Cast of the ballot thirty five Yeas zero names. The bill is passed transmitted to the house senator. Bledsoe SP eighty five. Senate bill eighty five by Senator Bledsoe to amend the right to view ultrasound images before an abortion thank you create the right to know and see at. Senator Bledsoe. Thank you Mr president ladies and gentleman you have before you Senate bill eighty five to amend the right to view ultrasound images before an abortion is before an abortion and to create the right to know in CA. The really the only thing new in this bill from what we've done before is that we are asking. That the and this is not that new the physician needs to explain the procedure and then the woman will get there have the right to have the monitor turn toward her so that she can see what's going on and you may say why is it necessary. Well so many of these young girls. Not necessarily women but young girls have been told that that is a blob of tissue growing was inside the wound we know that that's not true. That is a living human being and so as we have gone down the path of some of these abortion anti abortion bills we have heard testimony of women who are devastated by the decisions that they made when they were young in fact it was just with Senate bill six that we heard testimony of two women one was fifteen when she had an abortion and C. H. C. C. in this other lady that testified in our committee. The date. With a lot of emotion and through many tears a told the committee the this was the one thing that she regretted the most in her life and we know you can't go back and then do that. This is down to San legislation only provides an opportunity for the mother to learn all the facts before making this life or death decision it is important for the mother to see the ultrasound image before the abortion rather than after when it's too late and so ladies and gentleman. A. As you know in what I've said earlier that some of the proposed abortion women. Sometimes regret their abortion after late late later seen and ultrasound image of an unborn baby. All too Sam legislation allow some women to learn the truth about abortion before it's too late and I'll be glad to take any questions. Senator Chesterfield and then Senator Tucker. Senator Chesterfield recognized thank you Mister chair and thank you senator Bledsoe for taking my question who is paying for the old person I'm so glad you asked that because some letter dated. well. It is possible that the women themselves have to pay depending on whether they are of under Medicaid or whatever Medicare but it is possible that they will have to pay for you have not identified this is a state mandate I'm sorry this is a state mandate what is the state not picking up the tab something that it mandates. Well it is like a lot of other things they don't but that's a good idea for another bill well it's concerning to me because when you start mandating that people who are already poor pay for something else it creates an issue where the HIPAA laws coming in because you're not talking about sharing personal. Health information with the state what is it becomes well that but I mean that's the it's the woman and the doctor I don't think that's a that's on that's for her identification that's not publicizing anything so if he chooses not to do this you cannot choose not to she can choose not to do it this is for her edification for her knowledge because of so many of Mrs and miss numbers out there about abortion and when life begins in that kind of thing that you can actually see a moving living breathing human within the that part but I'm I'm just trying to get to the brass tacks of does that person stealing joined the privacy that is guaranteed by HIPAA absolutely it's between her doctor her doctor in the woman or the girl but you're mandating that the doctor tell you that they've done this it It sharing relevant permits it's in her medical record in that is protected that is under his law thank you. Thank you governor and I had two questions Senator Chesterfield already asked one of them about the cost my other questions Senator Bledsoe is whether you're aware of if the legislature mandates any other medical procedure along these lines. I'm not sure that this is mandated except to say that the you're giving the the girl and as we learned the last time we had I believe Senate bill six but some of these girls are lit our ten years of age and you're giving them a chance to see what is actually happening with within their body so it's not mandating anything they don't have thing turn their head you're not you're just giving them of the medical background the medical procedure and then if they want to turn their heads they can. Thank you. Thank you. You always to speak against. For. Senator closed yes. Sir Chesterfield U. object or on the boat. Please call the roll Ballinger. Beckham. But. Caldwell. Chesterfield. Clark. The bill is passed transmit to the House Senator Irvin S. B. two ninety one there's an emergency clause. Senate bill two ninety one by Senator Irvin to support Arkansas public schools and public school districts and implementation community school March. Server. Thank you members and and actually can I pass over this bill and come back to it at the end of the calendar without okay can I cannot pass over this and come back to it at the end of the calendar real quick yes I do not objection we can for. We're gonna Passover move on to Senator Ballinger. You get flowers Ballinger. You're here for all. Senate bill address B. three thirty four. Senate three thirty four by Senator Ballinger to amend the law concerning the use of eminent domain by a state agency and to add new definitions under in a month online several other. Thank you Mr president at the first two bills or a sensually identical that Bills the the first one deals with agencies of the state the second deals with local cities and counties essentially what this does is take and codified currently in Arkansas we have a really strong property rights laws when it comes to eminent domain so you know many of you heard of the kilo decision that basically said that you could you could actually go out to use eminent domain to take a piece of property if the only public good is the fact that it would increase tax revenue well in Arkansas you can't do that right Arkansas we have a in an article two of our Arkansas constitution the provisions as property rights are above all rights we have a fairly solid law in the state of Arkansas but there is certainly individuals and entities I'd like to see that that changed and see the law reduced well what this does is this basically just codifies it set up a mechanism to protect property rights through the process of using a met the main ticket or for things like blight the first bill actually has no opposition is one that applies to to the states what I have in and I'll go ahead and point out in visiting with after the bill passed out and visiting with municipal owned utilities they have some concern about it in particular with the next bill the Senate bill three thirty five we're going to amended in both sections it shouldn't if you look at him Senate bill three thirty four and thirty five and same thing but if you look at the definition of public purpose is specifically includes operating of the utility however so does is not gonna change the effect of the bill but there are two major not major minor changes that we're going to make one is we're gonna make it were the cause of action specifically only applies to local government and then the second thing we're gonna do is define out units of the municipal utilities as as local government so that the changes were gonna make on the on. The House side shouldn't change operational function of the bill it'll make it clear that and we're we weren't intending to cats the utilities which are under separate code section all together I'm happy to answer any questions. The question is recognized thank you here and thank you senator Ballinger. My concern is on Page two line thirteen and fourteen. Basically fourteen were you talking about giving people who have been cited only a hundred and eighty days to correct what he needs which would mean that if a person or email and unable to do so they could not correct that. Because there are some illnesses as we know now that it lasted longer than that why such a short period of time. And so I think maybe to some extent you're you're reading this sort of an not so that actually is a time frame that is considered to be a relatively it is a a general time frame for the property this is the time frame for what it is designed to be a generous time frame for the property owners which is actually fairly close to what we're doing if if the municipality or the the agency in this case we're talking about state agency if they're doing it right then they are they are offering this kind of time frame today so you qualifying practice is that what you're saying. I'm sorry your kind of fun practice well yes the best practices yes well I guess I'm concerned since we've been in this pandemic that some people are sick yeah I think the longer than six months absolutely and we're not giving them an opportunity then to do what needs to be done that's why I'm asking why such a short time why would it not be a year when the others for a year or two years sure and there is no no mandate that the that the agency to this they can go as long as they want and what what I think we're doing here is we're codifying we are protecting them in in the the intent and I'll tell you the the person came to me and asked me care this this legislation is institute for justice in civil justice cause is a nonpartisan organization that goes around and does several things but one thing they do the really pushed the protection of property rights and that's why we're codifying this is because we have fairly strong property rights and setting up a mechanism in order to give it some due process and some protections for individuals so they don't have the property take. Yeah the problem. Anyone wish to speak against the bill for the bill. I appreciate what gesture on the vote the object so just from. Action please roll. Ballinger Beckham Bledsoe Caldwell Chesterfield Clark Davis Dismang Eads Elliott English Flippo flowers Garner Gilmore hammer Hendren Hester Hickey Hill Ingram Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace. Anyone wish to change their vote. Lauer's NO. Okay. Senate flowers's NO Senator Elliot is no Senator Chesterfield is present in here with us. Senator Dismang is. Yes service mine present okay anybody else. Caster about thirty eight three days to present. The bill was passed. Transmitted the House Senator Ballinger esprit three thirty five three thirty five by Senator Ballinger to amend the law concerning the use of eminent domain by local government and to add definitions under eminent domain. Senator Ballinger is got the floor thank you thank you Mr president this bill is exactly the same and former fashion except it applies to municipalities counties instead of state agencies on this bill has the municipally gives the are the only one to have expressed the opposition to it Frank merrily they're concerned as they would like to see the the the existing case law changed to make it may give them more flexibility in taking property which course I think most of us you prefer protection property what select seats stay the same appreciate a good vote. Any questions Senator. Senator Chesterfield Senator Elliot. What would that is the local government I'm sorry why would we not believe this to local government. If you don't mind asking I. Why would we not leave this to local government and community believe as opposed to what while we running that is when we could be dealing with state issues rather than local issues that that is an excellent question and let me say that in how I deal with policy things when it comes to local governments or or not is we still represent those constituents and those constituents we have an obligation to make sure that their their rights under the US constitution or state constitution are protected so we're you'll see where you know I I justify getting involved in in a well I would say is you know local home rule is when we first when I feel like that that you had with citizens whose rights may be entered in this case we're not modifying. Much of what they do in practice the municipal municipalities we're just preserving I think a protection that to make it more lasting. Stuff the city's for yes. Thank you governor. I guess you would say what you said again that the reason this is justified because I didn't quite get it all pretty fast I was slowly one of those two one of the two so would you do that again for yet so so any time that that are typically what I try to be consistent where you see me Terry legislation that deals with home rule it's usually in an effort to protect some constitutional or natural right of the citizens so it what I what I think we all have an obligation to do is try to protect the the the rights of the part of our constituencies who also happen to be in the county also happen to be a municipality this is a perfect example where our state constitution says we all took a poll and the poll says the property rights are above all right to write in an article two and so what we're trying to do is is codified what we feel like is good existing case law and order put in the code and make it make it more lasting make it where it's easier to look up to make it easier and more accessible so that the justification for overruling home rule is that we are we are actually going even more local to the individual in protecting their individual rights and. Is this how do we know that there are individuals though that we are not protecting the because if we get we start going just to what to the individual instead of thinking about the whole how do we know we are not somehow hurting the whole. I I mean I think that it's from my standpoint what this legislation does the best legislation we have to enact case law which is consistent with the Arkansas constitution and in doing so we're protecting their their natural rights which are also preserved as our constitutional rights now this may be unfair to you but if you can be fair to the Municipal League says I didn't know to talk to them ahead of time why are they against it I mean one of the things that they will that will point out one article that requires them to demonstrate that they have to do that they have to prove that they that they didn't take into consideration other people who'd be willing to give up their land beforehand which is consistent I mean the the the of the case just in case also that it is necessary they have to prove that it is necessary before the take property through eminent domain SO this that would be consistent with existing case law they feel like that that could end up being a burden or a hurdle from taking property because it could be more difficult to prove that they didn't try to acquire the property somewhere else minute that is existing case law now that they're they're doing it now I think they should have no trouble doing that now but that will that is there what other objections I ran the same legislation two years ago made out Senate but died in House history ran away but it it does it their argument then was you know we understand that this is basically the current case law however we would like to see a change in current case law to give us more flexibility to to make taking a little easier and I get that if you're all you're doing is you're being advocate for cities maybe that's a good argument but for my case you know taking a person's property in order to be able to to put in a parking lot because it's going to help revenue or whatever to me that's not a very good use of of eminent domain and I would like to see our Kansans you know protected at a. At a higher level than what the US constitution protects your bill it would still be a case that eminent domain is possible you just have to have a compelling reason for have been invoked domain is not the same kind of bird and in this bill that they have right now yeah absolutely it's basically strict scrutiny standard which we already have an under Arkansas law so the burden yeah my argument is the burden is the same they may argue that the burden is is slightly different because it gets a little more detail to it I I'm gonna say if you're not doing it the way that this set up you're probably in violation of current case law okay thank you so much. Thank you Mr president. Sir Ballinger obviously alike this bill I wouldn't co sponsored it a new the court couple questions one of. You mentioned when you were presenting three thirty four that you you were addressing some issues in the on the in the House about local utilities I'm specific thing about water utilities would it. Of interest city inter government compact such as Central Arkansas Water be covered under that because I don't want anything it keeps getting water out of the west the Lasky County but obviously they need eminent domain to be able to run water lines it would your your amendment you're planning and that with that address their concerns absolutely that's one of the entities that are that I visited with so yes and not one thing I would say is we're not taking away anyone's right to do eminent domain I would say that in any other entity ought to be going through this same process however they are in a separate code section that we chose not to to approach through the legislation this year so so many of the intent is to is to pull out of this process okay so what we'll do that's will be doing in the house. Is it true that the kilo decision basically took property away from individuals with eminent domain so for the sole reason that that local government entity which was in Connecticut could allow a a high rise condo type development which they would receive more property tax and they in effect stipulated that was why they did it is that sort of the genesis of this these types of bills yes it is not not just make clear the kilo is not the law for not state law in Arkansas because we go further than that which were allowed to do but it is to codify what we have good existing case law so that we don't end up rolling back into a kilo decision which says you take personal property simply because it means increased tax revenue which I think most people opposed our candles would agree that that's not shouldn't be the public purpose as you know as recognized in the constitution so I had conversations with the Municipal League felt that in the past that we had a strong. In the committee protection for individual property owners in Arkansas however as I researched it further organizations like the institute for justice that measure these by this standard I found that we were sadly behind this that your interpretation as well I think so so I'm not sure I was absolutely following you but I think I yes okay thank you senator thank you Mr president. Thank you. In and I apologize I think a hundred percent. In line with what you're trying to do I'm certain Bentley I have been able to process all the to make sure I haven't missed something into that he said he'd be willing to make their yard to make an amendment to the on the house side hopefully in in one thing up but will not encourage. searches feel probably has a good point we could look at that day I mean all we're doing regardless of case law I think you're trying to set up the best practices on if there's going to be you know moving for them in advance there's as much protection cost again which I'm on a person on board with and if there's anything else that we can provide or help with it we can touch base would you be willing to pay absolutely visit that certainly in my from my standpoint we we wanna make sure to preserve this in the and a mechanism that that is the strongest possible still out of the municipalities to allow agencies to allow individuals to do what they need to do but we need to when you try to recognize that fundamentally the individual needs to the protection be absolutely at the end of the day your bill is pretty much saying unless you can prove public good And you define a public good is then there can't be a taking it is we don't like the way something looks or we don't like you know whatever it may be your allowing due process to take place for those individuals with their own lives at that whatever right questions it can follow through but they don't lose the value of the property just. Just because again absolutely and what and will visit afterwards I mean I I'm I mean I think that we get it through over to the house I'm not in a big hurry necessarily and and frankly to get it out of house judiciary we need to make sure we have have it done in this tight as possible so definitely happy to work with somebody on. Senator Ingram. Well the you said you got lost in senator Johnson's questions because I've definitely got lost in those questions all my interest is the nonmunicipal of utilities are you saying that you were going to exempt them out in the house that you're going to do that in the house is that what you're absolutely I think that the probably not covered under this legislation but they have some concerns of that could be because they are beautiful on the rand so we're going to specifically exempt them out of this which Amendment essentially is going to find them out of a out of the local entities and then and then make it clear the cause of action is only gets local entities so that the intent and you know other things that if you have things that that you you feel like our our issues I'm happy to have to try to address that as well thank you senator. Anybody else any other questions anyone would speak against four appreciate the injection on the vote. Please roll. Twenty seventy eight two days the bill is passed transmitted to the house Senator Ballinger the last one of three as before sixteen this one has an emergency clause Senate bill four sixteen by Senator Ballinger two men that they need Municipal Aid Fund to distribute Municipal Aid tenderly incorporated municipalities and plan of merger C.. Senator. Thank you Mr president okay this is this bill is just to prove that I can work with the Municipal Aid we're still friends so anyway that this piece this bill is a is really designed to help the newest municipality in the in the State of Arkansas that holiday island which became the city this last election cycle however because the fact that we don't have the census numbers to census numbers they really don't have a mechanism to collect on back finds so what this does is this enables them you too to GIS to be able development and estimate in order to come up with a number for the treasury department in order to be able to do turn back funds it's not gonna be any more money that goes to them it just means rather that those funds going to the county they'll go to the Holiday Allen would say already got some funds from the county that's allocated to holiday island so in the end there's there's no opposition to this it just helps the folks in holiday I want to be able to have a mechanism to collect her back fines and start finding the branding about any questions for the senator if you wish to speak against the. About thirty five Yeas zero nine is the bill is passed receive calls a doctor transmit to the House Senator Irvin and we're at the end of the Senate calendar. S. B. two nine one center or symbol to ninety one by Senator Irvin to support Arkansas public schools and public school districts in the implementation of a community school approach. Thank you members I had some senators I have some questions and I wanted to get there questions answered so I wanted to bring this bill we never had the opportunity to address those needs this is a community schools acts and community schools connect to community resources organizations and businesses to the school add to meet students needs and to provide enrichment out of school and so what this does is it does not change schools governance and any public school in the state of Arkansas can choose to become a community school the research shows the strategy bringing improvement in attendance college going rates on time completion of grades fewer discipline problems and help students build bonds with supporting community and school leaders and so what a community school does Batesville has actually enacted this as well as a school here in Little Rock School District is to allow for that school to really act as a resource for that community it's by choice there is sixteen billion dollars a federal federal money available there are no state funds for this however local districts can use our own fines to be a community school and that is part of the enhanced student achievement finds bill that just passed so this is a great model and really proud of Batesville school district and the little rock school district I one of the schools here in Little Rock that's doing it and then there's four more that were announced in September in Little Rock as well so it's a great model ends there's additional funding from private sources as well as federal funding for that they can apply to add to to make that school more of a resource for the community and to help those kids with their achievement gaps I'll be happy to answer any questions any questions for the senator. B. ten thirty Senate house bill ten thirty six by representative Taschen Senator Wallace to amend the Arkansas county accounting all county accounting law of nineteen seventy three to require counties to provide proof of payment tax payment retirement system contributions hello all thank you. Members. All this bill does is make a honest man keep them honest. If anybody at the county levels thank you about when the dark side to make a little bit tougher. bottom line is in the past with the county Clerk so whoever was possible for the county payroll tax and retirements Retirement fund they sent straight to the state this law simply requires that they also give a copy to the county judge or the county treasurer so there's more a cross check. And with that I'll stand by for questions any questions you always speak against or for Senators closed. Injection rolling the vote please roll man sector Ballinger Beckham Bledsoe Caldwell Chesterfield Clark Davis Dismang Eads Elliott English Flippo flowers Garner Gilmore hammer Hendren Hester Hickey Hill Ingram Irvin Blake Johnson Mark Johnson Leding Pitsch Rapert Rice sample Stubblefield Sturch Sullivan Teague Tucker Wallace in which change their vote. About thirty five Yeas zero nine the bill is passed return the bill to the house Senator Dismang H. B. twelve fifty five fifty five by representative eleven in center Dismang to regulate cross colorization Paulson's. Senate is thank you governor member sister just provides needed clarification as to the validity of a cross clatter station clause and reaffirms longstanding banking practice we have to take any questions any questions I have a question Senator flowers is recognized we yes Senator Dismang this seems to be a bill that's brought to mind do or at least. Or or I'm sorry what we go we just we can't see you thank you. This bill seems to be a reaction to a negative ruling in a court case against an equity bank versus southside Baptist Church of lead hill. In which there were two notes one the first note a mortgage of the church's property loan was given that property being as set out as collateral second no furnishings. And the second was by the by the church. But it added to personal guarantors. So without a clear reference in clear terms. In the second note that there exists this first note in the first debt how would those personal guarantors be protected. When the property. That's in the second notifying sheen's were sole and applied to the first snow would make the personal guarantors. More liable for greater debt because the sale proceeds were not applied to what they thought they were guaranteeing in. I don't understand the question and I mean I think. I mean if you're going to enter entering into a note or you're if you're going to to borrow money need to be thorough understanding from one what is your signing I mean I think that that falls on the banks being clear and then also those that are participating or the receivers alone to be thorough it's my understanding there be a listing of assets and loans and other debts and this you know this cross collateral is ation Clause is standard I think one of the things you know for me when I look at it is that this is a needed practice especially in the barman three and right now you know so there are businesses that are struggling and they're taking out you know additional debt be able to kind of get through the hopper hopefully get through the halls of the downturn that their particular entity may be in the problem is if we do away with the standard clause which is been something utilized for a very long time I won't even try to give a particular date the only individuals are going to be able to cross collateralized or those that are taking much much larger notes out they can justify having the legal fees associated with having to to have that particular item reviewed without be without being standardized that the warranty that goes away from those into these provide the clause in the forms goes away and again it would only be able to be lies by bigger loans that could justify the additional cost. But would you agree it's hiding something from those personal grandparent told towers that are not necessarily there at the bank negotiating for that second note and and the collateral that they are securing to be applied to the first note. Senate senator flowers can you can you point the camera we could see a police. Thank you. Service. M. and and I guess my response would be I mean if you're going to sign a love note you need to understand what it is you're signing if there's a reference in that that applies to prior notes that you need to be willing to ask the folks are asking you to you know put your name on the line what that applies to in in in what secure. So we're just going to do away with the existing law that we have now that requires clear. terms of what those personal guarantors are actually signing up for. Would you agree that you have one instance that is try trying to undo something it is program practice. I don't again will try to give a date let's just almost say for ever and so I think there's an understanding when you're borrowing money. That that you need to read what it is that you're signing this is a you know standardized closets in the contract any in something when you're when you're compiling this note in asking for the additional money ever all those parties are aware that does not exist. And if they're not they should be. And any other questions. They always speak against for. An education role in the vote.
