if I could have Representative Vaut come to the
well with me. Colleagues, today is gonna be a day that I'm gonna remember for a long time, mainly because the man in the North gallery is being honored is not only one of the greatest basketball players ever, but a great Arkansas story, plus, he, he went to the school that I attended at the University of Central Arkansas. Today, the single greatest basketball player to ever come out of Arkansas was a man by the name of Scottie Pippen. His senior year at Hamburg High School, Scotty led his team to the state playoffs and was named
the all conference team. But after a stellar year, no colleges came calling for a scholarship. Instead, Scotty was asked to serve as a team student manager at UCA for the basketball team that year. During his time, Scotty continued to work on his skills, and towards the middle of his freshman year, coach Don Dyer asked Scott to be a part of the team. Scotty got his first start for the Bears in 1984, which would have been a sophomore season. From that point on, Scotty carved a history path that has
gone on for ages. Kids nowadays still remember what Scottie Pippen has done. By the time his senior season came around, NBA scouts caught wind of what was going on. When he came to UCA, he was 6'1. By the senior year, he was 68. So much in fact, legendary NBA scout Marty Blake. As Coach Dyer to play God in all five positions at UCA is senior year because they wanted to see what he could do at each position in the NBA. So Coach Dyer did it.
Well, needless to say, in 1987, Scottie Pippen was drafted 5th overall by the Seattle Supersonics, and then was immediately traded to the Chicago Bulls. To this day, he's the only basketball player to ever be drafted from the University of Central Arkansas and to make it even better. We had Sidney Moncrieff up here just last week. He and Sidney Moncrief are the two highest basketball players drafted in the state of Arkansas ever and they were both 5th round picks. From there, Scott, he teamed up
with Michael Jordan and won 6 NBA titles, was a seven-time all-star, a 3 time all NBA first teamer, and eight-time all defensive first teamer, and a second and a two-time Olympic gold champion. Scotty finished his NBA career with 18,940 points and in 2010 was inducted into the Naismith Memorial Basketball Hall of Fame. He is also one of only a few to be a two-time inductee, as he's also there as part of the dream team.
Scotty's only one of 4 players to ever have his number retired by the Chicago Bulls. Not bad for a kid from Hamburg, Arkansas that didn't get the scholarship. On June 14, 2021, the University of Central Arkansas dedicated the basketball court and Scotty's name. Colleagues, it's with
great pride that we honor the single greatest basketball player ever to come out of the state of Arkansas, Scottie Pippen.

The thing about it that I admired most about him from the UCA days is he never forgot where he came from. Uh, each time he would, uh, make visits back. Coach Jones and Coach Dyer was always excited. Uh, they would always, uh, every time you call, they would always share it with the guys, with, uh, me, Frisco, and, and Mike
Marsh, and, uh, we were always happy to hear from him, but he also gave back to UCA. He gave back to the city of Conway, and he gave back to the game of basketball. Many camps that he, he, uh, He hosted there at UCA. So, I would just like to say congratulations on a great career, but thank you for what you've done on the side. to help me explain this bill, but he Hm Hey 8 HBT in '68 would make 10 metropolitan Port Authority employees and their employer eligible to participate in the Arkansas Public Employee retirement System. These ports were established under an intergovernmental
agreement along the Mississippi River, consisting of yellowbin poured into Shea and Chico County. Helena Harbor in Phillips County, and the port of Osceola in Mississippi County. I'm a member of APRS, and they go to great lengths to analyze the fiscal impact of adding additional members to the system. Two separate fiscal impact analysis were performed on the HB 1068.
One by GRS Consulting of Southfield, Michigan. They stated, and I quote, There would be no adverse effect on AR's employer contributions resulting from adopting this legislation. End of quote. And the second firm, Osborne and Carrera, and association from here in Little Rock. Perform a fiscal impact analysis on HB 1068. They stated, and I
quote, in total, in our opinion, the House bill 1068 would not have an adverse fiscal impact tapers. This bill, would make 10 hardworking Arkansans and their employers eligible to pay into the system and provide security to their families as they slip
into their golden years. And I'm living proof it happens fast. And I would appreciate a good vote. Representative McIlroy has

sick leave and vacation leave and they have the authority to do that. And that's what this bill does.

Thank you, Mr. Speaker. Colleagues, we all know that we are facing an affordable housing shortage in the state of Arkansas, um, in Washington County, for instance, where I live, in the last 5 years, the average price of a home has gone up 65% in Benton County just north of me, that number is 73%. Um, this bill offers a practical, cost-effective solution to that housing shortage. That solution is accessory dwelling units, ADUs. ADUs are small secondary units. Think of
like mother-in-law suites or converted garage apartments. Um, ADUs enable homeowners to more fully utilize their property's potential, and they also increase housing stock, providing affordable options for people who may be priced out of the traditional housing market. What this bill does is increase ADU supply by making it easier for homeowners to build ADUs on their land. It gives every landowner on a single family lot, the ability to build 180U by right.
And it removes certain excessively burdensome regulations that cities may place on ADU construction. So things like excessive impact fees or use permits. Allowing for ADUs in this way bestows a direct benefit on all landowners. It creates a new right for landowners to use their property as they see fit. Um, a lot of landowners want an ADU for various reasons. So some people may want some extra rental income. Some people may use ADUs to house family members, either young adults who are just getting on their feet,
uh, senior citizens to live in as they age. Older Americans actually are very supportive of ADUs, um, as a way to house caretakers nearby, but independent of their own structure. Sure. 80Us, unlike high rise apartments, um, are a great solution because they don't threaten the physical character of a neighborhood. They are small and often hidden behind the, the bigger main structure. Finally, encouraging ADU development helps make better use of our current infrastructure, because they're small and built on existing
lots. There's less need for new government spending on things like roads and utilities. So, in short, ADUs offer a powerful way to address the housing. shortage that we know is facing us. They increase housing supply, provide rental income for homeowners and provide affordable housing options for renters, all without altering the character of a neighborhood or increasing government spending. The housing shortage is real. ADUs are not the solution to it, but they are a

Very quickly, this bill is dealing with a law enforcement agency that a lot of people may not be aware of, and that is the Department of Agriculture, law enforcement agency. They used to be with the Forest Service department then when the consolidation occurred, they became part of the Department of Agriculture. What do they do? They're the first line of defense against livestock infections and diseases coming into our state. The other thing that they do is
that if you have a fire that starts somewhere a wildfire, they're the people that you
go to to determine where the fire started and what started the fire. And finally, the last thing that they've ended up doing is with our legislation that affects the Chinese ownership, the Chinese government ownership of property in the state of Arkansas, they are the lead agency, they have to be, and they're actually helping the federal government do these investigations as well. That's who they come to, to the state of Arkansas, to these guys.
So what are we trying to do with this particular legislation? Well, a lot of it is administrative corrections, dealing with the fact that they, they transferred from the Forest Department and that consolidation requires some changes, but the most important thing that this bill does is that it also gives some teeth to some of the, the enforcement issues that they have. I'm going to read the old language first, so help understand this. In the old language, on page 2, beginning with the paragraph B.
The old language that is being struck says any person who, after notification, shall fail to comply with the rules shall be guilty of an administrative penalty, he and she shall also be liable for damages to others due to infections from his or her stock. The language that is replacing that is a person who, after notification fails to comply with the rules of the department shall be guilty of a violation and subject to a fine not to
exceed $300 liable for the damage to others due to the infection from his or her own stock. Now, why do we need this change? This is not a new law. This is just trying to add some teeth to enforce existing law. Why do we need it? Well, one example is is an individual that owns some very expensive horses over in Western Arkansas that goes to rodeos and things. He's got a huge investment in that. Down the road, there's another person that owns horses, who refuses to get those horses
tested. Horses are supposed to be tested for things like coin's disease and things like that every year. Well, this guy doesn't do it. Well, they quarantine the guy, the guy doesn't care. The horses get out, they still go down there and rub noses and necks and things with these expensive horses. And the real problem is not only the danger to the individual who owns this horse is the danger to anybody who has horses at a rodeo that we, that that gentleman may be taking too, like Las Vegas or someplace like that. Suddenly these potentially infected horses
could be infecting horses from all over the United States, and the last thing we need is for that to be tracked back to the state of Arkansas as the source of that problem. They because these gentlemen, and this is not the only case, will not go ahead and comply and do something. In order to help protect their own horses as well as the property of others. They want to go ahead and have this fine levy to give it some teeth. Because the administrative Enforcement apparently has not had an impact.
And so they're trying to give this some teeth in order to stop what could potentially be a larger problem. The warnings and everything else, they're not gonna give this, I mean, they don't write a lot of tickets. Last year they wrote $100 worth of tickets. This year, they're up to $250 worth of tickets. So it's not like they're going to go in and, and, and, and trying to write up tickets for people, that's not what they want to do. On this, people get plenty of warnings, they need to comply with the law. They need to go ahead and step up and think
about others. And this is what this particular part of the legislation will do. Now, those fines will be kept. By the, the law enforcement department and will be used by them to go ahead and further training or other things that might be necessary. The other thing that is happening is that it also addresses the service revolver. All the law enforcement agencies, when somebody retires from law enforcement, they get to keep their service revolver. If they're killed in, in, in duty or something.
Then a, a, a dependent is allowed to keep that service revolver. And so this provides for that as well and everything else in it is just an administrative correction dealing with the transfer to the Department of Agriculture. I'll be happy to try to answer any

Mr. Speaker. Colleagues, I have HB 1385 for you today. This is a very simple bill. It's another constituent-driven bill.
It requires notification to members of the General Assembly when the oil and gas commission is holding a public hearing for a permit, a specific permit that may be located in our districts. I modeled this idea after what the Arkansas Department of Transportation does. You may be familiar with letters that were received from the Department of Transportation when there's a public hearing in our district. They invite us to let our citizens know our constituents know that this public hearing is occurring. So that's the idea I'm basing this on. You may be asking why I'm wanting to do this.
Well, I mentioned this is a constituent driven bill. Last year, the Oil and gas commission permitted a wastewater disposal well in my my district lies in the Fayetteville Shale in a wastewater disposal well is an underground well where production water or frack water from natural gas wells is injected under the ground. This water can't just be dumped out onto the ground. It has to be injected several 1000 ft under the ground. What made this an issue for my constituents is that it's
located in a moratorium area for this type of will. If you remember a decade or more ago, uh, there were some earthquakes in that area of Arkansas and it was thought it could be tied to these wells. So an administrative moratorium was put on these wells, which means that the director of the oil and gas commission couldn't just issue a permit for these wells. I had to go for a full hearing before the oil even greater concern to my constituents in this area. There is a recognized geological fault tied to earthquakes in the 1980s. It's very near to the location of
this well. The oil and gas commission did hold a public hearing and they granted the permit. And they posted the legally required notice in the newspaper. my constituents in the area had no idea this happened until the construction on the well had already begun. Have they known this, they would have attended the public hearing to make sure their voice was heard and to voice their. As mentioned, the hearing was published in the newspaper, but we know newspaper readership is declining and who is really
looking for public notices in the classified act. The oil and gas commission already notifies the county judge of the county where one of these wells could be located. So this bill just provides another avenue for our constituents to be informed by letting us know that that permit is being being requested. So we can easily share that information with our constituents. A couple of weeks ago, uh, one of the natural gas companies in the state announced that there could be additional drilling and
the more important as time goes on, if there's a need for more wastewater of fracking water or pretty important if, if you don't live in a county where there's oil and gas production for us in oil and gas producer. So in short, this bill is about transparency and good government. It ensures that we

patient and you came to see a physician and you were, and that physician was out of network with your carrier, uh, they would build the carrier, get an out of network fee, and then prior to this federal act, they could bill you for the balance or the remainder of what you owed. This federal act, uh, now, outlaws that process. So the new process is that for a provider, if you bill someone out of network and the insurance carrier doesn't want to pay the full amount. There's an independent dispute resolution process that happens that results in some arbitrated
amount that's to be paid for the provider. What this bill does is just guarantee that whatever that arbitrated amount is, that it's sent directly to the provider and not to the patient themselves. So this is money owed back to the provider and the issue that we're seeing in a few cases is the money goes. to the patient and then when the provider tries to collect the money, uh, there's some difficulties sometimes getting that money back to the provider where it belongs. generated from outdoor recreation, and it also contributes about 68,000 jobs to our state. Uh, something I want to make clear is that This is not an expansion of government. This is not a new position. Uh, it was signed in as an executive order in 2021. So we already have a director of outdoor recreation. Her name's Katherine Andrews, and she's been doing that since the executive order. She's been doing a great job. Uh, what this bill does is solidifies this office into law, ensuring the
continuation of this role and it coordinates and supports outdoor recreation here in our state. And it enhances the quality of life for residents and visitors. Colleagues, today, I bring you House Bill 1634, which is to create the Arkansas sports Raffle ax. This bill will allow for our Arkansas universities in the state to be able to hold raffles for fundraising efforts for NIL scholarships to general support of sports teams or the maintenance and construction of facilities at their said university. Currently there are more than 50 colleges and universities in the entire United States that do these. Some of those schools include the University of Missouri, Texas, Oklahoma. Tennessee, Mississippi, Ohio
State, Arizona, Florida, Kentucky, and Arizona and Georgia. Now I've heard from schools from all over the state of Arkansassu from the smallest of small all the way up to to the University of Arkansas and not one school has said this is a bad bill that's gonna hurt them. They all see this as a new fundraising mechanism that they can use to implement at their school to help with their general fund or in some cases NIL. Now there are some safeguards in this bill. Uh, we've had lengthy debates at the House Rules Committee and some of those
safeguards include a reasonable age verification in the bill that the schools have to do. All raffles are gonna be governed by Amendment 84 of the Arkansas Constitution. And the third thing is we're gonna promulgate rules through DFNA. I wanna thank former Speaker Shepherd, the Attorney General, and the governor's office for really looking through Amendment 84 to making sure that we can do this and stay in line with the Arkansas Constitution. not violate anything on that. Now, you know, the media, if you've read the paper recently, you see that it's been labeled the fifty-fifty raffle bill.
That is one thing that can be done if you're used to going to sporting events, uh, whether it be a professional game or a college game, you may see it pop up on the jumbotron with a cash amount and the the winner's gonna get half of that prize. They will be able to do this, but some of the smaller schools that I've talked to have said, you know what, this is gonna work great because we've got sponsors that want to donate a truck or a boat, and we wanna be able to auction or uh raffle that off and then we'd be able to make the money for our universities. Some of these schools have said

for the bill. Thank you, Mr. Speaker, uh, members, I come to the well to speak in favor of this bill. Uh, the idea of a raffle related to collegiate athletic events has been something that's been talked about for several years. And in fact, the idea was, was
brought up actually 2 years ago. And at the time, uh, I personally felt like it was not the right time to bring, uh, that bill to the floor. And, uh, Representative Hawke has done a lot of work on this bill, uh, as you know, it's, it's been a bill that's grabbed headlines both, both on the front page and the sports page, and it's been the subject of talk radio and internet, uh, blogs and all kinds of things, um, but Representative Hawke asked me, After the Bill Fel in committee,
if I would work with him, uh, to try to put Together a bill that could, that, that hopefully could alleviate some of the concerns. And I would say throughout this process, the idea of a raffle really, uh, You know, it really, I guess kind of heated up, what, 6 months ago during the interim. Uh, but during that process, since I had run the two bills that provide for NIL in the state of Arkansas, had a number of members that had come to me and asked me my thoughts on it. And so, what I would like to say
is that over the past two weeks, Uh, I've spent a lot of time on this bill with Representative Hawk, meeting with various interested parties, whether it's the institutions, some of the third parties out there that have taken an interest in whether Raffles could be run by casinos or otherwise. And I do believe that this bill is, uh, If we're gonna have a sports raffle. This is the bill to accomplish that. When I originally got involved,
And looked at Representative Hawke's original bill. Uh, my initial thought was that, uh, maybe the direction we would go would be a little different, but I'll tell you, I spent the weekend, a couple of weekends ago, really looking at Amendment 84 and Amendment 100. And you'll hear there's some that have wanted to move raffles under Amendment 100, which is casino gaming. And my belief was there's been some discussion of trying to
expand into i gaming, and when I got involved very early on, I expressed to those that I was talking to, that I was not in favor of iGaming. I would not be in favor of that. I know there are many people here in the legislature that are not in favor of that. I know there are many people, uh, in state government that are against expansion into i gaming. But when you look at Amendment 84, Amendment 84. Based on what the Attorney General's office has provided me, but then also in looking at
the language of the amendment, it governs Raffles, which a raffle means the selling of tickets or chances to win a prize awarded through a random drawing, Representative Meeks, the definition of a raffle. Describes what the contest is, and that's why it does not relate to the outcome of a game. It's just simply stating in the bill that a raffle has to be run in conjunction with the game. It's not just something that's going to run year round. It has to be tied to an individual
sporting event, but it is not based on the outcome of that event. The Amendment 84 takes care of that. There was a question asked about how does this help smaller institutions. Well, it helps smaller institutions because they have the opportunity. There's been so much focus on electronic raffles, but this also allows for just a manual raffle like we may have seen in the past where you buy a ticket and they mix up the tickets and you draw, that's
something that smaller institutions clearly, that, that's the route they may choose to go. And as Representative Paul stated the purposes for which the the money may be utilized. Is the payment of prizes, the payment of administrative costs, the purchase of software related to it, the provision of scholarships, financial aid stipends, or compensation for student athletes, compensation under the Arkansas Student Athlete Publicity Rights Act, general support of the institution of higher education's athletic teams or
programs, and the purchase maintenance repair, etc. of those athletic properties. So there are a number of different things, and what I would expect is that many of the smaller schools, it would have nothing to do. with NIL that it likely would go into facilities because I know that they are strapped for, for the to be able to come up with the cash necessary to maintain those programs. And so I just want, I think that, as I said in committee yesterday, If you were asking me to draft a bill to provide for a sports raffle that could generate the
most money possible, and you gave me a blank piece of paper and said go do it. This is not the bill that I would draft. But If you're asking me to draft a bill that provides for a sports raffle
in the state of Arkansas that complies with the Arkansas Constitution. Which is kind of
important. This is the bill. And so I appreciate Representative Hawke's work. I appreciate the governor's office work, the Attorney General's office, our colleagues on the
Senate end that have come in support the University of Arkansas, the athletic department. The bottom line is that all of these folks are supportive of this bill. We're not forcing anybody into the raffle business. An institution may decide they don't want to. They may decide it's too much trouble. We're just setting up the framework under the Constitution.
