do is codify the rule that DFNA placed, uh, related to the information that's displayed on Arkansas driver's license. Uh, so, um, basically, the bill requires the display of gender information on, uh, an Arkansas driver's license ID card and specifies that that gender information must be stated as either male or fema. email Uh, in the past there was, uh, a rule that allowed them to place X on the driver's license, um, if the applicant, um, didn't

House District 4, and I'll, I'll first I'll start by echoing uh Representative Beatty's, I hope your day goes nice and smooth, so, uh, I'm excited to be here today to uh to present House Bill 1798. Uh, you'll remember about a month ago or so you guys had a House Bill 1064, which was the blue envelope program. This is a very similar um bill which is the green envelope program, so, uh This bill to explain it a little bit, this bill was brought to me by a friend and licensed uh clinical social worker Ange
Pereira from my district, um, in the session you guys passed 1046, uh, 1078, or excuse me, 1798 is gonna be a mirror image of that blue envelope program addressing individuals, uh, with diagnosed mental illness is the is the main difference. So in 2024, to give you some perspective here in Arkansas, there was a couple that was diagnosed with schizophrenia, PTSD. Panic disorder as well as other conditions, uh, they were pulled over because of uh having expired vehicle tags due to the mental illness that the couple
suffered, that situation caused a great deal of stress and anxiety, as you may imagine. It escalated very quickly for both the couple and the law enforcement officers that were involved, um, House Bill 1798 could put safeguards in place that would protect individuals that suffer from mental illness, uh, as well as the law enforcement officers, um, that, uh, that would have to uh respond to those incidents, so, uh, with January 1st, 19 or 2026 date for enactment, there is sufficient time for the green envelope program to be
implemented at the same time that the blue envelope program would be. Streamlining the process and not creating a duplication of effort, uh, to address a few questions that came up during the blue envelope, uh, presentation training in this, uh, training and dissemination of this information is going to be key. Uh, I did speak with uh Sheriff Scott Bradley about that, and there's a lot of different ways that we can get that information out. There's emails that get sent out to all the different uh law enforcement officers as well as annual training that has to come up, uh, and so some of this could be
added to that, uh, easily getting it out in their hands so that they understand. uh, what can be expected. One other question that was raised was a placard or symbol for the exterior of the car, dealing with folks that have uh suffered from mental illness that could be something that they would really not uh want to have uh on their vehicle because of the possibility of being targeted like was, uh, discussed earlier, uh, with the blue envelope, but also just the, the thought process that someone could look at them, uh, differently in that way and so it could play into the mental illness that they do suffer from.
So House Bill 1798 will not solve every problem for the mentally ill individuals. However, it has the potential for doing a great job of protecting our Kansas as well as law enforcement officers and helping to prevent situations from escalating rapidly endangering Arkansans as well as those law enforcement officers. So we do look at a diagnosis, so the expectation is that a diagnosis would come, uh,
and then from that licensed clinical social worker, then they would talk to their patient, letting them know about this, um, about this blue or green envelope program and then they could then get involved by going to DFNA and, uh, request it. So it would be a diagnosis from one of those health care providers. Follow up, so will they have to have a note from a

1834, uh, it's kind of a companion bill that uh representative Kavanaugh ran just a few days ago, has to do with dealer tags, uh.
Uh, I'll just try to touch on this, you have any questions, I'll be glad to try to answer them Adly adds a right of action for the motor vehicle commission to deny or suspend or revoke a dealer's issued, uh, license issued by the commission in the event that the dealer misuses an extra dealer tag license plate by allowing a non-eligible, uh, user to drive on the license plates in lieu of the suspension of the dealer's license issued by the commission a dealer may be. penalized in a, in an amount up
to $4000 per occurrence in lieu of revocation of the dealer's license issued by the commission they did or may be penalized amount up to $10,000 per occurrence. In addition to this provision, section one, makes a technical correction from temporary cardboard buyer's tag to a temporary preprinted paper buyer's tag. Also in section 2, it allows the uh motor vehicle commission. flexibility to review the dealer of the dealer uh service and
handling fee, uh, this fee is set by the commission rule, uh, commission and Rule 8, which is must be approved by uh legislator or or legislative council we'll review it,
so there will be no charge to the current uh or present fee. And I'd be glad to take any questions if you've looked at the bill, have any questions from committee saying no

everything's gone electronic. I don't have to tell you that everything we do, we sign I even signed electronically here in this committee, uh, we buy, we go, we go through buy groceries now we sign electronically we sign on our credit cards electronically so we buy electronically so what we're talking about here in 1845 is to allow DFNA to implement electron. uh titling and registration system for the transfer of
ownership of motor vehicles, uh, HB 1845 is a permissive bill allowing DFNA to implement a system uh for the electronic ignition titling of motor vehicles that will allow dealers and uh uh in Arkansas to digitally upload customer documents with the goal of ultimately just speeding up the registration of titling process, uh, and you know sometimes that can be. Trying that the process we go through now in getting, we've even extended our, our, uh, time
from 30 days to 60 days because we've had so much trouble getting titles, uh, for clarification on electronic lien and title application provides an electronic means of transferring information between lien holder and jurisdiction motor vehicle agencies, uh, to perfect update and to release lien information on vehicle titles all electronic re Uh, registration and title system is designed to provide uh electronic means of processing
the title or registration trans uh transactions by an authorized user on behalf of the jurisdiction. Uh, states across the country are are implementing these electronic procedures for vehicle registration, and this will just help, uh, move Arkansas in the same direction. That's uh also in section one through 7, it, uh, it puts Arkansas in line with federal e-signature guidelines, and it will allow documents such as an
odometer statement and power of attorney forms to be signed by electronic signature. That's it in a nutshell and Mr. Chair, I'll be glad to answer any questions or attempt to. Have any questions from committee? I

introduced yourself and you can proceed, sir. Thank you, Mr. Chair. Greg Kirkpatrick, Arkansas automobile Dealers Association, um, and Representative Hall, these, these programs are going all across the country at this point. Um, I know West Virginia, Ohio, uh, Kentucky, um, multiple
actually almost all states are in some level. of this electronic registration entitling implementation, Arkansas is one of a few that has fewer services. And really what we're talking about mostly in this bill is the transfer of the paperwork, so when you go buy a car, you're doing everything for the most part on a keypad. At this point, those documents are now in many cases still being have having to be printed out. Postmarked and sent to DFNA. This is going to allow DFNA to
start implementing, and it is permissive to implement a system that would allow dealers to upload that paperwork digitally. That's really fundamentally what it is. That's the e-registration and titling part. And then to representative Steinel's, um, kind of concern on the title piece, that's really a separate conversation. Um, there is a section that does allow DFNA at some point in the future to look at a digital title. This bill does not do that. That's a, that is a concerning area for a lot of people and, and we want to take
that very slowly. We're all incredibly concerned how that technology is going to move forward. We like paper too, so this process, but the process of getting the customer's paper to the state as quickly as possible, then it allows the lien holder to release the lien quicker. this really is just the transfer the, the, the whole, so there's a couple of holdups right now and, and the customer being able to register their vehicle. The
holdups are, they're two pieces of paper that we're still signing in Arkansas odometer disclosure and a power of attorney form and the Truth and Mileage Act, um, called a team of 2. Right now, the states still requiring those to be, be handled, um, with a heart with a wet signature. federal law, you're allowed to, to provide an electronic signature. So the vast majority of this bill is just clarifying that. Um, but it's permiss all of it's permissive though, but the, the actual title itself is
