members uh Thank you, Senator Stubblefield. Members, I think that maybe they're going to pass out an amendment that I need to amend the bill based off of our conversation from last. Committee cycle. I want to commend the committee for being

Senator Bart Hester
Unverified
0:53
since may proceed. Our members, this is a bill we've we've already passed in this committee. It just gives a contractor, uh, the right to seek damages if they're not paid, even if they weren't licensed if uh if they, you know, accept the timely fines and assessments from the contractor board and with
Senator Clark Tucker's wise amendment we we added back in either or in equity. And so I'm with that, I appreciate a good vote. All right, committee, you've
Senator Gary Stubblefield
Unverified
1:26
heard an explanation of the bill. We and the amendment, we have a motion and
a second, uh, in discussion? All right, all those in favor say aye. All opposed. All right, Senator Bill, uh, is passed as amended.
Mar who is Mr. Carr, Joey Carr here Senator Wallace, you're recognized. This one has another amendment that we have to put on. I
think we've got another amendment to pass out. Yes, sir. Huh?
All right, uh, Senator Wallace, if you want to go ahead
Senator Dave Wallace
Unverified
2:56
and explain the amendment. Yes sir, Senator Dave Wallace, District 19. Remember, this bill has actually passed out this committee one time, uh, we found out a few days later that there was some confusion between the attorney General's office and the human trafficking folks, and so we have added some language back in, specifically in the old bill, we restricted the distance from
the interstate to 1320 ft. That's now unlimited, so it's, so any, uh, facility along that that. That interstate, uh, will have this posters in there. The other thing we did, we took out private clubs. And we found out later from talking with the human trafficking folks that And I didn't know this at the private clubs actually have a pretty high rate of human
trafficking in them, so we, we added what was in the law already back into the law. And the bottom line is the only thing that this bill changes as we add it. Massage parlors and nail salons. OK. And, and with that, I stand by for your questions. All right, any questions from
Senator Gary Stubblefield
Unverified
4:12
the committee? We have a motion to adopt the amendment, and we have a second in discussion? Are all those in favor to adopt
the amendment and the bars the motion as amended. Say ah. All opposed.
to Alright, we, we've already heard the bill, so we have a motion to adopt the bill as amended. Second, any discussion? Well, Du
pass as amended any, anyone in the audience wish to speak for guests.
Are all those in favor say aye, all opposed. Alright. Congratulations, Senator Wallace. Thank you, Mr. Chair. Thank you, members. Any
other senators in the room that have a bill? Senator Clark,
I understand that another committee. Representative Bentley, do you have a bill? I feel go at the end of the table.
Representative Mary Bentley

Senator Gary Stubblefield
Unverified
5:42
hang on just a second, Representative. OK, this, uh,
Uh, this bill was added on late to the agenda. So I want to make sure that You have a,
Senator Clarke Tucker
Unverified
6:08
you have a statement. I've just heard from some people who want who want to be here to testify on this, and they weren't able to be here because it was added late. All right, what's the committee's how late is that.
Senator Gary Stubblefield
Unverified
6:32
It was there. This bill was just added this afternoon, John. Representative
Bentley, uh, I think it's the will of the committee that they needed more time to let people know what happened about this. I just know that we're all busy, didn't want
Representative Mary Bentley
Unverified
7:03
to miss an opportunity if you guys are happy to wait. It's a very simple bill, just really quickly tell you before we, before I leave that it just really puts it to statute what's current practice for DHS right now with foster care, and they're good with it, so happy for you guys to look at it and I'll come back another time. No, no problem. Well, if there were
Senator Gary Stubblefield
Unverified
7:19
some individuals that are prepared to come here and testify or, you know, or ask questions. I think we should allow that, so that's perfectly fine. That's what the process is about.
Representative Mary Bentley
Unverified
7:26
Well, I'm sorry for the, sorry for your trouble.
Senator Gary Stubblefield
Unverified
7:28
No, that's fine. I've got plenty to do. Thank you. We'll put you
back on the agenda. Anyone else here? Any other Senate bills, House bills? I, I've got Senator Gilmore, you'll go up to the end of the table. Starting where you want.
Speaker 36
8:05
Thank you, Mr. Chair. Uh, Senator Gilmore,
Senator Gary Stubblefield
Unverified
8:11
which bill are you going to be presenting Senate Bill 446. Senate Bill 446. If you'll identify yourself again for the record, and
Senator Ben Gilmore
Unverified
8:21
thank you, Mr. Chair. Senator Gilmore, District one, Southeast Arkansas. Are you? Thank you, members. This is the
bill that allows um businesses, retailers, private
entities to utilize license plate readers. You may be familiar with some of the retail crime bills that have passed out of this committee. Of late, I think this one is one that we, we can consider as part of that simply because there are people who are preying on our retailers and other business owners stealing, stealing from and doing it in a way that is organized and so this is a way to help tamp down on that. I do want to go through the bill because I want to make sure that everyone understands what we're
dealing with and how thoughtful we were in crafting this, so on the first page you'll see where it defines an additional subdivision of who can utilize this private landowner, private leaseholder, commercial business, um, it locks it down to basically private businesses there. Um, go over to the next page on page 2, again, um, it locks it down to how they can use it in
in monitoring their premises, um, and again that is as it states there on their on their property and again if you go on down to page the bottom of page 2, it outlines basically how long the data is retained and that's 60 days by the private landowner, private leaseholder, and commercial. Business Um You go on over to page 3, basically government,
governmental entity may only compel the release of the captured plate data under section those sections there with a valid subpoena, again, making sure that this is not misused, mishandled, or anything like that, um, there's, there's also in this bill on page 3, making sure that they can't sell that data, um, and then Going on over um To page
Um, I want to point out on page 4 in particular, um, That they are subject to the Attorney General's deceptive trade Practices Act. So basically if there's an issue that is, that is, uh, you know, arises from, from misuse of this, then they're subject to penalties there. I don't want to over talk the build. I want to belabor the point. I know we have other things to do. I'm happy to take questions. Our committee, you heard an explanation of the
Senator Gary Stubblefield
Unverified
11:04
bill, uh, Senator Johnson, you have a question?
Speaker 68
11:09
So is, is this the enforcement part that is the enforce
Speaker 69
11:14

Senator Gary Stubblefield
Unverified

the committee? Is there anyone in the audience that would like to speak for or against the bill? Saying none, Senator Gilmore, you're But you not close
Senator Ben Gilmore
Unverified
11:31
for you, Bill. Members, I'm closed. I appreciate your support on this bill. I think it's a good bill just to help our business owners, um.
And I see Senator Tucker looking at me, so I'm going to shut up and just
Senator Gary Stubblefield
Unverified
11:48
ask for a good vote and make the motion to pass. Yeah We have a motion to pass in
Speaker 74
11:56
a second in discussion. All those in favor say I
Senator Ben Gilmore
Unverified
11:59
all opposed. All right, congratulations, your bill passed the Senator Gilmore. Thank you, members, um, House Bill 1551 just came over. I would like to, um,
Present this bill and I think per our majority leader's rules, I need to amend it so that my name is on it. Uh, so I would, uh, make a motion to suspend the rules for a verbal amendment for the purposes of adding
Senator Gary Stubblefield
Unverified
12:26
my name as a co-sponsor. are without objection we uh We have a motion
to amend the bill. And the second, clothes
Senator Ben Gilmore
Unverified
12:36
in favor say aye. When did this bill come over, Senator Gilmore? I think maybe this morning, I'm
Senator Gary Stubblefield
Unverified
12:42
not entirely sure that would be a question for staff. Anyone in your have an
Senator Ben Gilmore
Unverified
12:51
objection to hearing this bill since it came over late. And I will just tell you that this bill passed
Chair
Unverified
13:00
the House with 99 votes, so I don't think
Speaker 76
13:03
there's Too much objection. And what, what bill number
Senator Gary Stubblefield
Unverified
13:05
is it? 1551. No objection from members to hear this bill?
All right, then Senator Gilmore, you're
Senator Ben Gilmore
Unverified
13:19
recognized to present the 1551. All right, thank you, Mr. Chair. Again, Senator Gilmore, District 1. Members, this is a an important bill basically it creates a criminal section of coercing by means of fraud, someone to take an abortion inducing drug, um, and it has in there upon conviction, there's a class C felony, Class B felony, if the gestational age of the unborn is
more than 3 months, um, and so with that, basically this is cracking down on, on someone that there was a case I'm familiar of that's sort of the impetus of this bill that someone was coerced and actually had a drug put into her drink, if I remember correctly, um, that by her husband or significant other to try to induce an abortion without her knowledge. So that's what we're trying to crack down on. That's what the bill does. Happy to take questions.
Senator Gary Stubblefield
Unverified
14:14
community heart explanation of the bill. Any questions?
Speaker 80
14:20
And he won the audience that would like to speak for
Senator Ben Gilmore
Unverified
14:27
or against the bill. You are wrecking your clothes for you, Bill. I close, ask for a good vote. Make a
Senator Gary Stubblefield
Unverified
14:32
motion to pass. We have a motion to pass in a second, uh, any discussion. All those in
favor say aye I post. Congratulations, Senator Gilmore.
Unknown speaker
14:55
Anyone else have a bill? OK. OK What. Uh? OK. Do you know who they are? I
Senator Gary Stubblefield
Unverified
15:38
Gentlemen, there's a There's an amendment to this bill, and it cannot be discussed without Senator Clark first. OK. You have to sign the bill and we won't
be able to discuss that. So if you want to go ahead and discuss the other part of the bill, the rest of the bill We passed it to get the amendment Well, he, he's not here to sign it. If he comes in before we
adjourn. They both have an amendment, so learn
Senator Gary Stubblefield
Unverified
16:48
And what will that bill intimid uh Senator Clark Have any effect on this bill, even no intimidation. OK. You want to go ahead and go
at the end of the table, you're to present? You got a problem. Would you
Senator Ben Gilmore
Unverified
17:19

Senator Gary Stubblefield
Unverified
17:31
Huh Come on, that one I like. OK, you'll go
Senator Ben Gilmore
Unverified
17:35

Senator Gary Stubblefield
Unverified
17:41
Senator Gilmore, District one. You are 1629. Thank you,
Senator Ben Gilmore
Unverified
17:43
Mr. Chair. This is very easy bill, uh, basically allows a prosecuting attorney or deputy
prosecutor to retain their service weapon if they were so authorized to have one when they um uh leave their service. That's all it does. Happy to take questions. Committee heard
Senator Gary Stubblefield
Unverified
18:02
an explanation of the bill. Any questions? Question, uh, Mr. McKee. Thank you,
Senator Matt McKee
Unverified

Speaker 109
20:13
Alan, Alan's on his way. You recognize this,
Speaker 108
20:21
uh, this has a healthcare workers with first responders and law enforcement. For the uh criminal offense of
aggravated assault defines the healthcare worker. It's not limited to, but includes a physician and nurse, paramedic, or other emergency responder technician, uh, pharmacist, dentists, health care aid and assistance therapist, any of those healthcare workers, I would say it Puts him under the protection of that, the aggravated assault.
That's my best understanding. It looks like a good deal. Lee usually doesn't do bad ones, so.
Senator Gary Stubblefield
Unverified
21:12
All right, uh, committee, you've heard an explanation as I can get it of the bill, uh, any questions from committee? Senator Rose. I. No.

Senator Terry Rice
Unverified
22:05
Do we have anything on the books now because this has position on there. I thought we had something on the books already because I mean this, uh, does it not say that even Throwing bodily fluids or other things. Is, is the salt. We do
Senator Clarke Tucker
Unverified
22:24
have something on the books and I have to apologize. I have about 10 prosecutors down on the other end testifying on bills that have been texting me, but so I'm half here and half there, but I
do know this is the one on the healthcare workers, I think, and I believe that someone had talked to Bob McMahon about this bill, and they worked with us on getting the language so that what we have now in that bill are not going to be conflicting, OK, I
Speaker 128
22:51
I'm not, not against it, but I just, I was a little surprised that uh I know there's something that
Senator Clarke Tucker
Unverified
22:58
applies to like Department of Corrections workers and other things, so I think they used the language from that and put it into this bill that may be what
Speaker 130
23:08
I was thinking that. Thank you, thank you. Senator Tucker,
Senator Clarke Tucker
Unverified

to double check that. I wanted to think that aggravated assault may be a little higher than a D felony, but I can look for you and let you know for sure. That's the, that's
the penalty for this proposed crime, so I just was curious if we're being

you, Mr. Chair. Jay Robertson with Opportunity Arkansas. All right, you're breaking up. Thank you. This is a simple amendment to the bill that passed out of this committee last week. The intent
of the bill is to promote family integrity and better
placements within our foster care system. Since last week we got some feedback from folks from the judges and the AOC and DCFS who had suggestions to improve the bill and this language came from them, and so Happy to answer any questions about the bill, but it's substantively the same bill that passed out of committee last week with suggestions from those stakeholders. Did you just explain

the amendment? Any question from a committee on the amendment.
All right, we have a motion to adopt the amendment in

Mr. Robertson explain the bill. Thank you. Um, what this bill does is it promotes family integrity within our
foster care system. It gives parents an additional option to petition for restoration of rights after those
After having rights terminated, it changes the timeframe for that from 3 years to 2 years to put us in line with Texas and it allows individuals who are placed on the child maltreatment registry to have an opportunity to be removed if that finding was for a case of neglect, and so it still focuses the registry on cases of abuse, sexual abuse, sexual exploitation or cases of neglect that happened in an official capacity, and the only way someone can be removed from the register. Can you
that Mark just a little closer. I'm sorry. Yeah, it's better. And so what this bill does, it allows for individuals who were placed on the registry just for causes of neglect. They can only be removed if they've already been reunited with their children. More than a year has passed and no additional findings have been made. That was an amendment that came about because of all the stakeholders who had input on this bill, and so that's a brief explanation of the bill. Happy to answer any questions. All right, committee, you've heard an explanation of the bill. Is there any questions?

the proper time, but I'm just curious why in the amendment we we are striking child. Uh From the list of people who can file

Speaker 162

on page one, I think Senator McKee is limited to the discussion, so whatever you're going to answer, you tell him and then he can discuss. Page 1 line 33 of the bill this is current language that a child can file a motion.
Senator Clarke Tucker

To resume services for a parent. So they deleted and the amendment that's being deleted and replaced with DHS. Is that because we're replacing with the attorney Ed Liha and only the attorney ad litem can do it, and not a child yeah, so
Speaker 163
31:17
right now only DHS or or Guardian ad litem can file for restoration of rights. That basically, Senator
Senator Matt McKee

31:24
Tucker, I believe that takes it back to
what is actually existing right now. I would,
Senator Clarke Tucker

I, I don't think so, because uh and this is, you know, a general concern with adopting an amendment of this size in committee without it being engrossed, but If you look at on page one of the amendment, that word, that word child is struck through. And I don't see another place in the amendment where it's added
back in. Mr. Chairman, how, how can I

So, um, the intent of the bill is to allow for parents to have an additional option to petition for restoration right now only DHS or Guardian ad litem can initiate that process, and so most of the rest of this all this language was reviewed by DCFS and AOC to ensure that that's what the bill actually does, and so nothing about this amendment changes the way that process works, other than allowing parents the additional
option, which is the new language you see on page 2 of the amendment. Senator Tucker, I think
Senator Matt McKee
Unverified
33:09
that that is added later on on page 2 added back. Possibly. Or maybe specifically to children who are in the custody
of that department. So I understand what you're saying the intent is. I just don't think that's what the language says.
Uh, because we're not just adding parents. We're deleting the child, Mr. Chair. Would it be OK with the committee, I'd like to pull these back and let Senator Clark get these engrossed so that we can, you want to answer another question first. You want to throw them back. I'm going, OK, all right. Go ahead and pull them. Thank you, Mr. Chair. Let's just It is 326. Mr. Sheridan's 326 have the same substantial amendment to it. Is it another significant
amendment or is it a little one? These were all added by DHS. My understanding is they came
from the judiciary and from DHS, OK. Don't you want to pull them both then? Well, if the amendment to SB 326 is a small one, and the committee is comfortable in reviewing it tonight. Then we can go ahead and
run 326 if it's substantial like 325, then we probably need to pull it. Our committee, if you had a chance to look over the
