House Bill one thousand two by representative Shepherd and that transfer funds to the reduced restricted reserve fund executive legislative three fifths vote set aside the unallocated restricted reserve majority vote set aside the general revenue allotment reserve fund And economic
development incentive quick action closing fund and the player emergency. Sir design thank you member's bill for the transfer related to the project products are still project. Any questions no more speak against speak for this bill any objection on the boat still has an emergency clause requires eighty votes and and twenty four March she calls please hold while. Ballinger Beckham Bledsoe Caldwell Chesterfield Clark
Davis Dismang Eads Elliott English Flippo flowers Garner Gilmore Hammer Hendren only Hester Hickey Hill Ingram Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace. You wish to vote or change their vote. Cast a ballot thirty three
eighty zero days the bill is passed emergency clause is adopted return the bill to the. We ought to do the business agenda Senator Dismang. House bill one thousand one by representative Madison Senator Dismang to amend the state income tax to change the name and funding of the long term reserve fund and declare an emergency. Thank you have members just there were some comments yesterday and I mean we've
already rehashed bill but I think there's some items that may need some clarification first I think it was stated that the credit was refundable and non refundable it is non refundable if there has nothing to do with a refundable tax credit which again just means that you know that credit can exceed your actual tax liability second was related to foreign corporations I think we talked about Nike in a ice cream company and maybe a sweatshop in China and so I think it's really important that we just make sure we understand who we're talking
about when we talk about for corporations so this morning I just looked at my district very quickly and when you pull up or you know local pages sensually all of our large employers in Searcy Arkansas our foreign corporations minus one or two just run through that real quick that's price for which employs four hundred fifty people Eaton corporation employs one hundred ninety people lander frost employs five hundred fifteen people cal Maine foods eighty people X. P. O. logistics
logistics a hundred forty people Chilson Burch a hundred eighty five people Pontiac coil eighty people those are all foreign corporations that are job creators in my district I could move on and go outside that in Lennix industries who is also in my district has seventeen hundred employees this album for which just helped us in a I read bring in the Remington plant has nine hundred employees and growing and so again these are job creators they are critical to our local economies without those major employers in my
district I don't know what would happen we would definitely would have a strain on our local housing folks are builders are retail shops our evening service industry restaurants hotels across the board to review a ripple effect those entities we're not operating in my district to senator garner just phone point of view we have Lionel. Murphy USA resolute forest products products Deltic timber Lockheed Martin aero Jett evergreen packaging and that's
just to name a few of the foreign corporations that are job creators in your district and if anyone like to locate in our mind I am more than happy for them to do so because they are vital to our local economies. Question. Senator Johnson Mark Johnson thank you Mr president. I Mark Johnson Senate is going I think I know the answer this but to clarify those that might not understand the nomenclature foreign does not mean from
another country that meets some organization a company that is can cooperated other than in the state of Arkansas Senate rates corrected its you you have domestic corporations for the others that have. Organized in the state of Arkansas in foreign corporations which are corporations that have organized outside the State of Arkansas but still doing business in the state of possibly in one of the other forty nine states more than likely more than likely yes thank you senator thank you for any other questions Senator are
but what I saw yesterday was to recognize corporations like Nike or for corporation and they will receive a tax cut because of this bill is that correct I'm not sure any direct retail in other words if you but I think most of them close to right ninety outlets in the state of Arkansas beyond that I'm not sure how there's a nexus for us to charge ninety income tax for instance just an example and and so and if there's a foreign sweatshop in China that has a nexus back to the state of Arkansas perhaps in it and they
would have to have you know employee or location or something for that nexus then they can benefit from an income tax reduction but I'm not a we're really aware of how that would play out well I as this application I ask bill or staff I know tax to read they have issues with on the number sometime but access to the question of corporations like that would be included they said there are examples of Arkansas within our tax code of those doing as well so it is very important to the knowledge that that this money will be going to allow state entities as well and that money will not be in
Arkansas we could stay here they're income tax but I appreciate your clarification that sent the vast majority of our entry entities that are operating major employees employers or foreign corporations and that was the point being made this morning thank you is responsible if you will speak on the bill come down there anyone speak against four four centers close any objection rowing the boat lease roll vote. Ballinger Beckham Bledsoe Caldwell Chesterfield Clark Davis Dismang Eads Elliott
English Flippo flowers Garner Gilmore Hammer Hester Hickey Hill Ingram Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace anyone wish to change their vote Senator Leding is no. Senator Elliot is no. Senator Tucker is no. Senator Chesterfield.
There's no. Anyone else. Casts up the ballot. Twenty ninety days for that four days the bill is passed verticals is adopted. Returned to the house Senator Hickey. All sorry Sir Sam for all purposes are you gonna handle this next bill. Okay. We're doing one oh three ten oh.
Welcome to. Yeah. Yes that was mislabelled appear on the okay. House thousand three by Senator sample concerning security personnel employed by the General Assembly and declare an emergency. It will once I get senator I want to make sure I know that the. Strain said H. B. one zero zero one I just wanna make sure that everything's good road one zero
zero doesn't doesn't happen only for just wanna make sure Sabrina is good I don't know anything about right now saying that the computer I agree. I learned a long time ago the ball so this. She sits right here. We're good. We're good okay center please proceed. I thought was great I may be crazy but a look at what we did that go ahead thank you Mr president
I believe to present this bill if you live. I didn't have to go it. Members of a house bill ten three is you bill that concerns security personnel it will the house of representatives have hired or full time security person they're retired federal law enforcement officer it also this bill also gives a the
Senator ability to do that where do we do it or not that person will have the responsibilities of full time law enforcement officers in that will give them the ability to be certified in the state of Arkansas they will they can go outside this building And company of. A person a. Members to different events if they so choose and they will have statewide jurisdiction I'll take questions questions Senator
or. Yes Sir is this any substantial changes this than what we discussed the committee I believe two days ago the change we did they're running changes going to we do have a promise that it will come back in the change probably this spring. Okay thank you always speak against for okay Sir garners good speak against. Sure garner's recognized.
Thank you governor I I generally agree with this concept and have no problem with the idea behind this to fully reports of this section is really concerned first if you look at it it talks about getting certified training from the law enforcement academy but it actually doesn't say that what it says is we can of further empowers to somebody as to the same standard of having that level training there's actually no requirement they be certified so as we know you can hire just about anybody who will have the full authority and
power of a police officer here in the Senate they do not have to be certified I mean literally if this pass I could hire link in the next day and I guess he could be a certified police officer up here with a gun to protect us secondly the statewide jurisdiction I would love to hear of greater explanation of why we need to get these local capital Senate and and house members statewide jurisdiction I don't know about you but I heard about the story many years ago I can't say the it is verified or not but I'll look it up in there was a news
story about it about a former Speaker sending out police officers to pull people back from votes and so the whole process that earned certified police officer to come down and old rate Arkansas Grammy and yanked me out of my house with full statewide jurisdiction and pull me back up here with a gun is something I'm not going to support now there's better written to focus more on us in was written so there be some kind of training certification I'd be much more open to it but we're offering a lot of people power to people who do not have
to be certified and who can come to your house and get you if a future pro tem or Speaker says that's a good idea. Anyone wish to speak for. Yeah. Certainly it was. If you wanna answer senator Elliots question among the. So recognized for a question thank you senator garner I cannot discern to figure out
how this new. Officers of whatever I guess we would call on that group of people would intersect with the capitol police and who determines where the lines are I couldn't figure that out you get anything in the committee that could no ma'am I did I was out there yesterday because I assume there to be updates this an apparently there wasn't that being said I don't mean for anything from the bill recognizes that would trade deals jurisdictional issues now I know we gave power to the
governor to do sort task force if there's a murder situation like a riot and that level jurisdiction in the the level of command five come up with that but how that would work practically with the state capitol police I could not say ma'am and do you know any particular thing has happened that would cause us to need this level of police that could not be handled by the capitol police the way I understand it from reading the news stories in preparation for this session is that the house has a member who
is a former FBI agent who they want to have the training has the ability to and for those powers and could use that and more official capacity to protect the house members in the Senate as a cautionary note cautionary skis as a precaution in case we ever want to do in the future Senator Hickey speak about that more in the future but as far as knowing if there's some specific partner or like something like that I cannot say the thank you. You always speak for the bill.
Both questions sorry servers recognized for questions Senator thank you for taking my question as you know we've had some incidents or I personally have had some incidents of threats and have had to have capitol police escort thank you know personally about that I want to say thank you actually to you and many of the senators who who help to that situation and I was not in the committee but from my understanding is not really the intent behind this bill though is to try to give that level of protection
when those of us have faced those threats to our person and then also to our homes I know we've had several members that have had threats of their homes begin and violated in burns and and and and and their property destroyed because of of folks that have disagreed with us and so it's not really coming the intention behind the legislation and you're just wasting your concerns about the way it's written yes ma'am I did your
first point I think that's a ballot didn't and very neat reason why you'd want to have a certified law enforcement officer just like we do in the back right now I mean those two men protect us right now it's my bust in here with a gun they're going to do their job and they're trying to do it I have a leader in my district so I know what those men and women go through down there. The problem I have is you don't have to have men like that or women like that you could have anybody in they get the full power as if they're certified by the way this is written to the second question no that's a little bit more tricky if we
should be sentence security forces down to secure our own houses did you have local jurisdictions down there like a red PT or any county sheriff's I know I've talked Arkansas state police when I get certain death threats and things like that which happened pretty often news jobs you will get a test so I don't know if that would happen the same way with this thing there's no discussion about that case because. Senate. One second Senate so Garson
Teague says they want to ask you a questions Senator Teague you're recognized for a question you know if you guys could we apply. That is exactly why we need certified training. Anyone wish to speak for against centers closed. Senate your clothes.
The and. Member center closing members senator garner is right. And but like I say and I have the. The words from the Speaker that this bill will be corrected and brought it to their but to. Senator six point the the House can maintain its standards on who they want to hire and so I don't know that you would be
even considered. but I would consider a good vote thank you. Any objection rolling the vote. Mmhm. I heard. Secretary please call the roll. Ballinger. Ballinger. Back. Beckham. Bledsoe. Caldwell. Chesterfield.
Clark. Davis. DISMANG. Elliott. English. Flippo. Flowers. Garner. Gilmore. Gilmore. Hammer. Hester. Hickey Hill. Ingram.
Irvine. Blake Johnson. Mark Johnson. Leding. Page. Rapert. Rapert. Rice. Sample. Stubblefield. Sturch Sullivan. T.. Tucker. Wallace.
If you wish to vote or change their vote. Senator. Hang on hang on a second we got about ten of the senator garner is no. About. President Senator Gilmore surgeon was present Senate Beckham's NO K. anybody else over here. K. anybody over here. Anyone else Senator Rapert is by anyone else cast up the ballot.
Nineteen eighty eight thirteen days bills pass emergency clause is not adopted. Senate is. Twelve thousand four by Senator representative Dalby dismaying to clarify the app failed of the uniformed limited liability company act to confirm and retain the limited liability status and limited liability protection of certain limited
liability companies and declare an emergency. So does my thank you this is the date change that we discussed earlier thank you any questions that you were speaking against or for any objection on the vote the role of. Ballinger Beckham Bledsoe Caldwell Chesterfield Clark Davis Dismang Elliott English Flippo flowers Garner Gilmore Hammer Hester Hickey Hill Ingram
Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace anyone wish to change their vote Senator Clark is that not voting present Sir Clark president anyone else. The cast of the ballot. Thirty two yes zero days bill is passed the Emergency Clause was adopted returning to the house
Senator Solomon is already down here House Bill thousand five the representative Payton inter Sullivan repeal the law concerning pharmaceutical discounts for insulin and declare an emergency social. Thank you our focus is same bill we ran through I think the other day just wanna make sure we all understand how important this is there are discounts that are available to certain parts of our population and discounts that are not available we work real hard to get that discount for all Arkansans and we will be
coming back in future sessions to try to get that with that I'd appreciate a good vote thank you any questions anyone would speak against for the centers will close any objection to rolling the vote C. nine. Ballinger Beckham Bledsoe Caldwell Chesterfield. Davis Dismang Elliott English Flippo flowers Garner Gilmore Hammer Hester Hickey Hill Ingram
Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace you always change your vote. Because of the ballot thirty three A. zero nice bill is passed March a closed up to return it to the house design. House thousand six by representative Jett and Senator Dismang to amend the law concerning the initial appointments to the tax appeals
commission and declare an emergency. So does this bill just creates the consistency on the appointments to the initial appointments then ladder Richey any questions will always speak against for for centers close any objectionable a vote saying none please role but I've sector. Ballinger Beckham Bledsoe Caldwell Chesterfield Clark Davis Dismang Eads Elliott English Flippo flowers Garner
Gilmore Hammer Hester Hickey Hill Ingram Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace. It was injured vote. Cast a ballot thirty three eight zero nine bills passed the mercy clause opted return the bill to the house.
Your name walls of one say so we got a lot of high school. students here today and saw watching attentively in that may wonder why you just run in through votes with no one saying anything and then on the others you don't do that you allow people to say yes or no just so you know what it's not they're not paying attention or whether they may or may not be but that's not what this is about.
Eighty three you in the newspaper well. But when it's a non controversial issue that most people maybe one or two one but most people are going to be totally good with then we roll the vote and it cuts the time down significantly and gives everybody up for the most part yes if they want to change it to a no they do that section this makes a lot faster on things that there's general agreement
on I saw some of the puzzle yeah I just want to explain that so that you know what's going on Senator Wallace. Thank you. Thousand seven by representative Jett senator Wallace to amend the income tax credit for waste reduction reuse or recycling equipment so all thank you governor members this is the same bill it's just the house version of the Senate bill we
passed yesterday thirty four zip it deals with the tax credits for the economic development. Issue coming into the northeast Arkansas and with that I stand by for your questions any questions anyone wishing to speak against. Senator Hester as questions go in. Senator Wallace yesterday you mentioned to us that you have personally met no many people from the area that are working some of these jobs making one hundred thousand dollars a year that did not get a college degree is that accurate yes Sir
this is a great thing thank you Sir it's good for the district thank you. We speak again for centers closed I am closed centers close this does not have an emergency clause yes the only bill that does not anyone object one The vote. C. nine please role of a. Ballinger Beckham Bledsoe Caldwell Chesterfield Clark Davis Dismang Eads Elliott
English Flippo flowers Garner Gilmore Hammer Hester Hickey Hill Ingram Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace. Anyone wish to change their vote. Seeing none cast a ballot thirty three ages zero nine the bill is
passed Mr president. What. What once. Attention. Of the bill is passed returned to the House center Mr president I rise for motion. Senator Rapert what your motion. Mr president of the Arkansas Senate vote to extend the second extraordinary session of the ninety third General Assembly according to the provisions of Arkansas constitution article
six section nineteen and extend session not exceeding fifteen days for purpose of considering legislation to create the Arkansas B. thank you ally human life civil justice act to regulate abortion in Arkansas in say the lives more children this is in accordance with the fact that we have now concluded all business that was on the call and it's a proper motion. I. A couple things first of all I I have to announce through
procedure after it out from here we are finished with the governor's business. I don't think I don't think I got that out. let us finish the governor's business and then we'll come back to you I'm recognized well actually Mr president the government is not finished okay when the last bill that was called was cashed up that concluded each bill that we was on when I have to say from you're going to make a motion
the the wide okay but I'm supposed to say from. From this podium that were finished with the governor's business so let us wrap that up let me say I'll come back to you then I'm gonna go to. You senator let us finish all that go to you then you and centers what what purpose you. I have a motion. Okay so we're not totally through yeah okay go ahead
senator Sam have a motion to expunge the bill the Emergency. The vote by the the two emergency clause of house bill ten three five okay H. B. ten oh three the bill pass emergency clause did not pass I have a motion to expunge the vote on the emergency clause all those in favor say aye. Those guys have a motion is carried the vote on emergency clause is expired. Well he it.
You got a request that it be how we wrote voted again I request that we revoked the emergency clause this is something from our house if we do this this will allow the house to do ahead and have their office certified without this and get away the extended period of time to have a million certified even though he's retired officer in only if we have for years. There is a stipulation there that the SPD certified by the
state of Arkansas right now we don't have that process this will allow them to sort of officer the case what one say yes Sir sample so this is a motion to vote but. One second please state state right there you have a question on this senator Johnson he yes Sir my question Mr president is is this we weeks finds the vote is a vote on emergency clause which fasten is what Senator sample bring up is debatable.
The motion what we're gonna have a motion which passed we have another motion which he's gonna may to revote the emergency clause in the mood to do that there will be an opportunity to debate or not Clause. Yeah once we get it yes. Like we normally would thank you Sir thank you have a motion devoted for. A pass first got a motion to
remove a movie we revoked one one second. Senate. Mister chair questions Senator questions Senator sample Senate sample. The issues raised by senator garner that me by my time of adjournment the reasons and even a broken clock is right twice a day. This is Gary to me. And I need some assurance that what you say is gonna change
when will it take place so that the issues that are raised that are very to me as far as all reach. Those changes take full advantage. Told by the Speaker of the house that if I have the opportunity they will make the change in a fiscal session. But in the meantime. We're legislation that would give an individual the opportunity come to my house interest. So.
The person that got to be hired by Senate bill one second so I thought your question was on the motion is a motion to revoke has not passed. And then we can deal with the substance of the emergency clause thank you Mister chair I think my my questions answered okay. We'll just get this done All the favor to revoke the. The ayes have it we re voted by. There any questions now the substance of the emergency
clause you senator garner thank you and so I'm assuming if we don't pass emergency clause that employee at the house may lose his job because we have such an emergency we have to get it done in a certain time is that true can speak to the House man I hate I hate anybody have to lose their job waiting three four months for emergency clause all my support this. Thank you Sir okay any other questions on emergency call centre Hester. Senator sample it's my understanding that the the
importance of this passing the Emergency Clause is for immunity for that officer should have to take action in the job he does not currently have an unity until until this bill passes once again certification you have many community thank. Search for all the questions you thank you Mr chair of this immunity gives him the opportunity to do what. Two. If this this is just a for instance.
Say that the Speaker or any member walking to their car or to another building and was accosted he has the ability to take it protect them or the reviews by physical force or. Even as much as is dry or wet. well my concern is we have two gentleman in the back of that that same we do it The Simpsons Lassie so special this. I can't I can't answer that with this is to allow them to have
that that person personnel on duty. If I went to like we had our retirement meetings at another place that would be give them the opportunity to have a. Certified a law officer there in support if they need some protection of some whatever well and let me just make my my concern clearer. The Senate has the ability to determine the security of the
Senate your house has the opportunity to determine the security of the house so why is a joint of motion necessary just for this first they put it in there just in case we the Senate wanted to hire a person like that It goes back to senator garner first question They have somebody has to take up thank you Mr thank you
senator centering around has a question sure. Your house not only John bass. Hi I cannot assure you. Even though I thank you will be an excellent person is large enough yeah. Any other questions anyone wish to speak on this or against. Senator Mark Johnson which is. Hello we're gonna get senator Johnson the chance to all.
Senator Johnson is recognized. Oppose the Emergency Clause. Thank you Mr president I know everybody got quiet when I brought my rule book appear I voted against the bill an emergency clause. If it didn't have an emergency clause I might consider voting for it I I'm I'm for security folks don't know of veterinary
long time I can remember seeing people in the gallery that frankly I was a little bit for a dive not these wonderful young people we've had today but others long time ago I share the concerns of basically deputizing state of individuals to go anywhere in the state and do that but I do want to mention something for senator garner benefit. We have a rule that allows the president pro tem to create a a
a committee of five members to compel the attendance of absent members now whether that means going all the way to elder radio order Crossett or or somewhere else in the state to compel the attendance it just means we we have a way to stop a Texas style boycott where they would not show up so you can do business we have a way to address that this is about the certification of someone and given. Making them a law enforcement
officer which come confers certain benefits if and Senator sample I'm not against the idea of your bill and I'm not against keeping the house from doing what they want to I just sat there and thought you know if we had ninety days to take a look at this it may be it be better than to make it instantly applicable when the governor's Penn live soft paper I want to thank our two state troopers that are here today I remember when that was all the security we had an cap or state troopers now we have the capitol police I appreciate them and maybe we
need these others but I don't think it rises to the level of of needing it instantly and I would appreciate a vote to keep them to not pass the emergency clause and allow this to become law in regular order after it's been reviewed by the general public thank you Mr president.
Anyone against anyone would speak to clause. Okay madam secretary of the Senate is closer sample closed non center please call the roll. Ballinger. That. Bledsoe. Caldwell. Chesterfield. Clark. Davis. Davis. DISMANG.
Elliott. English. Flippo. Flowers. Garner. Gilmore. Gilmore hammer. Hester yeah. Hickey. Hello. Ingram. Irvine. Blake Johnson. Mark Johnson.
Leding. Page. Rapert. Rice. Sample Stubblefield. Sturch. Sullivan. Teague. Tucker. Wallace. Anyone wish to change your vote
Senator Beckham is buying any one else. Sir Davis's I. Cast of the about. Twenty four yeah age nine days the Emergency Clause is adopted. Transmitter is. Now we have completed the governor's call. And we're gonna go. We will eventually move to the resolutions but Senator Rapert is being going to be recognized
for motion then Senator Hickey has requested to be recognized. Aw you. The right you can repeat it all I don't know if people want to hear it all again or not but Senator Rapert you're recognized for motion you care for me make a motion here's what we do from the well you can make it you can make a motion right there if you live. Members I move that the Arkansas Senate vote to extend the second extraordinary session of the ninety third General Assembly
according to the provisions of Arkansas constitution article six section nineteen extend the session not to exceed fifteen days for the purpose of considering legislation to create the Arkansas human heartbeat and human life civil justice act to regulate abortion in Arkansas save the lives of unborn children utilizing a civil cause of action being that all the business of the session on the call from the governor has been concluded this is a
proper motion and I ask for good vote okay this is so the I'm not going to repeat all the specifics by the senator has made a proper motion to take the stand of the session it requires a two thirds vote and it is a debatable because it is not a privilege motion. I want to be recognized okay Senator Hickey is recognized. When will you be recognized. Right.
I'd like to make a substitute motion okay please state the nature of your motion okay having completed the business of the governor's call I move there and the second extraordinary session ninety third General Assembly signing that give consent to the house of representatives to journey. Follows. In addition to that by doing that these resolutions that we have. Right right here but what I believe that we would do if you grant by substitute motion will
have to go to the committee of the whole to take the proper respect for the individuals who are here today and travel records. Okay Mr president I respectively object and I do not yield the floor from from my motion. Well that right so I ask for clarification okay your your motion is a debatable motion so once you make a motion I recognize individuals to begin the debate further the
recognized so that so his substitute motion is proper I know a lot of people here on both sides of I studied is extensively and I've talked to Steve probably more than eight years so let me walk you through with the rules or here. Okay so we have to proper motions the first motion was a motion to extend a second motion is the substitute motion the motion to extend as I indicated is debatable requires two thirds
of the second motion. Is a motion sensor motion but the underlying substantive part of that is a motion to adjourn normally. Normally a motion to adjourn is not debatable for example had Senator Hickey just been the first to stand up and made a motion to adjourn that would not be debated but because it's a substitute motion it takes on
with regard to debatable or non debatable it takes on the nature of the motion that he is replacing so this one would be debatable but this is a privilege motion and take precedence we will dispose of your motion and then we will go to Senator Rapert motion. Senator Sturch Mr president and parliamentary inquiry. Please I either am confused over all wrong but did we ever take a vote on house bill ten oh two.
Yes well bill or. Regular agenda yeah that. It was very first we did that thank you there was a numbering issue that I'll make a note of earlier but okay thanks Sabrina says it is all purposes okay okay. Okay so Senator Hickey you understand what is everybody any questions or what I just said. Senator Rapert. Any questions Senator Hickey it questions I do have a question
being guys this substitute. Being that this substitute motion underlies the primary motion. Are you ruling that this would still only require eighteen votes of the members act on that yes substitute motion I know that's not eighteen this is a majority of those voting during second I will say some of. Yeah majority of those voting corrects the current. Okay is it proper motion if I'm
making another substitute. You. I think it is. Okay I think you could but the other adjourn motion you make a substitute to the so that is the highest ranking right that's what we're going to get it you you could you could theoretically may and they saw no the substitute motion but if you look at the president under the rules the adjournment motion
is the highest president there is so no matter what motion you may we've got to take his all now in this motion at being you've clarified just to make sure that this is debatable. Yes we're about to debate Senator Hickey is motion to adjourn. We dispose of that they will go we will go. to the motion to extend normally a motion to adjourn is not available but under the rules it
takes on the nature of the motion that is amended again because you went first with your motion it takes all the non debatable nature of yours okay I mean sorry the debatable name writers thank you for clarification members know what this bill is all about in the issue that it's about and so I appreciate to be heard. Senator Hickey is recognized as a motion. Okay members you all of the
motion and but I do wanna explain some things and try to answer some questions I was actually hoping to do this this is actually why put this on the the supplemental agenda it's been out there since day one I filed that is Senate resolution one so nobody would have any questions that I was going to walk around and and make a motion to adjourn so just a few things about this I mean this is the opportunity whenever you look at the thing in a macro
standpoint the way everything is of whether or not you want to stay in session or whether you did not it's not about any specific type of a bill that's already been filed but I'll go into that. What would happen if you do not to If you do not pass the motion to adjourn what we're going to do at that point after of course exhausting the Senate resolutions is in we're going to take those the memorial resolution in the and the one for the ball team this year.
What we're going to do then is take everything else has been filed and we're going to start down through those if we get a two thirds vote on any one of those that opens up the Senate. to be here for up to an additional fifteen days. Now that. The one that you all vote for does it have to be the same one that the House boats before that you normally would think it would like it would be an identical one that's not correct
if they vote on any of the heirs also whether it meets ours are not then they're also going to be going to be open so that's what that's what that would take. So Let's just say that happens because if if it does I think that all the members even even if you're for this they need to understand a few things so that they'd be able to prepare to do some stuff. I understand that if we stand up to the fifteen days but there's
no breaks in that so in other words if we of us in the House did that today here on Thursday that's day one. Tomorrow's date to Saturday's date three seventy four and so on down the line now if you will say well I don't want to be down here Saturday and Sunday that's okay if we both that in here but what I don't want you are what I do want you to understand is the the clock doesn't stop that is still the days inn and were only
there for these fifteen. Another thing is What you all would have to know if you do that is that fifteen days is also includes the of any corrections or vetoes you all know that most of the time whenever we do this what we'll do is we'll leave and then we'll wait a few days in several come back and sign it does the reason we do that of course is because the governor has fifteen days excuse me the governor as five days.
To actually figure out if he wants to veto review wants to sign a bill or what he wants to do so we wait that time in KC vetoes it to allow this body the opportunity come back in override that. What you would need to consider is that yours would also have to be you would have to pass your bill. And for open to that that's any bill that any member in the entire legislature wants to file so if that was to happen. If that was to happen.
Here in the House anyone of you can go file one two or ten or twenty bills and we'll start trying to hear those the best that we can. But again what you need to know when you say well that's the tenth day that's not exactly right because if yours was filed if if you got yours passed on the tenth day of this We would all have to be sitting down here at eleven fifty nine and forty five seconds and try to organize it that the total was doing at that point it also gets a little confusion here and
I know it's going to get a little muddy although we are Clark could be running straight with the fifteen days the governor's clock would be the same as normal and he's not required to use Sundays although we would in this case so that actually puts another day and so you'd have to have all your bills passed by. Seven or eight days if you over to the side to do that will have to have to go to work one other thing that you have to know and I had been laid on your desk.
In the event that you do this we have monies available you know groups with the staff but I have an appropriation bill this late on your desk that we would also need to pass would to which would take seventy five percent of the members in here to pass an appropriation. I will presented out of respect for the body if they want to do that I would not be voting for that so it's it's just another thing that we have to consider as far as that goes. And with that I'll try to answer
any questions you may all have any questions Senator Hickey center Chesterfield. The question is what the chair. I'm unclear as to why the motion to adjourn is not available. If you will okay. Good question I'm sorry that I didn't make that clear you give me an opportunity to place did you go in a little more first of all I just want to. So you don't bug Steve all of time there are a couple of great sources on this Roberts rules
and Mason's rules online they're all consistent. We generally use Mason's is the foundation of our of our rules if you go to page. Senate Bill Page forty four. Okay. Your question is what allows a motion to adjourn now debatable. Aw it till I did my further
research and we discussed it extensively. You would think a motion to adjourn is not based on. Well this is not really a motion to adjourn this is a substitute motion. Motion to adjourn as the nature but in the rules it comes substitute. I. And it says the first wine. That a substitute motion. Is debatable. It.
It is non debatable when the motion it is to be it's trying to a man trying to replace is not debatable so. You Senator Rapert spur regional motion would have been non debatable. Then the jerk the substitute motion to adjourn would retain its non debatable character. But because. You've got a lot of other people listened that may not some yeah so that's that's the deal. Okay any other questions.
You wish to speak against. For. Okay. Senate parliamentary questions just wanna make sure everybody in the room's clear this low passes or what's the threshold is of the the majority of those voting it still is and substitute motion it's still the majority of those this is a majority of those voting if I say something wrong statement correct. Did you have a question. This Senator Hammer.
Your. This is a substitute motion to adjourn yes is in favor of the motion and it just requires a majority of those voting. Mr president I have a question okay you want to speak you have a question go ahead question because this is a motion that he's made to adjourn. This is site this is a substitute motion that
substitute then we're finished. Everything. You can't there's nothing more the body's done we can't even transacting. To expand because for a man yeah CLIA okay I wanna make sure that the member we won't just. You will be adjourned. I will not do those in it is a we have to do this in committee for the much okay no more questions
Senator Clark wishes to speak against. Okay. I'm voting against I'm wearing jeans today. Only wear jeans on the last day of the session. Because I'm planning on going home. I didn't have any doubt about how the vote was going to go. but I don't find any of this to be transparent.
Okay Senator Ballenger but what when we speak in favour okay against Senator Ballinger. Thank you Mr president you know. We're going to take a vote here to decide to go home and not take up for the legislation the reason for that and also I think Senator Hickey is is trying to protect his member from hard vote no I don't think that that's a dishonorable thing to do but the reality is.
The reason that they're trying to do this as they're afraid that the resolution will get a two thirds vote why would the resolution get a two thirds vote. Because your constituents want to vote for this. Because in Texas babies lives are being saved today and have been for ninety days every single day babies are being saved at least in Texas you know what's happening there drive in Little Rock. Go sit outside the abortion clinic Little Rock look the tax
Texas plates Texas Playtex sport Louisiana Arkansas Texas Texas Texas Texas they're coming here to kill the weeds. Okay I want to go home I don't want to be here. But I came up here to save babies as much as anything else. And. What back home that's what we did we kill this motion to to to to go home to adjourn that's why that motion to probably get two
thirds vote real close to it because your constituents want to vote for I don't I mean honestly I think. As much as I want to be home because we don't want to go Christmas shopping with my babies and action taken supplied to do all that stuff I want to stay here because that's what. I appreciate the vote. Aw for the motion to get Senator Rapert. President. Members as I said previously.
This is a body of a process procedure. This is what we do. Some not mad at anybody. For whatever their decision is it's a process. This process for me is about standing up for what we said we wanted to do it the first this year the first session. We passed ACT three oh no. We pass that twenty seven of the members of the Senate actually passed at three oh nine.
Seventy six members of the House pass this bill and we were proud of it. Two years ago we were named the most pro life state in the entire nation. As a result of what each of you pro life membership nine each and everyone of you and I've heard you speak about it in your districts. We're proud of what we've done. We came in and passed SB six which was a total ban on abortion except to save the life of the mother. Strong which thing we've ever done.
In a federal judge enjoin that. But what's happened is since we did that action and they stopped or bill from saving babies lives. Texas passed the Civil cause of action that's a strategy and a new tool that we did not have available that we didn't know that we could really use. And can I tell you today that right now. Right now IMO's low which we passed.
Has a substitute Civil cause of action that is available right now. That said that that Civil cause of action is available I was confirm that yesterday. So we have had this that we're using in some form or another bill and what I'm asking members to do is to do what we said we wanted to do at the beginning of the year in many regards frankly it's a technical correction all it's doing is replacing state action with the civil calls of action.
Just to Senator Ballinger stated. The state of Texas they now say they've estimated over three thousand babies have been saved and just over ninety days in the state of Texas. We're not the first to come up and and do this again. The state of Florida cited in Forbes has already followed suit with Texas is filed the same sort of bill there the state of Ohio has done that there so my question to you is I close my comments and ask you to vote
against this substitute motion to adjourn. Allow us to handle the business we could be out here in a couple days if you want to. Absolutely. I'm going to say is I close my my comments. The second provision of the Arkansas Republican platform says that we honor the sanctity of life. The first first is faith in almighty god in and I look at
the twenty seven of you that stood up for life. In all I'm asking you to do is what we've done every step of the way now for ten years. When we see a tool that can save lives we stand and use that tool. I got up this morning I put in my pocket this rock from Jerusalem the streets of Jerusalem but I've carried every day from fourteen. Why is it important to me number one it says never leave a stone
unturned what why would I not use a tool that the state of Texas is using to save babies. When I know the tool is there for us to use and quickly. The second thing is when I think about Jerusalem is most holy city in the entire world. We thank god is the giver of life. And I do believe that I know many of you do too. Then why not at Christmas when we go celebrate the birth of
Jesus Christ as our savior who gave his life so that all of us could be saved would we not take a couple days to save the lives of unborn babies I appreciate you vote against this motion to adjourn and let us handle this business for the people of our state. Yes all the Senate bill or are we. We're debating the motion is that.
All of the. Aw. For. All the. Back this chair gives wide latitude Senators your elected and if you want to read Dr Seuss as some have done another bodies. That you could do that you could talk about and it's not my role to when someone is speaking for
against the bill for against a motion to tell them that the veering into the debt you're not hearing into the death of a law so I give wide latitude to. All meetings are a. Okay. Well I'll have a look at. Well you you can make a motion
to substitute motion FOR immediate consideration although I believe the president's. Which all states. Yes okay.
Are you I ask if you would be allowed it would be a lie because it would simply be to stop this debate and move on to the vote on the substitute motion. There are. You've heard the motion it is a proper motion all those in favor say aye. Follows. The ayes have it and now we will vote on the.
We will vote on the we're gonna vote on the substitute motion. To adjourn sine die all those of favour say aye. Follows. Is have it. One two three four five six madam secretary please call the roll. We have a pair at the desk.

One second this relates to the ballot and so it is proper for me to recognize Senator Garner correct The question I have for the chair for procedural part is Senator Hendren requested leave earlier yeah he should be he should not be S. correct I don't think it. We have a prayer today as I understand it but it's the members of the majority of people here he's not actually here that the pair overturned that because he's not here.
We're. One second. Yes to be think it's a majority of those voting not those present one second. Majority of those voting. Majority of those voting. It's not it's not gonna be dispositive the way but it's a majority of those voting record just wanna make sure. President. Is this related to that is
