Arkansas has the fifth highest poverty rate in the nation one in five children live in poverty two hundred and ten thousand arkansas have lost their health insurance tax cuts for the wealthy do not stimulate economic growth the wealthiest individuals are more likely to save or invest their additional income rather than spend at locally let's cut taxes that we know help lift the economy and help eliminate eliminate poverty like the grocery drug or gasoline
taxes let's add an earned income tax credit or child care credits education and work force programs training for small business supports let's make sure everyone has a living wage access to health care and affordable housing these are the strategies that will eliminate poverty and grow our economy we don't have to pass this bill to understand its consequences we can look to our neighbors and kansas who live through the
failed real time experiment of trickle down tax cuts and an update just last week done hyme and wrote as an elected republican and former kansas house majority leader my message to my counterparts is simple do not expect that simply cutting taxes will magically produce economic prosperity it did not happen in kansas and it will not happen for you I urge you to remember that government at is core is a service industry if desperate budget cuts

businesses for economic development projects in this state when we have an tax rate that makes it hard to attract those workers they desperately need so I want you to think about that we do not operate in a vacuum here in the state of arkansas we have to compete with our surrounding states and it's globalization increases competition is getting harder and harder so we have to be aggressive and we have to be smart and we've done that there's a reason we haven't filed the suit like kansas has in which they did massive tax
cuts that were not planned out services recurred and things went down he'll fast we've never done that we've been very meticulous we haven't used the hatchet. equitable in these tax reductions we had one for the middle earners one for the higher one for the lowers I asked my first session you know why we do in this higher income tax cut and are always her that reference we've got one for middle one for a low one for high but now we come back here after year and do just about the same thing we can taxes for the highest earners in the state in fact this year we will have done it twice. And I don't think that is a a
bad thing necessarily in a vacuum but I do think that it is a lot signed at tax cut what we're doing here for the middle earners it is inadequate and for the very very wealthy it's unnecessary there is a way we could do a tax cut and I think should do a tax cut right now that would really benefit the middle class that's not what this is if you look at who benefits under this and how much they benefit it's pretty start if you make fifty thousand dollars a year in arkansas this
point three percent tax reduction gets you seventy seven dollars seventy seven dollars is barely enough to take your family out for a dinner but if you make a million dollars you get almost three thousand dollars under this bill which is a much better deal obviously why said the person who has so much who earns so much get such a windfall under this bill when the middle class person gets
scraps it doesn't really have to be this way it's the way we've done it in the way we are continuing to do it but it doesn't have to be this where we could pass meaningful middle class tax relief I wish we would I would strongly support it but that's not the direction we're going to win fall for the wealthy and scraps for the middle class and that's why i'm a no. things here that we might not be thinking about compared to our other states. If i'm an appointment employer here in arkansas and i'm recruiting someone outside the state to come to arkansas and they happen to be in texas or tennessee I have to pay five percent higher than what they're going to pay there for them to be even in arkansas because they're gonna lose that income tax run off the top where they're not going to pay it in the other state if i'm a business and I want to come to arkansas I have to realize that i'm going to make four to five percent more
profit just to be even then operating any other states don't think those business people and good employees are not looking at that we also have a commitment from the governor of oklahoma that they are now intending to race to the zero one only contacts mississippi let their intentions note several years ago they're about we're we're out when those states go to that that competitives will be much more fears where we're out with our
income types. Here's another thing I hear about property taxes in other states property taxes or a local issue those cities those counties vote on those property taxes most of those states do not have well the texas does not have a personal property tax when you put all that together in you compare rule counties to rural counties. It's not a lot of different unless the local voters made the
choice so but ask only down in our income tax does automatically make everything up going up higher because we're still local control on our property taxes so great bill it's good for arkansas future and we need to move forward. that's going to be a reserve account set up of over seven hundred million dollars that bill is gonna be used can be used should it be needed to back fill the revision stabilization at if we have cut taxes too much frankly I don't think we have I think this is responsible way to do it and I think that's what our people back home want us to do and i'll tell you something else it's more than just a tax cut we have to keep architect competitive and I don't know if you've looked at it lately but I have.

But i'll go through the sections of the bill and talk a little bit about each one.
House bill ten twelve a mins the foy law in a way that is necessary to protect the security of the governor and the governor's family as well as the rest of our constitutional officers currently our freedom of information act only exempts the security protocols emergency procedures emergency plans etc related to the governor's mansion and the mansion grounds and this bill would amend it to additionally cover the statutory responsibility that state police has.
To protect the governor at the state capital as well as executive protection. The fundamental reason that we have executive protection is for individuals who may be exposed to a higher level of personal risk. Because of the job that they have to do and that certainly applies to the governor the governor is the head of state and with no offense to any of our previous governors I can't think of one at least in recent in memory there was a household
name the way our current governor is if you follow politics in america everyone knows who sarah how could be sanders and those folks often have strong opinions about political leaders it's no secret that when our governor worked in the white house she was the first press secretary in the history of the country to require secret service protection you don't get secret service protection as an employee of the white house unless there are real credible sustained threats on your life
it's reserved for the president and the vice president and unfortunately we live in a time where our politics is not just caustic in toxic but we've seen recent episodes of political violence members of congress of both political parties have had assassination attempts on their life in recent years. And we see on a daily basis the hate the victory all the attacks that are directed at this governor and they're not just confined to assess pool of social media
they sometimes spill over in the real life like last month when a man in ended oklahoma was arrested for threatening to murder governor sanders and her family like last year when a man and russell ville was arrested for threatening to shoot our governor on top of that we have political activists who are using foi and the fact that we don't have an exemption in the law for this to try and obtain information about the governor's executive protection and her security
detail the same people have posted the location of her children's school on social media. This is information that has very little public purpose and there's nothing in our foil all that would prevent someone with me level and intentions about disturbed or deranged individual from trying to obtain this information. In section two of the bill you'll see that we're adding a new reporting requirement that
hasn't existed up until now related to the fiscal information of state police and the executive protection that they provide they'll be required on a quarterly basis to report this information to legislative council and the joint budget committee this will give us more fiscal information about the executive protection that the governor has then we've ever had before and it'll be broken down by month by category in terms of the spending
section three of the bill adds in records that reflect the planning and provision of security services for the rest of the constitutional officers for many of the same reasons it makes sense to protect that information section for the bill deals with retroactivity there were some questions about this in the committee so to explain that in in the most simple terms possible there are pending records requests currently for
security plans for the executive protection information things of that nature and the way the voice works is the law that is in effect at the time of the request governments the request and so to pass this law umm it needs to be retroactive to protect that though those those documents from the current request and as colonel hagger I think you're a great job of explaining in the committee yesterday when it comes to the operational procedures of state police once the two space it is
out of the two it's virtually impossible to get it back in there and there's only so many ways that state police can protect the governor and so if they have to redo their operational procedures and things of that nature then that would be detrimental to there it would diminish their ability to protect the government. Section five is do not codify language that just says this act does not limit the ability of legislative audit to report information it obtains to the general assembly and then
section six is an emergency clause i'm very pleased to share with you that both the arkansas press association and the arkansas broadcasters are in support of this bill and I appreciate all of you for your input and your patience this week as we work the decision and I think over the days as they've passed we've gotten to a product that I think we can all feel go.

information related to as they're in a twelve eight one away as the statute that gives state police the responsibility of protecting the governor it says the department of arkansas state police shall be responsible for the safety and security of the governor in his or her family and he said it's been their practice that they've not released information related to that but you know they also said that there were no reco. I don't remember him saying that
but he said that it's been there practice not to divulge that information but the situation that we find ourselves in is that these records have been requested now under four and there's a lawsuit pending related to those and so for those reasons it's necessary to take this past this bill but no records exist right there are not I don't recall i'm saying that but thank you representative represent ray is left the well

I feel like you know I need to give an explanation for why i'm still opposed to this they'll even though I will acknowledge that this bill is a lot better than the previous two bills from
my perspective as somebody who believes in the importance of the freedom of information act. This bill has been presented as the security only bill and if it were just a security only bill I would happily supporter because II think like everybody else I believe in the importance of the governor security and I don't believe that we should be allowing any records to be released which if released would endanger in any way the security of the governor and her family
but this bill does go brother than that and that's the issue that I have with that's why I don't think we should pass it because the freedom of information act as we all agree is is critical it is the people's law through the freedom information act we have transparency in government through transparency we have accountability into accountability we quite literally have democracy so to the extent we dv from the norm of making record subject to
disclosure it should be for a very good reason and it should be as narrowly as possible in the case of the security of the governor and her family that is a very good reason but I don't think that that strong is nearly as possible and i'll tell you why that's how I read this bill even this bill which is limited to the topic at least of security what it says here is that anything related to the duties of the state police and protecting the governor's safety and security and that ever family as well as the mansion
and the capital is going to be exempt from disclosure. That doesn't mean that all records that would be exempt from disclosure if released would endanger the security of the governor they're too different thanks and so to put it a little bit more concretely staples is doing a lot of things in the course of protecting the governor they are making maps they are signed personnel there are scoring her their lending or the plane they're paying
reimbursements for the troopers when they go off and and do whatever they're doing in the service of keeping the governor in her family safe they are so to speak the fruits of the tree of this central mission and in the course of all these things all of which are legitimate and should be done in the course of this they're generating and maintaining records now some of those records if released would endanger the safety and scared of the governor that's where
colonel hagar kept talking about in these various committee meetings in the house and senate. The patterns and practice and even some things which we might not think could endanger the governor in a family could in fact and danger the governor of family to me they should all be exact anything which would endanger the safety conscious of the governor of release should be exact but another category of records will also be produced in the course of all this work the state police is doing in this category of records if release would have no impact on the
safety and security of the government and so what's the rationale for keeping those secret from the public we have a default rule that these are subject to foyer because they matter for various reasons reasons that maybe obscure sometimes in the moment but are very important to the public or two uh a reporter or two and advocate and so unless there's a good reason given they should in my opinion remain disclosurable
under the forum. Now there's ways that we could have drafted this that would have gotten a little bit more specific to what i'm talking about the difference between the records that if released would in fact endanger the governor and those which would not and you know there have been some ideas that we've talked about this week that would actually get more specific on that but we chose not to do that and so for that reason this is still too brand in my opinion and there's some other ways in which this is brought that's the biggest issue
I have with it but it does exent all these constitutional officers and members of the general assembly and and others I know that there will be an argument made that the travel expenses will be reported in the agreement to ALC and audit as the expression to go in there but there is just not the same as the being subject to disclosure under the foyer being subject to disclosure into the four year is a lot more detail in a lot more specific information information again which if disclosed would not end
