February is black history month in the United States of America and I believe it ought to be black veterans month in the state of Arkansas colonel Todd thank you for coming today. in the culture that I grew up in basically I was in the navy my whole adult life. And when you have a chance to do a friend a solid you do it this is my way of saying thanks for the memories. Madam Clark would you please read the bill in its entirety. Maddox Maddox Clark please pray read the resolution in its entirety where is dating back to the American revolution African Americans have played key roles in the history and success of the United States military and where there are more than two million African American veterans in the United States and we're as Americans story is written in this week sweat and blood of military here is on the lower and service and we're as African Americans have stood on their diverse counterparts training and fighting for the principles of justice freedom and democracy and where as the first Rhode Island Rayment the first Continental Army unit largely comprise comprised of black new Englanders showcase African American steel as soldiers and commitment to their brethren in the battlefield and whereas just over one hundred years ago during World War one the Harlem hell fighters battled hostile forces of bride and racism and home demonstrating a remarkable commitment to the country and we're as beginning in nineteen forty one the nine hundred twenty six all electricity airman carried out hundreds of escort missions during the World War two never losing a single plane to the enemy and we're at African American veterans have use the experience and discipline they acquired in the military to attain prominent positions in the civil civilian world including David Robinson James Earl Jones Arkansas native Sheryl Underwood and Morgan Freeman in which John Hanks Alexander from Arkansas was a very first AfricanAmerican United States history to hold a regular command position as a troop commander of the troops ninety Calvary now therefore be it resolved in the House representative of mine for General Assembly of the State of Arkansas. Madam Clark please read house bill thirteen forty thirteen forty by representative Tosh regarding the supplemental nutrition assistance program and to require the Department of Human Services to apply for a waiver regarding certain veterans disability benefits if allowed under federal law represent Tosh you're recognized. Thank you madam Speaker colleagues in as we all know that ever bill has a history of story behind it I just want to briefly share that story with you as to why presenting this bill today. About a year ago I had a constituent contact me. Not just any constituent this was a combat veteran that had been in injured obviously income that. He was paralyzed him and some of his fellow soldiers were in a vehicle and I. Ran up on a land mine and he was able to survive that but you know he was paralyzed. From the waist down. He applied to the snap program which we all know is a one hundred percent federally funded program and. Anyway she applied for food stamps. His wife to. Unable to work because she has to take care of him around the clock. Three kids. He calls me up and he tells me like many of you get calls from constituents and this is when we realize maybe there's a problem and something that we as legislators need to address. But he told me that he had been declined for the food stamps. And so when I checked out it would be a J. as I found out that what they were doing is they were counting his disability check his military disability check as a combat veteran they were charging that against him and that put him over the maximum amount of money that you can make to receive food stamps. Collins I understand that and I get it I know we have to have a maximum amount that we have to draw the line and say if you make over this amount then you cannot qualify for food stamps but. What I have a problem is that when we've got a better. A veteran. That was standing our watch. For us. When over there. Let the wild kids behind. Came back paralyzed. His life was changed forever. And of all people and of all the groups and all the things that we do in this state to help people with food stamps and everything else. Our our combat veteran was declined. Because of that disability check. The college I'm gonna take you. A disability check there's a reason he's receiving that. It's to compensate Hillman I can assure you whatever amount he's receiving in no way. Can truly compensate him. Are any of our combat veterans when they lose a leg or an arm. Are they lose the right side or they're just figured. Are my constituents case paralyzed. From the waist down. And I look at a way to try to help my constituents just like you look for ways to help yours. And I found out since this was a federally funded program that here in the state that was very little that I could do. So I met with DHEA is trying to find a way to resolve and get help especially for combat Beck bedrooms it replaced in this same situation DHS tells me there's probably about sixty to seventy combat veterans. You're in the state of Arkansas. That would be affected if we could get a waiver. That your disability checks that they receive for those injuries in combat was not counted against them in the total income that they receive every month. I ask DHS that they would submit a waiver. To the federal government. Asking them. If we could have a waiver not to count that disability check. Against our veterans are combat veterans and the agents told me that the only way they can make that request. Was that they would have to have legislative authority. So I come before you today and I bring you this bill. And with your help today. We can give DHS that legislative authority to make that request to the federal government to see if they will give us a waiver not to count our combat veterans disability checks against him in the total income. Colleagues I understand that I know that. You know if they if they reach a certain amount and they're disability check is not counted against of obsolete they don't qualify I understand that but I'm just saying for what they've gone through and for the suffering they've expansion for the life change that they've gone through and because they were doing this standing or watch for us. Not counted against on the list we have DHS the opportunity to send this waiver to the federal government and see if we can get some help for a combat veteran about that madam Speaker I take any questions. House bill twelve fifty four by representative may be to amend the state's financial participation amount by using the basic project cost per square foot for public school new construction projects. Thank you before we begin the session. Some legislators gathered with some superintendents from a variety of size of school districts both small and large and they shared with us some of their concerns that they had one of their big issues was that the cost of everything has gone up and I think all of us can agree that there is probably nothing right now the cost the same that it did in twenty nineteen. But their issue with the school district is that we've got a lot of construction projects going on and currently they're being funded at two hundred dollars a square foot. The average price in twenty twenty two for construction projects at our schools was three hundred seventy five dollars a square foot they're being funded at two hundred. Now with this New rule a lot of school districts also have to add a safe room. And because of that safe room the cost goes up even more in the projected cost is five hundred dollars a square foot I'm gonna back up and remind you they're being funded at two hundred dollars a square foot. We've got to figure out what we can do to make this work there is only so much money there. And so we have to divide that money in a different way and what this bill does is it allows the current cost factors to be considered. When you're planning the budget don't you want to know what. The real budget is real numbers that's what this bill does it make some look at real numbers today not numbers that were arbitrarily assigned at an earlier point in time. If you are a fiscal conservative you should be for this bill because it's making us do it to the current budget and allotment with current numbers if you are for small school districts you need to be for this bill because it helps small school districts accomplish what they want to do very briefly I want to tell you that in committee it was shared that the top ten school districts we're all basically small school districts but I want to add that the top fifty school districts that would benefit from this thirty four of them thirty four. R. will use athletic terms R. one eight into a school districts. Those are the smallest school districts in the state. This is going to help your school district actually accomplish what it wants to do and it wants to build facilities because our school is growing. I will be happy to take questions please be nice represent bought for what purpose question recognized so I do have a question I know that our funding is done two years out. So we're we're two years off and in that two years if the costs wings back to where it's less than are we not going to be stuck at that because that was the first initial cost that's why we're using funding factors so that we can make sure that we are using. So what are you will need to be funded at the five hundred dollars per square foot meaning the state puts every penny for the building. Well that there be and that they're doing now well this the state doesn't find completely it's based on a wealth ratio and the state does not pay completely for the school district has to put money up to that of up to that cost. To support your bill a hundred percent my question is I've got some districts that have already received state funding they went out and passed a millage and then they got their business twelve million dollars short will this help them in the law this is for future I think we have a lot of issues that we need to talk about moving forward Dollars yes yes so I will say that we as a body can do something to help all the school districts that are in the crunch right now but this is moving forward we need to make sure that we corrected so we don't have those same problems moving forward so you agree that we need to go back and look at those of already been funded but inflation there is filed Hillman January or February and they found their twelve million dollars or one this I I I do say we need to look at that as a legislative body and figure out what we can do we're dealing a lot with some potential education plans and some income tax cuts that we want to do and I think all that needs to be in discussion do I have the complete solution no but I'm sure the school districts would love to have some more money I think our department of ed would love to have more money to help with facilities in those difficult situations thank you Mr chairman representative represent Wardlaw what purpose question you're recognized. And I'm real slow so you may have already said this so just kind of bear with me farmers don't do well of words. Funding factors is the language that you actually added in in place of formulas can you explain to me the difference between funding factors and formulas and how that would be calculated going forward and maybe a follow up missed Speaker. Funding factors would actually make them look at what it costs right now to build it instead of just eight arbitrary formula that is used out there would have to Max actually look and say last year twenty twenty to cost three hundred seventy five dollars on average to to build this facility. So you're using that average to set the participation rate from the state to the school I was on school board for a while so I I understand facility funding a little bit not very much. So that's what you're saying is this would change that percentage or would it change the way they look at the square footage cost I think eighty would have to analyze how they would do all of that okay representative ray for what purpose. You're recognized. A representative Mayberry I'm a little bit confused reading the fiscal impact statement it says that there's no revenue impact but then it later goes on to say the proposed bill will increase the cost by sixty two point three million can you explain sure absolutely so there is no fiscal impact in other words nothing about this bill puts more money into facility funding I mean it's it's zero we still have the same pot of money that doesn't change what does change is based on this bill. The amount that could potentially go towards each school district increases so therefore last school districts receive funding so we go from seventy five school districts that might have received some funding at two hundred dollars a square foot to potentially fifty school districts that will now receive money it's the same pot of money we're just dividing it in less dividing it less but the school districts are actually receiving more money so they can accomplish what they're trying to accomplish. So so if if you were districts are going to receive the the award. Who who for lack of better term who's gonna be the winners and the losers in a question well as I as I pointed out in this Reference here thirty four well I'll just say twenty two of the school districts for one eight twelve of the school districts are two eight seven three eight five or four eight three or five eight zero or six a and one is seven may so really are smaller school districts will benefit from this and then everybody else starts moving up the ladder it doesn't mean that they never get funding it just means that they are not able to get funding right now because we only have so much but we as legislators can put more towards it thank you I appreciate a good vote represent Vaught. But if my school does cannot finish completion if my school can't actually finish the funding that they need for the project my school would not be chosen in years would but so it can finish the project correctly to my understanding and then I wouldn't have to fall to the bottom of the list I could stay in my order and moved one hundred percent you're not going to fall back down thanks you're exactly right thank you.
