House resolution one thousand six by representative Richmond to commend Mr rose on his efforts on the passage of the promise to address conference of toxics Act of Richmond you're recognized explain resolution. Thank you Mr chairman chair I'd like to ask for representative Maddox also join in the will. Thank you Mr Speaker. Colleagues I'd like to just tell you a little bit about this individual is here today his name is bill roads and Mister Rogers sitting right behind me Mr road if you would could you stand up please. Thank you so that is Mr roads he lives in me in Arkansas and in two thousand sixteen he came into my office they said I have an idea I said okay well that's here tell me about and I didn't know when so I was interested in it and he said I want to change the law to cover veterans who were exposed to toxins who were wrongfully denied I was like okay well that's going to be a big left and you know so I started explained to him that that would be federal not state but he stopped me mid sentence and said I know it's federal so he was already doing his research and to be completely Frank with you I thought I would be very difficult for him to do so he starts on his own making trips to Washington DC countless trips over and over and meeting with Arkansas delegation. On his own lobbying our delegation lobbying any senator and representative who would meet with them and I do want to give right I really want to thank the Arkansas delegation specifically senator Bozeman because he took the ball and ran with it he filed this legislation to cover these veterans in two thousand seventeen could not get it past two thousand nineteen could not get it passed Mr roads continue to come and talk to these people talk to anyone who would listen and eventually he changed federal law and got veterans who were wrongfully denied benefits for being exposed to toxins got them covered and he did it all on his own and I just want to commend him for having the ability and just the fortitude to stick with it and get something like that done such an amazing accomplishment so let's give a hand if we could. Allege Mr roads also came to me I went with them when we went down met with the representative Westerman the first time and he brought a bill it already had this bill type does it look like just as good as anything that we had here sometimes maybe better from time to time but I want to find the problem here because. Everybody knows an agent or agent orders cost all of these difficulties and things for the veterans that were in Vietnam. But somehow another in in the wisdom of our bureaucracy that if you cross that internet across that border between Vietnam and got over into highland. Suddenly Agent Orange was no more a problem. It was had no effect you can use the suntan lotion it you'd be alright as far as they were concerned but that's simply not true. Unfortunately. Staffs are roads has also had issues that are related to Agent Orange. When he saw what happened he went up I started trying to deal with the bureaucracy in anybody this deal with the Arkansas a federal we're actually knows what I'm talking about they responded just like a fat boy with a bucket of beans they made a lot of noise the created the big state but in the end nothing really significant ever happen. And that wasn't good enough for stance on roads. He decided that he was going to continue on and he was going to make a difference. And he did not only for the people that serve outside of Vietnam. Demonstrating that actually Agent Orange is bad for you no matter where you are in the world. He also helped the marines at camp was June I'm I know you've seen the advertisements. On that probably over and over and over again. About the water camp was I myself got to drink the sweet water camp was June I get a letter every year telling me are used or ask me if I'm still alive congratulating me if I am. They just told us that you know well just think of it as a marine corps energy drink is just got extra minerals and things and. Well simply wasn't true and because of his work a lot of people that did not return did not have that that that service as a retiree would have now can get some wrongs. Created and turned into a riot. What he did and his dedication just demonstrate what is best of any American. And it goes to prove this. You need a job done go find a marine. If you want it done right the first time you go finder marine staff in seal because that's exactly what happened here with staff sergeant. Stetzer road. Superfine you're. Ross noble NO. Thank you colleagues I would appreciate a good vote. We're we're going to be here for a long time anyway so Mr Speaker would you ask the Clerk to read the resolution in its entirety. I don't Clerk please read the resolution. Whereas Mr bill road from Camino Arkansas was instrumental in the passage of the promise to address comprehensive tax is packed at in with Mr rose to join the military in nineteen sixty eight was stationed at royal Thai air base in Thailand where tactical herbicides we use and we're as after more than a decade of services rather exciting military service for the rank staff sergeant is subsequently develop heart disease prostate cancer and diabetes which he attributes to exposure to tackle herbicides use while on a military base in whereas miss rose was denied services by the United States Department of Veterans Affairs stating that Mr as the not qualify five under the Agent Orange act in nineteen ninety one or subsequent laws and wears two in two thousand seventeen to two thousand nineteen miss road work for the United States senator John both men who introduced legislation expanding eligibility of military service members harmed by exposure to chemicals herbicides while serving in the military and within twenty twenty one senator president again introduced legislation and working in a bipartisan manner and with the tireless efforts of Mr rove he's his proposed legislation was enacted and signed into law by president Joe Biden in August of twenty twenty two when Mr roads present for the signing and whereas and champion this bill before the United States Congress Mr road spent countless hours in Washington DC and during the summer of two twenty twenty two spent two weeks in Washington DC and had fifty seven meetings and nine days with members of the house of representatives and the Senate of their staff now therefore be it resolved in the house of representatives of the ninety first General Assembly of the State of Arkansas that the House representative command Mr bill road for his service and dedication to the members of the military service in its efforts to support the needs of veterans vice champion the passage of the promise to address complaints of toxics Act. Thank you madam Speaker colleagues I wanted to explain this amendment simply because I've gotten so many questions about this bill it passed out of house insurance and commerce committee about a week ago and after it passed out of the committee I was approached by several casinos who had concerns about the bill and I've worked with them very diligently over the last several days to come to an agreement on an amendment that I think satisfies virtually everyone involved in the amendment does five things number one it clarifies that income earned in a paid E. sports tournament is a is subject to all applicable tax laws in our state secondly it clarifies the E. sports does not include any House bank game where a competitor competes against the house or include it and also does not include any casino style gambling see our casino style games so you couldn't play for example you know video poker tournament or something of that nature the third it clarifies and substitute a lot of language animal manner that's more precise fourth clarifies a question it was brought up several times in committee that way in a what if someone were wagering on the outcome of any sports event tournament this bill clarify are this amendment clarifies that that is not authorized by this subchapter and the only casinos licensed and regulated by the Arkansas racing commission under Amendment one hundred would be able to do that and then lastly but certainly not least it adds representative Vivian flowers is co sponsored be happy to answer any questions. Seeing none would create a good vote. Representative ray has explained the amendment does anyone wish to speak against the amendment. Representive Haak you're recognized. We are passing over that today. Adam Clark please read house bill thirteen sixty. House bill thirteen sixty by representative agreed to allow residential actresses to perform work on three and four family homes and to amend the law concerning definitions of electricians. Representative McGrew you're recognized to present your bill. Thank you madam chairman. What this bill does colleagues is there to classification under the electoral lessons ones of full commercial license which allows you to do anything under elector or the other is a residential masterclasses which allows you to do residential work and my understanding in the career for thirty seven years at a license allowed you to do almost anything residential came into question that An inspector was in no you couldn't do that so I ask for clarification from the state election the specter said with the definition says you can only to a single family dwelling or duplex so we changed the definition to include a tri plex and quadruplex the state chief inspector has approved this the lasting in tourney has helped put the legislation together so the all the approval is it doesn't do a whole lot except just clarify that into law. I'm available for any questions. And saying and I appreciate a good vote thank you. President of the group has explained the bill is anyone wish to speak against the bill. For the bill. Thank you madam Speaker colleagues this bill would require voter approval of any new advertising and promotion tax or an increase in the rate of an existing AMP tax I just wanna be very clear on this point if you have an advertising and promotion tax in your city it would not be affected by this bill unless they try to raise the rate in which case they simply have to seek voter approval the reason I'm bringing this bill is because I think that whenever possible it's reasonable to voters ought to be able to consent when their taxes are being raised and our laws and policies should be designed in a way that airs on the side of protecting our taxpayers with that be happy to answer any questions. Being done we appreciate a good vote. Representative ray has explained the bill does anyone wish to speak against the bill. For the bill. Representative ray indicates he is closed for the bill the question before the House is the passage of house bill ten twenty seven madam Clark prepare the machine. Madam Clark please read house bill thirteen twenty seven. Thirteen twenty seven by representative Gazaway to amend the law concerning deposition of contraband and seize property and to allow forfeited firearms to be treated fairly licensed firearms dealers. Representative Gazaway you're recognized to present the bill. Thank you madam Speaker colleagues this is a bill that comes to us from the Arkansas sheriff's association. The simple bill simply adds to existing law a way that a law enforcement agency who is in possession of a forfeited firearm can dispose of that firearm currently the way the law reads there are certain ways that are permitted for a lot of law enforcement agency to dispose of a firearm that was used in the commission of a crime that includes at a public auction melting it down and and other various ways that are set out in our code this would allow the law enforcement agency to trade the firearm to a license federally licensed firearm dealer toward credits for future purchases and so you know we had a sheriff in committee yesterday that would include things testified to that would include things like bullet proof vest other firearms that the law enforcement agency can actually use ammunition and things of that nature and so that's all the bill does I'm happy to answer any questions. Seeing none I'd appreciate a good vote. Representative Gazaway has explained to the bill does anyone wish to speak against. For the bill. Representative Gazaway are you close for your bill is closed for the bill the question before the House is the passage of house bill thirteen twenty seven madam Clark prepared. House bill thirteen eighty three by Speaker Shepherd to amend the name of the south Arkansas Community College to sell Arkansas college into the clearing emergency. Eker Shepherd you're recognized to present the bill. Thank you madam chair House bill thirteen eighty three is pretty self explanatory it was brought to me by south Arkansas community college that's the current name of the community college and held radio they have asked to change their name south Arkansas college there's been a trend over the last number of years for a number of what would have been community colleges to change their name to just eliminate community and just reflect that it's a college I think the testimony yesterday by the president a committee was just that it it's you know eliminating any potential barrier that the maybe out there any preconceived idea about what the institution is a more truly reflects the nature of the institution as this and you'll note that represent Barker is co sponsoring this bill along with senators stone so it has the support of the legislative delegation from Union County and I'd be glad to answer any questions. Not appreciate a good vote. Speaker Shepherd has explained the bill would anyone like to speak against the bill. For the bill Speaker shepherd are you close for the bill. In about one thirty eight by representative banks to repeal the licensing requirements of clinics and health centers in which pregnancy of a woman known to be pregnant is willing fully terminated or aborted and to declare an emergency. President Burch recognized explain the bill. Holly's SP one thirty eight is a technical bill that was designed to clean up the conflict in the Arkansas code currently the law says that abortion clinics shall be licensed by the department of health however we all know abortion is illegal in Arkansas and the state agency cannot licensing entity to perform an illegal acts. We work together the sponsors of this bill with the executive branch in the health department on the legislation and it is the cleanest in the simplest way to deal with this particular conflict all of the reporting requirements all of the consent requirements all of the inspection requirements that apply to abortion clinics remain in the coat nothing about removing this provision changes that clearly if the law were to change in Arkansas relating to abortion we would want there to be some kind of licensing framework in place and you may seek legislation in this session regarding that or in the future session remember also that the governor retains the power to issue executive orders around this and the department of health has the right to promulgate rules related to many things relating to abortions none of that changes in the code. The Department of Health attorneys the AG's office have spent years as you know dealing with abortion litigation in Arkansas this bill was reviewed by the AG's office we had Matt Gilmore from the department of health we had the attorneys from the department of health testifying committee and they are in favor of this bill as is and I would ask that you support it today as well thank you and I ask for good. Represent mac one direction. Thank you Speaker members I am honored to present to you Senate bill one eighteen it defines anti semitism as it relates to discriminatory acts and helps ensure that public institutions continue to comply with the civil rights obligations this bill is very straightforward and adopts the definition from the international Holocaust remembrance alliance it has been adopted by nearly two dozen states either an act or an resolution. We need this bill because well the Jewish people represent about two point four percent of our population. They are the recipients of over sixty percent of religious discriminatory acts. This definition will aid in determining if there has been a violation and policy rule or law regarding discriminatory acts in single questions I ask for a good. Thank you Mr Speaker colleagues This truly is just a technical clean up bill all this bill does is remove some obsolete language I will give an example of what it does because it is fairly lengthy I know but for instance right now there's a program that's called grant them and university system it was originally called the varsity so which is making that modification and others that are very similar makes no substantive changes there's been no no opposition that I'm aware of it that's really all this does but I would be glad to take any questions if there are any. Saying that I appreciate a good vote. Percent. We would like to speak for the. Cinematics close for the bill the question before the House is passage of Senate bill one O. one per machine apart. Number one sixteen by representative wants to allow the purchase of permissive service credit under the Arkansas teacher retirement system and to declare an emergency person when you're recognized to explain the bill. Thank you Mr Speaker. S. the one sixteen creates a new type of service can be purchased at actuarial value if the classroom teacher leaves active employment for a period of time and then returns back to employment the gap years are available for purchase at actuarial value which is not cheap. The type of purchase is limited to five years the hope is to encourage experienced teachers who took a break from teaching get back in the classroom the system's actuary found the bill would not have an actuarial financial impact on Arkansas teacher retirement because the burden of coming back and purchasing those years is going to be on the member. I would appreciate a good vote. Percent worn is explain the building would like to speak against the bill.
