gentlemen. This is a great honor for me because it is not often that a state employee works for 36 years with those who are suffering from mental illness.
Mr. Burris is a 79 graduate of Lyon College, and he has been married to his wife, Elizabeth, for 28 years, and they have three children, Frankie Markell and Charlet. And Mr. Burris began his service in Arkansas as a social worker in 1983, after which he served as Assistant Director of Children and Forensic Services of the Division of Mental Health Services from 1990 to 1992, before accepting his current position as the Director of Forensic Services. And whereas there was a luncheon to honor him on March 23rd at the Arkansas State Hospital,
And whereas Mr. Burris dedicated his career to the betterment of Arkansas and made the state a better place. Now therefore, be it resolved by the Senate of the 92nd General Assembly of the State of Arkansas that the Senate recognizes Mr. Billy Burris for his service to the Arkansas State Hospital and the people of Arkansas, and be it further resolved that upon adoption of the resolution,
an appropriate copy shall be provided to Mr. Billy Burris by the Secretary of the Senate. I would urge adoption of the resolution.

This bill simply says that public school districts cannot use public school funds to pay membership dues on educational professional organizations that then turn around and use those funds to lobby. So the law as is currently includes teachers and classified staff. This bill simply expands the definition of teachers to say including without limitations superintendents
and assistant superintendents. So in my opinion, there's no reason that we should be exempting superintendents from something that we do for teachers which is make them pay their own educational organizational dues and I simply believe administration should be included in that as well. What this bill does not do, it does not say that organizations cannot still lobby. It also does not prohibit districts from paying membership dues with public funds. It simply just says
that the organizations cannot take public money that they're paid by school officials and turn around and use those funds to lobby. So the really the decision and the weight is on their shoulders to decide how they're going to split up their money and if they want to create a separate fund or whatever where only private money goes into that fund they can use that money to then turn around and lobby. We just simply are saying in this bill that they should not be allowed to use our public school funds that should be used to educate our children
to use it on lobbying, coming down here and trying to kill bills that are good policy. Something that you may or may not find surprising is we know that superintendents have been using NSLA money to fund things, not just limos and conference extras like we've seen on some of their school AppScan reports, but they've also been using NSLA money to pay dues to AAEA. So meanwhile, two-thirds of the kids in the state of Arkansas can't read.
They're spending that money to pay an organization that then turns around and lobbies us to kill bills like Senator Clark's bill that's just trying
to help make sure kids across the state of Arkansas can read. So

What this bill does is very narrowly, it allows for a group of individuals, 1,500 or more, to be able to petition, have their local vote to incorporate if they want to, even if they're within the three-mile threshold. This is language from the Invisible League specifically designed to help the community of Holiday Island be able to decide to have a vote one way or another if they want to have a vote. This, I had a long meeting, six-hour meeting with the folks from Holiday Island a couple
of Saturdays ago. This is the only thing that there was pretty much universal support on, was at least allowing Holiday Island to have that vote and make that decision. So anyway, having all the other things that were controversial aside, this one is actually relatively not controversial.

The federal funds directs the governor to designate a single state organization responsible for receiving and administering these funds. That requires a state plan for establishing the program priorities and requirements for receiving those federal funds
and requires a state advisory group to participate in development and implementation of the state plan. We worked with the AG's office and the governor's office on this, and actually, and it designates DYS as that state single state organization responsible for those funds, and including the state plan development. So an executive order actually will be needed and is already ready to go that will have to be issued by the governor to do this, and that's what the bill does.

Senate Bill 618 is my attempt to address a problem within early childhood care and do so in a way that's been proven to be effective in other states. We've done a fairly decent job in the past as far as regards to the quantity of preschool slots.
We increased ABC funding by $3 million under this legislature and this governor. As a result, in 2018, then Congress almost doubled our grant, our block grant for preschool by $25 million. But we haven't always focused on quality of programs. And so with Louisiana and Nebraska, both in recent legislators past, they've been trying to focus on the quality of the educator in the classroom through tax incentives so that they can increase their credentials, whether it be a bachelor's degree or an associate's degree.
So what Senate Bill 618 does is it would create an early childhood earned income tax credit based on their credential. It's $250 for a certificate, $500 for an associate's degree, or $1,000 for a bachelor's degree. We took this example from, like I said, Nebraska. Theirs was much more. It went from $500 to $1,500. It cost the state $178,000 in its first year. To me, I don't need to tell you the benefits of a preschool program and what it means for our state.
The Nobel Prize winning economist James Heckman once said that every dollar that we invest in preschool is a $7 to $12 return and what it means for the state. And so I hope that you'll consider this with all due diligence, and I'll be able to ask or answer any questions. Any questions for

What this does is it provides that the remaining unexpended funds, which have been appropriated for reimbursement for counties for juvenile officers would be released to the counties for juvenile services. Right now it's
a match system and some counties take advantage of that match and some do not. But what this would do is allow for those funds that are not utilized for that match to be then given back to the counties to be used for different services. And it remains, so this would be provided a mechanism to begin to address the disparity in juvenile staffing in economically challenged counties, provides an incentive and financial support for counties that are implementing the validated risk assessment tool
that was in my previous bill, and recognizes the goal of reduction and commitment requires increased local community services so that they could actually apply for that money for all those three different things. and so this is not money from this is not AOC money but it's a pass-through money that goes to the county's direct and even if a county doesn't take advantage of the match and they give money so they're not getting that money that still it doesn't preclude them from receiving
these funds for services it just allows them flexibility to pay for this other stuff so it's a great bill and we need help with our probation officers and our juvenile officers and so that they can get better qualified folks. that data to make better decisions. I can't be the only person in this room who really has sat through all of these appropriations, and probably by the end of this, we will have appropriated $27 billion in state and federal dollars, and we don't have a clue what that money's being used for what the results are. marijuana dispensary is attempting to open within 300 feet of a developmentally disabled facility for grown women. I talked to the director there. Most of these women have the mind of a small child, even though they have the body of a full-grown woman. The parking lot that they're at, they typically walk over there when they're playing and things like that outside. And we think it's a terrible public safety issue that we have these very vulnerable population that close to these dispensaries.
We already make exception in the constitutional amendment for daycares and K-12 schools. And since this population has those similar kind of attributes, I think it would be a good day to extend that to that 1,500 feet thing. I'll take any questions. I see questions.

El Dorado, no. What they're trying to do is attempt a transfer, and you have to go in front of the Medical Marijuana Commission to do that. And so we wanted to change this law beforehand. There's been many discussions with the company out of Chicago to attempt to find another area. Thank you Mr. Chair. When I was in state agencies this bill was brought to us. It includes flags, it includes plaques, it includes all of that. And what's particularly troubling is if a young person comes along and removes a flag or someone else removes a flag unwittingly, he or she could possibly face a fine or be charged with a misdemeanor, a felony, whatever it is in the bill.
We need to be very careful when we're doing this because it does take away the local control. It does present to us the idea that the movement of anything, we are stuck with whatever it is we have today, where it is, how it is, for whom it is. And as times change, we may want to change that. We may want to move something from one area to another,
but this bill does not allow us that flexibility and when you have a lack of flexibility at the local and state level we even have a lack of flexibility at the schools because they too are public entities if they need to tear down buildings they are forbidden if it has historic significance to someone no one defines who decides what this historic significance is. No one can tell you that, say, at Arkansas
Tech, something that was historically significant today may not be as historically significant tomorrow, but this law says you've got to keep it. Or in West Memphis, or in Little Rock. And so we find ourselves on a slippery slope of tying people's hands because we want to enshrine something that may have changed tomorrow. I would urge you to vote no on the bill.

We're seeing an explosion of new equipment and technology in the safety realm that can be used by our truckers on board and new equipment. And there is a group of people that have been hesitant to adapt some of this for concerns not on their employees, But if they have a contract trucker that they're working with, that there might be some confusion whether the definition of whether somebody is a contract or if they're an employee.
So what we've done is we've clarified the language in this. On page two of this bill, it says the deployment, implementation, or use of a motor carrier safety improvement by or is required by a motor carrier or its related entity, including by contract, does not in whole or part affect, impact, or change the worker status of a driver. which clarifies that language so that they can implement this kind of safety equipment on those employee trucks, employer trucks, and also on the contractors as well without affecting that separation.

So what you're saying with this bill is that this may allow companies to develop technology that could prevent future tragedies like this if that happens. Is that kind of what your intent
is behind this bill? Well, there's already things coming into the market that they're using sometimes through technology
and equipment they put on a truck or also through coaching with that. And there's been some concern in the definition of what's the difference between a contractor and an employee, and so they want to make sure that those aren't getting crossed. This is more of a concern of being able to keep those separate and still allow those companies to offer that safety equipment, that coaching on this new technology out there, without them being considered an employee. So
they'll have a clear line in the legal definition so they can implement these things without worrying about violating the law. Is that correct? Employment law, essentially, yes.

it regulates guaranteed asset protection waivers and if you wonder what one of those is it's a contractual agreement where an accreditor for a separate charge agrees to cancel away all parts or amounts of a borrower's finance agreement with the creditor in the case of a total physical
damage loss or unrecovered theft of a motor vehicle and the contractual agreement is part of a separate addendum to the borrower's finance statement. It is not insurance, but on page four of the bill, it says a retail seller shall insure its guaranteed asset protection waiver obligations under a contractual liability or other insurance policy issued by an insurer. This allows the creditor to cancel the sales contract, in effect, and cover that loss through
this process. If also an example where if someone were, we use the term upside down, they owe more on their vehicle than it is worth and would receive an insurance settlement, this would make up the difference to make them where they would be, the debt would be covered in that. So it got 89 votes in the House, no opposing. The insurance department the automobile dealers, the banking association, the banking department, all think it's fine.

kids the first one of our if you look in section a there it's basically people who are here or children of those who are here on I 76 766 says work permit basically the kids of those who are here working legally under work permits we have many of these in Northwest Arkansas professionals who come to work in some of our businesses raise their families here the kids have graduated from the schools. But nevertheless, they are not allowed to have in-state tuition. The next one is basically
the Marshallese kids who are families that have come over. I don't know if some of you are familiar with the situation from Marshallese. It used to be U.S. territory. Now they're under a compact agreement with the United States to basically allow them to come and work here legally, partly because we pretty much nuked their islands into oblivion during some of the Cold War testing and it's caused a lot of challenges for them the other is those children that are known as the DACA kids those that came over here when they were under 16 complied with the law to register and they also comply with the conditions of
DACA they shall not be expired in order to be eligible for that they can't have their parents can't have felonies or drug convictions and then the requirements also as you see there they must have graduated from one of our schools or have a diploma from one of our high schools and have attended for three years and then the last part is it will allow the Department of Higher Ed to promulgate rules for the implementation of this so that's what it does I think everybody's aware with it aware of it I want to be clear these are
not kids who are here illegally these are kids who are here for conditions sometimes because of their parents sometimes because they were brought here here when they lived as an infant or a child and grew up here, and the idea that some of these, we would spend all these dollars educating them with K through 12, only to say that they're going to have to pay a premium to go to our state institutions where they can get in-state tuition at some of the other states makes no sense at all. explain the bill, I feel like it's important that we acknowledge the meaning of the title
and where exactly that comes from. Nathaniel Crump was born in 1987, and he graduated from Beebe High School in 2005. After a short
stint of working with Senator Hill, he actually began his work as a fireman with the Searcy Fire Department and concluded his service with the Little Rock Fire Department. He also served as a volunteer for the Antioch Fire Department, which, if you don't know, is a suburb of Beebe. On June 21, 2017, just two weeks after his forced retirement,
at the age of 30, Nathaniel lost his battle, and just last weekend, his name was added to the memorial just outside the steps here. His wife, Jessica, would tell you that Nathaniel was a born firefighter. He was a hero in every sense of the word. You know, one thing that can happen today is for Jessica to come down and give her presentation, which is a lot more powerful than really anything that I could say. But what I would take away from what her comments were is they are searching for a meaning, you know, to be brought from
the experience that her and Nathaniel had. And really, the meaning is inside this bill. And to put it as simple as possible, the reason for this bill is this. Our firefighters should not be battling to continue to pay their bills while also battling for their lives with an occupationally caused cancer. And so I want to go through what the bill specifically does. It allows for six months of leave for firefighters that have served five years or more.
This only includes paid firefighters. This does not include part-time, hourly, or volunteer firefighters. And because of that mandate, we do understand that there is a financial impact. And there was a lot of work with firefighters across the state on how do we reconcile that. And so the bill does offer some remedies in regards to that and offsets in several different ways. First, it establishes the creation of a firefighter relief pool.
This will allow firefighters to donate time to impacted cities in order to fill the void by an impacted employee. This time, again, will be donated. There will be no charge to the impacted city for that firefighter and that volunteerism that he's going to contribute. you. Numerous firefighters organically donated their time from Nathaniel and Jessica. And so the creation of this new network will formulate what has already occurred. It will formalize
it and allow it to be deployed in a more systematic way. Second, it does allow for the established catastrophic leave banks to be utilized to help offset the financial impact. And then one thing that's important to remember is it does provide for presumption that cancer is related to the
duties of the firefighter so long as the firefighter has no previous indicators or behaviors that would have caused the cancer. There
is, because of that presumption, also the ability for a city or a municipality to make a rebuttal of that presumption. They can prove that with
evidence and if that is the case and that rebuttal is made, then the city is allowed to then force that situation to go through a normal workman's comp proceeding. And so there's been a lot of talk, and I wouldn't say the Municipal League and I have agreed on the bill. I wouldn't say they're supportive of the bill. They are not. They're still opposed, but we do agree on some principles in regards to the funding cost and what it may cost the city. And so for a cost to
incur to a city three things have to be present and all three things must be present. That means you can't have one and two, you have to have one, two, and three. So first, the city must be understaffed with firefighters. That means that there's just simply not enough people to be able to go and fill out and fill the void for the individual that is not able to be there. Second, there is no catastrophic leave bank to be utilized. And third, there is no operational
relief network in place. So in essence, this firefighter relief pool that we're talking about doesn't exist, or the municipality chooses not to utilize the firefighter relief network. And to be clear, all three of those things have to be present for there to be an incurred cost to the city. And so one thing also to keep in mind, and this was a discussion with the Municipal League, is that this bill is left open-ended in a number of ways, and that is to allow, in my opinion, to allow them to be able to draft the ordinances that they need to draft
to follow and adhere, or to adopt the hiring policies that need to be in place to be able to adhere. And again, I didn't want to, you know, put something in law that would mandate each city have to follow that I believe that's something that can individually be done on a city level and with that I'd be happy to

important to bring to your attention what this bill may lend itself to and possible consequences.
And in doing so, I want to provide for you or inform you of what our current law is. Now, the other day when Senator Ballinger brought this bill, Senator English asked a question concerning a person that was nominated in the will of an individual to serve as the guardian of that person's child.
And that's the general practice. In fact, in our code, Arkansas Code annotated, section 2865.204. The title is Preferences. And what it says is, in subsection B, subject to this rule, the court shall appoint as guardian of an
incapacitated person, and a minor is an incapacitated person, the one most suitable
who is willing to serve, having
in due regard to, one, any request contained in a will or other written instrument executed by the parent or by the legal custodian of a minor child for the appointment of a person as guardian of the minor child. Two, it also provides that any request for the appointment of a person as his or her guardian made by a minor 14 years of age or older.
So, number one, courts generally look at what's contained in a will that a parent has left, and in the event of their death, a court would consider that person nominated in that will, named and nominated in that person, in that will, to serve as the guardian of that person's minor child. And two, if the minor child is 14 years of age or over, then that minor child, the court will do, give due deference to,
in terms of the child saying who they would like their guardian to be. Now, the thing about this bill is it
sets forth this option to get parents
to do a notarized statement saying in the event of their death who they want for a temporary guardian of their child.
Our code already provides for this. Now, what happens in our code, as opposed to what Senate Bill 625 would provide, is that what's in our code is subject to court supervision. And if the argument is for the bill that this is operative immediately upon the death,
well, immediately can mean a lot of different things because it has to be communicated to whoever has presumably gotten this notarized statement from the parent. So you can't imagine that there's not going to be some
lapse of time. Well, under our code, Arkansas code now,
you can get an emergency temporary guardianship. And that's
provided for in section 2865.218 of our code.
And it provides, it's called, the title is temporary guardian. It says, if the court finds that there is imminent danger to the life or health of the incapacitated person or of lost damage or waste to the property of an incapacitated person, and that this requires the immediate appointment of a guardian, immediate appointment of a guardian, of his or her person or estate or both,
the court may, with or without notice, appoint a temporary guardian for the incapacitated person for a specified period, which period, including all extensions, shall not
exceed 90 days. And the court may remove or discharge him or her or terminate the guardianship. Now, the thing
about doing it under court supervision and as our law presently provides
is that once a court appoints after, whether it's an emergency request or application for temporary guardianship or just plain old petition for temporary guardianship, which generally can be heard ex parte if there are no objections. But the point is
there's court supervision, there's a court order, and the court order, there's a guardianship order.
And what it contains, and this is all pursuant to section 2865-214 of Arkansas Code. A court order establishing a guardianship shall contain findings of fact that the respondent, which is that incapacitated person or the minor child in this instance, that they are an incapacitated person because of their minor age and is in need of a guardian for the person or estate or boat.
The order may limit the power and duties of the guardian and may define the legal and civil rights retained by the incapacitated person. So a court can limit what that guardian that may be appointed for this child that just lost its parents in terms of what their authority is over the child themself or their estate or both.
Now, one thing that is really disturbing about this bill, this bill does not suggest or indicate whether this is a
temporary guardianship for the person or the estate of the minor child or both. It doesn't say. But a
court, even if it was just a petition, even an emergency petition for temporary guardianship
of the minor child, there is in our code a section called the bond of the guardian. In 2865.215 of our code, it provides bond of guardian. And subsection A says, if the guardianship is to be of the person only, the amount of the bond shall not exceed $1,000,
or the court may dispense with the bond. And then B provides at every accounting, the court shall inquire into the sufficiency of the bond and
of the sureties. And
if either or both are found insufficient, the guardian shall be ordered to file a
new or additional bond. Now, when you're talking about the estate of some
individual, incapacitated person, the court is going to be looking at what are the assets of that incapacitated person.
And we have in Section 2865.205 of our Arkansas Code annotated, the requirements that should be in the petition, where one applies to court of probate for the appointment of a guardian, temporary or otherwise. and in that section of the code there is a provision there dip it's over 13
things that are required in that petition and one of those things is the approximate value and a description of the incapacitated person's property including any compensation, pension, insurance or allowance to which he or she may be entitled. So it's conceivable that children, minors, incapacitated
persons for the purposes of this
bill may have assets that are valuable, could be in the form of a bank account, could
be in the form of a trust account, it could be in many different forms, depending on the age of the child, depending on the parent's means to have left provisions for the child.
It could be an insurance policy that names the child as a beneficiary, which all you need there to collect on that is the guardian and you need a death certificate. And that guardian has all authority over all this, these assets of
this minor child that has had no court review at all.
Courts look at whether somebody is
eligible to be a guardian. We had a bill in Judiciary Committee this morning that dealt with, gave felons the ability in certain instances to be the guardian of the person of an individual that they have a close relationship with and if they've been pardoned or some other thing.
But generally, a felon cannot serve as a guardian, either of the person and particularly of the estate. not too many felons that I know that are able to go and get a bond to take care of somebody else's money I don't think even any banks are going to hire persons particularly depending on the crime if it was theft of property can't imagine somebody putting somebody over somebody's estate
that's stolen money or goods or anything like that. So, but the court looks at all that, those qualifications and disqualifications that would disqualify somebody from serving as a guardian, even a temporary guardian. You know, this session, I was reflecting on this bill and the bills that we've been passing this session, and many of them have to do with child trafficking.
and how we want to try to curb trafficking of children. We see it in the papers every day. Even we try to prevent trafficking through adoption. We have a bill now in our Judiciary Committee that suggests that lawyers that are handling adoptions, sponsored, by the way, by the same sponsor of this bill,
suggesting that these lawyers are doing things in the realm of
adoption cases that lends itself to child trafficking, human trafficking. And so why we
would want to just have a written document no court supervision nothing you don't get letters of testamentary
I mean letters of guardianship generally after you get the court order appointing someone as the guardian the court is going to order and instruct the clerk of the court to issue letters of guardianship after the person appointed has signed an acceptance to serve as the guardian and
also after they have posted any bond that the court has required.
None of this is done if we have this bill as our law. Now, like I said, we already have a provision in our law that says you can name and nominate somebody in a will to be your child's guardian. And one thing that I noticed the other day that I heard suggested was that a will is not operative and you can't do anything pursuant to a will until it's admitted to probate, filed with the court, heard by a judge.
that's not true when a person dies with a will there's an executor generally named in that will and it's their responsibility to act immediately to preserve and carry out the instructions and intent that is expressed in that will the last will and testament so whether that be finding the person who they have named, the deceased person has named in the will
to be their child's guardian or whether it is to pay your last funeral expenses or whatever it is. But when they do it in a will, there is something that you can take to the court and say we need
an order of temporary guardianship on an emergency basis. So my point is, and
I hope you will agree,

for opioid addiction, and opioid addiction crosses all socioeconomic boundaries from the very poor to the most economically stable homes. The bill accomplishes two primary things. It is removing insurance company prior authorization requirements on the prescription products used to treat opioid addiction, and it's ensuring that they are affordable. This also ensures that Arkansas, Arkansas, Arkansas seeking treatment are able to get it promptly before they go into withdrawals.
Most insurance companies have already done this, and with this bill, the others will be asked to get on board. We have made several amendments to address any concerns from insurers, including giving Medicaid until the end of the year to rewrite any programs or policies that they need to change. As presented to you today, there is no opposition to this bill. This is part of what is considered nationally best practices for combating the opioid epidemic

And then you stop making payments on that car. so then someone comes to possess the car and this bill says that they have to give you time to get your rims and wheels off and what has been happening is these cars the people are coming and if they have those rims and wheels and they know their car is going to be possessed they'll just leave it on blocks, on cement blocks and so this bill says that you have to give people time
to get their rims and wheels off before it goes to auction and then the people that are taking the car have to replace it with something that is kind of a standard wheels and rims and that's what the people are doing and there is no opposition. It's agreed to be. It's very important

is my favorite bill of the whole session because I really learned something. There are companies that will rent to own these oversized big wheels and tires, these rims.
And people want those. Obviously, the market created a desire for it. These people responded to it. But if the individual with the car doesn't pay their payment to the rent-to-own wheel and tire company, they come repossess just the wheels and
tires, not the whole car. So the car is left somewhere, as Senator Bledsoe says, sitting up on blocks. Well, what this
bill does is say to that repo tire wheel company, you can do that, that's your property, but you can't just leave this
vehicle where it can't be moved. You can take the old wheels and tires that came off original equipment that you saved and stuck in your warehouse and put them back on. So when the bank that actually made the loan on the car or the finance company can actually get it and roll it wherever they need to take it. And I hope there's a good vote on this, but I was confused. And when I finally learned what it was, I realized that this was just one of the craziest situations I've ever heard, but I appreciate a good vote.
