Um, it looks like there's uh more language than is being added, uh, pretty much the, on the first page, it's pretty much restating the the struck language that's at the bottom there. So what it does is it adds a member of the General Assembly currently only the CEO of a county, city or town can request these tax reports. I just wanted us to have the ability as legislators to be able to do this. the same thing. Um, there was a lot of confusion about what exactly these reports had on them. It'll have the name of the company, their primary address is reached out to DFA to get a kind of a confirm what I understood. It'll have the company name, their address, let's say it's a Dollar General. It may be an out of state address. It's on there. It's just the primary uh address for the corporation, and it will only say if the taxes have been or if taxes were paid during a period. Or not, it won't have any details on how much was paid in so if we're requesting for a specific period, it'll just say if they paid taxes or not during that period, and that's all it does, you know, there was some debate in this room last night and after we talked about it between X and A and HL they've they've been unable to determine um which this bill won't help that to the fullest extent, but they're, they can't get an answer from DFNA how tax revenues coming in and they thought this bill was going to fix it, but it won't actually tell how much, but it will show who's paying taxes and help them kind of gauge a little bit better who else's paying taxes within the uh within the city or county. if someone decides to do it. I could not get that information from DFNA, although every retail uh concern that has a resale license has to display their license in public, uh, but, uh, they could not give me that answer. as to whether or not I had another uh RV park that we know was the city paying their taxes as they should, and I don't know that the city should be in in a private business, but I could not ascertain that information from DFNA. I went, I went and asked, and all I ask are are you collecting sales tax from them, and I could not get an answer, and it's pretty unique to sit on this committee with overseeing the FAA, and they tell me I'm not going to answer your question, and that's

Just just back up. um, because I I'm very le leery of giving us the authority to try to be an enforcer of any kind as it relates to businesses, I think I, I can't understand the goal of getting this information other than trying to be punitive to someone. Maybe that's not the case, but if I understand things correctly, And even the one example we have, that's the way that I would interpret that, uh, I, I mean, and I also would just say there's been a push from counties or cities to get additional information about who a particular payer is on refunds, uh, and I believe that typically that request has been made and it's denied. But it's so that those entities can be punitive, and so I'm leery of injecting us into something that I don't think is our place, um, I mean, I think if the taxing authority wants to request that information, they should be able to do that so long as they're not doing, I mean, again, they can be punitive if they want to, um, but I don't believe that that's our place. We're we're not in an enforcer. We shouldn't be the watch guard dog, whatever you want to call it, uh, amongst our businesses that are trying to operate in our districts. I just I think it's

So Bro Foundation was, was set up for the purpose of engaging with school districts to help encourage financial education, specifically pairing financial education for elementary schools with a grant to a 529 account for each student. And so we set up a foundation to go about doing that and along that process what we found is there are certain privacy law restrictions that make that difficult for us to set up an account for the benefit of each child that would require participation on behalf of parents for them to sign that up. And while we're certainly willing to get that information from the parents. History shows in these programs from around the country that the most needing children will not actually get. from parents or guardians because of their specific situations, whether it's the fact that their parents don't know what a 529 account is, whether they are concerned about the implications of what it might mean for their benefits, um, things of that nature. And so, um, what we needed was a way for us to specify this group of children and to allow for the schools to share that information with the state treasurer's office without necessarily providing it to us so that we could set up those accounts on behalf of those children and then provide the parents the chance to opt out if they were concerned about it, but also that this program was set up so that it wouldn't impact their biggest concerns, such as eligibility for benefits and things of that nature and so that's what this this proposal does is it allows us to go to schools and have a pathway for them to communicate directly with the 529 office at the Treasurer's office and share that information without going through us so that they can be ensured that their privacy for their child is protected. summary of what they're trying to do is they, they're adopting an elementary school, essentially, and they want to they want to start a 529 account for every child in that elementary school, and if it works well, then they want to expand that program to other schools, so this just allows a nonprofit with the bill actually does is it allows a nonprofit to set up a 529 account with the treasurer's office, and the information that the Treasurer's office needs in order to establish that account, they can get that from the school. The nonprofit never gets. that Confidential information. It stays with the treasurer's office. The Treasurer's office has, has that confidential information for every 529 account that they have, so there's nothing different about a nonprofit starting in as opposed to a parent starting it on their own kids' behalf. They have to provide that social security number and date of birth information anyway. And um anyway, Mr. Andrews came to me with this idea, we, we want to put foundations in a position where they can help kids on a broad basis like this, you know, every, every kid in elementary school to have a 52 529 accounts started on their behalf, a really wonderful thing. So we reached out to the treasurer's office. We've worked extensively with them. We've got, there's 4 folks here from the treasurer's office this morning. Happy to answer any questions, but we worked with them on the language we're in agreement on the language of the bill. It does allow parents to opt out. There are, there is no fiscal impact. The confidential information is protected within a system they already have for their 54,000529 accounts. That information's not shared with the 529, the treasurer's office is in support of the bill. Cavanaugh represent District 30. Um, this is has no physical impact and this is just to define what substantial improvement is on when the assessors assess something. Um, during this process, we found out that there's all kinds of different ideas and what makes up substantial improvements, so taxpayers will be handled differently in each county. This simply states that if there is a 2 5% increase of the assessed value that would then make it substantial improvement if it's more than 25% and it also clarifies that if you're having to rebuild because of a natural disaster if you use like kind components, then there's not gonna be any change, but if you upgrade the components that you're going back with and it increases the value more than 25%. It will be substantial improvement. It also says that there can't be any out of state comps used for Arkansas property unless it's a commercial property and we have no in-kind state comps, and that's what it does.

Uh, and so, uh, Mr. Chairman, members of the committee, in reviewing the House Bill 1444, we did notice that there is a provision where under existing law the Department of Commerce would review certifications by a qualified data center in terms of their meeting their employment and investment thresholds, um, some of the duties under existing law for the data centers, tax exemption under this legislation would be transferred over to the Department of Finance and Administration. You're just doing the amendment, the amendment. Yes sir. And what we did notice in the draft, um, of the legislation of the new bill HB 1444 is that now that those duties are being transferred over to DFA there were limitations on the use of the information that were placed on commerce, but since DFA now has those duties, It did not make good sense for those limitations to extend to the department. So this amendment clears up that confusion, allows when DFA under this bill to Review the documentation provided by the taxpayer that we were not limited to that sole purpose of using it for making sure the project requirements in the employment requirements were met. Instead, we could also use it for other uses auditing of the exemption and any other lawful purpose.
