The committee last week discussed including the private colleges and universities in the bill. There was an amendment prepared addressing both public and private institutions and then when the current amendment that's before the committee right now is drafted, it says the Governor may consult with educational institutions and that is inclusive of both public and private institutions within the state.

Mr. Chair I think everyone has that either on their machines or in front of them I'm not sure okay yet we do have it all right I was here see what today's Friday's here Wednesday and and representative Davis and several other members afterwards kind of said they agreed with him and we had in the line that spoke of operator error or equipment failure we have gone back and If you're on the midway down this amendment, you see page 3, delete line 19, and substitute the following.
It says now operator error or equipment failure due to operators. So Representative Davis and others, we amended that there. The other issue we had in front of you was some language with, I guess, enforcement with Game and Fish was concerned on life jackets and so on and so forth. So last night, late, and let me first compliment the staff at BLR. We got this amendment done at 9 o'clock last night, and we got it to Game of Fish to look at again this morning, and I think they are here.
And with your permission, Mr. Chair, I'd let them come up and speak on this amendment if that's okay. That will be fine.

kind of explain some of the problems that we had. Okay. Thank you. One of the first amendments that we had dealt with the definition of vessel in the original language. The paddle sports group or paddle sports, watercraft, canoes, kayaks, that sort of thing, was excluded from the definition of vessel.
Well, in doing so, the term vessel is used extensively throughout Title 27, which is all of our state boating laws, and specifically where it pertains to equipment requirements and manners of operation for vessels. So we didn't want to exclude those classes of operators that have kayaks and canoes to exclude them from the life jacket requirements, to have life jackets on board or to, you know, operate their vessels safely.
So we just wanted to make that amendment to basically strike that Section 1. Section 2 was amended. Again, the Paddle Sports Act is basically directed at outfitters or rental facilities that rent these paddle craft. But we do have, obviously, private citizens that also enjoy these activities, and we have private, you know, owners of canoes and kayaks and paddle boards.
So we needed to leave that in there that those people were also protected under current 27-101-201, which is the liability of those owners, operators of those vessels. So that needed to remain in there, that they needed to be afforded that protection, the private entities. It's my understanding that there was a, we deleted the definition of a personal flotation
device as it was actually inaccurate, that it indicated that a floatable cushion is acceptable PFD for paddle sports craft, which it is not. It needs to be a wearable type life jacket. And then the final amendment was we revised or modified 27-101-903-C4 to read fails to provide a participant with the equipment required under 27-101-203-A and any rules made under that section.
And again, that goes back, that is referring to the equipment,

quick I think everybody understands the bill one of things we do members and we saw an example when Representative Vines presented his bill in the house for yesterday said sometimes we have unintended consequences of good things and we did our best to find all unintended consequences and this one kind of came in late but I'm glad game and Fish did find it, stepped forward, and I think we fixed that.
I think we fixed an unintended consequence that this committee pointed out. Again, I've been with everybody I can imagine. I don't think there's any left out there. I think this is a good bill with good common sense, and I believe it would be a good thing for our state and the outfitters if we do this. So I would appreciate your consideration of a good

Resolution 1006. Thank you, Mr. Chair and Committee. House Resolution 1006 is very simple. The National FFA has had a recognition ceremony every year as recognizing FFA during what
we would consider President's Week. This year the recognition of FFA week will be the week of February the 18th. There will be several FFA chapters are planned to be here, and we would like to recognize them from the House floor on Tuesday the 19th, but House Resolution 1006 is a joint resolution with the Senate. This is a resolution to honor the military career of Lieutenant Colonel Brenda McCaslin-Cluck, who is retiring after a distinguished career in the Arkansas Army National Guard. She had a number of firsts in her career. She was the first woman that was ever an aide to a general in Arkansas. She was a great soldier for the 212th Signal Battalion, where I first met her many years ago, and incidentally, and Ron Angel's here today as well, but Ron Angel, Brenda McCaslin, Specialist Petty, and myself were all in a pretty big firefight,
in Baghdad in 2004, and I think probably the calmest person in the Humvee was Colonel Cluck. She and the rest of the crew perform admirably, but she has demonstrated to me that she is the highest character in keeping with all the things that are best in this nation. She really is. None of us are perfect. We are all just mortals. But of all of the people I've known, she's there at the top.
She came back home. She continued her service to her nation. She met her husband in Iraq, her future husband. They came back home, and they started a beautiful family, and I just want to honor her in this way. Thank
