howard baity district 95 here's present uh house bill 1796 uh basically what this bill is is going to do is codify the rule that DFNA placed related to the information that's displayed on Arkansas driver's license so basically the bill requires the display of gender information on an Arkansas driver's license ID card and specifies that that gender information must be stated as either male or female in the past there was a rule that allowed them to place X on the driver's license if the applicant um didn't identify as male or female dfna changed that by rule back during um previous session and this basically codifies that information so with that i'll entertain any questions

start by echoing Representative Beatty's. I hope your day goes nice and smooth. So I'm excited to be here today to present House Bill 1798. You'll remember about a month ago or so you guys had House Bill 1064, which was the blue envelope program. This is a very similar, um, bill, which is the green envelope program. So, uh, this bill to explain it a little bit, this bill was brought to me by a friend and licensed, uh, clinical social worker, Ange Pereira from my district. Um, in the session, you guys passed 1046, uh, 1078, or excuse me, 1798 is going to be a mirror image of that blue Envelope program, addressing individuals with diagnosed mental illness is the main difference. So in 2024, to give you some perspective, here in Arkansas, there was a couple that was diagnosed with schizophrenia, PTSD, panic disorder, as well as other conditions. They were pulled over because of having expired vehicle tags. Due to the mental illness that the couple suffered, that situation caused a great deal of stress and anxiety, as you may imagine. It escalated very quickly for both the couple and the law enforcement officers that were involved. House Bill 1798 could put safeguards in place that would protect individuals that suffer from mental illness, as well as the law enforcement officers that would have to respond to those incidents. So with January 1st, 2026 date for enactment, there is sufficient time for the green envelope program to be implemented at the same time that the blue envelope program would be. Streamlining the process and not creating a duplication of effort. To address a few questions that came up during the Blue Envelope presentation, training and dissemination of this information is going to be key. I did speak with Sheriff Scott Bradley about that, and there's a lot of different ways that we can get that information out. There's emails that get sent out to all the different law enforcement officers, as well as annual training that has to come up. And so some of this could be added to that, easily getting it out in their hands so that they understand what what can be expected. One other question that was raised was a placard or symbol for the exterior of the car. Dealing with folks that have suffered from mental illness, that could be something that they would really not want to have on their vehicle because of the possibility of being targeted like was discussed earlier with the blue envelope, but also just the thought process that someone could look at them differently in that way. And so it could play into the mental illness that they do suffer from so house bill 1798 will not solve every problem for the mentally ill individuals however it has the potential for doing a great job of protecting arkansas as well as law enforcement officers and helping to prevent situations from escalating rapidly endangering arkansas as well as those law enforcement officers so with that i'm open any questions and i do appreciate your support

bill sir thank you mr chair uh committee if you've looked at the bill 1834 uh it's kind of a companion bill that uh representative kavanaugh ran just a few days ago has to do with dealer tags I'll just try to touch on this if you have any questions I'll be glad to try to answer them it adly adds a right of action for the Motor Vehicle Commission to deny or suspend or revoke a dealer's issued license issued by the commission in the event that the dealer misuses an extra dealer tag license plate by allowing a non-eligible user to drive on the license plates in lieu of the suspension of the dealer's license issued by the commission a dealer may be penalized in an amount up to four thousand dollars per occurrence in lieu of revocation of the dealer's license issued by the commission a dealer may be penalized amount up to ten thousand dollars per occurrence in addition to this provision section one makes a technical correction from temporary cardboard buyer's tag to a temporary pre-printed paper buyer's tag. Also in Section 2, it allows the Motor Vehicle Commission flexibility to review the dealer service and handling fee. This fee is set by the Commission in Rule 8, which must be approved by the Legislator or Legislative Council. We'll review it so there will be no charge to the current or present fee. motion your bill has passed thank you chair and committee i appreciate it uh house bill 1845 i guess before i even start into my talking points everything's gone electronic i don't don't have to tell you that everything we do we sign i even sign electronically here in this committee uh we buy we go we go through buy groceries now we sign electronically we sign on our credit cards electronically so we buy electronically so what we're talking about here in 1845 is to allow dfna to implement electronic uh titling and registration system for the transfer of ownership of motor vehicles uh hb 1845 is a permissive bill allowing dfna to implement a system uh for the electronic ignition and titling and motor vehicles that will allow dealers and in arkansas to digitally upload customer documents with the goal of ultimately just speeding up the registration of titling process and you know sometimes that can be trying that process we go through now in getting we've even extended our our time from 30 days to 60 days because we've had so much trouble getting titles for clarification on electronic lien and title application provides an electronic means of transferring information between lien holder and jurisdiction motor vehicle agencies to perfect update and to release lien information on vehicle titles. All electronic registration and title system is designed to provide electronic means of processing the title or registration transactions by an authorized user on behalf of the jurisdiction. States across the country are implementing these electronic procedures for vehicle registration and this will just help move Arkansas in the same direction. That's Also in Section 1 through 7, it puts Arkansas in line with federal e-signature guidelines, and it will allow documents such as an odometer statement and power of attorney forms to be signed by electronic signature. Greg Kirkpatrick, Arkansas Automobile Dealers Association. And Representative Hall, these programs are going all across the country at this point. I know West Virginia, Ohio, Kentucky, actually almost all states are in some level of this electronic registration and titling implementation. Arkansas is one of a few that has fewer services. And really what we're talking about mostly in this bill is the transfer of the paperwork. So when you go buy a car, you're doing everything for the most part on a keypad. At this point, those documents are now, in many cases, still having to be printed out, postmarked, and sent to DF&A. This is going to allow DF&A to start implementing, and it is permissive to implement a system that would allow dealers to upload that paperwork digitally. That's really fundamentally what it is. That's the e-registration and titling part. And then to Representative Stimel's kind of concern on the title piece, that's really a separate conversation. There is a section that does allow DF&A at some point in the future to look at a digital title. This bill does not do that. That is a concerning area for a lot of people, and we want to take that very slowly. We're all incredibly concerned how that technology is going to move forward. We like paper, too. So this process, but the process of getting the customer's paper to the state as quickly as possible, then it allows the lien holder to release the lien quicker. It just allows the transaction to be sped up. So it really is a benefit to consumers. And, again, it is being implemented across the

with a paper title. This really is just the transfer. So there are a couple of holdups right now in the customer being able to register their vehicle. The holdups are there are two pieces of paper that we're still signing in Arkansas, an odometer disclosure and a power of attorney form in the Truth and Mileage Act called a TEMA-2. Right now, the state's still requiring those to be handled with a wet signature. Under federal law, you're allowed to provide an electronic signature. So the vast majority of this bill is just clarifying that. But all of it's permissive, though. But the actual title itself is not changing until the state decides to start implementing a digital title. And we're not there yet. So, yes, you will still have a paper title in Arkansas.
