district I want you to know that the runner-up the team that they beat was Batesville but anyway they've had a great season these are a great bunch of young people and again taking the uh the the championship of the boys swim team their coaches here Kathleen Dingman and Gary Herron and uh so I just ask you we'll present the resolution when we get it from the house but I'd ask all of you to recognize them on their accomplishments and their state championship now if the coaches and I'm going to see if they can sort of gather and stay in I want to bring
the rest of the Magnolia group in the basketball team we're bringing the basketball team in the basketball team recently defeated Mills High School in the 4A championship uh I'm going to kind of let y'all just kind of line up right along the back here now three of their team members had to get permission from the junior high school to come today because three of their team members were freshmen that they elevated to the senior high team and uh coach
dying long is going to be in here in a little bit uh AETN did great coverage of the state basketball finals. I was able to watch it on the finals. Now, Darian Ford, where are you? Darian, come down here a minute. They went into overtime with Mills, and Darian's one of these freshmen, one of these ninth graders
that they moved up and with three seconds left and the magnolia was two points ahead mills threw it in to kevin cross who was their their 6'8 240 pounder power forward or center or whatever he was and uh and darian went up this little freshman went up and preserved the victory hold that up let them see it darian and preserve the victory for a magnolia panthers with a clean block coach dion long is down here and uh the thing and i really i really don't want to just
single out darian because it was really a a team effort everybody contributed but uh when darian was named the most valuable player i want to i want to tell you what coach long said about him he said he is a great basketball player but what makes him so special is that he's a better person than he is a basketball player and you could say that about a lot of these young men and uh just so proud of them and the way they conducted themselves uh even though i was watching on tv the commentator said oh many times over that about three-fourths of the crowd at least was
dressed in panther red uh there at the bank ozk stadium or arena there in hot springs so let's recognize the magnolia panthers on their state championship they're going to be headed down to the house and make sure they get down there so they can go ahead and file out this way uh but we're so delighted to have all of you today and to recognize you you want to go back that okay we'll we'll head back out this way we've got some other folks

Okay, so members, this is a relatively brief resolution. I'll read it today, and when we get it over here officially, I won't read it again. I'll just ask for a passage of the resolution. But this resolution is to celebrate and recognize the University of Arkansas at Little Rock women's basketball team. Whereas the University of Arkansas at Little Rock women's basketball team known as the Little Rock Trojans is comprised of highly talented student athletes who excel both in the classroom and on the basketball court while exhibiting exceptional sportswomanship and serving as role models for Central Arkansas youth.
And whereas the Little Rock Trojans have inspired the citizens of Little Rock by providing exciting NCAA Division I basketball that has brought our city national recognition, earning the moniker of the Little Rocks team. And, wherever, the Little Rock Trojans five-time Sunbelt Conference Coach of the Year has been at the helm of the program for 16 seasons.
That's a lifetime for coaches. Leading the Trojans to 20 win seasons, 11 of the last 12 years. And, whereas, Coach Joe Foley, raise your hand, Coach Joe Foley. And whereas Coach Joe Foley earned his 700th career victory in the NCAA tournament's first round in 2015 and has amassed a total of 768 wins. And whereas the Little Rock Trojans earned the conference automatic bid to the NCAA tournament for the sixth time
and entered as the number 12 seed in the first round automatically. So I'll skip something here and say, now therefore, be it resolved by the Senate of the 92nd General Assembly of the state of Arkansas, and given props to Tori Lasker, raise your hand, Tori, some props to Tori Lasker I've missed here. We have therefore resolved that the Senate celebrates and recognizes a member of the University of Arkansas Little Rock's women's basketball team, as well as head coach Joe
Foley and the Little Rock Trojans coaching staff on their outstanding accomplishments throughout the 2018 and 19 season. I have seen them play. We need them on our team in the Senate when we play again. So, will you please welcome them and show them your appreciation. will ask for leave again to take pictures. Thank you. Thank you so very much. It's hard to keep my composure. This is absolutely thrilling, and it's extremely humbling that you have absorbed into your hearts what I've been working on for more than eight years.
And to understand the complexity of the issue, how our children who are abused beyond words, and how that not only impacts their lives, impacts their future, impacts everyone around them, impacts their health, their nightmares, suicide rates, obesity rates, cancer rates, cardiovascular, just on and on. And in the time that I've been doing this, seeing the transformation
in adults who suffered such traumas in their childhood, who suffered all through their adult life and on into their 40s and their 50s and beyond and still traumatized by those terrible nightmares from their childhood when it's supposed to be a most pleasant time and a nurturing time that you take with you for the rest of your life, but to take such a heavy burden with you through the rest of your life. And so the call on my heart is to get more children's advocacy centers
elsewhere through the state because what's always been lost before there was ever a CAC was the truth. The truth has always been maligned, confused, contorted, even to the point where the child wished they had never said a word. And so the culprits go on to do their ghastly deeds for generations and generations. So, it's just astoundingly, powerfully wonderful that you
recognize the purpose of the Children's Advocacy Centers of Arkansas to intervene on the behalf of the children for their truth to not only be heard, to be recorded through our videotaping system through our specialized interviews that we do, not interrogations, but interviews to get to the truth and have that passed along to the rest of the multidisciplinary team. Thank you for the years past that you have recognized us
and incorporated us and made us a member of the multidisciplinary team so that we can work hand in glove with the authorities and sharing their information and helping them stay informed of the child and keeping the child from having to be questioned and interviewed over and over again and further traumatized and, again, the truth being lost in the whole process. We are so lucky to have one in Russellville that serves the River Valley. So thank you all for the very compelling, tangible work you do in the lives of these children. I know it does change lives and change generations, so thank you. I'll read the resolution now. Whereas in 2018, an estimated 350,000 children were served by children's advocacy centers nationwide,
and whereas in 2018, 17 children advocacy centers and seven satellite offices throughout Arkansas served an estimated 5,000 child victims of abuse, providing victim advocacy and support services to them and their families. And of those 5,000 children, a significant number were 12 years old or younger. And whereas, although neglect is the most common form of child maltreatment, victims also suffer year after year from physical abuse, sexual abuse, drug endangerment, commercial
sexual exploitation, and psychological maltreatment, and whereas Children's Advocacy Centers seek to model, promote, and deliver excellence in child abuse response and prevention through direct service, education, collaboration, and leadership, and whereas Children's Advocacy Centers of Arkansas is the leading statewide organization supporting multidisciplinary response to child abuse, and whereas it is appropriate to underline the growing problem of child abuse and the serious impact child abuse has on the citizens of Arkansas and the future generations of our
state, as well as on those of the rest of the nation. Now, therefore, be it resolved by the House of Representatives of the 92nd General Assembly of the state of Arkansas, the Senate concurring therein, that the House of Representatives recognize that abuse and neglect of children is a significant public health problem, commend the important work being done to combat this serious public health problem, and proclaim April 11, 2019 as Children's Advocacy Center Day in Arkansas. I'm sure you've heard that the third season was filmed here in Arkansas. Production was based out of Fayetteville, but filming spanned Benton, Carroll, Franklin, Madison, Newton, Sebastian, Washington, and Yale counties. Conway native Graham Gordy was a writer on the show. The show's creator, Nick Pizzolatto, actually got his degree at the University of Arkansas.

Currently, the way that we do it is somebody will file an interim study, and they've got to be filed by a certain date, et cetera. And we will have the debate, and then we'll come into session, and we spend a lot of energy talking about scope of practice, a lot of debating going on, a lot of lobbying going on. And so what's represented before you this morning, having served on public health for four terms in the House, and now my term on the Senate is a proposed law that would guide how we would go forward for the next session, and I'll just walk it through real quick first of all on on page one this is
intended to procure a consulting service and it would work under the direction of the Senate Joint Senate Committee of Public Health Welfare and Labor and the House Committee and they would meet together and I've given an outline of approximately nine ideas starting on page one and just simply says the purpose of the study is to recommend legislative changes to medical professional scope of practices for the 2021 regular session and it lists nine things that it would include but it is not limited
to those nine at the discretion of the committee they would be able to expand that area of nine or that scope of nine and then the senate committee on public health and labor shall carry out the procurement process and select a consultant to contract with the bureau of legislative research to conduct the study, but just know that ALC rules, and we checked with staff, ALC would have to approve the recommendation of the Senate committee in that process, so it would
stop with ALC because the committee doesn't have the authority to expand, but ALC does, so the committee will do the yeoman's work to get this prepared, to identify what would be a good scope of work for the consultants to come in and then the consultant will have access to the assistance of the Bureau let's save research so that we can help minimize the time as far as researching particular things says the consultant selecting contracted she'll conduct the study and they're going to report back to us or it would be it would be set to
go by September they would report back to the committee by September 1st of 2020 with their findings and then that report would be made to legislative council so there's involvement of ALC by October 4th 2020 I have an amendment that you should have on your desk it was passed out a while ago that I will add to the house just for the sake of time and expediency make sure it flows and basically what the amendment does it it takes out on page three lines 11 through
14 the intent of that originally was to make sure that the consultant would not be tampered with by anybody of substituting a proposed amendment that would be added on the house should I get this out of here today that just says members of the General Assembly employees of Bureau would have access but there is a spelled out process we would have to go through the Senate committee chairs for there to be engagement with the consultant part of that is just to make sure that the process is pure
and that it is kept on scope and that no one is trying to influence the consultant and the work and the responsibility would be put on the consultant in order to be able to make sure that there's a pure process. And the idea behind this is that when we come back or when they present that report on September 1st that we would have a product that would have been arrived at as far as a pure process based on statistics fact taking national trends into consideration so that we can have that report to move forward

Thank you. And I did visit with Senator Hammer to let him know I'm speaking against the bill, and I appreciate the amendment he's trying to offer. I do share the same concerns Senator Dismang brought up. But I want to say a couple of different things about this. um number one the this mandates that our public health committee will take all of this time to talk about this issue to hire a consultant and that's mandated in the bill on page two on line 26 that we shall carry out this procurement process and select this consultant and we have
a ton of issues in the public health committee that we have to address Medicaid is one of the primary things that we have to talk a lot about. We're going to have a lot of work on that, as well as the Department of Health and all the different things that we deal with, not even talking about Department of Environmental Quality and Welfare and the labor issues that we have to address too. Of the committee's work, I want to bring to your attention that we had five different bills that I can count, nicotine, and that were all scope of practice bills that were actually negotiated and
worked out, which I appreciate the work on these bills. Nicotine replacement products was one of them. Naloxone and all the issues that we're trying to deal with in opioids, that was another one. Vaccinations and immunizations was another one that was brought to this committee that was worked out. Biological similar substitution, that was another bill brought to this committee worked out. Schedule twos with doctors and nurse practitioners, that was another one that was brought and that was worked out. There were some that were worked out and others that were not,
but that's the nature of the process of the committee. The consultants that I rely on are the constituents that I serve. I'm the one that I call the constituents that I serve in my district and across the state to try to figure out how we can work through these issues and how we can come together as a process of policy. We're the policymakers. We are, and I think that we need to hold that in sacred, that we're the policy makers. I would also say that the ISPs were
actually ran in December. They're filed in December, but not many of them were actually run at all. We didn't hear hardly any of these ISPs, only a few of them. The governor has issued an executive order to do a rate review. So this would be duplicative in addition to what the governor has already ordered an executive order on reimbursements, rates of reimbursement. That's on page two, lines one through three of the bill. The last thing I would say is that Senator
Representative Johnson and I tried to file a bill in the House side that would create an advisory council with all of our boards with the Surgeon General under the Department of Health. That bill was aggressively worked against by one of these groups that are involved in scope of practice. They aggressively worked to defeat that bill and are aggressively supporting this bill. So I don't believe that this is going to be unbiased because of what's already happened
in the lobbying efforts of this issue. So with that, I would just say that I don't believe that this is the right way to go, and therefore I would urge you to vote no on this bill. I do not believe that we need to hire consultants. I do believe there needs to be increased collaboration amongst our professions and that's what we were trying to attempt to do in Representative Lee Johnson's bill that got defeated by one of the groups that are involved in scope of practice.

And so generally these pop up through the discussions from associations and the lobbyists that are hired then from the associations to pursue an expansion of scope of practice. but the boards are appointed
and if you'll look for instance I think it was last session there was an incredible collaboration between the medical boards or the medical folks and the dentists and they collaborated so that the medical doctors would be able to apply varnishes fluoride varnishes on teeth of children because they see children more so in their offices than they come to the dentist and so those flora those um sealants that you actually use a little toothbrush
with that was actually a collaborative effort that you had two groups of people that came together that said we have to do something with children and decaying teeth and cavities so let's get together and increase the scope of practice for physicians and let you guys learn how to paint these sealants on people's, on children's teeth. That's a wonderful example of the collaboration that I believe should exist and can exist, and I think that should happen under our Surgeon General
and under the Department of Health and with the boards and all the people that are on those boards that are appointed.

And so the question is, maybe it is something, maybe it is time for something new and a new approach. Secondly, we're not surrendering policy. We're asking help for shaping policy on the basis of what would be national averages and the nine points plus what would be added to through the debate of the committee to come up with a set of guidelines and questions in order to seek help from a consultant to come in and to be able to give us a point of reference time of here you are and here's where you need to go. so we can get off the bottom and start moving toward the top.
And then I guess I would just make this my last point. Were any of you not influenced by a lobbying group or by a medical profession on any of the issues that were discussed this year in scope of practice? We have all been lobbied. We have all been advocated for. And all I'm asking is just to time out in the way we do business and say, here is an independent report, what you do with it from this point moving forward, take it and go forth. And the debate then would occur at that point.
There's a deadline for scope of practice bills to be filed, okay? And this would be in, in time for us to have that healthy debate, but at least we'd have a book to hold up, a report to hold up, and say in reference to any issue on scope of practice, this is what the consultant said.

All right, so what this bill is, this kind of creates a new mechanism within the law that allows you to appoint a temporary guardian that can actually serve immediately upon your death. So as it sits under the law now, that if you have, you know, me and my wife have got seven kiddos still at home or not a majority. If we pass away immediately upon our death, there's no legal guardian of our kids until you actually go to court and have a temporary guardian appointed for the kids or permanent guardianship, depending on how you do it. well this provides a mechanism to do that now just like a lot of things you know this was a
relatively new bill but people hadn't really got a chance to look at it there is some things that people have concerns about on this legislation and so there there is the judicial council actually loves the concept but they've asked us to make a couple amends and visiting with Senator Hickey he has has a concern about some clarity and so we have agreed to make an amendment on the house end and it's about the only way that we'll be able to get it done but let me tell you what what we're going to do on the amendment. One is clarify that it is that you can appoint one person. So there's one thing Senator Hickey pointed out in the law that if you read it, depending on how you read it,
it could be read as only a husband-wife couple could be appointed. So we'll clarify that that's not the intent. I don't know that it'd be interpreted that way, but it could be. So we'll clarify that you can appoint a single person or a married couple as guardians. The other thing is going to reduce the 90 days to 45 days. That's something the Center Flyers and other people have had some concern that is, you know, the intent is not to make this an appointment of guardian without having a court order or a court review the process. What it is is so that when you're
in a situation where if something were to happen to me and my wife, my son is also going to be devastated in that. And to make it where he's not put in a position where in order to be able to obtain medical records, take care of, you know, the kids' things for school or whatever, that they'd be able to, he'd be able to engage in that right away while there's given time for there to be letters appointed and actually go through the process of having a guardianship appointed. And then the other thing is instead of it just being a notarized statement, actually make it be witnessed by two witnesses, something similar to what we do today with a will or
other testimony instruments. So having said all that, that is the amendment. And I'm kind of like you, I'm kind of hesitant to pass anything out that isn't perfect, but we're in a place in the session where if I'm going to do it, it almost has to be moving, and then you'll have an opportunity to come back and concur in it or not later on. A will of no effect unless you actually take it to court and get a court order based on the will. And so what this does is bridges that gap from when a person passes away to the point where they actually go to court and get letters appointed and get the temporary guardianship appointed.
So it covers, as it is right now, anybody who passes away who has minor children, immediately the kids are without any legal guardian under the law currently, which usually gets taken care of. Usually the courts, they're not, I mean, they try to, if you have some concern that you have to get taken care of, they'll usually try to act fairly quickly on it if you have an emergency. But what this does, this alleviates the need that when you're in a really tough spot emotionally, having to now go find an attorney, hire an attorney to make the petition
with the court and go through that process that's going to at least take weeks. And so, you know, it empowers a parent to be able to beforehand do this so that immediately a guardianship's appointed for a temporary time in order for them to have that time to actually get to court. So, this is

out coming down here speaking against Senator Ballinger's bills. I'm not against all of his bills, but some of them, you know, I just have to come down here and speak to you all about. Like Senator English pointed out, this is normally an act that is done in someone's will.
And of course, you know, will is generally got a proof of will to it. It's the proof of will is notarized. The proof of will has the witnesses' signatures saying that they attested to the will of whoever it was that wrote it or went to the lawyer's office. You can actually do a will in your own handwriting. It's called a holographic will, so it's not that cumbersome and costly.
You can do it in your own handwriting. You don't have to go engage a lawyer. and then you can get two people to to attest to the fact that that's your signature at the end of a handwritten wheel but the point is this is something that you are accustomed to seeing in someone's will a designation of someone to serve as the guardian of your minor child.
And upon death of an individual, the will becomes operative. Of course, it has to be made valid through a court, but prior to the petition to admit a will to probate, the executor who's named or executrix who's named in the will has the ability and the duty under Arkansas law to act.
And the things that are given to the executor or executrix under the will to do, they're supposed to be doing that, preserving the estate. If there's somebody that's nominated to serve as the guardian of the child, a minor child, that executor or executrix is supposed to make sure that that's communicated to that person. And then to go on and do the things that are required
to be done for the legal appointment of a guardian, whether temporary or permanent. Now, one thing that this bill strikes me kind of badly about is, it is without review of a court. There are no letters of guardianship. Generally, when someone is appointed to serve as a guardian, whether
temporary or permanent guardian, the court determines the fitness of the individual to serve, and it also determines whether or not there should be a bond posted by that guardian, by that person who's named to serve as the guardian. All those things are dependent upon the court reviewing what is in the ward, which is the
minor child in this case, the guardian is in charge of what they call a ward under the law in Arkansas. So you look at what the ward has in terms of a person, whether it's a disability, whether there are special circumstances concerning that minor child, that proposed ward, and also whether that child has an estate.
Children have estates. They could have inherited money. They could have savings that have been set aside in trust for that minor child. This bill does not even acknowledge that those are considerations that should be taken when you're talking about appointing somebody to serve with authority over a minor it doesn't say whether it's a guardianship a temporary
guardianship of the person or the estate or both that's troublesome to me I mean you're talking about somebody that has a statement that could have been written sworn to notarized 15 years ago or when the child was first born and now the parents after 15 years of the child's life suddenly die and they probably forgot about it maybe they revoked it how would you even know
how would that person who they gave a copy to way back when that child was born if the parents revoked it or tore it up and then made a will and put in the will who they wanted to serve as the guardian of their child. I mean, it calls for too many problems to come into play. Now, there are, in legal proceedings where a court reviews the petition for temporary
guardianship, and by the way, you can get an ex parte order for temporary guardianship. You can just go to the judge the same day and allege facts that say this child is without anyone in custody of them and ask a court to sign a a temporary guardianship to be returned in a few days, 10 days, or something like that.
But those are safeguards in the law to protect children and to protect families. The other thing about this is there's no notice, as is required under our law now, to the proposed ward. Anybody 13 years of age or older and somebody's trying to get a guardianship on, they're to some notice, notice of their rights that they don't have to be, have appointed some person to serve as guardian over them. That child at that
age has a right to to say to a court what reasons they do not want this person to serve regardless of what a parent that passed on has said so those are important things to consider the thing that worries me the most though is if this takes effect and say somebody just I mean they might have moved on out
of the state or something and they come after they find that the parents have passed on and they come to collect the child and where's the residence of the child gonna be is this person allowed to just take that child out of the state this this I don't think this has been thought through and I don't understand the need for this but what really concerns me is the child and the child's estate and then does this
is this going to lead to the fact that okay you got a sheet of paper notarized 15 years ago that says I want so and so to serve as my child's guardian and without going to court and then all of a sudden, this person comes on the scene and then builds the whole estate or starts taking funds from maybe a child's account.
I mean, 90 days? Even if he reduces it to 45 days, do you know what kind of damage you can do in 45 days? And without letters of guardianship, I can't even imagine a bank or a school even honoring this I don't know what this is this is a piece of paper it's not a court order you do not have a court order saying the court after notice to the ward
or after all the requirements of the law have been met that the the court finds that it is in best interest of this child, that so-and-so be named temporary guardian. I don't understand why this is necessary. And we had no testimony in committee about the Judicial Council supporting this. In fact, because of a motion for immediate consideration, there was not much debate at all. This is dangerous.
We're talking about children and all these other bills that we have deliberated on since we've been down here this year. We've done everything we could to try to protect children. Can I yield to Senator Hendren for a question? Senator

And so it also directs the agencies, when they promulgate rules in the future, to drop the regulation out of it. If all they want to do is go ahead and amend their rules to get rid of regulations, then this gives them the ability to do so without going through all the process.

One was in Little River, the other one was in Sevier, and the other one was in Senator Malik's district over in Columbia County. But what it also does is there's a host or a variety of functions that they may do. So two years ago, we ran a very similar bill. This is mostly cleanup language. But the Secretary of State, when somebody files a lien, they have to file it.
Even if it's – well, the example of what we're trying to overcome right now is there's a group known as Sovereign Citizens that if they can identify an FBI agent or a police officer or a judge, they go and they file a lien against them for $3 million. Secretary of State has to file that, and that person doesn't even know it's filed against them until they go to get a loan of some sort. What this does is if the Secretary of State gets a lien in, and it's not from someone that normally does liens, a bank or an equipment dealer,

or not this bill conflicted with Senator Dismange's two transportation bills, and it does not. Senator Dismange's bill provided for a legislative council to do a study on efficiencies, and the other bill he ran reported how the $95 million that we passed in tax increases on gas and diesel, they would do an independent accounting study on how that money was to be spent. This bill simply issues the Highway Department to address these problems, to report on traffic volumes, a lot of statistical information.
Highway Department already has all this. This just mandates or requires them to provide it to the legislature, either during the physical session or the regular session, so that we can make informed decisions about what's going on with our highways. It requires that they report routes that have the highest traffic volumes in the state, how we spend in relation to traffic volumes and accident reports. It also has a breakdown of how far the traffic volumes are in regard to population.

in which case that may or may not be an issue because what you can do, they can arrange for that student to be a part of a virtual that the school doesn't have. It had a capacity of 376 passengers, and after the Civil War ended, they were sending Union soldiers back home, and they had over 2,300 passengers on the Sultana.
It was overloaded. There was documented that there were sort of tips to get extra, the paymaster to let more people on the boat. It stopped in Helena the night before on, I think, the 25th, and they repaired the boiler, and it left, came upriver, and seven miles north of Memphis, the boiler exploded, and it killed over 1,200, and there were over 700 that were dragged to safety by people
from Crittenden County. This is a major tourist attraction. The city of Marion has a museum dedicated to this. This has been one of the 10 greatest disasters that have been forgotten events in American history, and the reason that it was forgotten was because on April 12th, just five days before President Lincoln was assassinated, so it sort of lost in all of the clamor about President Lincoln's death. Documentaries have been done on this, the
Travel Channel, the History Channel, and PBS in the last five years. Yeah, I think I got my questions answered. It seems like that each different element you can meet to do this. I'm not 100% sure about that, but we are still adding the ability to overcome that presumption to the parents. And there is a rather extensive list that you have to meet, but still we're going to violate that kind of fundamental principle that the parents have the best interest of the child. Now, I think it would be rarely of use, but I could see a situation where a rich grandparent or great-grandparent
could petition to court for custody or for rights to be able to see visitations and be able to prove through an attorney they meet these elements when in reality they don't. I have a personal situation that for a certain member of my family I don't think I'd ever want to see my son or daughter. And I would fight tooth and nail if that ever happened. And usually it looks like under the old law, there were some very limited ways that could be overcome. It seems like we're expanding it. Governor. HB 1831 is a bill about incentive and hope for those paying a debt to society. It started out as HB 1540, but we had to work with the county sheriffs, we had to work with the prosecuting attorneys, and we changed the bill so much we issued a new bill, 1831.
It does three things. Acknowledges the intent of the legislator to do the study of the criminal records ceiling. It removes the five-year look-back period only for nonviolent felonies. It removes the $50 recording fee. It does not change any other laws regarding which records. It came off the House floor with a 95-0 vote. I'm open for questions.

book your your soybeans or corn or things with elevator and there is instances this year where those bookings they would deliver to elevator and you would be graded down and so they would leave that elevator bring that grain to the to the river and get possibly two grades higher at the river so this would give us give some consistency in grading for elevators and if that occurs members what's going to happen is you're going to shut down these elevators by
word of mouth because members or folks will not deliver to those elevators so this will give some consistency in grading across the state and so we can match up with those elevators on the river with our grading system and thank Thank you. of us know, microbreweries have become very popular nationwide, and there have been
a tremendous amount of them established in Arkansas, and they have become a tourist destination place. Currently, there is no avenue for private club restaurants to offer this popular amenity. House Bill 1852 by Representative Spencer Hawkes creates a very narrow addition to the existing private club laws that would allow a private club restaurant to offer micro-brewed beer through a separate microbrewery restaurant private club permit.
This bill does not affect wet counties. It only deals with dry counties. The practical effect is the cost of these microbreweries are going to keep it probably just a minimum number expected. The bill mirrors the current private club and microbrewery statutes to create this new permit, but it limits sales to on-premise, consumption only. There will be no package or off-premise sale. The bill uses the same locally controlled process for obtaining a private club permit.

you, sir. Members, this one appears a little more complicated, but it's really not. Years ago, what we had done is we had a Fidelity fee, and we were collecting that from the retailers. Here a couple of years ago, what we did is we had a self-funded bond program opened up. And what we've been doing is we've been collecting $75 annually on that for the
retailers. We've only been collecting $10 on the Fidelity Fund account annually for the retailers. So what we're going to do is do away with the Fidelity Fund. I'm also going to roll the two accounts in together. And at the first of each fiscal year, anything over a half a million dollars, we'll transfer that into the scholarship fund. If I remember right and don't hold me to this, I think there's probably going to be about a quarter of a million extra in there right now that will roll over
into the scholarship fund when we do this

I wish I could say it's going to be easier the next few, but we've already got 50 bills on the calendar for tomorrow. So come prepared to work. Hey, a couple things that you need to pay attention to. First is we did it some today, but you'll be seeing this more and more often, and Senator Malek mentioned this. In order that we can finish next week, we may amend bills in the morning, and if the amendment's not too complex, hear them later on during the day.
So what that means is normally you just skip everything on the top of the calendar except for bills that are for third reading and final passage. You need to be looking at the bills that are going to be amended because they may actually be voted on that day. So make sure that you're staying up on that. And again, if there's objections to that, we'll hold it. But most of this stuff is pretty common and we want to be able to make it finished. The other rule that we have that you probably may not be aware of is the two-day rule that if you file a bill, normally you can't hear it in committee the next day. Now, hopefully, you've got all your bills filed, but just be aware, if you do file a bill and you still want to get it through and you want to have it heard the next day, we're going to have to suspend the rules, and we'll look at that on a case-by-case basis.
And the bottom line is finish up your stuff. Look down your legislative thing there, and if you've got bills that are somewhere, sitting around somewhere, either waiting to concur in an amendment or waiting to get someone to handle it on the House, get those things finished so that we don't end up having a big thrash the last week of the session. And then the final thing is I just want to say thanks again to you all publicly for the great support that you showed Thursday night for the institutions and for all the work that went into that.
