What we don't want to do is take a shortcut and then end up making a mistake. So please follow through on your calendar. The first thing I'm going to do is kind of go through the flow of this. So we're going to go basically the first page as written. We're going to go through this top of the second page. You see these are House bills
with Senate amendments. So these have to go back to the Senate to concur. There'll be one or two added at the bottom of that, House bills that came out to have amendments, Senate amendments put on. We're going to hear all those and then we're going to put them at the later in the calendar to pass them so we can get them back down there to the House. Then we're going to do the Senate bills for third reading and passage. We're going to do all of those so that again they can get down to the House. You go to page three, we will then come back and vote

Senate Bill 179 is a modification to the city government law that allows a city that is a city manager form of government, if they choose to transition to be a city council, mayor council form of government.
It would allow them to accomplish that without holding but one election, and that would be the election for the change of government itself. In Little Rock, and this will only apply to Little Rock, when Mayor Scott was elected, there was a lot of people in the community speaking of the fact that perhaps
Little Rock should consider changing to the mayor council form of government. And Mayor Scott did weigh in for or against it particularly,
but I got to thinking about it and realized that it'd be rather silly to have a popular, popularly elected, I'll say that three times, mayor, and then if you change the form, you'd immediately have to turn around and have to have another election. So I came up with Senate Bill 179, which basically will do this. If within the last two years you have elected a mayor under the city manager form of government, and Little Rockets sometimes call the strong mayor because we changed it a few years ago to give the mayor more power.
So I had the bill drawn up, and I took out. There were some technical things that were brought up, and I fixed it. Mayor Scott saw the bill. He seemed to like it. He said, I'm not going to get involved, but he goes, it seems okay. Once we got the bill out of committee, he asked me to make some changes, and I agreed. I asked Representative Love to sponsor that amendment in the House
when we get that over to them. But what this would do is it would allow the city board by ordinance to refer a change of government election to the people. Still require a vote of the people. It would maintain the fact that you could do it with a petition drive, but it would also allow, if there's consensus on the board, that they could provide, they could turn it to the people and
ask, do you want to change to the mayor, council, form of government?
uh the uh the amendment that i asked i had originally put in here that the wards would be drawn by the election commission as they are for jp districts under the new when it's changed the mayor asked if i would take that out and i agreed to do that and we
will amend it in the house to do that but the the gist of this bill is if little rock chose to opt to do that then it would not cause a upheaval in how city of little rock's government would operate the mayor
would remain as mayor under this form the city board members would become city council members under the new form it allows for a transitional period where those city three of the city board members in little rock are elected at large rather than by ward and it would allow a phase in a period of over the four years to where and they were all elected the ones at large were just elected for four-year terms so they would all everyone that was currently serving would get to
finish their term after reapportionment and just like we go through in 2022 everyone would would run and then they would draw for position so each ward would be six wards each one could have would have two city council members and they would have they would they would run then in 2022 and then we they would draw and when we have a four-year term we want to have a two-year term very similar to how we do it the Senate after
the redistricting process again mayor Scott seemed to like the bill he just asked for those minor changes which I agreed to do and I've already had the amendment drawn up and representative love has agreed to carry it when we get this bill over to the House. So this is about as close as we get to what we call an agreed to bill on this. It is permissive. Little Rock could choose not to exercise the rights that we give them by passing this bill. And I'm not advocating one way or the other for it. I just thought it
would be rather silly since we just had a very high profile and expensive mayor's race in Little Rock. We elected a new mayor in Little Rock, and this would give the city board and the mayor the option to change the form by only having one election rather than two or three. And so as I looked at this bill, typically we have what ends that happen when we write a bill for a specific part in our state, we end up having something in there that causes an unintended consequence for those other cities. so the only way to check against that is to look for the language that peels all

Well, the thing is that unlike the organization of our counties, which is constitutional, and by, you know, Amendment 55,
we lay out exactly how you have an organization of counties in the Constitution. Cities are governed by statute, and we have three forms of city government. We have mayor council, city manager, and city administrator. And the vast majority, as you know, are mayor council, but Little Rock has a city manager form, which has been amended to have some Little Rock-specific things in there. The city administrator form of government is what's in Fort Smith.
Again, those are optional at each level of cities, and they can change back and forth. There may be some things in the statutes that limit how often you could do this just to keep you from constantly having people do petition drives to change the form of government. Years ago, when I was working in Governor White's cabinet, we had an issue where we had a couple cities that were city manager for them, and they didn't like the city manager. So rather than trying to get the city manager replaced, they wanted to change the form of government.
So it's not always good policy just to do it because of an individual incumbent in a position. But again, to answer this more directly, it's absolutely up to Fort Smith, whatever they want to do. But we have to have the procedure because the outline procedure of how a local government is organized are these three that are in the statute. We don't have a fourth one. We don't get to kind of come up with our own idea of it.
As a matter of fact, when Little Rock proposed what we now sometimes call, they call it the strong mayor form of city manager, form of government, they had to come to the General Assembly, get the statute changed to allow them to do that. And generally, the legislature's been good about giving them that option because the size of Little Rock has some unique issues. But this just takes that idea of doing something that would specifically meet a specific example in the law.
And again, I understand your concern about, but again, only three forms you can have. They have a few variations, but basically those are the three. Maybe someone will come up with a fourth way of doing it someday. But at this point, we have those three, the mayor council, the city manager, and the city administrator. And this would create a simple and seamless solution, cutting out having to have two elections if Little Rock or even in the future Fort Smith chose to make a change.

My first 90 days in the legislature on House Judiciary, I met Senator Hayard as we discussed her, and she is consistent, and I always appreciate her being open and talking, and she knew I was coming up here. Consistently then, she was advocating for parolees to get expedited voting rights back. So while I appreciate what she does, in judiciary we had discussion again,
we've kept up with the process. I don't know how to do it. Her and I talked this morning about the Pro Board wasn't there the other evening, although it's been there multiple times, but they weren't there. So let me relay to you some of the concerns as I talk to them about it. it requires expanded reasoning as far as details finding a fact because as you'll see in the bill the old language report shall be or excuse me the report shall include the reason for each denial
of parole and this includes a detailed reason including detail finding a fact upon which the board relied to deny parole to the otherwise eligible person. Their concern, as they've stated to me, is that this will slow the process tremendously. It will require hiring more staff and in the short term before people's in place, they feel like it will spike some prison population
and maybe balloon a little bit, and the county back up. The reasons they are using now are some terms that say, such as the death of a victim, the age of the victim, weapons were involved, or prior criminal history, or something similar to that. As we discussed many things in judiciary, and if you just heard, if you were in there a while ago, city judiciary did come together as majority to have a resolution to urge the governor to look at
the parole process and some things that can be done. I do have concern in here strictly for the volume that this can cause the parole board to have to handle. And some of the things we discussed as we discussed multiple bills in there, the other things they have to look at are detailed on the Arkansas Department of Corrections website when it says in there, this is after you're incarcerated, that there are many things, destructive behavior, manufacturer contraband,
certain violations. Those all have to be. So I don't know how detailed a process. You can't go back and retry what the jury did. And I don't know that the process is going to be helped, but I do think it's going to slow down the process. So that is my reason for opposing this. I appreciate your consideration. But when you say detail-finding of fact, you've just complicated things even more. when I heard by email from the chairman of the parole board,
he made it clear that the result of this would be a slowdown in the whole process. And that's for people who are deserving and ready to get a parole and would get one if the process worked out. But for both the volume it would create and the extra work and not without an increase in their staffing to do this, He said that the result couldn't be anything but an increase in the prison population and a spike in the backup in our county jails.
I don't think that's the sponsor's intent. I know she's trying to do the right thing, and I absolutely agree that something perhaps should be done. But by tinkering with this one thing in the process, we may have the unintended consequence has told us by the people who actually carry this process out that it could lead to those serious problems. Someone may be being delayed in getting the parole that they otherwise fully deserve, and the unintended consequence that we all find ourselves dealing with regularly

Thank you, Mr. President. Yesterday in committee when I was presenting this bill, one of the individuals that spoke in opposition to it said it was a solution looking for a problem.
Well, I thought about that for a while, and I thought about the families that I have spoken with over the last few weeks whose loved ones have been in accidents all over this state, Some of which have been severely injured, some have lost loved ones because of someone who was here illegally, who had no liability insurance, was not arrested,
never showed up in court. Does that sound like a solution, looking for a problem? Tell
the mom and dad of a 13-year-old girl who was just killed yesterday in Florida,
who was riding her bike to school, and was run over and killed by an individual who was here in our country illegally. Does that sound like a solution? Looking for a problem? Tell her to the family of Alabama whose 12 year old daughter was raped, brutally raped, just Tuesday of this week by a man who had previously been deported twice. That little girl will never be the same. Does that sound like a solution looking for a problem? Tell it to the angel mom in Arkansas whose son
was killed in a wreck caused by a person who was in the U.S. illegally. Thousands of American citizens are dead as a result of people who came to our country illegally. Does that sound like a solution looking for a problem? That doesn't even take into account the hundreds of thousands, if not millions, of Americans who have died, who are currently struggling with addictions as a result of drugs brought across the border into this country by individuals
whose first crime was to come across the border illegally. Just last year alone, in 2018, our border agents seized 282,000 pounds of cocaine. This is not at the ports of entry. This is across the border. They also obtained 2,400 pounds of fentanyl. That's enough fentanyl to kill every U.S. citizen in the United States.
In addition, they confiscated 248,000 pounds of methamphetamines, 6,500 pounds of heroin. That's a total of 1.7 million pounds of narcotics in one year. So if death and addiction aren't causes sufficient enough for us to comprehend the magnitude of this issue, just consider the strain that it puts on our economic infrastructure. The millions that we spend in healthcare and rehab treating those, including our loved
ones, whose lives have been impacted by these issues as a result of not securing our borders. Everyone in here, including our federal officials, would agree that our immigration system is broken, no question. Our laws are not being enforced, and our citizens, the very people that you and I, we stand in this chamber to represent, they're tired of it. After 30 years of promises by both political parties, promises that have
not been kept, people are getting weary. You see, adherence to our laws is really the bedrock of a functioning democracy. The primary function of government, whether it be the state or local level, is the safety and security of our people. It was brought up in committee that this bill might get us into trouble with the feds. We might even lose some federal funding. That's absolutely not true. As a matter of fact, Congress at
this very moment is considering a bill that has been introduced to strengthen the interior enforcement of our immigration laws by allowing state and local governments to enforce federal immigration laws. This bill simply prohibits sanctuary cities. It defines what a municipal sanctuary policy is in subsection B, line 1, 6 through 1. It provides a penalty for the law in subsection C. And as each of you know, sanctuary policies defy federal laws which our city,
county, and state government bodies are duly bound to comply with. It prohibits profiling. Now, someone may say, we don't have a problem. We don't have any sanctuary cities. Well, let me tell you something. You may be walking around with a terminal cancer in your and even though you can't see it, you've got a problem. Just because you can't see
something doesn't mean you don't have a problem. So with that, Mr.

who doesn't have to even live in the municipality to file a complaint, and then the Attorney General shall issue an opinion stating whether the municipality is in violation of this section. Well, that's going to require an investigation, right, to figure out if they're in violation. And then for those of you who care or have said throughout this session that you care about the power of the legislature and protecting the power of the legislature, if you'll look down to line 18 in that section on page 2, line 16 through 21, you'll see where we've given the power to the
Attorney General to declare a municipality ineligible to receive discretionary monies provided through funds or grants administered by the state. So we've turned that power now over to the Attorney General to make this determination and not the legislature. I personally don't see how that's constitutional. Senator Stubbeville said otherwise. And then if you go to the very bottom of the bill, lines 32 through 34, in addition to all that, you've made the records
created in connection with these investigations of these cities that we all live in, exempt from FOI. So whether you agree with the policy in the bill or not, the bill is drafted improperly, my opinion and against many of the things that i've heard from many of you throughout this session appreciate a no vote would anyone like to speak for the bill against the bill seeing none
