As our expectation that each of you will exercise proper decorum and govern yourselves accordingly during today's proceedings without objection the rules will be suspended and the Senate will dispense with the reading of the Journal. The morning hour has now begun any announcements or introductions at this time. Senator Hester you're recognized members have I think we're we're at Looks like you're just a few hours we're gonna be we're gonna be wrapped up for session then there unless the governor vetoes
or something like that we will not be back until sine die which is in. I think about a roughly may first I believe but I will I will email out and an exact date and I want to just a few minutes Senator Clarke Tucker did you have a motion on an issue. Senator Tucker recognized thank you madam president thank thank you senator this is an issue to
address on raising for tornado victims as we all know we have a Senate ethics rule that prohibits us from raising money during the course of the session now the way the rules written it if it's a prohibition on campaign contributions so I personally don't think it has any application when it comes to raising money for tornado victims but there was a question raised about this and it's also a Senate ethics rule only there's no law against us raising money during the course of a legislative session so to the extent there's any ambiguity
or lack of clarity in any way I would like to make a motion to suspend the rules to allow any member of the Senate to raise money for the purpose of helping tornado victims I'll be happy to answer any any questions yes Sir. Senator Petty you're recognized with that motion also include in kind as in water and supplies yes Sir thank you. Sender Dotson you're recognized. Thank you governor Senator with
that either the duration of this ninety four General Assembly. Is there a time certain the rule. So that the motion would only it's it's it's a good clarification the motion would only apply to the time were prohibited from raising money so the rules thirty days essentially from today because today's our last day I think this is is it from today or sine die. Thirty days from today.
Yes so for after thirty days we can raise money for whatever you want anyway so this is just for the next thirty days you can raise money but I don't again I think you could do it anyway but just to clarify to raise money for tornado victims. Senator Hammer. Medicare would be expectation understanding that for any money that we would raise to make sure that their accountability transparency that that should be reported on our financial statements you're more
donation for. For nearly fifteen or what will be the ability to make sure that somebody's actually taking money for that purpose so I think that it would be the same application as it would anyway if we're raising money for nonprofit for example no we would report that anyway because the money goes straight to the nonprofit not to us if someone gives money to us to a campaign account and then we do all that money out then yes that's going to be on a campaign contribution and
expenditure report just like it would be otherwise. And I'm not opposed to idea and all that yes I think I think I think the only way we would ever reported is if the money was a campaign contribution and that as well as we all know we're allowed to get campaign money to five oh one C. threes so that might be a case where this not personally the way I would do it I would just have people give money straight to the five one C. three but if some for some reason you thought it was best to receive a campaign contribution and then you then donated the money from your campaign account to a five oh one see three you would have to
account for the contribution on your next contribution and expenditure report and for the expenditures of the five oh one see three thank. Senator Clark you're recognized. Three of already looking. Better to sense of what to suspend role we don't think we have or to I have a a vote to acknowledge that's not the rule. Either way this is really Senator Caldwell is the one who
really wants kind of public clarity on this issue because he received some counsel that he was not able to do this so I've the main thing I think is for us to say as a body one way or another that you know he he can do this so I would I would look to Stephen Philip for for the answer to that question. What. I don't know what the motion to vote on would be otherwise so

She S. hello called and I did ask him to call us Senator Tucker and that is now this is no way he goes to anything with this campaign but is he said he had actually had been doing this to make sure that he had done everything correctly and it could be multiple organizations. Right members for as Mr Steve Mister Charles Stephenson Stevens Steve cook a native of Arkansas began his career with the Senate in nineteen eighty five and after thirty eight years will retire and we're as Steve cook earned his bachelor's degree in history and political sciences from Arkansas tech
university and his juris doctorate degree from the university of Arkansas fable and whereas prior to joining the Senate in nineteen eighty five Steve cook began his career working in the legislative branch of government on September fourth nineteen seventy nine. As a bill drafter and committee staff analyst for the bureau of legislative research and. Or as upon moving to the Senate Steve cook was hired to be the assistant chief of staff and then became the Senate's chief
counsel and parliamentarian and or as Steve cook too has witnessed the evolution of the Senate including the aero aero of Max and knocks. The brotherhood. Term limits and a change in the majority party control from Democrat to Republican for the first time since reconstruction and or as Steve cook became a counselor mentor confident and friend to the senators and Senate staff while preserving the standard of this role in the Senate and protecting the
legislative legislative institution as a whole. And whereas during Steve's cook tenure with the Senate. He has worked with twenty one different President Pro Thames of the Senate and twenty two general assemblies and served each member during these these past thirty eight years in a manner that exemplifies his commitment to public service and we're as Steve cook is admired and respected by the senators for his discretion
non partisanship historical knowledge of the Senate humor kindness inside and legal ability. We're as well Steve cook will be greatly missed by the General Assembly his retirement will allow him to spend more time with his wife Mary Kate McKinney. His daughter Melanie and Higgins and his two grand sons J. and Palmer and we're as Steve cook has been an integral part in forging a strong working relationship between the house of representatives and the
bureau of legislative research and has done so to ensure a cohesive General Assembly that works towards a common goal. A. N. four as Marty Garrity the director of the bureau of legislative research stated. Steve it's been such a valuable resource for me and I know that I would not be where I am without him Steve is become more than just a colleague.
But I am no Senator. But it's a truth you do but it's a true story and. And I'm so grateful for his support the bureau of legislative research and the Senate are much better place because of Steve. And for as Senator bored Hester. President pro tempore the student stated Steve's unique personality has been a gift to the Senate he has the ability to navigate the many personalities
within the Senate and in doing so has fostered an unequivocal level of trust among the senators year after year his dependable and unwavering knowledge of the Senate procedures and rules of the uppermost chamber is a measure is an and on in marriageable value to the Senate and the state of Arkansas. Now therefore be it resolved by the Senate of the ninety four General Assembly of the State of Arkansas that the Senate Committee and try Charles
Stevens the cook Steve cook for his distinguished service to the state of Arkansas when the legislative branch of government thank him for his countless contributions and wish him all the best in his retirement. bring this bill on behalf of representative Cozart the bill is a working bill this bill will work alongside our matrix that we use now and have for the last twenty years which is old and inefficient we have talked about changing the education adequacy in committee for many years and this is the result of bringing forth a proposed change in dealing with adequacy like to share with you briefly what the bill does this bill sets up a process of a structure for the house and Senate committees to
use during the upcoming adequacy study process to revamp the public school education funding system it is based on the Tennessee model that was put in place to ensure dollars are targeted to the needs of all students to schools to create education system is able to help each student reach high standards this includes being able to read proficiently by third grade and meet specific learning targets through their school years specifically the system recognizes that small schools to have the efficiency
is required to supply adequate resources the students facing such challenges poverty language barriers and special education needs often require more in resources to achieve the same level as their peers he did not face the same challenges. This bill provides for a new funding structure in which each child generates a unique amount of funding for the school district first of all the students receive foundation level of funding which provide those basic elements of all students needs in their schools for adequate education second weighted funding is applied on
top of that to me help meet the needs of students learning of small schools and schools with concentrated poverty and who themselves have specific Corning age next there's a direct funding that goes to schools based on student populations for existence additional funding and providing free students in grades K. three to pay for those additional resources to ensure students are par for reading by third grade there are several things that this bill does but I wanted to maybe just I have a few questions that I can answer if they are asked and have the
answers prepared I will say that representative Cozart has worked on this for some time and the question may be asked why is it coming now not come sooner it's because learn Jack was consuming all the time as far as getting this drafted to the satisfaction where was modeled after Tennessee model which is proving to be a successful and with regards to where the governor's office stands on this in the Department of fed the governor's office is okay with this as well as part of it I wanna read the exact quote that I sent the

with the state Tennessee during this is increased by one billion more dollars and we just can't afford it I do think that the the committee needs to restructure the funding formula one hundred percent but I'm concerned about subscribing it this way in law. My response would be is sorry prescribed in law the way it is and this would prescribe it a new way in law to guide the discussion moving forward knowing that is not going to be implemented into twenty five and
if we have the discussion under what is now currently in law will be limited within the constraints that are involved where is with the new one and and agree or disagree I respect under the new one it would take us in a direction that I think from represent Cozart perspective aligns more with some of the concerns that he's had having listened to to the concerned about the way it's currently structured and I share those concerns because I was there with me I guess my biggest
concern is the additional bins and what Tennessee went through with the this one billion dollars from my information I got sure and I think at the end of the day at the end of the day the amount of the stand. I don't know whether this is good or bad I know we've got a long time to do it but I don't know why wouldn't go to interim
study so that the committees the joint committees could study it. And then come back and say this is something really good. And the dollars would be there and we would make sure that what he says about rule education is a good thing that we since we're changing in this bill we are changing that issue what we deal with kids with all rent isolated areas that's no longer going to be there it's a new definition I don't know what the definition means and I'm not I just ran out

continue on with the president adequacy study but will be doing adequacy for the next two years and studying this just as well along that same path so we will have a busy time but I think it's worth it because I think most of us know that what we're doing now just really doesn't work and it doesn't it doesn't meet the needs of so many of our schools that are out there the funding formula just doesn't work so I am totally one hundred percent just from the perspective of having worked on this for so long of setting this

going to try to build around an old wall that we know that several of the stress they don't lie and so we're going to try to do this in a year and a half time under an old law knowing that run to tweak it as we go is that really the best method moving forward versus moving forward with a new approach that addressed a lot of the issues that have been expressed over the years adequacy has been being discussed would not be better to have this new model so that we can build toward what would be a conclusion as far as
not only the cost but the tweaking that can occur through the processes that are built in the bill one of the main things to consider about this bill is that it's our working bill it will be worked on for the next year and a half and then rules will be provided by the department of ed and then it will be proven that is going to do what it needs to do to be effective and efficient and adequate funding for all students and schools if for some unknown reason that something
doesn't work right it won't. Something doesn't work right it won't do the job that we wanted to do it this bill will not be made will not actually be made active until July twenty twenty five we can then take it up and if we don't like it then we can adjust from there I'm going back to this comment and uses my closing comment not appreciate your vote on this as I mentioned I was in on the Education Committee but I sat in on those means because I want to understand adequacy and I'm on a

hundred dollars if it was five hundred dollars all reporting it's down to two hundred dollars but for those of us to do our own campaign finance reports for those accounts to doing for people the two hundred dollars is it if you're ever questioning like does it have to be reportable or is it not when somebody's you know when you're filling out reports how much detail yet have removing the number it's two hundred dollars so right now we know if somebody gives an aggregate of fifty dollars or more so they give you ten dollars a month once they hit fifty dollars you have to report their name now we're gonna move
that to two hundred and so But also if you're political action committee right now I want you get five hundred dollars you had reported we're dropping that down to two hundred dollars as well for making a two hundred dollar a consistent a consistent theme. Then something that's Important for us to we're gonna be able to file a citizen to commit to file complaints online. Okay so right now you can you can handle over you can mail them in but we're gonna be able to accept them through email or have an online system but
they're gonna be a we're gonna we're gonna they're gonna work to rules on like verification who these people are because right now you know you have to have it notarized and then the last thing. It is it if you do not do a report. And for three consecutive. times within one election cycle so you missed the first report they're going to send you a letter so you didn't do your report next month you skip the second port they're gonna send you a letter saying you didn't
do your report third month if three consecutive months to ignore the ethics reporting you're supposed to do you will receive an automatic thousand dollar fine. Unless there is good costs. And there could be a lot of reasons probably for for good cause I don't know but we're gonna leave the ethics commission the ability to that define what that is but it will not be a surprise to somebody because when you sign up to give a good address right and you immediately start and so if you
don't to report you get a you will you receive a letter in the mail month one month two after the third consecutive time you don't do it not the third overall so third consecutive time within an election cycle you would receive a fine I'm happy to answer any further questions questions Senator English. that is that still you don't have to do that that's correct you still would not have to do it and then the other thing is is the. Computer financial thing online is that. Well it it will be fixed and there's a little language in here that says it will actually aggregate for you so if you're putting in somebody's at twenty dollars for five hundred dollars it this is requiring that it aggregates for you so that you would automatically know if somebody is given above a threshold that they shouldn't have which could happen accidentally if see if you
reported something on a primary or you know if that ever happens it's almost always an unintentional but the system would notify you of that the new system or is it still. I you know that's up to the secretary of state I don't know we're not requiring a particular system or new we're just giving them further instructions on with the system they do use has to be able to do okay. I hate it really critical but two years ago I sponsored we passed a bill for the secretary
of state's office to revamp their online filing. And. If passed pretty much unanimously I think and they've been working on it and they promise this promise that I can say today from personal experience that. Not only is it not working but it works against the intent of the original legislation which is transparency and and that's a wonderful thing. But I want to know if your bill has any.
What college exceptions loopholes for some of the things that can go wrong I have had software glitches that it cost me to file a report the next day after it was do you I have had the on specifically this year on a pack report I tried to go in and and review the pack situation I think we've done something to fix that act out believe it represented rated that by my may be wrong but the fact is that we
depend on this senator Chesterfield just mention the situation she had no expenditures and no contributions in the court that what you're supposed to be on the online form you could check a box that's basically it was a no activity report. And I'd. No we can do that now because the old system is dead I will call at that meeting there could and the new system is not up yet asked some members and I
put in that bill two years ago what I would call a no fault of paper filing requirements other words even if you'd rather file you can file on paper if you without having to say I don't have a broadband connections and some centers have taken advantage of that the other thing that I put in that it was that and I think this is good for everybody my life some people might like this I'd rather go online but where you could fill out an on on your computer
fill in the blanks PDF and put all the activity in that and then rather than trying to upload or whatever printed out for sending text of an email to the Secretary of State I only ask you about these. Look exceptions and and protections because. We're in a situation where as you well know this is something for our political opposition to play gotcha with and it's become so complicated that it is not
difficult to make a mistake and I I just ask you if if this bill I have not read it well enough to to be able to to know so I'm trusting you and asking you is there something in this that allows us to mitigate the fact that we tried the system didn't work for this moment doesn't exist and then work but we're gonna have to be held accountable you know you know what happened senator you know that your opponent filed the complaint says he's being investigated by the ethics
commission. And it takes a month or two or three to even take a look at it therefore we're sitting there under this cloud of accusation when really we were a victim of improper functioning software so I just I'm I'm OK with the concept of matter fact I support the concept overwhelmingly but I'm I keep worrying about. Run to the secretary of state's office the base budget at four twenty five in the afternoon
trying to get some the last day and they're already locked up this is the kind of thing I've had to deal with and I'm just asking is is going to give us the flexibility to avoid those types of of slings and arrows of the coming our way. Sure is thank you senator Johnson you spoken at that great lengths about frustrations have nothing to do with this with this bill and and well I think everyone in the group room would agree that that that the online system is is not adequate this bill I think it dresses at least some of your immediate concerns
on the gotchas and what happens now to that rather than having different different type of goals all or like from fifty dollars or five hundred moving everything to two hundred that way there's less confusion or concern about what off reporter what do I not report that eliminates hopefully helps address some potential concerns on got just and then if you look on page six. Line thirteen it says third and subsequent so if you have one time you have a problem when you run down there and you can't get it fixed my guess is that will not happen three consecutive
times in one election cycle so it does address your concern for many you know the potential concern that the online system wasn't working tonight or didn't end the third thing it does in there that helps alleviate your concerns is it the online system will require it to go ahead and do an aggregate for you so you know the exact amount of that someone has given and so or that you've reported they've given anyway so I I I I think I actually share your concerns with the difficulties of the online system that there continue to
make better work through I believe this bill addresses and helps each one of those concerns with you would still be allowed to have a hearing or whatever it the ethics commission even if you were really not in ms three in a row or something like it absolutely said you get this fine unless you have good cause meaning you have the ability to you have the ability to show good costs okay thank you senator what thank you. medical marijuana program and prohibits the department of health from disclosing the identity of a medical marijuana card patient to the state police for the purpose of facilitating a background check for the issuance of a CCL. Due to uncertainty with federal law the Arkansas state police did not extend the protections written into Amendment ninety eight which states that no patient should have any right or privilege infringed upon on the basis of their patient status
now the federal government is issued guidance that echoes the law's intent and also says gun rights should not be restricted based on a person having a medical marijuana card. Additionally NO other prescription medication including opioids disqualifies anyone from having a CC a license medical marijuana patient should not be an exception. business guy he was also a Democrat but that was a different time the in and out that bit any pitchers would probably still be the same today but that was a question they would always ask you use every time you take on something he is how are you going to pay for it and at that time our budget was going over four billion dollars and there was almost a billion dollar surplus now a billion dollar surplus the and I'd much rather have that than what we have today but if you look at the progression of things and when I've spoken up against different things for and stepped out it's trying to be looking forward and make the right assessment for the time in two thousand eight for example we governor B. B. wanted to expand that the natural gas tax on severance which I think I think I may be the only one down here at that time but you know natural gas was very high at the time you governor Beebe went down there and said we're going to base these estimates on paying for these highways on conservative estimates of natural eight dollar natural gas. Natural gas is went down and never been above the fact I think of the last four five years it's probably average around three or four dollars not much much less than what governor B. B. a promise thank my quote in the newspaper is a freshman Republican was discounts governor Beebe and say
you know what I'm glad governor Beebe is not my stockbroking predicted process so that's what you know is speak up and say and you know because you have to look future down the road I'm a farmer sadly today in our budgets today we look at the next political post card that we can put out the next election and not look for five years down the road so if you go to fast forward to two thousand nine when RSA came up. We had had a billion dollar surplus on a four billion dollar budget. Much more of a higher percentage than we do today with these
other funds which I sometimes wonder about that there really a true surplus because they're just basically build upon the federal government company in a bunch of money the economy not the old days may well Linda was down here during that time when you budgeted money didn't come in and then you had to actually make it up for make cuts or do something else and make tough decisions. So if you look at two thousand nine I did not vote on RSA at that time our economic climate was very detrimental and I see many parallels today in that are key Konami climate back then was
all the states we're going into recession Arkansas wouldn't quite there yet in years past we were typically a lag states so that wasn't something a natural for us to be going through at that time but what happened in two thousand nine the recession started hitting Arkansas the housing bubble busted any two thousand ten we go into a fiscal session in me and four other Republican legislators stood up and said that we are spending way too much we're projecting spending way too much at this point time and four of us voted
against me and not for others voted against our essay that time and was widely criticized because we were just trying to be obstructionist we were trying to be troublemakers we're trying to be that one really idealistic Lee we just believe that we were spending too much in our target spending was going way out online what that time the recession did hit in two thousand ten we only found out later that governor Beebe was using federal funds to cover state things and we had a forestry scandal when the money ran out. We also found out the governor Beebe in two thousand nine had
passed a tobacco tax that was supposed to be used for trauma centers and he did not do use that he used it to cover his own budget Linda's. It is very and and so what I'm saying is that when we look at the future so we have to be cautious if you go to two thousand thirteen when we expanded Medicaid some of us said at the time if we expand Medicaid it's going to hurt other budgets the time the talking point at that time on expanding Medicaid was it was actually going to save other budget we want to save money by
expanding Medicaid and we did not expanding Medicaid actually impacted the other budgets because in our I say it's like a balloon to be expanded one place it's got a contract other places it's just that simple we went through task forces that didn't get estimates right and missed estimates we had spent millions of dollars on consultants that could not get estimates rights we can discontinue to expand money and grow government you know we talked about the federal
deficits and the debt consider stuff bill talked about how bad it was when I first came in the Medicaid budget was going over three billion dollars now it's almost ten billion dollars most of which is federal money so every time we talk about what's the city or Joe Biden or somebody's brand in the debt we have to first look at ourselves like I said Senator Stubblefield said earlier more government equals less freedom this section is not been anything but more government more spending more programs more everything you cannot spend more money and have
less freedom accordance Senator Stubblefield and I would agree with that. If we look at two thousand seventeen would deal with criminal justice and I keep on and say the same things about looking forward instead of looking at the next political postcard and how the RSA and everything affects the future budgets and spending money when we expended we expanded Medicaid we spent forty four point four percent of our dollars on education that actually did the last two years even down below forty percent and thirty nine percent I have those figures
that I got from the bureau that I will share with anybody if you look at some of the rough figures of when we expanded Medicaid in one area as I said when you expand part of the balloon in other areas it impacts the others that amounts to if we to cap the same level of spending with Medicaid that previously had been done it in fact about two hundred million dollars these are not my figures this is a pure let's say research that I asked them to get the figures based on what I ask two hundred million dollars would build prisons back then we spent eight percent of every tax
dollar when I first came in years ago on corrections this last budget this last time and this time is still still around eight percent we have not increased RSA to address prisons and corrections now because we didn't address the two thousand seventeen now we're having to spend hundreds of millions of dollars more because it's much more expensive now to build a prison that it would be back in two thousand seventeen in two thousand seventeen I try to dress a prison crisis by putting for if you went to corrections for time to serve eighty percent
of your sentence it came with a big prospect so when the question probably got ask is how you're going to pay for it I gave several options at that time we if Amazon had been starting to voluntarily give that internet tax and I said we should capture that money and put it towards law enforcement back on law enforcement up we should bid build prisons at that time and it all got rejected in the end because people would not vote down RSA. So we get into the thing of looking at future years right
now I see a lot of clouds out there we have inflation we have supply side crosses we have a housing market that is definitely cooling may wound up even busting we even have notable economists saying there's going to be a mild recession whatever that is so looking at year three and four when we set up our spending levels and we continue to go up when we hit those levels if we do which I hope they don't I hope that it literally our economy gets better and we don't have to do that but the reality is looking at everything today is Senator Stubblefield said is our farm spending more the
questions now we're taking these costs the impacts of me and my brother we're spending actually less because we know in three or four years things we are planning on getting tougher arconic cannot continue this we cannot continue to spending levels and depend on Washington DC the second largest contributors to the national debt behind the president Congress is to governors and state legislators so when we go down here and criticize the national debt and we want to criticize Joe Biden as Republicans and do this the reality is we have to look at
ourselves I'll go back to the same point when I came back in the Medicaid budget which just going over three billion dollars now it's almost ten billion dollars of which mostly is federal money and I can remember people at the time say in our Medicaid budget just went over three billion dollars I don't know how much more we can sustain of that if you look at the point of two thousand nine when governor Beebe fail to address what was going to go on the economy and had illegally used funds federal funds to
cover state budgets as I mentioned before St. The reality is that when he didn't look at that. We're actually spending more and more and more we're laying in in price increases with learns that is in baseline spending that in three years what's kicking in in three years the criminal justice package that was just passed. When I asked about a plan B. R. essay is not a plan B. R. as agents being shooters forces you to spend less if you look at the estimate ten dollars coming in and only eight comes in RSA's
figures out how do you spend eight dollars the reality is I think that we're we have failed is not looking at situations but dedicated tax streams to pay for these ongoing things or as that Senator Davis in Arkansas learns if you can increase right now at this time you're going to create spending a hundred fifty million here you need to decrease in a hundred fifty million somewhere else. My point is about RSA is to just make my statement because I'm gonna wind up vote no any good news about video is that I guess I can get my message out and
explain it and and just do that and that's colleagues that's my point coming down here we should get back to the point that figured out how you gonna play port this idea new money coming in and this time in this economy with everything that's happening today and that's not including. All the Chinese balloons our world today is much more dangerous and the other thing is to those more dangerous if we have an economic downturn to dealing with the is we didn't have to reenter fifty thousand more people on Arkansas government dependency right now so we have more dangerous things
right now to deal with and I will say this I hope I'm wrong I hope but you know I'm just doing the same thing I said in the campaign and doing the same thing in our own lives and I just think that we need to be more cautious in spending money right now.
