and the families to visit our campuses we have two campuses here in central Arkansas we have schedules that would only require you to be on campus twenty five hours a week and we have licensed instructors that teach all of our students we make all necessary accommodations within our guidelines to assist their students we work with agencies such as the Arkansas rehabilitation to provide funding DHS or meet with counselors and parents to ensure that all parties on the same page for the student success are licensure rate is over ninety six percent for those that test and that is from a range of students that come to our campus we are not permitted to discriminate for who applies and who attends our school so we have people from all abilities all backgrounds attending. Our school an education will give you training with AnnaLynne I'm not just sampling but learning about skin and hair disease safety for yourself and your client during sanitation we've into a bit of business training I encourage you to meet with our school and our licensed cosmetologist to learn what chemicals would RC for you and our customer you only have to be sixteen and a half to enroll in a cosmetology school we do require a high school diploma due to federal funding that does require three hundred hours to receive the federal Pell grant why are I don't want to students like her to be truncated and their income due to their education level and their skill set I don't want to put their livelihood to be in jeopardy because he didn't know the difference between a blow out in a Brazilian blowout that may include chemicals like formaldehyde formalin and pair form really really let's educate ourselves don't limit it to just shampooing build a foundation that can help you become a successful business person in our community I really do encourage our students to get that training and to answer a few questions we do have fifty sixty schools in our state it's found on the Arkansas department of health website under training and testing and the cosmetology section. We're talking about training we can't quite that to licensure all jobs require some training that doesn't necessarily mean that that training needs to be mandated or dictated by the government so I just want to clarify that Represent classes question earlier now do I wanna make sure I don't I said is clearly enough under the cosmetology Act it requires any cosmetology license to project hearing services under the natural hair braiding Act you you that's actually exempt under that act so there's it's unclear whether you can provide that are not so with my discussion with the board of cosmetology if you're providing shampooing services they will deem you a natural hair braiders so you can provide the services so I I I know if I said that clearly earlier just want to clarify that. on consumer protection I think again these are these are safe issues and this the services are very safe I think it can be market driven consumer driven so the number one thing that people look at when they're looking for these type of services is word of mouth Google and yelp reviews one of the last things that consumers wait on this is whether somebody has a government license and so look if if people are not providing safe services or not doing something well they're not gonna be able stand business doing this people are not going to be when I go to them to see them and as for shampooing goes the worst thing that can happen is you just take change shampoos so it's not gonna do a ton of damage on the type of product that's being used. You can go to Walmart and purchased these directly from Walmart go the second self checkout there's no in in a in a minimum age nobody. Ask for your ID so they're not dangerous same with flatirons any of the blow dryers you can buy those strict one more and fax the lawns sell them out of their salons to people to use outside of the government supervision and the last thing I'll say because I don't want to take it to its ninety for a lot. I think somebody mentioned this here. It takes twenty thousand dollars you incur twenty thousand dollar debt to go to cosmetology school. This is a jobs bill we don't need you to encourage twenty thousand dollars of debt to provide these very limited services so just last comment I know there's been some discussion about you know whether or not we should provide like a limited license or anything like that and also you I think this is the best bill I like the way this is structured I will respect the commission the the the wrist the what the committee wants to do for sure of what you guys might be I'll do that I will say though other states already do this without this licensure Tennessee actually had one for a limited scope somebody mentioned earlier people don't utilize them because there's not as much money to be made in getting those licensure and actually Tennessee repealed they're limited license so I don't like that route as much but again I will respect the wishes of the committee but that appreciate your time. So we're seeking that now just to clarify the board's authority the board has some general authority to establish an inspection program which they apparently relied on at the time That the board and the current board in the secretary would like to speak to. Could question believe my legal advice to the board is to get the specific legislative authority to issue a license and charge the fee apparently they relied on some broader authority to adopt the up by rule a code inspection program. But I don't my advice to the board was that's not specific enough to issue a new class of license and issue a class of license and charge a fee they need specific authority to do that. Yes ma'am Mr. Yes a few years ago we clarified that And said you had to have specific legislative authority to be able to do that and it hat and any rules to follow had to be approved by legislative counsel is that not correct that is correct these particular rules were adopted in two thousand and four okay thank you Mr. Representative Gonzalez you're recognized for a question. How many of these people who have license in the state now about three hundred three hundred into the last I checked which would have been January. And that's an annual fee of twenty five dollars yes Sir it's about seven thousand five hundred if my mass right a year. Okay what's that money used for right now we're provide the apart from the program in general we provide free annual training to those municipal inspectors which is the main goal and purpose of that program is to get often municipal inspectors do not have. The small cities cannot afford to have a plan at plumber and an electrician that you don't just have one code inspector and that code inspector may be a plumber or an electrician or in the or H. BA they may be referred. A former teacher you know so mostly that she's for training and assistance to the to the local municipalities okay how much money is an account now what's what's the balance that fund balances about half a million I believe I don't can't tell you the exact amount. But I'd be happy to to get that to you you have one more follower okay so how much of that do you use per year for training. Not more than the seven thousand I mean the training the annual training is. Used for out of that seven thousand it's collected. That. Most of that fund balances may that from the private sector license fees. Okay all right so it's all going the same it of all going into the same yes thank you representative Boyd you're recognized. Inspectors municipal inspectors yes okay so as part of the training the you include any customer service on how to appropriately treat the the people there inspecting. What do our inspectors to or the municipal inspectors. Will I get to start this new twenty five dollar fee and and license what what exactly are they doing right now that they shouldn't be doing that they would no longer be able to do it this licensed if what they will has to okay I'm sorry I didn't and what they will have to the board will re evaluate their free that the training they have been providing to those municipal inspectors on an annual basis. So we're just talking about training only for the municipal inspectors yes and those are those are like I said often times municipal inspectors particularly in small towns. They do not hire a an electric shouldn't Anna Palmer and that so there they they'll have one code inspector who may have limited construction knowledge or construction experience with respect to what they're inspections are are and so that's what they do we do the same thing with electric shins we provide the training electrical training for those city inspectors thank you. Motion carries your members adopted you're recognized to present the bill thank you Mr chair so I'm running this for a representative Johnson but part of this bill is actually something that I had asked for so cut it to two different things in this the first thing on a is that Arkansas Medicaid program shall the beneficiary to have six prescriptions per month so the way in that it currently works is that Medicaid adult Medicaid beneficiary gets three prescriptions per month and they can get in the extensions up to six prescriptions per month now that requires actually it actually applying for the extension it's not hard to my knowledge most I was like a hundred percent of extensions get approved so all I was asking for and what this bill allows is essentially to do away with having to apply for the extension of benefits to get the six and just let you go to six automatically. and then the part in the bill it's representative Johnson wanted was to you and essentially what he's at the program shall not count of medication for any of the following conditions are treatments towards the prescription benefit cap and that's essentially maintenance meds for high blood pressure a cholesterol blood modifiers diabetes or inhalers so those would not count towards the six limit prescription and this is something that I've always wanted to do is look that expanding for years and years and I would like to thank the H. S. from the table for working with us this session to try to expand some Medicaid benefits.
