amended. So what House Bill 1963 does as amended is it would allow an advanced practice registered nurse to substitute a therapeutically equivalent stimulant medications, so these are like Vyvanse, Focalin XR. Adderall XR, they're they Right now, currently in advanced practice nurse can write those prescriptions, but a physician has to write the initial prescription and has to be seen by a physician at least every 6 months, and so they're basically allowed to continue it, but what this would do is say like there's a prior author or there's a formulary issue or or whatever this would allow the advanced practice nurse to make a therapeutic substitution, but then he or she would need to notify the physician who originally wrote the prescription if that happened. OK, are there questions? Question,

State Senate District 25. right, recognized to proceed on House Bill 1523. OK, thank you, Madam Chair. Um, this bill is um a missing person's advisory system for um adults who have disabilities, they're, um, Often like adults with disabilities maybe are runners, I think specifically of people, people with Down syndrome. So this is just to ensure that if they're missing, um, they don't qualify for the silver alert, that there is an advisory system in place so that we can find these adults with disabilities. I'm happy to take any questions.

Senator John Payton Unverified 5:42
Question, Senator Payton. Are we on 1523. Yes. OK, that, that sounds very familiar like a bill I read before, but what I'm seeing is where we're moving all this and structuring it under the state police in this bill and it's the Amber Alert system. It's a silver alert system. And then Right, so I mean. And I thought I remembered a bill coming through earlier in this session that did what you just described. But it looks like this bill is putting all of that. Under the state police, I don't know where it was now or before, and I'm not against that. That's just, I wanted to make sure I was on
▶ Play Suggest a correction Report an error
Senator Breanne Davis Unverified 6:31
the right bill. You are on the right bill. Um, We, we made a pretty substantial amendment to the bill when it came over to the Senate because originally this was the purple alert and, uh, we took it down to an advisory system so that they're just not overload the alert system, um, in Arkansas, so every time they're not breaking in, you know, repeatedly, and people kind of have a little fatigue. The concern

Senator John Payton Unverified 6:52
I had over the bill that came through previously was that it would be like the boy that cried wolf, too many things coming out for people to pay attention to. So this is the same bill. It's just been amended and changed this

Senator Breanne Davis Unverified 7:05
much. It's an advisory system rather than an alert. So the, the difference in that is they won't break in on the news, um, it'll just be, um, an advisory, so maybe you'll see it

questions from the members of the committee. I think Senator Scott had a bill, uh, it was Senator Scott's bill, but it was diff it's similar to this one. That's right. That's what I think that's what you're remembering. But that, that one was specific to children, yeah, 2 children. Any other questions from members of the committee, I see none. Is there anyone here to speak for or against House Bill 1523. All right, Scene none. You're recognized the clothes for your bill. I'm closed. Thank you. Motion do pass and second, all those in favor say aye and opposed, I have it. Congratulations, you've passed House Bill 1523, um, you have, is it 1250, no, uh, 1801. Yes, and I see represented Moore has also come to the room. You will both state your name for the record. You are recognized. Brianne Davis State Senate District 25. OK, and this

right, is there a motion to adopt the amendment? And second, all those in favor say aye and opposed amendments adopted, uh, please proceed House Bill 1801 as amended. Kinder Moore, State Representative District 23, right? You may proceed.

Speaker 54 9:24
Thank you, Madam Chair. House Bill 1801 allows specialty compounding pharmacies, which are a special class of compounding theacies that are licensed and regulated by the FDA and must be in good manufacturing standards. The special compounders create medications that are no longer produced or experiencing shortages. Historically, these facilities were not allowed to sell to retail pharmacies for them to be able to dispense these medications. to patients. However, the FDA has recently changed its position on that last year and issued a guidance that now allows these specialty compound pharmacies to sell to pharmacies and dispense with to patients with a valid prescription. So this bill just brings Arkansas in line with these FDA guidelines which are being followed by many other states and allows our constituents to be able to take advantage of these compounded medications when the FDA allows them to be compound. The saving our constituents' money. And please note this only applies when a product is not commercially available and on that FDA shortage list. And I'd also like to state that the pharmacy association is in support of this. The national community pharmacy Association as well as the board of Pharmacy gave input that we incorporated into this bill. And with that, I'll be happy to take questions. Any

Second, all those in favor say aye post. I have it, 1801 is passed as amended. Thank you committee. Thank you, Madam Chair. All right, thank you. All right. 12:51, no, um, 1537. Chair. State Senator Tyler De District 37. You This is House Bill 1537 from Representative Ladyman, and what this does is repeals the Location Act for community homes for individuals with intellectual and developmental disabilities. This is a lot of great work from uh works of Ladymen, uh, working with the HDCs across our state and so it looks to move in a good direction and repeal a lot of the sections that needed to be taken out. Happy to answer any questions. Are there any questions from the

members of the committee? Senator Love, you recognize her question. Thank you Madam. Now, what's
▶ Play Suggest a correction Report an error
Senator Fredrick J. Love Unverified 12:21
the practical effect of repealing the the Location Act. So no questions. I appreciate it. Just kidding.
▶ Play Suggest a correction Report an error
Senator Tyler Dees Unverified 12:28
Um, OK, so, I believe this helps with um some concerns they've had around the HCCs have had with this section of the code, something about density control. There's been some things about that that they've they've disagreed with and so working with that group, I believe there's 9 HDCs. I need to double check that number across our state, but um about concerns about some of this section, but that, that's about the the furthest extent that I have uh on that conversation. I will echo a follow up on that and say that um you know, I've not received any pushback on this. I did fall through the house there were 94 votes with zero dissents. And if you've got concerns, I'm happy to to step out and and look into him. Any other questions? Seems like a really

Senator Missy Irvin Chair Unverified 13:27
odd statutes to have in Arkansas statute, to be honest. It seems very odd to me that it was ever even in code like this, but Wait, I'm, I'm fine with repealing it. Any any other questions? Anyone here to speak for or against House Bill 1537. All right, no motion do pass. Second, all those in favor say aye and opposed as habit. Congratulations, you passed your bill. Thank you. Thank you. Thank you. We are adjourned. great.
