Public Health Committee meeting is called to order. Public Health Committee meeting is called to order. Senator Boyd has an amendment on his bill. This is the 1963, is that correct? House Bill 1963. Yes, ma'am. Okay.

with the record, please. State Senator Justin Boyd-Fort Smith. And this amendment is an agreed-to amendment between the bill sponsor and the Medical Society to clarify that if a substitute is made under the bill as drafted, that notice would go back to the original physician. You've heard

an explanation of the amendment. Is there a motion to adopt the amendment? So moved. And second, all those in favor say aye. Aye. And opposed? As have it. Amendment is adopted. House Bill 1963 present as amended.

So what House Bill 1963 does as amended is it would allow an advanced practice registered nurse to substitute a therapeutically equivalent stimulant medication. So these are like Vyvanse, Folklin XR, Adderall XR. Right now, currently, an advanced practice nurse can write those prescriptions, but a physician has to write the initial prescription and has to be seen by a physician at least every six months. And so they're basically allowed to continue it. But what this would do is say, like, there's a prior author or there's a formulary issue or whatever. This would allow the advanced practice nurse to make a therapeutic substitution. But then he or she would need to notify the physician who originally wrote the prescription if that happened.

Senator Davis. We need to, you have some amendments, I think. Do you have amendments? Yes. Okay, do you want to go ahead and get that signed? And also, can somebody text Senator Tyler Dees? 1523. Breanne Davis, State Senate, District 25. All right. Are you recognized or proceed on House Bill 1523? Okay. Thank you, Madam Chair. This bill is a missing persons advisory system for adults who have disabilities. They're often like adults with disabilities maybe are runners, I think specifically of people with Down syndrome. So this is just to ensure that if they're missing, they don't qualify for the silver alert, that there is an advisory system in place so that we can find these adults with disabilities. I'm happy to take any questions. - Question, Senator Payton? - Are we on 1523?
▶ Play Suggest a correction Report an error
Senator John Payton Unverified 5:41
- Yes. - Okay, that sounds very familiar, like a bill I read before. But what I'm seeing is we're moving all this and structuring it under the state police in this bill. And it's the amber alert system, It's a silver alert system. Right. So, I mean, and I thought I remembered a bill coming through earlier this session that did what you just described. But it looks like this bill is putting all of that under the state police. I don't know where it was now or before, and I'm not against that. I just wanted to make sure
▶ Play Suggest a correction Report an error
Senator Breanne Davis Unverified 6:26
I was on the right bill. You are on the right bill. We made a pretty substantial amendment to the bill when it came over to the Senate, because originally this was the purple alert. And we took it down to an advisory system so that they're just not overload the alert system in Arkansas. So every time they're not breaking in, you know, repeatedly and people kind of have alert fatigue.
▶ Play Suggest a correction Report an error
Senator John Payton Unverified 6:48
The concern I had over the bill that came through previously was that it would be like the boy that cried wolf, many things coming out for people to pay attention to. So this is the same bill that's
▶ Play Suggest a correction Report an error
Senator Breanne Davis Unverified 7:00
just been amended and changed this much? It's an advisory system rather than an alert. So the difference in that is they won't break in on the news. It'll just be an advisory. So maybe you'll see it scroll. So is it

already under the state police? It's new.

other questions from the members of the committee? I think Senator Scott had a bill. It was Senator Scott's bill, but it's similar to this one. That's right. I think that's what you're remembering. But that one was specific to children. Yeah, to children. Any other questions from members of the committee? All right, scene nine. Is there anyone here to speak for or against House Bill 1523? All right, scene nine. You're recognized to close for your bill? I'm closed, thank you. Motion do pass and second. All those in favor say aye. Aye. And opposed, ayes have it. Congratulations, you've passed House Bill 1523. You have, is it 1250? No, 1801. Yes. And I see Representative Moore has also come to the room. If you will both state your name for

the record, you are recognized. Breanne Davis,

State Senate, District 25. Okay, and this has an amendment. We'll pass that amendment out.
▶ Play Suggest a correction Report an error
Senator Breanne Davis Unverified 8:42
If you'll explain your amendment. So the amendment just adds at the end that the board of pharmacy shall promulgate rules for the labeling of the contents of the bill. Okay. Is that right?
▶ Play Suggest a correction Report an error
Senator Missy Irvin Chair Unverified 8:58
All right. Is there a motion to adopt the amendment? And second? All those in favor say aye. Aye. And opposed? Amendment is adopted. Please proceed House Bill 1801 as amended. Kendra Moore, State Representative, District 23. All right. You

may proceed. Thank you, Madam Chair. House Bill 1801 allows specialty compounding pharmacies, which are a special class of compounding pharmacies that are licensed and regulated by the FDA and must be in good manufacturing standards. These special compounders create medications that are no longer produced or experiencing shortages. Historically, these facilities were not allowed to sell to retail pharmacies for them to be able to dispense these medications to patients. However, the FDA has recently changed its position on that last year and issued a guidance that now allows these specialty compound pharmacies to sell to pharmacies and dispense to patients with a valid prescription. So this bill just brings Arkansas in line with these FDA guidelines, which are being followed by many other states, and allows our constituents to be able to take advantage of these compounded medications when the FDA allows them to be compounded, saving our constituents money. And please note, this only applies when a product is not commercially available and on that FDA shortage list. And I'd also like to state that the Pharmacy Association is in support of this. the National Community Pharmacy Association, as well as the Board of Pharmacy gave input that we incorporated into this bill.

And with that, I'll be happy to take questions. - Any questions from the members of the committee? All right, anyone here to speak for or against 1801 as amended? Seeing none, all right, You're recognized or closed for your bill? I'm closed for my bill and appreciate a good vote. Motion do pass as amended. Second. All those in favor say aye. Aye. Opposed? Ayes have it. House Bill 1801 is passed as amended. Thank you, committee. Thank you, Madam Chair. All right. Thank you. All right. 1251? No, 1537. I think it's our last bill.
▶ Play Suggest a correction Report an error
Senator Tyler Dees Unverified 11:39
Thank you, Madam Chair. State Senator Tyler Deese, District 37. This is House Bill 1537 from Representative Ladyman. And what this does is repeals the Location Act for Community Homes for Individuals with Intellectual and Developmental Disabilities. This is a lot of great work from Representative Ladyman, working with the HDCs across our state. And so it looks to move in a good direction and repeal a lot of the sections that needed to be taken out. Happy to answer any questions.

Are there any questions from the members of the committee? Senator Love

here, recognize your question. Thank you, Madam Chair. Now, what's the practical

Senator Tyler Dees Unverified 12:20
effect of repealing the Location Act? So no questions. I appreciate it. Oh, just kidding. Okay, so I believe this helps with some concerns they've had around the HCCs have had with this section of the code. Something about density control, there's been some things about that that they've disagreed with. And so working with that group, I believe there's nine HCCs. I need to double check that number across our state, but about concerns about some of this section. But that's about the furthest extent that I have on that conversation. I will echo a follow-up on that and say that I've not received any pushback on this. I did follow through the House. There were 94 votes with zero dissents. And if you've got concerns, I'm happy to step out and look into

them. Any other questions? it seems like a really odd statutes to have in arkansas statute to be honest it seems very odd to me that it was ever even in code like this but wait i'm fine with repealing it any any other questions anyone here to speak for or against house bill 1537 All right, seeing none, motion do pass. Second, all those in favor say aye. And opposed, ayes have it. Congratulations, you've passed your bill. Thank you, Madam Chair. Thank you, members. Thank you. We are adjourned.
