Um, it looks like there's uh more language than is being added, uh, pretty much the, on the first page, it's pretty much restating the the struck language that's at the bottom there. So what it does is it adds a member of the General Assembly currently only the CEO of a county, city or town can request these tax reports. I just wanted us to have the ability as legislators to be able to do this. the same thing. Um, there was a lot of confusion about what exactly these reports had on them. It'll have the name of the
company, their primary address is reached out to DFA to get a kind of a confirm what I understood. It'll have the company name, their address, let's say it's a Dollar General. It may be an out of state address. It's on there. It's just the primary uh address for the corporation, and it will only say if the taxes have been or if taxes were paid during a period. Or not, it won't have any details on how much was paid in so if we're requesting for a specific period, it'll just say
if they paid taxes or not during that period, and that's all it does, you know, there was some debate in this room last night and after we talked about it between X and A and HL they've they've been unable to determine um which this bill won't help that to the fullest extent, but they're, they can't get an answer from DFNA how tax revenues coming in and they thought this bill was going to fix it, but it won't actually tell how much, but it will show
who's paying taxes and help them kind of gauge a little bit better who else's paying taxes within the uh within the city or county. if someone decides to do it. Senator dismay,

why does the General Assembly need that information? If something comes up, we need to know then I mean if if we have a constituent question, we would have to then go to the county judge or the mayor and ask, and you

Situation and so if you can help me

see that, I mean it just comes down to if a constituent asked me a question, I want to be able to reach out to DFA myself instead of having to contact my my mayor of the city or the county judge that I may or may not have a relationship with, you know, some sometimes people can be difficult to work with, so I'm just wanted us to have the same abilities. Senator Caldwell, thank you, uh,

Senator Des may answer your question. I had a specific situation like that with one of my cities that was running an RV park, and I asked where they collecting and paying sales tax on it. I could not get that information from DFNA, although every retail uh concern that has a resale license has to display their license in public, uh, but, uh, they could not give me that answer. as to whether or not I had
another uh RV park that we know was the city paying their taxes as they should, and I don't know that the city should be in in a private business, but I could not ascertain that information from DFNA. I went, I went and asked, and all I ask are are you collecting sales tax from them, and I could not get an answer, and it's pretty unique to sit on this committee with overseeing the FAA, and they tell me I'm not going to answer your question, and that's

uh, Representative Underwood, uh, went through the same, a similar situation that Senator Caldwell was just explaining when he was trying to help X and A and high work through some of their their
issues that he couldn't get any information from DFNA, and I know this isn't as extensive as a Both those parties would have liked to know because when we're trying to work out an agreement those those two entities need to know how much tax revenue is being collected completely, but this, this at least allows them to know which which parties are Paying taxes within the community or county. And we said

be fine. Just just back up. um, because I I'm very
le leery of giving us the authority to try to be an enforcer of any kind as it relates to businesses, I think I, I can't understand the goal of getting this information
other than trying to be punitive to someone. Maybe that's not the case, but if I understand things correctly, And even the one example we have, that's the way that I would interpret that, uh, I, I mean, and I also would just say there's been a push from counties or cities to get additional information about who a particular payer is on refunds, uh, and I believe that typically that request has been made and it's denied. But it's so that those entities can be punitive, and so I'm leery of injecting us into
something that I don't think is our place, um, I mean, I think if the taxing authority wants to request that information, they should be able to do that so long as they're not doing, I mean, again, they can be punitive if they want to, um, but I don't believe that that's our place. We're we're not in an enforcer. We shouldn't be the watch guard dog, whatever you want to call it, uh, amongst our businesses that are trying to operate in our districts. I just I think it's

Senator Clarke Tucker

came to me last year with a really wonderful idea with the foundation that he works with and I thought he could tell the story of what we need a law changed in order for him to do what he wants to do, but I thought he could tell briefly the story of what he wants to do better than I could,
Speaker 54
10:46
so Mr. Andrews, go ahead. Thank you. Yes, sir. You're recognized. Thank you. So Bro Foundation was, was set up for the purpose of engaging with school districts to help encourage financial education, specifically pairing financial education for elementary schools with a grant to a 529 account for each student. And so we set up a foundation to go about doing that and along that process what we found is there are certain privacy law
restrictions that make that difficult for us to set up an account for the benefit of each child that would require participation on behalf of parents for them to sign that up. And while we're certainly willing to get that information from the parents. History shows in these programs from around the country that the most needing children will not actually get. from parents or guardians because of their specific situations, whether it's the fact that their parents don't know what a 529 account is, whether they are concerned about the implications of what it
might mean for their benefits, um, things of that nature. And so, um, what we needed was a way for us to specify this group of children and to allow for the schools to share that information with the state treasurer's office without necessarily providing it to us so that we could set up those accounts on behalf of those children and then provide the parents the chance to opt out if they were concerned about it, but also that this program was set up so that it wouldn't impact their biggest concerns,
such as eligibility for benefits and things of that nature and so that's what this this proposal does is it allows us to go to schools and have a pathway for them to communicate directly with the 529 office at the Treasurer's office and share that information without going through us so that they can be ensured that their privacy for their child is protected. Yeah, so, uh, you know, one sentence
Senator Clarke Tucker
Unverified
12:37
summary of what they're trying to do is they, they're adopting an elementary school, essentially, and they want to they want to start
a 529 account for every child in that elementary school, and if it works well, then they want to
expand that program to other schools, so this just allows a nonprofit with the bill actually does is it allows a nonprofit to set up a 529 account with the treasurer's office, and the information that the Treasurer's office needs in order to establish that account, they can get that from the school. The nonprofit never gets. that Confidential information. It stays with the treasurer's office. The Treasurer's office has, has that confidential information for every 529 account that they have, so there's nothing different about a nonprofit starting in as
opposed to a parent starting it on their own kids' behalf. They have to provide that social security number and date of birth information anyway. And um anyway, Mr. Andrews came to me with this idea, we, we want to put foundations in a position where they can help kids on a broad basis like this, you know, every, every kid in elementary school to have a 52 529 accounts started on their behalf, a really wonderful thing. So we reached out to the treasurer's office. We've worked extensively with them. We've got, there's 4 folks here from
the treasurer's office this morning. Happy to answer any questions, but we worked with them on the language we're in agreement on the language of the bill. It does allow parents to opt out. There are, there is no fiscal impact. The confidential information is protected within a system they already have for their 54,000529 accounts. That information's not shared with the 529, the treasurer's office is in support of the bill. That that's it in a nutshell. Happy to take any questions. Remember anyone have any questions in regards to this.

The law around what qualifies for your homestead exemption, and there was a recommendation to lower it from the 160 acres and your primary residence to a lower number we found out that this created a an undue hardship on a number of totally disabled veterans, and this bill simply adds back the what was The originally, uh, the 160
acres and you're their primary residence, and that's the essences of this bill. So,
Speaker 70

so this, this goes back, this goes back to what we were previously, correct? For, yes, the

160 as I as I understand it, I can't remember exactly where we started. I know we lowered it, but I, I'm Virtually sure it was the 160 DFNA might be able to confirm that it was, I think this may have been part of their bill or something. Was it does that?

Does does DFNA mind Come to the table on this one. This was 2 years ago and
and we But that's whenever we, we, we started authorizing authorizing this credit though, right? That was actually the startup of it. Yes. And I think you meant that that maybe that bill or something started at 160 and we amended that bill in here. OK, that's that. So that wasn't a
Speaker 74

statute that that we had changed before, that
was just the bill that was presented two years ago, I think and hopefully they can confirm, but I thought there was, it was a higher number to start with. Can y'all kind of give us some background? I, I

vaguely remember all this, uh. Thank you, Mr. Chair,
Speaker 78

members of the committee, Paul Gehing DFA. Mr. Chair, members of the committee, Robert McGee, assessment coordination with DFNA uh, this clarifies there were some discrepancy with collectors on the actual acreage that was used statewide, um, there was
not enough specificity in the statute or rules with collectors. So last year's bill was both an attempt to get uniformity for all 75 counties and then in doing that, uh, it impacted more 100% disabled veterans, then I think everybody initially thought, and so they're raising the acreage level back up to a level that seems that will accommodate a correct amount. OK.

So let me just ask this, so we're saying last year we're talking about last session. 2 years ago. I mean, we did this in that we didn't do it in the fiscal. We did in the last regular. Alright, so
Senator Jimmy Hickey, Jr
Unverified
18:28
2 years ago. Did we have a statute on the book at that point that was allowing
Speaker 78
18:33
up to the 160, not to the 160 itself. Collectors were taking it upon themselves to prescribe the amount of acreage that they would accept. That's
Senator Jimmy Hickey, Jr
Unverified
18:44
what I remember, yeah, yes, OK, and so we, we attempted at that point to As you just said, make it, make
Chair (Senator Jimmy Hickey, Jr)
Unverified
18:51
it specific. We tried 40, but I guess what we found out was is there was a bunch of collectors that were allowing A whole lot higher acreage. Although it was never actually uh dictated by this legislature what should have happened or what shouldn't have happened. Correct, yes, yes. I had any, any questions about
Senator Jonathan Dismang
Unverified
19:15
Any of the uh Members You got one center this way. I'm just not sure that I'm, I'm fully understanding what, so what's the, what's the impact? What's the ripple effect going to be even when I read the green sheet, I'm not sure that I'm smart enough to understand. Now what we're saying is, is at one point, Some homesteads in some counties were deemed to be larger acreage than others. The conversation, I'm sorry, we passed a bill, I think I remember to take that down to
whatever a designated acreage which was generally reflective of what the IRS would consider a homestead whenever you. sold a piece of property for your, you know. And get the exemption. From the sale. I think that's what's the logic behind the amount, and now we're saying. It's been punitive to some because some counties count. Larger amounts of acreage is the homestead, and when we passed this. That Impacted those that set group of people and then so what's the outcome from doing this?
Senator Jim Petty
Unverified
20:18
So I, I had a conversation with a couple of veterans that were 100%
disabled, and they, uh, they may have a, a, a small home and 160 acres and 80 acres or 62 acres or whatever, and they weren't getting the benefit of that after we changed it to the 40, so they were, they were having to pay more tax had an increase in their tax, their property tax, after we implemented this this bill after we define homestead, yes. That's correct.
Senator Jonathan Dismang
Unverified
20:54
But again, it's the 100% disabled veterans only. I mean, just a question, is there a way to grandfather those individuals in. It's kind of a hard argument to say that 4 more than 40 acres is your homestead. I mean, I don't, it's not recognized to be that in. Most circumstances. I don't know. I'm fine with it. I think I generally understand it. I think I'm not sure what the ripple effect's going to be, but.
Senator Jimmy Hickey, Jr
Unverified
21:24
Thank you. I kind of, I kind of agree with Senator Dima, and I don't, I don't know if there's a way that we could go back, you know,
to 2 years ago I mean, do, do we know, have, have we looked at that? How many, how many, how many individuals were we talking about at that particular time that we're getting a credit. Over the 40 acres,
was it 100 or 3000 or do we know? Just stab in the dark. Um Our attempts to collect that
Speaker 78
21:56
information were incomplete, not all 75 counties turned in that information to us. I at this point, my memory serves that we were somewhere around 40 in responses. What was, what was given the
Senator Jimmy Hickey, Jr
Unverified
22:08
clerks the authorization to to set it on their own. They're just doing it. Or I think it was less what was giving them
Speaker 78
22:16
authorization than it was what was keeping them from doing that. Fair enough. Any, any other questions on this one?
Chair (Senator Jimmy Hickey, Jr)
Unverified
22:33
Anyone from the audience want to speak for the bill. Anyone want to speak against the bill.
Senator Jim Petty
Unverified
22:51
It was a pleasure of the committee. A close, yes sir, I apologize. I'm
getting that off. So the other issue that that that I had a conversation with the veterans in this is that they own this land and it's in multiple
tracks. It's large tracks, and they're going to have to come in and survey out that 40 acres and so it's not just the property tax, it's the added cost of surveying and and uh it specified as their homestead. With that, I, I think it's, it's probably a, a somewhat limited number, but a big enough number that uh there were a lot of interested
individuals. Worried about the cost of doing and complying with this as well as the implications on the property tax. So with that I'm closed and I would appreciate a good vote. Discussion real quick. Well, are you OK with that, Senator Petty? I'm gonna, I'm gonna let you, since
Chair (Senator Jimmy Hickey, Jr)

I've already closed in our normal course would be to take the motion. I would, I would like to too, but I, I don't, are
Senator Bart Hester

24:05
you OK with that? OK, yes, Senator Hester. So I, I, I, and maybe I've missed some, but like. I think we'd all agree 1000 acres
is not a homestead and this is saying 160 acres. Is that what I heard? Yes, and, and,
Senator Jimmy Hickey, Jr
Unverified
24:23
and where is that? It's, it's own 34 on page one. And this
Speaker 47
24:36
that would be my problem. I've been saying sorry, there is, there is a Senate bill that you're looking at
Senator Jim Petty
Unverified
24:42
that I was looking at as well before I came. I'm not, I'm not gonna take the hit on that one. No, I just, it's
Senator Jimmy Hickey, Jr

getting late in this late in this session I'm good.
Speaker 39
25:01
I'm good now. My they read almost the same. OK,
Senator Jimmy Hickey, Jr
Unverified
25:08
my, my, well, since we're in, since no, since we're in discussion, I've got one more.
All right. Do we not believe though that it would be beneficial if we just had an amendment that grandfathered those particular ones in. That were there and then from this point forward started defining them as 40, because what we're going to have over the next, as someone buys this stuff over the next 100 years we are setting policy and we're always going to allow it on 160, and that may be what this body wants, but I mean, I understand if somebody's going
to get harmed by it. I don't want to do that, especially at our veterans. Nobody in this room does. It's just just the way it is. But would it not be a
Speaker 112
25:48
better bill if we grandfathered those in. So that's
Senator Jim Petty
Unverified
25:53
a, that's a, that's a good question. I don't know how we can go back and grandfather those in that have already been affected by this. It would be a new uh Defined as I understand it, I'm happy to have the conversation here and discuss that, but I don't know how we could
grandfather it in at this point since it went into effect 2 years ago. He would just have to, it
Senator Jimmy Hickey, Jr
Unverified
26:18
would just have to say that. Anybody that was allowed up to 160 as of that particular date, you know, would would be able to still, still take
that credit, but I mean, I think we could get there. It's just whether or not this body wants to do it or if this body's good with
Senator Jim Petty
Unverified
26:34
the 160, then we'll roll. Now, as co-sponsor, my preference would be to let this go. We've made it very clear as a body that we
want to attract veterans who want to take care of veterans and, and, and I think the the impact to counties is probably minimal if we want to come back, and I'm happy to have a conversation with them about etching a new bill that says henceforth, you know, it's going to be the 16. or 40 or whatever number we want to, but I, my, my preference at this point would be to to pass it as is and then look at another piece of legislation, uh, because we're, as you know, running out of time and send it
back down there, it's not going to get hurt and then we're into that week or two period that we were talking about the other day
Speaker 74
27:20
in caucus, so. Uh, that would be my preference, but it's the will of the so we'll consider you

Cavanaugh represent District 30. Um, this is has no physical impact and this is just to define what substantial improvement is on when the assessors assess something. Um, during this process, we found out that there's all kinds of different ideas and what makes up substantial improvements, so taxpayers will be handled differently in each county. This simply states that if there is a 2 5% increase of the assessed value that would then make it substantial improvement if it's more than 25% and it also
clarifies that if you're having to rebuild because of a natural disaster if you use like kind components, then there's not gonna be any change, but if you upgrade the components that you're going back with and it increases the value more than 25%. It will be substantial improvement. It also says that there can't be any out of state comps used for Arkansas property unless it's a commercial property and we have no in-kind state comps, and that's what it does.

so we'll have it on the record. Senator Jonathan Dismma District 18. Paul Gehing DFA.
Speaker 77
31:03
Uh, and so, uh, Mr. Chairman, members of the committee, in reviewing the House Bill 1444, we did notice that there is a provision where under existing law the Department of Commerce would review certifications by a qualified data center in terms of their meeting their employment and investment thresholds, um, some of the duties under existing law for the data centers, tax exemption under this legislation would be transferred over to the
Department of Finance and Administration. You're just doing the amendment, the amendment. Yes sir. And what we did notice in the draft, um, of the legislation of the new bill HB 1444 is that now that those duties are being transferred over to DFA there were limitations on the use of the information that were placed on commerce, but since DFA now has those duties, It did not make good sense for those limitations to extend to the department. So this
amendment clears up that confusion, allows when DFA under this bill to Review the documentation provided by the taxpayer that we were not limited to that sole purpose of using it for making sure the project requirements in the employment requirements were met. Instead, we could also use it for other uses auditing of the exemption and any other lawful purpose. So that's the purpose of the amendment, OK, remember, as you've heard the discussion on the amendment. Does anyone have any uh

Questions on the amendment itself. Are you seeing none. We have a motion. So this makes motion. Senator Hester's. Second, this is for the adoption of the men all in favor say aye. Any opposed? OK, the amendment is adopted, so now y'all can present your bill as amended. All right, members,
Senator Jonathan Dismang

32:54
uh, last session we passed a version of this bill. It's what we have on the books right
now. We were in the first states in the country to pass a data data center
bill like this or wanted to try to recruit data centers. Everyone else took our bill. They perfected it, made it a little bit better, became more competitive, and so this is in response to the the other data center type bills around the country. Uh, a couple of things. does require a qualified investment of $2 billion or more within 10 years of construction, $3 million annual payroll, including contractors and it lowers the data center investment requirement from a
half a billion dollars to $100 million and it keeps in place that positive cost benefit analysis requirement from AEDC keeping the bill neutral and the last thing just so we didn't get into any more confusion about Bitcoins, bitcoin mining explicitly. sets that these are not, that's not what we're talking about here. These are
data centers when you think about that, you think about storage or AI. And there's no, there's no
Senator Jimmy Hickey, Jr

fiscal impact whatsoever, of course, with this. That's correct, Mr. Chair. When the
Speaker 77
34:08
bill was originally enacted in 2023. There was no fiscal impact to the state. also with the amendments to House Bill 1444. Also no fiscal impact to the state. It is revenue neutral the taxpayer is entitled if it's, it is a qualified project to a sales tax exemption for their purchases and their utilities, but there are no, there are no tax credits. There's nothing that's going to be where the state is Responsible for paying.

36:14
Uh, H Bill 1497 is to add the Department of the military to the list the claimant agents for the purpose of the set off against state tax refund. This bill amends the definition of claim an agent for the purpose of obtaining state set off tax refunds to add the Department of Military through Arkansas Code 26363031A. This bill enables the Department of Military to collect fines, etc. Assessed through military justice action, including
non non-judicial punishment and court martials, and that's by ACA 1264301. Uh for not for punishment and this covers 405 and 407. The general and special and summary court martial fines. The Arkansas National Guard is attempting to address the situation where individuals are fined and either go absent without leave or separated prior to collection of the fines without paying their
fines. We'll be happy to try and attempt to answer any questions. A Sinder history, you reckon that,
Senator Bart Hester
Unverified
37:23
sir? Can you give me an example or two of a fine that you would, is it like a speeding ticket on the
Speaker 142
37:29
base or what, what do you find people for not typically like that, sir. Typically it's use or possession of
Speaker 140
37:35
a controlled substance. The individual tested positive while in a military status they showed up to work and did that, or it could be AWOL and we got our hands on them and then went through one of these processes, um, but I've I've never seen
anything like traffic tickets or anything like
Senator Bart Hester

37:51
that, sir. So if somebody's got controlled substance on base and you would find them $500 or $10,000. I mean, what does that
Speaker 142
37:59
look like? Uh yes, so there's specific limits in the
Speaker 140
38:02
statutes and as you might imagine with the military, sort of whoever's imposing it, the higher the rank, the more, you know, risk they're, they're assuming. It's tied to the pay of the service member, so for the most part it's limited to 14 days pay of of their military pay, which
Speaker 145
38:18
which could go up to a couple $2000 depending on their rank. But usually it's in the, they won the $500 range. Yeah, thank you. Any other questions? Senator Crowe, I
Chair (Senator Jimmy Hickey, Jr)
Unverified
38:29
don't want to put you on the spot. Do you know who's, who's able to do these setoffs now. I mean, since we're adding them, do you know, is there a whole list of other Agencies or whatever that we allow to do this. Yes
Speaker 146
38:42
sir, both, and I believe in this statute and in others I'm looking at DFNA and they're nodding yes.
Speaker 145
38:48
There's quite a few others within the statute, there's a list, a lot of state agencies, I believe the counties also use this process as well and a lot of, you know, subcomponents to the state and then the counties and of course you're not
Senator Jimmy Hickey, Jr
Unverified
39:01
going to know the information or how much it might be. So what you do is you just submit this, you just submit this, uh. Garnishment or set off or whatever to DFNA and then if there is a refund, then they'll pay it. Do you have to resubmit it every year or if it's not enough there to cover it or do
Chair (Senator Jimmy Hickey, Jr)

informed resubmit every year, OK. Right. Any other questions? Hey, anyone from the audience want to speak for the bill. He wasn't going to speak against the bill. Are you close, Senator Crow? uh that pass, and it was good to have you with us, Cap. Thank you. Yes, sir. Any other, anything else? All right, no, see no other bills, members, what we are going to do, I'm gonna go ahead and tell you, of course, we're going to not be here next
