Well thank. Thank you very much members I think you'll still have me here in a few months I'll have a I'll have more of a speech prepared but this is a responsibility I take I take them with a significant amount of a diligence and I I want to thank Jimmy Hickey I mean this is this is a bigger job that I may need to separate and I've been here ten years I couldn't imagine doing this without without Jimmy Hickey has been the only way I can describe
since the moment that I was elected he's been magnanimous towards me I mean we're two months out and offices are his offices already empties latitude you never wait to me nice I cannot thank you enough and I think that transitions going to matter to our entire body the way we move for treating each other anyway thank you for that Jimmy so.
Okay so. Or get started members I want to go over a few housekeeping rules. we don't have buttons in the Senate some you have members maybe one or more they are we vote by vote of our voice of our hands and so when you get asked when your name is called if you're yes you say yes or yea and say like like ninety thousand people elected you right it's hard a lot of times it's really loud in here some
for for the staff to hear you members to hear you say yes or yea if you're a no you say no or nay if you want to be president you say president. If you don't want to be recorded at all stay silent. Comes up will also work for yes a thumbs down will also work for no customarily we always run through it then after everyone is voted whoever's in the chair will say has everyone voted that wishes to vote or change their
vote at that point you will have a chance to change your vote if you want to or if you didn't vote the first time three you have a chance to vote again so we're gonna have a chance to vote on several things here and please make your make your voice heard when that when that time comes. Yeah we got some new members of some new staff in case you haven't seen but with Steve's retirement we have added a new US legal counsel slash parliamentarian that is philopatry Phillip regulate the heavy.
And in the person's going to take up a lot of the brunt of the beatings the session on behalf of me when I do things wrong we have Zachary rockers in the back he will be assisting me and all you this session. Yeah Zakri there is in the back corner and he will I'll get you all his cell phone number very soon. Okay so the next item for item number two on the agenda is the recommendation from the ethics
committee to the ninety fourth General Assembly that the loss of seniority for Senator Alan Clark be sustained and he remained at the position thirty five. I'm gonna ask you Senator Kim Hammer if you would like to come make a motion regarding that agenda item.
Senator Hammer you're recognized. Thank you Mr chairman make a motion that the Senate up hold the recommendation of Senate ethics committee to suspend Senator Clark to the thirty fifth position make that motion. We would like to speak for or against the motion. Senator Alan Clark.
Senator Clark you're recognized. Thank you Mr president. I don't really want to speak don't expect to change anything but. The. To punish someone who's not guilty. Of is a serious thing and for those of you. Of. Who might not know of I think I owe it to you to at least present some facts.
Of what I was charge with was falling for was charged. Thanks George. When I begin to investigate. The member had. Receive sixty four hundred dollars. In pretty on for an attended four days. I couldn't make the numbers out. I kept trying and I'm a math guy kept trying and trying to could make him out of. And finally.
I tried something and it worked. And what work was. I had it in we can't. And then I had my per diem pulled hello to my party. Sure enough. I was getting paid per diem for weekends. Then again to do some investigation I talked to pass pro tem's past speakers. And found that the decade old
practice that went back at least eighty nine a trace to back that far no goes back further but although we started in two thousand fifteen and started again in two thousand seventeen. Then I thought I don't really want to be the guy to bring this out. Six hundred thirty four other people besides me I don't think it's right. We've actually said it's not right we said you shouldn't get paid for not attending meetings. Of course I had the issue I was already looking at.
Remember that got paid sixty four hundred dollars. For expenses. And only intended for days. And I fold that ethics charge. And I thought. That that member would probably figure it out and bring it out and they did no there's nothing in the report. But they did figure it out. The center and said senator Clark how many days a week for you paid for. I said seven.
When I was asked if I want to withdraw this charge. I said no. When all is said nope in order to follow charge it says here under rule twenty four oh nine any member of the Senate who has good reason to believe that a member or members of the Senate have violated the Senate's code of ethics ethics may petition the Senate ethics committee. To meet in a public forum an executive session to conduct an investigation regarding the alleged violation. Why did reasonably. Number six sixty four hundred
dollars and only intended for days. We have had Jill thirds to stood here before us and told us that was against the rules and that member has stood right here in the well and quoted that rule. Have their own bills so I could reason to believe. But what I was told withdrawal that there's no need to be to withdraw that this committee could say Hey. No harm no foul we. We don't think they're really meant to do anything wrong.
But I just didn't just say no I said but. Even though they paid money back they're still question thirty four hundred dollars. The only intended for thanks sought in the report. It wasn't that I wanted anybody to be punished that wasn't something even the member was responsible for that was something for the ethics committee to look at and say. Should we be getting paid for the weekends and especially for not here at all.
If that's not an ethics questions I don't know what else I was told later by leadership but that's actually what we decided not I think way more this body in the house to that anybody ever decided. That we would pay members. Expenses for weekends that they never came on the can you imagine that all of us never came and we paid us all expenses for weekends. No possible way.
So four thousand dollars has been paid back. That can't be. A frivolous chart. Half million dollars per session that goes out for a weekend per diem is in question I can imagine that we would continue this practice surely we want that can't be frivolous. Senator Blake Johnson for

What that has to do with the frivolous charge I can't take it it seems to you know of a political protest. First amendment is protected first amendment speech that may make you very angry. But it has nothing to the fertile Sturch it said that I had threatened the Senate multiple times. That's not against the rules but it's also not true. The evidence that was presented was one newspaper article. And some.
Facebook post. What is true. Is that I have defended members of this body. Numerous times. Linda Collins Bryan King Stephanie flowers jim Hendren who was a perfectly fine to Cecile Bledsoe. Bart Hester and others who mention because you don't even know you were attacked. And so offended Mark Johnson and in this case it was in the paper
in this case I set a bar in the house and that's the only thing I sent what what through all the articles in it And notes on things that this is the only thing was brought out and by saying aye burn the house down a method in that July meeting. That I would bring out other things more serious things that could've been bows at the charges. And perfect under perfect consideration I did not. Never said anything else but any of you anyway. Which is more what you would expect it from me from the last ten years.
The Facebook posts that were presented as evidence once a Sunday school lesson. You know about king David. And you know and one the first thing Senate because a friend had brought up to me years ago that well the first thing stated business as what's the reward and right there in and it says you know first thing is make sure you get paid well if it was a this who in the world would pay me. Ill call Mars is the one who first said that it had something

It is ridiculous said nothing to there and then the other is something to from jim Croce operate up if you know anything about popular culture jim Croce is singing about the guy the depressed standing in a phone booth. Having no one to talk to. But the operator in tears not exactly a threat. The only Facebook post made in all that time that mentioned the Senate.
Was a defense of Bill sample. Please leave him alone. Because people were coming after him because he made the motion to turn me over to a prosecutor. Yet it was said that I did this because Senator flowers second motion. Sir Clark from an asset you talk about the motion. Less less about the fact that we're we've given you some time and I'll give you some more but
try to stay on the fast the motion thank you. Like I said I didn't expect to change your minds people are politically invested some people are angry.
I'm truly disappointed. I used to really care what you thought. I would have thought. That you would know me better. And some of you did and didn't have the courage to stand.
This thing about protecting the Senate in sacrificing me. I can handle anything that you do all I couldn't but with god I can. I'd rather be me. In any of those that are doing this. It's all about protecting the name of the Senate. This is embarrassing but it ain't because of me.
Senator Clark I spoke against the motion would anyone like to speak for the motion. Against the motion. Senate you're recognized for substitute motion. Thank you Mr. Members I was part of the ninety third General Assembly but not the Senate and as a new coming member of the Senate we're here
to organize the ninety fourth General Assembly and As I look at the options of voting for or against the motion that was offered. I couldn't find a comfort zone for me I was not part of the litigation and the and the arguments that were made and I understand Senator Clark coming to defend itself I've not spoken with him at all since all those proceedings I watched a lot of them on on the TV.
But the bottom line is I felt like if I was to vote for this motion. To set his seniority of thirty five for the ninety fourth General Assembly. That I would be voting for further punishment. I do want to respect. The decision of the ninety third. General Assembly and the punishment that they imposed which was to strip him of his seniority. And so.
It seems that if I vote against the motion. To sediment thirty five then I'm. Then I'm voting against the penalties that were imposed by the ninety third General Assembly and I don't want to do that if I vote for the motion that sets it seniority at thirty five I feel like I'm voting to impose further penalty than what the ninety third General Assembly had. To had authority to do so my substitute motion is this. That we.
Respect the decision of the ninety third General Assembly and the fact that they stripped Senator Clark of his seniority and that he come in to the ninety fourth as. A freshman like myself. That instead of setting his. Seniority of thirty five that he draw with the rest of the freshman. With this prior service not recognized. So my. Substitute motion is that.
That he would draw with the rest of us knew coming members and his seniority and for our membership would not be recognized. Thank you. Senator Hickey you're recognized to speak on the motion. Senator Teague you're recognized for a substitute of a substitute motion. Yes I'd like to make a motion that we oppose the US Senate ethics committees recommendation with one small change in that the day before we come into the
session it says that the timely ended the eleven fifty nine or backed it up to eleven fifty eight so we comply with the rules of the change thank you. A recommendation interpretations Senate rule seven point oh five a seniority concerning previous senatorial service. Senate Chesterfield you're recognized. That was a substitute motion does not have to then be voted on as the main motion or do we do that in the Senate. That was a substitute motion does it have to be in the voted on as the main motion or is that
not what Mason's requires. Once it is taking place in the in one it is voted upon it becomes the main motion in most parliamentary procedure and then we vote on it as the main motion four hundred masons once a substitute is taking place is it just automatically the main motion. This is. I'm asking.
But in many parliamentary areas the one the substitute is offered in then becomes the main motion and a second vote is taken and so I'm asking you if that is necessary under Senate rules it is not okay that's what I need no thank you. All. So Senate Johnson you're recognized for parliamentary inquiry and this is simply I guess it's for state it may be from the chair of the motion passed to sustain or shall I say continue the.
Page but recommended on Senator Clark in the ninety third General Assembly. and it's my recollection is it would be continued through the ninety fourth General Assembly to I guess the end of the ninety four generals. At that point with that. seniority eight thirty five. Remain or would be re referred send me for example Sir Clark road for your term today in the ninety fifth would he referred to his previous position of
seniority. Has that been clarified I think my interpretation of that is he is now thirty five if there any changes he moved thirty four thirty three on on as if he was thirty five it would not be continued on past the ninety first General Assembly those are cal Council concur in that.
Eleven fifty. The question is is we're only talking about seniority starting a ninety four General Assembly will will Senator Clark specific in thirty five have the ability to move up or will be thirty five in perpetuity.
My question is if in the future at the end of the vote for. Would Senator Clark seniority go back to what it would have been otherwise for will he be restored to worry laws or is this an effective lasting punishment aged thirty five he might move up to thirty six thirty four thirty three whatever I thought I'm I'm I know that this may be more technical may require require okay but I did want to get inquire if at all possible and I'll withdraw my or just because
it's already confusing and well I think I think Senator Johnson's Inquirer was Is. Not confuse myself when I had a very clear answer but Yes senator Hammer. My dress with thank you senator Clark should means senator Johnson's intention you can clarify that is would that be okay with the chair I thank question is that based upon what we just voted that one comes the next time around in the next General Assembly meets will
Senator Clark referred back to where he is prior to that or will he for example five new senators come in next time he would go from thirty five to thirty and resume there is that I think the No it's is it through thirty five today and everything else remains the same just like any other member so it's it's as if he came in through thirty five. And so all all of the rules will
remain just like any other member. So the only thing we're we're choosing vases Senator Clark is thirty five the nothing nothing else beyond that. Okay moving on to item number three recommendation termination Senate rule seven point oh five a seniority concerning previous senatorial service this is involving senator Bryan King my interpretation of that rule is that senator Bryan King has previous service and therefore he will be number one in his class.

Seeing no objection moving on item number for discussion adoption of Senate rules for the ninety fourth General Assembly. I guess I need somebody to come take the chair Senator Dismang or Senator Hickey would you centers my.
Senator Hester you're recognized as in a rule change. Some members I'm gonna propose we follow the house's lead which is something we should rarely do. But the the house has a rule that allows members to trade committees. and I'm I'm making or a proposal of a rule change that we can trade committees and a committee for a Committee beef Committee for B. committee or a or B. four C.. during today only.
and you will not be able to trade a vice chair or chair position so only members position and it all has to be signed off by the minority leader for the Majority Leader whichever party or in and the newly elected pro tem so I'm happy to answer any questions. Members you've heard expectation of the rule change with any questions. If you're recognized for a question. Just just for complete
clarification he said today we need you want to put a time on it or are we saying. Midnighter or have you want to do that just so that everything will be clear so I would say close of business today which I will say that I'm. Thank you Mr ladies and gentlemen of the Senate I'm one of those who understands that when trains are rolling and I'm about to get run over back of blues but I would be remiss if I did not say that I think this is a poor rule. There is absolutely nothing six people can do to diminish about. Not anything. You have one and you have one greatly. And now we would be so small as to say that if three of us had
an interest in a Committee too bad to say. Too bad to say and that's exactly what you're saying and that's fine if that's what you want to do but I don't think it speaks well of this body that I have known all these years as a deliver to body that has been expansive and allowing the intercourse of conversation. And what you are doing now is diminishing the ability to your anything that does not agree with what your thought processes

I'm not a big fan of of partisanship and some of my democratic friends might actually not like to hear me say that but it's the truth I don't like a label being put on me and I frankly I don't like putting labels on other people I think it limits as as individuals I
think it limits us as an institution and because of that it limits our potential as a state I think parties the idea of parties is a means to an end that end being policy but in politics in America these days it seems like parties to become an end in themselves. Winning for winning say no matter what where when it becomes more important than what you've won and a lot of cases what you've lost in the process as well now I'm not ignorant to the political reality that senator Chesterfield alluded to.
Hi and the fact that we have to operate within that reality that reality is in the ninety fourth General Assembly twenty nine senators were elected as Republicans and six were elected as Democrats. Anna Senator L. Chesterfield eloquently said. Why why I have this rule with those numbers there's nothing that the six members of the minority party can do to stop any legislation that comes out ultimately so why have the rule as a practical matter I'm not
sure this actually is going to affect any committees that any of the democratic member select anyway which makes it even further unimportant or irrelevant but beyond the practicalities of it there's a bigger issue here in my opinion this is what senator Chesterfield was getting at. We're going to have those labels put on us a Democrat Republican other labels as well that we may not like very much but there's one label that all thirty five of us have in this chamber and that label Senator.
That label Senator. And that means a lot of different things one of the most important meetings it has is that we're here representing ninety thousand people in the state. Now it's not a coincidence that any of you are here representing your districts your constituents chose you. Well senator Chesterfield constituents chose her to be their voice to be there Senator the same for Senator Leding and senator flowers senator for loving Murdock and myself. The way this institution is
always operated is that once you're here everyone's voices equal. And what this rule says is everyone's voice is equal unless you're a Democrat. And the committee selection process. And we're chipping away at what that word Senator means. And when you start to chip away at it. You don't know where the next steps are coming. So. I think this rule lowers this institution and I think it's a poor way to start off the ninety
fourth General Assembly. Sir Clark spoke against the motion we would like to speak for the motion saying on Senator Leding you're recognized to speak against the motion. Thank you Mr president I will be brief my colleagues made most of the points I just wanted to refer back to the story that I had the fortune to share last night orientation meeting right talk about some of the very important bipartisan work they were able to do I know we will have partisan fights in here but
the from welding amount of the work to be doing here doesn't fall across partisan lines we're all working together on issues to better serve our Kansans and as I said last night you never know what you're gonna get that vote that you need and so there are just six of us what we would need this rule to further restrict for any of us choose they would be best able to serve their constituents by picking a Committee I just think goes against the whole spirit of why we're here so I would ask that you vote no thank you. There is no reasonable explanation for changing this rule. It used to be that we could choose our committees and. We could have for. On the Committee. From the minority party. Or maybe we had the tainted to three. And three still wasn't enough to
defeat a bill committees are made up of eight members it takes five members to pass the bill. So I don't understand the point of this I was elected justice Senator Clark senator Chesterfield Senator Leding said. I came here to represent the people in district eight. I hope you will allow me to do that. And allow other members. In the minority party to do that
we need to know what it is that we are deliberating on in this body and sometimes. The subject matter of the committee might be more important for one part of the state maybe the part of the state that I represent. And maybe two other colleagues on the democratic side. Feel the same way. Should we be shut out. The been having some.
Input impact into those kinds of decisions. I come from Southeast Arkansas. A rule part of the state. You have to look at the makeup of the body where the most members from. I welcome the new members even those that are. Laughing I don't know when the last scene At me or what but hope that we can all get along. I understand that I'm human I
represent our Kansans just like you all do. In the majority party I think this rule is wrong I think what before we start changing rules we need to consider the reason for changing rules. What's behind the change what are you trying to do. What's the impact going to be. I appreciate a novel. Senator flowers against the

Members this rule change represents the elective will of the people of Arkansas and mirrors the percentage in this body and I would appreciate a good vote. All those in favor of this rule changes. Of for those over the new I apologize you haven't seen this before for those you the returning senators this was the rule change that I handed out to you during our last meeting and it just clarifies the responsibility and procedures of the Senate ethics committee it takes away. The executive session and twenty four point zero eight. Five. And it adds this section and
twenty four point ten on procedures it the. The biggest change is that it means that this committee like every other committee and the General Assembly as a whole does its business in public the claimant responded in any ethics complaint shall make their statements in public all witness testimony will be in public and the respondent has a right to retain counsel and have such counsel at the ethics committee meeting and the respondents
council shall be allowed to direct questions to the respondent the claimant and any witness and these are constitutional rights that are enshrined for just about any. Tribunal of any kind in the United States of America these constitutional rights are guaranteed it also states that the ethics committee hearing shall be live stream and all testimony recorded and archived as we do our standing committees as well as our special
committees Legislative Council audit and Health C.. the final thing is says the S. ethics committee may only meet deliberate in executive session after all testimony has been heard from the claimants and respondents and from all witnesses the claimant the Committee made deliberate but not vote in executive session. Any findings and recommendations by the ethics committee shall take place by public vote those of you that have served on different to boards or
commissions or city councils or a quorum court's know that that's how we do business in Arkansas sometimes there may be an executive session but before an official action is taken you come back in the public and the public's business is done in the sunshine so this is to me a clean up thing I don't in anyway disparage the authors of the. Previous ethics rule because we're kind of feeling our way along and trying to do things right but I think a recent
situation at least for my the point showed that we need a little bit more openness and a little bit more transparency and a little bit more due process so I would appreciate a positive vote on this rule change be happy to answer any questions if there are any mission Mr president there any questions Senator Mark Johnson Senator Solomon you're recognized for a question this is address the issue of a someone who's charge to withdraw their complaint right right you're just prior to determination the senator I
would not affect that in my opinion Senator Solomon one way or the other so it doesn't change the existing rule on that particular point okay thank you. Any other questions. I say the last meeting the one of the last meetings we met as a Senate business meeting I handed this out and I was originally going to have it considered at that point Senator Hickey had an amendment that would require a more than one senator to to actually make a complaint to the committee and that rules that change passed and I voted for that and handed this out but decided it would be best to hold it
until we had this meeting and I also maybe you might recall I ask if you had any ideas or changes I would be open to amending the draft of this no one contacted me to make any changes so I decide this we just go on like it was I tried to keep the changes minimal about transparency due process in the right of an accused to have attorney or the council president. But I did make that and handed

his vote and that is that they're sensitive matters are dealt with that in cases such as what we have had to deal with not once but twice in the past that it is to the best interest I think of everybody that there's the ability for the chair to be able to put this into executive session and if you want to use a comparison such as school boards for example that go into executive session this is not like we're trying to hide anything this is to the best interest of the process and as a previous chair
I would just encourage you to weigh heavily and I would encourage you not to vote for this thank you. I mean the person I'd say is thank you for looking at the ethics rules I do that I do not I don't think there pursuit I don't think anybody in this room thinks they are you know we wonder when some things that we've never experienced before as a body or the chamber in you know you would expect you're
going to flush out some issues I don't think that necessarily all those are fleshed out with this particular rule change in some of them I have some great concerns about with that I mean I would say and I thought we were headed with the ethics committee and really is a chamber was to have a more robust conversation about change that would be needed need to be made and in fact when I could rattle off several at the exchanges that I would like to see made not just for the process but as we conduct ourselves here in the chamber
with that I would ask that we you know take some time you've got a new members out here that have never seen this language and I think it's important that it is fully vetted because you know having an attorney here and acting like that you know and and giving them the right to conduct their cells that would like to see fit and that's a concern of mine and I think we need to fully flesh that out as membership with additional changes that need to be made traffic rules.
