House Bill 1091 was drawn up and originated with the Arkansas Association of Counties and the County Judges Association because of the difficulty particularly these little counties in southeast Arkansas have in collecting their sanitation fees. They've had the fees for a while, but people just don't seem to equate a sanitation fee with electricity, that it's something that you have to pay. So they have been collecting them and trying to collect the delinquent ones, and really the bill only pertains to after the fee becomes delinquent, in most cases after nine months. What they do at the end of nine months is they turn it over to the collector, the county collector, and the fee is attached to the property tax, and then they can't get their license renewal or car tags until they pay their fee. And most of the time that works, you know, when it's either pay your fee or you can't drive a car they pay, but there's still a problem. So the basic changes in this bill is the fact that collectors want to add a 10% fee, like really not an interest, but a fee for handling the collection after they become delinquent. The reason they want the 10% is in many cases they're having to actually hire an extra person, either full-time or part-time, to collect the fees, maybe in some situations to decide who the renter was. So it is a bill for the counties. It was having the support of the Arts Association of Counties, the County Judges Association, the Clerks Association, and I also had this read by Little Rock Property Owners Association, and they have no problem with it. That's basically what it proposes. It does encourage, not demand, but encourage the property owners to maybe include this fee with their rental fee in some cases, like sometimes they include electricity or water. I'm going to present this with a purely hypothetical situation that does not resemble my family in any situation whatsoever. However, there are some campuses, I know that where an elementary school and an intermediate campus may join each other, may be next to each other. You have multiple children at different campuses. You have cars that are lined up for maybe an hour in advance. The people in those cars, oftentimes, especially during cold weather or hot weather, their car is running, and so they are operators of the car, but those vehicles are in school zones and moving very slowly. Would this preclude those people who are essentially at a standstill from being able to use their cell phones to perform whatever duties that they needed

Thank you, Mr. Speaker. The purpose of this bill is an accountability measure for the Arkansas Public Defender Commission. The genesis of this legislation came out of a Supreme Court decision this past May. And essentially what that decision said was that if an individual in Arkansas is an indigent And if their attorney wishes to have expenses associated with their defense, those expenses can be paid by the Public Defender Commission. Now, the commission appealed that from a lower court ruling in Pulaski County, but the Arkansas Supreme Court, in a 7-0 decision, found in favor of the defendant's attorney. And the opinion has a good lesson, I think, for all of us as legislators, because the court talked about how they looked at the plain and unambiguous language utilized in the statute in making their ruling. And I think the court, in my opinion, it was a ruling that was proper based upon what they had before them. What I'm doing with this bill in an effort to use plain and unambiguous language, I want to make it clear that looking forward in the future that any attorney fees for retained counsel would not be paid by the commission. As a policy matter, they're not paid now, but to go ahead and make that clear into the statute and then make it clear in the statute that should an indigent wish to have other expenses that are associated with having their defense pulled together, that their attorney meets the same criteria as attorneys that are appointed or employed by the Public Defender Commission. The Public Defender Commission is there to provide defense for those individuals who are unable to afford their own attorney. They do that in a variety of ways. Some attorneys are appointed by judges, others are actually employees of the commission, while still others are contracted. We're just making sure that the same standards that these attorneys meet are met by a retained counsel, which chooses to have their expenses paid by the commission. I think the way I've drafted this bill meets any constitutional issues that are out there. I think it is a good oversight, and I appreciate a good vote. Members, you

explain your bill. Thank you, Mr. Speaker. Good afternoon, fellow legislators. I'd like to tell you the story of Mr. Lance Owens. Mr. Owens was serving time in prison, and while there, he plotted a way to get revenge. He began to file false land claims against those who helped to put him there. The victims of this crime had to hire attorneys. They had to invest money and time trying to clear their name and reclaim their good credit rating. This was a burden on the victims, but the crime was just a misdemeanor, so it had no impact on Mr. Owens' life. And it didn't matter how many times Mr. Owens filed these false claims, it was still just a misdemeanor. I have other examples of people who committed this crime. Out of revenge, it was false. They filed false liens, false land transfers, even false foreclosures. Clearly, we need to change the law to prevent this from becoming a pattern among those seeking revenge. House Bill 1045 accomplishes that. First of all, it will protect all citizens. The second time you knowingly file a false claim, it becomes a low-level felony. Let's say the neighborhood Scrooge gets mad. He files a false claim on his next-door neighbor. That first time will be a misdemeanor. If he files something across the street that's a false land claim, that second time will be a low-level felony. But this bill also creates a special category consisting of those who make the laws that's us, and those who enforce the laws. Filing a Falk's claim against those in this section makes the crime a Class C felony. The physical impact is minimal. The Arkansas Realtors endorse this bill. The Attorney General's Office endorses this bill, and others in law enforcement also endorse this bill. It's a very simple bill, and I would appreciate a good vote.

One is before I present one of my own, I want to make sure you can all see me in behind the speaker stand. The second reason is because I've had this done to me. I had a false claim filed against a business of mine, didn't even know that it had been filed, and leaned on my property until I went to have an assessor's report and tried to sell the property.
