Just kidding. Well I feel like I told you all last week House bills this week very very slim chances of getting through so will we will hear your bill but not H. B. nineteen thirty nine. And if you your guest would like to introduce himself and it will be able to testify whenever so. Hello my name is Diane Robinson I'm a member of the Conway school board okay all right you all are recognized to present all right thank you Mr chair thank you committee HB nineteen thirty nine as bill designed to help our local school boards maintain experience members after the census currently all board members are up for re election of the after the decimal Census Kerr's so this would allow members that are elected at large to maintain their seats and lesser current terms expire. And with that I am open to any questions. Questions. All right Russian Lowery yes question thank you If you could give give just a little bit of background of how the the school board members in the Conway to act and I know that you're being careful that this is not local legislation but the way you presented obviously local legislation so how are the members currently voted on and. What do you anticipate could be the downside of of a rezoning without this law. Represent Lowery I am at the issues and the issues this effect or not once the that that affect just the Conway school district or school districts across the state we have in our because we're a larger school district we have seven elected members which is which is fairly typical five of those resound in their required under law to be zone seats because we have over ten percent minority population within our school district as it currently stands as the law is currently written all seven of us would have to stand for re election next spring now we have as a several school districts doing you superintendent coming in this summer and the prospect of having one hundred percent turnover in the school board at a time of transition in the school district is not a healthy thing for our schools it's not a healthy thing for art ministrations what we're asking on behalf of school board members across the state is anyone whose own has not changed so their constituency is exactly the same as as who elected them that they would be able to maintain their seat without standing for election again anyone whose own does changes would have to stand for re election next spring so that they're representing their their current constituency. Follows please. So. The members coming up for re election is not just due to the redrawing of the lines it's just terms are up correct no Sir did it just to give you an exit we we are elected on a staggered basis so for example I'm up for election this spring I'm on the ballot next month I would be on the ballot again next year and that will probably happen anyway I want to be clear this won't help me personally because my son is likely to change I probably will have to be on the ballot next year and then if if I have a then depending on how we would draw straws for length of term it could be three elections in three years for some members potentially but the way it works is that is that the school board's owns or staggered so that one or two of us are up for election every year we have five year terms that means there's never a one hundred percent turnover of the school board and that kind of instability that that again I think it's not not healthy for our schools it's not healthy for student achievement okay I do have another follow that out I'll get in the queue I'll get you back to Q. Reserve Godfrey. Thank you Mr chair represented hyped we talked about this last night I visited with the school board and the sensation a little bit this morning I'm not I understand the intent and and certainly see that it's not a local as you there are several superintendents up in my area who were trying to you know find a solution for the similar problem and that what I heard you say and is that we don't we don't want and hot at large members and because their constituents they wouldn't change but the way I read the bill on page two lines one into that any board member who resides in his own whose boundaries were redrawn so to me that would include at large board members who live in as them and that is reason even though they don't represent the zone there at large members that language of the bill says reside in so I mean I think that's the interpretation to the school Association and mine is you know school board member unfortunately it does seem a little bit problematic with the way it's worded with the word resides and would impact at large members if they live in is because they reside there even if they don't just represent that am I correct in the way I'm reading that. Because we can make it yes. And I would like the attorney at some point I don't know if this is a proper time to come up here and to address that question if you would like to speak to that. Mr Lucas heart. You want to Danny B. R. Lucas to ever bring up there to address that. Legacy to state your name for the record please. Look it's harder Arkansas school boards association and represent Godfrey I would say that that would be a valid interpretation of the language and that was certainly not the intent when we were asked to assist with the drafting of this language and so it would be possible to amend it to be a board member who represents the zone whose residents zone has the boundaries redrawn to fix that that issue but yes that was not our intent with assisting with this language but I do agree that is a a possible interpretation of of the language follows. You're recognized it and I appreciate you you're looking at it and represent hikes we spoke last night just because I I know what the intent is because superintendents in my area we're concerned about a school board members Mary were concerned about it but I do think it is a little bit problematic the way it's written because it would exclude any of those out large members who live in as that's affected so I don't know at this point what we need to do or can't do or should do about changing it but I think if your intent is to allow continuity of of at large members that has to be changed I'm sorry. No I I appreciate you guys looking into that and I guess with that if this bill you know from the attorney who is that the bill is not going to do what it's intended to do in I would request that we pull the bill the bill down and I'll amended. I'll be for the for the bill sponsor not obviously people the bill down today than there won't have time to get through this the the the the the deal so I guess I'm kind of torn on this I I think I like the idea of the the continuity but also like that the people The accountability to the people so as I understand the intent of the bill it's to allow the at large district folks to remain to continue out there term which is maybe not a bad thing because it might reduce some of the confusion around everybody having your elected all once but sought but I guess my concern is you said that if someone lives in a district that is not redrawn but they also would not have to run for reelection if that's correct so my initial begs the question who's responsible for rezoning those districts because my concern is you know I I'm not you know I like her she's my favorite school board members often to make sure her district stays the same but you know Joe who's always causing me problems over here I don't like him so I'm gonna of scribble the the mass out his district to make sure that he's got a face opposition so that so that the who's who controls that scribbling up risk crippling of the district's. I believe that it is the school board that has the responsibility based on information from it it's not a dissimilar process that the legislature goes through and that we have a demographer that that gives us information to make sure that the zones are saying roughly a quick roughly equivalent terms of population across the district but you know I certainly cannot promise you that they are never politics involved in redrawing of districts just as there are just as there are in the legislature right so so the school board would be responsible for redrawing its own boundaries so if we all decided that we didn't like representative fox we're gonna re scribbled his district just because we don't like him and. So I'm I can't my characterizing that correctly I guess I'll try to speak to that representative makes because in my district were were actually in this process right now so it is the responsibility of the school board to have the zones redrawn. That does not mean that the school board does that and and through the school board association they are contracted with a. G. O. service who for a very very minimal prices will come in take the census data look at the populations draw those owns out so that there is perfect balance with agent representation of those zones within the different buildings within the districts you will provide that information based upon either a seven zone district or a five zone with two at large member districts so that so is it a completely neutral party that's doing that or so the school board couldn't manipulate that is correct okay right thank you and the lawyer smaller districts for all at large so you the only have that in the big metropolitan areas that's going to have those strong represent that no you're not yet not yet. My concern is basically what makes he touched on it that you're taking it out of the will of the people and I don't think that you know for sure that you that any of you would lose your race when you run for those different zones I mean that to me somebody's gonna win that's already in there at that's been doing a good job so I just really feel like we're taking that the will of the people to vote and to do what we set out to do. Thank you. Okay. If I could respond to that representative the the. Everyone will still be voting on their representative for asking that the at large representative who zone has not changed that the five year term that they've been elected to that that five year term that they serve out their five year term and then they stand for reelection the end of that five year term if for example my zone is likely to change I would need to run for re election next year but because my zone has changed in my constituency has changed and that is reasonable and fair but if there are but if there are zones that haven't had no change the people had voted to elect that person that person will have to stand for re election or stand down after five years as part of the normal election process so we are just asking that if someone's constituency has not changed that there's no reason for them to have what is ineffective a mid term additional election. Yeah no question. Why we keep asking questions to. Everybody's got their hand up to ask questions. Let me let me talk are you are you gonna pull it down after questions are you gonna pull it down before questions all we still have people on the bill to call in. And you know I mean if people want to speak to this issue I think it's important issue that could be heard it is important issue I just but just I think I have done and that it will be no the allies sign in this bill if I send it for an amendment it's not going to be back in this committee and run through the process and there's no feasible way for that to happen well that's that would be my later the deal for this committee that this will be the last regular meeting will have we will come back for concurs of call of the chair on Tuesday so that would be about it and right Senate so I think it's doing the same thing so possibility of getting a bill through the house bill two from here today after this is pretty slim I will say it couldn't happen you know if you're a magician who can do that. Well first of all say everyone knows that you like Nelda Ballard made that's like calling her first but now I just a suggestion I I so I still think there's the there's a problem with it in case you bring back next session or something like that that who has the I understand that there's a neutral party that draws the maps but who approves which maps are adopted and it that is in fact that the school board and used I think it's to have the same problem because then you have members approving whether or not they would have to go before elections just input thank you. I'm just going to get save one short thing I I'm a very extremely sensitive to this issue my mother was on the Pulaski County school board for about a dozen years and she was pro administration and so she got targeted by the teachers association every election cycle they could never beat her but they had a chance to redraw she was not political so she didn't know that she could be involved in the conversations about how her son was drawn and she ended up getting drawn into his own with a member who was pro teacher union who already was in the middle of their term and so she had had to sit out these things do follow political machinery I mean they do you can have an independent person look at the democracy demography of it all but we you know we don't draw hard our boundaries. there's a separate board that does that we might be able to be asked about it so I I just have some real concerns especially about saying and I understand your issues I mean you don't want was it was the same fruit basket turnover you don't you know you don't want to complete turnover all in one election cycle you you want institutional knowledge now I know this legislature wish that they had less of my institutional knowledge and. You might get your wish but so I I'm sensitive to what your issue is I'm just real concerned about how it really does have the potential chilling effect on the public's ability to sound the alarm who they want their representation to be but thank you for bringing it to us. B. six ninety four thank you Mr Mr always going to meet the table with chairs as those five go ahead and introduce yourself there thank you Mr chairman chair Broadway issue system you're recognized I'll try to be extremely brief to my knowledge there's no opposition to this bill this is basically the the idea was that college students a lot of more coming in and taking on tremendous amount of this with without a good understanding of personal finance and macroeconomics and so the idea here is just that that at all early point in their career they are required to take some sort of classes to to help them make good financial decisions Then I'll just stop right there and answer any questions because thank you really is that simple. All right any questions represent Godfrey. Thank you Mr chair represent one of like when I read this I didn't really think it as the a class or a course can you talk to me or miserably about just how long this would be how much material how much time can administered would be required to participate in this and and then also this section on and but shall be taken by all students to kind of envision this playing out okay thank you president got for working with the center back on we came to us before you file the bill the original concept was going to add six hours to graduation and to the core and the scholarships and all those kind of things but thankfully you showed me a copy before we got that far so we sat down with Maria Markham and ADHD and and my counterparts All institutions currently by federal law all of our students and staff and faculty have to take a course have to take a weapon are I guess play a good term to explain it about title nine and you you go through and you watch the video and you got to answer certain questions and so instead of adding courses to a degree plan that was the idea we came back to center recommend represent Womack about is developed kind of a it it will be like a weapon are will work with economics Arkansas so you're familiar with them I reached out to them but we already have a programming issue Jones recalled scarlet to black the play on red or black it that we get to all of our students to some institutions already have a program so they would be thank you to send that to ADHD though would be to develop a video that students would take and we wanted to be flexible that's one of the bill says we'll do we'll take it in accordance to rules developed by the Department of higher ed so you will see what those rules are when the students have to take it but as director Markham said classes start we have student short mid week of the first week you know so we're not going to say you got to take this before you can take your we'll start classes so you'll give us some flexibility around those situations but it will still. We'll I mean I think the guarantee will be they will have to take it before they graduate our preference is to take it in our first year and that's where our program is because so many kids we're we're prohibited by federal law I have had this conversation our congressional delegation a million times. Kid takes out all student loans they can they're told they can get we can't tell no we can try to we and we came discouraged. All we can do is try to provide information and so I think this will be a helpful tool for us to be able to explain to them yeah you're going to pay this back or or other personal finance modules that they will see through this that will help them make better choices financially as a college student so I think it would be a good thing and something that we probably we already had developed in different ways with thirty three different campuses we just don't have come one thing that everybody can use us that's our plan. Representative brown you're recognized for a question. Thank you Mr chair Mr Broadway. I really think that. Students need to know this information. I just wanted to be in a pretty thorough yes I've got a couple of questions about it are they going to be given any kind of information about what they're earning capability will be if they follow their chosen degree plan. Will they be able to correlate that with generally what one is but the amount of debt everyone should carry compared income and You know what the cost of living is projected to be and how the all that's gonna fit together so they can make really smart choices that's what doctor to fill to our professor ation John Breaux has done in his program like I mentioned scarlet to black so yes ma'am we can ensure that that's included they get that information now I've heard a lot of discussion the table about some of these bills to come through Senator Clark pressed a bill several years ago one ACT was exit eighty eight eighty it's report done with desi and an ADHD now the students are given I think in the eighth grade secretary the does that correlation we look at college graduates and what they make five years out in in their desired builder if they even went in that field that permit that the information provided to him in the eighth grade now so we would just take that I think is gonna be further expansion upon that information but yes ma'am I think that's the relevant information they would need thank you very much it definitely needs to be repeated. Shane I know we've we've had this conversation before and and I know every time it comes around that number just keeps loading I think student loan debts now at what one point five trillion somewhere around that yeah something like that by and I've heard you say before that the university personnel are are not able to dissuade students In the advising process what little bit you can do interview said that the communication is you know you're gonna have to pay this back right I think a lot of students don't even realize that even if they declare bankruptcy it is the one that said sticks with them until death exactly I mean is that is that something that is shared with them yes in that process and when we do that we do initial actually we do I know it talking about financially Director Jonesborough and Anderson we do a pre visit with them in their financial a when a week we show here's what you're eligible for and then we do opposed when they leave if they stop out for when a graduate we do a post interview as well and my understanding is that is explained to him that even if you file bankruptcy that that does not go away and so is something we'll reinforce and and this module that will develop to but you're exactly right and it's it's a challenge the C. lead times could see dollar signs and they see Hey I can get all this you know money whether I needed or not and they they take it out and parents to have theirs you know you get the parent will parent plus loans and the lot and take it out because it's a lot of times a cheaper rate yes and and that's that's a big challenge to us but yeah I've had that covers every time we go to the C. I had that conversation or delegations just give us some authority to say no you know to some ability to say you can't take that much out. Recognizer follow and you mentioned this the the module would include some of these conversations it in an instructional way through Montreuil it would this be in person or or something they sit down and that would sit that's what we call it and I thought in my lifetime I never see the words asynchronous module and the Legislative bill but it did jump on for now thank you thank you the intent is is that they could take it out and that's what a synchronised they can take it whenever they can take it you know they can take it at night and take it on their own it would not be going to a classroom that's the biggest challenge many of those center Beckham you had you at three hours to the core three hours graduation and you're talking about you gonna have faculty you're adding a lot you know in so doing it this way I think it's gonna be the best way but hopefully it will be something that we can all develop so everybody's getting the same message today and take it but there whenever it's convenient for them but since it's instructional mantra you can be a little bit more forceful yes I mean like for instance have if it's an online video that they often watch that you could have a horror story exactly you know have somebody interviewed that said it totally destroyed my life I was not able to make can you go that far I don't know where you live well I hope you would yeah is it that that really that reminder because you're right they just see it as free money right I mean I I kind of with the same thing when I went back to grad school so I grow okay this looks good sounds good on. Thank you Mr chairman I like this idea but I do have a couple questions first of all since this is not an and our credit credit our any right correct is there any cost associated with that though for the student to take this online there won't be any cost associated with the student there will be a cost for us in developing it and so we'll work with that's why I reached out economics Arkansas will reach out to some others to help us maybe fund or finance the development of the video or weapon or whatever it is we decide to create but there won't be any cost student follows. And just for my curiosity sake is there any. Any percent same prohibition for our K. through twelve and not warning the kids of this debt that they can't discharge and if so was this something that maybe we might wanna incorporate before they. I do it's not exactly on point but it it connects tangential has anything been done. To discourage or prevent students at I heart of a student who did this and I was shocked that I would tell you that I would enroll. Get their student loans. Any their withdrawal are just not to attend classes and they would do the same thing semester after semester of semester has anything been done to stop that from happening. That's more of a federal issue because of federal student loans in terms of our limitations or anything that you could do one thing you have done this was back when Senator Hammer was in the House about lottery because we had we had an issue sometimes of students enrolling in courses staying at to the eleventh day. We would send the money when I was at higher it we would send the money to the institution and student would never showed back up so you all pass legislation that if the student does not complete any hours in that semester that they are no longer eligible you can't get it back but you can at least ensure that you don't spend anymore dollars on that kid. but at I would have to check with my financial aid folks in terms of of students still being able to do that but that would be more of a federal issue than a state issue but out there I think there are some safeguards. but there probably are some students who have who have been able to do that take federal loans or Pell grants and and not go to class. Thank you I don't know somebody here to make a claim no other questions representative Johnson. It just do we have a fiscal impact on this that was what I was looking for I see the green she's here I don't know if there was there shouldn't be notice because tire it so there would not be at this not once I'm just curious the cost of the module you said thank you gonna give an idea of how much that would cost I mean what if what if you don't get funding from outside sources we're we're with the funny come from that I guess that's the only question I don't know none it's a Dieter's about the I think you made we don't if we don't get in the I think the intent would be to do a video. that would probably be the preference I think you get to a point where you don't have resources you can develop a weapon are for little or nothing cost wise that everybody could share so I think it's something we can we'll we'll figure a way out seeking grants or other funds I think there are a lot of the a lot of interested parties banks and others who are interested in personal finance and those kind of things I think will will be able to pull it together. If you go ahead and reduce yourself to be read I doubt very Arkansas veterans coalition you're recognized both of you go ahead calling since bill to create the Arkansas military child transitions active twenty twenty one. the it's thirty five pages and it's primarily pulling. All the code and of all the various sections of that pertain to military accommodations that we might for military child education into one new section of code so that it will help facilitate Our guidance and help military students and their parents up. Find it you know have easy access to the information they need when moving to Arkansas. there's a couple of new things that are included in Mr berry's welcome to correct me if I get this wrong it come it permits schools to enroll in bound military children in virtual course work it helps the the student's merge into the new curriculum without losing ground one of the situations that we discussed this weekend was that students who were whose parents knew that they were being transferred to Little Rock Air Force base or wherever in whichever military institution in Arkansas they were printed from Germany were prohibited from traveling so this enabled so some of the students were able to enroll virtually and go ahead and begin their course work so that when they got here they can just March right into the classroom It also extends eligibility to a small number of reserve component technicians. Guardsmen and reservists moving to Arkansas. And with that I would allow you to ask Mr very questions. All right uh we have questions. Or he can fill in any gaps anybody else of questions. Thank you Mr chair will since we've we have suspended the rules on fiscal impact and that's okay I mean I understand but is there any fiscal impact. Me we are in the past a Twenty nineteen we enacted the legislation it basically set up most of this and we're just doing some reorganization here that there was a fiscal impact no fiscal impact statement on on the twenty nineteen legislation. In in this legislation what one element where there would be probably some. Budget consideration would be the fact that depending upon the scale and we're probably talking about something in the neighborhood of ten to twenty students who would need this virtual course work in transition and and more than likely it's due to Incoming search of into their twelve years so there is grade twelve and being able to make sure that their their credentials for of course work that they're gonna be taking their senior year and cabinet match up so that we don't end up with delaying his graduation so there would be some virtual course work that would be probably up a cost at some point down the road but not really significant probably in the neighborhood of ten to twelve students would be in this category. On. Yes a good phone. So and we already I mean we already have a virtual of school that is available to other students and so I would assume that that those same modules could be used to it is that correct and I would expect the same that is just the. That incorrect whether or not the variable cost of an additional seat in a virtual classroom what whatever that cost associated is but this the. The legislation does not require the development of a virtual course just to support right that transition so it has to be an existing course work and and I know the the dynamic the dynamics of transitioning to say Little Rock Air Force Base area would involve. Especially your time in a situation where the family is transitioning from Germany I mean how how would they know. Because there are a lot of families that are for whatever reason they're making decisions to not that may be station will rock Air Force base but they're not buying housing in the Jacksonville north Pulaski school district there instead going to cap it. How would they know really which school district to actually transition to if they are out of state out of country. Reserve smiling military families know about the about their second assignment they know where they want to live everywhere they have friends that are already there they may have been stationed there they may have been come from there although interestingly enough of some very small minority of active duty families that are stationed in Arkansas are again since less than less than a hundred typically. But we pretty much know where we want to live Pretty quick if you if if you have not been a station that installation you know someone who is stationed there and you call them and say where do we want to live and they tell you. Until our twenty nineteen legislation it didn't make any difference you had derive year civilian seem to think that like they do they drive around for a month and find a place where they want to live military families pretty much know where they want to live within like. Two hours of of their assignment notification because it's where they live is not significant for them because they're not going to be living there in three years there any moving again so the the factors that are most important to military families. the number one factor is their child's education because of the breaks that they will go through during that period of time which is not really much different for all families and then military spouses employment is the other factor but they're dealing in increments of two to three years so that in they're not making a home investment in a property what they're looking for is the school district and they can they're able to very quickly determine where it is that they want to batch their students with their their children with a particular program and it it's you can see the numbers and watch it did it happens very quick okay and I noticed a reference here that this does not and I'm again consented this because my dad retired from the Air Force after twenty six years and we moved out to central Arkansas and I remember. We came very close to actually locating in the North Little Rock School District and just because they couldn't. If the house that they won it we ended up in Pulaski County school district this bill specifically references this this does not apply to retired military personnel that are transitioning is actor at the all right thank you. I have no one signed up to speak I've already basically speaks Mr here I've already spoken basically fourteen get opportunity down the Senate Arkansas is one of only four states in the country that has been able to achieve a either more of the DOD military family Projects of the Duterte required and one of them is advance enrollment one of them is virtually Roman which is on this bill but they're only four states in the country that have a or more of those slate issues a completed Texas and Virginia have nine of ten in Indiana and Arkansas have a gift and this will make us nine of ten basically leading the country in this area the bill that you're seeing there is. Not so much for our department of ed as well the board of the school districts have some great rules that were written out of the twenty nineteen legislation but it becomes a really big marketing opportunity for Arkansas we're seen as one of the leading states as it relates to military child education one of the best features of our twenty nineteen legislation not speaking on this one. Is our military fat District education coordinators which required every school district that had twenty or more military to students or three thousand total enrollment to have a military family education coordinator. Inside of one month after the legislation passed in twenty nineteen over forty of our school districts had volunteered to stand up and be able to get some other people within the school district office trained on that so we were before the bill ever became for enforceable law forty four school districts of the fifty five or so that would required had already done that and it's a step it just shows by example the work is being done by our school districts really it's important military families and we really thanks a thank you to them thank you to the committee. All right since we had no way no one else signed up was that your closing. How is enrolled in nine different school districts so I am really proud of Arkansas for what they're doing to help make these transitions easier hopefully military families are moving quite as often as we did back then but anyhow I I really appreciate this legislation all the work Mr Barris done and I'm. So the committee members I was as I was gonna say if you're not familiar with the dental insufficiency or Addison's disease as the disease where your adrenal glands don't make enough cortisol in response to stressors so when your body's under any kind of physical stress your adrenal glands respond to that AS secreting number for my owns that help your body adjust to that stress most often this would be you know like an infection for minor infractions our bodies respond to that really well for people with this disease they're they're doing implants don't produce sufficient amounts of cortisol and so when they do have some sort of what tax would be a minor physical crisis at their bodies can can shut down for lack of this hormone the treatment for that is to give them a steroid injection and just like people of auto injectors for journal and if they have an allergic reaction to be staying or or just like people who have diabetes keep sugar on hand or glucagon which is to be a drug we get for low sugar these people who have this disease carry with them at you at some socks some kind of emergency kit for giving themselves an emergency dose of steroid and so the spirit of this bill is very well intended the spirit of this bill is to provide a pathway for kids in our school who have this disease which is which is rare it's a rare disease but they're certainly kids in Arkansas that have this to provide a pathway for them to self administer the medicine that there did they know they need in a crisis and also provide a pathway to educate volunteers in our schools in our school nurses the ability to give them that drug as well there is precedence for we've done here the bill originally tried to shoehorn this into existing statute for how we manage a day across is for kids with diabetes the probably it needed to be. Its own because those two diseases are so different that did it was not the best way to approach trying to do this is with which is why appropriately our school nurses here setting off stage left here I'm gonna have committed to have them come to the table shortly probably raise the flag to say Hey good idea but it really needs to be on its own and not in this other amended because there is training finish to be authorization from both parents there needs to be some language about indemnity in the there needs to be are you the authorization needs to be renewable and and so they had some suggested ideas to how to make this a bill that they could support at that I can support and again sorry for this being short notice but I think it's a valuable enough because an important issue for the kids that have this crisis to try to go and push this through this session if we can I just wanna make sure we're doing it the right way in with that I'd be happy to answer questions and also like to ask one of one of the ninth ladies here from the School nursing association if if it's okay to join us at the table and I speak to the bill that you have before you and also try to answer any questions it is okay okay last you see. My name is Anne Fortner on the current president of the Arkansas school nurses association all right and you have somebody else coming chairman okay with yes one police. Please introduce yourself and who you would please yes thank you chairman Cozart I'm Margot bush Meyer also a member of the association and the school nurse for twenty five years okay you are recognized to speak. Okay the Arkansas school nurses association was against the SP five sixty nine as it was originally written as professionals connections we felt like the concerns addressed and specifically with adrenal insufficiency and the treatment should read as a stand alone bill and for the current condition that it is and we're here with the health and safety and protection of our own students in mind that's our job in that circle with that being said a is an except the current Amendment SP five sixty nine bill as it's currently written it does address the safety concerns the educational components and the things that we feel like the students that have the specific currencies need and deserve. The Arkansas school nurses association also appreciate anybody reaching out to us for further terminology or language assistance for future bills in regards to the health and safety of our school students school students sorry about that okay would you like to add something up I would just like to say I think all school nurses would support this bill because it says it makes a safe students with this condition could be state's campus on field trips and everything related to their education which is what we want we run at school learning safely okay stay there think we have some questions for you rectified you have one of them responsible for them. Your first of thank you Mr chair I am not familiar with this is it similar to an EpiPen is it injected into a muscle. It again. they're different devices so the room that it used to you carry a cat will you draw it up and give it like and yes I can I am injection the same way you would have to ten it depends we would change some overtime I would give those they can give subcutaneously or orders into the muscle they're newer devices that have been developed that that or subcutaneous now it's so you can it depends on the device that the child or patient would have they could have an old fashioned get withdraw it themselves they could have an auto injector so their new devices on the market that are more similar to the same kind of thinking is that you're talking about thank you. President makes. Thank you Mr I like this and support this the the only. The thing I would that would ask is when a student is going to administer this medicine can they inadvertently do more harm than good by not doing it correctly or by doing too much and and how that would be regulated to make sure if the. The carriers in hours now yeah so it was due to that point the newer devices our our auto dosed in so it would be really difficult to give an inappropriate amount because they're designed for that your no brainer stick it here push a button kind of deal it. If if you you know if you were to inadvertently give you like if you thought you're having a crisis and you gave it and you didn't really need it it's not gonna cause any problems is not going to cause any overwhelming you know steroids to warmer anything like that but it did not create just some symptoms but not any long lasting effects of it if if if it didn't it would be the kind of thing to you we would rather you if you have this disease go ahead and get ahead of it and give it when you didn't need it then wait and get in trouble and not thank you. Kochhar. Represent Johnson I'll ask questions you we may need if you've got some legal here that also can help explain this on on page two Subsection B. one and two just talks about indemnification. Would this be in addition to the normal indemnification. Or would it replace indemnification. That's a great question and I'm looking towards my. Scott Smith we are supposed to resource center I was actually trying to take a different state but anyways so I think the thing that we probably would ask or have a concern is that currently as you know school districts and charter schools already enjoyed tort immunity in Arkansas and then immunity does not go away unless there's insurance that would cover a particular issue are there was gross negligence or some intentional act the only concern with this and I see the intent here they're trying to also offer protection but the indemnification clause generally recognized is that a claim may exist or as immunity says no claim exist unless you get to a particular stage up there so I would just ask the sponsor to if they're willing to agree to an amendment to say that this protection here is in addition to the already existing tort immunity that exist for school districts and charter schools out there and is not intended to take away from that immunity that already exists for schools in some form or fashion. Certainly I would be happy to try to make that amendment if I thought I could make that amendment in the next. I don't know if you minutes amendment here to tell you that or not I don't think I can I think I don't think there's any way to make that amendment at this point I don't think we can and we can and I think that I think this Mieres language that's already in statute with the other the other places where we have this I'm looking at my school nurse but I'm pretty sure there is already language like this and statute for I think we did a bill last session on I'll be your office school nurses to use with that with that with the auto injector so I don't think this is you I thank while I accept your point I think you Merete distant other places and has a created myself to the Department about that they may want to address that but I think we still have that concern so I'm not sure that was actually accurate okay. Tell me that but I agree with. Represent Johnson there we will. To me this is parallel to what we did in the last session without be wrong what we've done with that opinion. I don't think we there's not be any issue with that I think this mirrors that language but since it was specifically put in here just wanna clarify make sure that that that this was under the same parameters of what we've done previous bill that's my understanding. Well let me let me just say this even if that's true just because we didn't do it right necessarily another time we still want to make sure that that immunity exists for schools in this situation all right any other questions. This bill just says that school districts and shall include standards for which a superintendent may be terminated so school districts will have the ability to and determine the standards for themselves we crossed out the language that and specified the way that it is now if they go into the school distressing and things like that and so school districts will have the ability to make their own terms with the superintendent contract and then and that most important part of the bill I think is that the contract and buyout agreement cannot use more than twelve months of state dollars and it cannot exceed the amount of money as remaining on the superintendent's contract and it cannot exceed the remainder of that fiscal year. Thank you Mr chair have several questions one is I see the starkly stark your language share on what we originally had in code for the requirements of termination now that is that strength through how does that of impact and a couple other elements of this existing contracts. And all school districts they can still if they want to keep the same terms they can just write amended the superintendent contract the way and contracts work and for superintendents is whenever they do renewals and in January they're doing it for the third year out there and a three year rolling contract so they can write in whatever terms or conditions they want to into the contract. I think that this is this is a good good trajectory of forcing these issues I I know especially here in Pulaski County but we had a a run at their little rock school district where they were replacing it seemed like they were placing a superintendent every eighteen months and they were having to buy out buyout by an. The real issue that I have the with the way this is worded I I don't understand and maybe the department can help us with this the the segregation of state versus local funds it seems like to me a foundation funding comes into the state it co mingles and it becomes local funds so I I don't really understand that distinction thank you cap the amount of state funds we have the. Is that the equivalency of state funds or is in actual state funds cannot be used to for that by now yeah so it is state funds not though reason it's written that way is and it's mirrored after that bill that we just passed that said we can't use more than twelve months for the state funds to buy out presidents or chancellors and contracts and higher ed and I would have preferred to amend but it's the end of session and and and and if you again maybe next session have the opportunity go back and just say tax dollars cannot be used thank you that's what that's what the House schools are funded essentially is tax dollars so I don't think there should be a differentiation but and but there is as it is right now and it's just because we're out of time and so I don't think that tax dollars tax dollars should be going to educate children not buying out superintendent contracts for superintendents that cannot perform their job well and so that is the purpose of this bill there's no reason for us to be just be spending that money and I do wish that language is clear I just have time to get to an amended okay. yes in and I agree with that I mean I think that's been very disconcerting that we've because I think typically. A lot in a lot of school districts I talked with one of our colleagues who is superintendent he said that it's in many cases there are three year contracts and then each year and a half years added on if you get it positive reviews so you already are always always always for three years if something happens negatively right after the review and they've got three years and you've got three years of by. And so I I appreciate an effort for us to limit that because you're exactly right this dollars should be spent on kids thank you. Roces speaks. Thank you Mr chair did you it was my understanding that when you all done that one for the chancellor and all that that you sat down with them and they had input in that have you done that with this am I was not part of that presidents and chancellors Bills but in no on this I have not I served on the school board for nine years so and we dealt with you know super intendant contracts regularly at attended many conferences across the nation and found that actually the three year rolling contract is just a national standard that superintendents have created for themselves and so it's just standard we just continue to at renew every year for the third year out and if you don't renew that year then if they're still good for two more years on their contract and and set and it's a big deal when it when a school board doesn't renew and there's a reason but then they're still stuck with two more years on a contract and so and No representative speaks at a not sit down and work with anyone or talk with anyone on this and I think they're completely opposing will probably and. It to that today I'm assuming and so. Thank you thank you I would like to hear from them thank you they are coming thanks representative makes. Thank you Mr chairman and of Senator I think I'm with you on this one so that that I have a question a follow up though is obviously understand the intent here and I agree with the with the intent but obviously the courts are going to look at what's written in the way the language is written it says the contract shall not use more than twelve months worth of state funds to compensate not going well you know as you know twelve months worth of state funds is roughly twenty five billion dollars or twenty six billion dollars whatever our state funds is so I'm wondering if that is better to find a summer because of I understand the intent you're going after here but state funds is you know if you've got a wily attorney state funds can become the entire state budget for the year because that's the entire state funds. Well I think that second point under that that says that state funds for a contract buyout agreement shall not exceed the amount of money as to the superintendent under the remainder of his or her contract of employment so there's like no superintendent has a contract worth you know twenty five billion dollars or whatever so I think it's safe there just they can only be paid and yet not more than what's on their contractor I just wanna make sure that the intent is you want to limit it to twelve months and by having that large hole there you could potentially inadvertently allowing a loophole so that they would school district would still be liable for the full three years in the in the case that we were talking the the other follow up I had is and I just wanna make sure I understand or says the and section be that we're not going to a compensate the outgoing superintendent for any term exceeding the remainder of the fiscal year that's just a stop gap to basically at the end of the school year that the superintendent is not gonna be the superintendent anymore that kind of the marker trying to put their yes correct okay thank you. Richard Smith. Yes Senator Davis I was just wondering by eliminating the three year contract. Is there a chance that it would just drive up to one year contracts in monetarily and we will seek higher salaries for getting good superintendents and. Personally I believe that that's just a fear mongering talking point I don't believe that that's the case and as I said at superintendents across the nation have created a standard for themselves that you know they need to be on a three year rolling contract for and job security and because they don't they don't fall under teacher fair dismissal hi this is something that we don't afford to teachers are almost anyone to be on a three year rolling contract that we afforded to us to our superintendents and the truth is we have a lot of good superintendents and this won't apply to them because they do their job well but there are superintendents who do not perform their job well and do not meet the standards of their job that are terminated in our state is spends hundreds of thousands of dollars buying them out and I just think that's an egregious uses of tax dollars that should be educating kids and instead it's paying for superintendents who did he do not perform their job duties well and so I don't think it will try that one year contracts because if you're good superintendent you can get a job we're and and I did have a conversation with the superintendent about this and like they can go anywhere and get a job if they're good superintendent there's no worries there and it's the superintendents that are not performing the way they should that should not be allowed to get hundreds of thousands of dollars and in buyouts because they refuse to do their job as they should have. Follows. You know as a thirty six year educator I've been under several superintendents and. Good and bad but I was worried too about the clause in there that says the board can come up with their own. Their own. Expectations on what the duties of the superintendent should be and I was just wondering from a legal standpoint. If they come up with some that could not be legally Hold up in court for termination of the superintendent there any stipulations for that and then being able to put in what they would want in the contract description well I will say that and almost every school board is a member of the Arkansas school board association who have attorneys on staff and I think most if not all school boards also have a separate attorney and just not on staff but ma'am on retainer that they use and then of course we have a a E. a with their several organizations that are tied in very well with school districts school boards superintendents and that sent out and model legislation model policies guidance and and so I don't think that that will be an issue because quite honestly the school boards follow I would say probably almost all the guidance and the school board association or eighty eight so I think they'll probably be steered in the right direction there to ensure that what they put the contract is legal and for superintendents sign thank you. Thank you Mr chairman the center that is that but I guess my question and and as the guy that just asked our committee to press a bill through here the end of session for what I felt like was valid reasons if this is late in the session there is does sound like there are some concerns that maybe could be amended to make this a better piece of legislation is there reason that this issue's being pressed right now and couldn't wait it's a through an interim study period to get a get a piece of legislation the members a little better suited to what you're trying to do I'm not specific the reason it's being right now is because I just have the bandwidth finally he know it session work and have different things are focusing on throughout it I filed it awhile ago and and I have it's something like I said my nine years on the school board at something that's always bothered me I don't think it's right and and I think that you know that passed yesterday thirty five zero out of the Senate passed unanimously out of Senate education and so I think it's something that member support and even in light of some of that and concerns and just points that we've kind of talked through and so I think it's still good and is it could be better absolutely and but I still think it's good the way that it is and something that we can work on next session as well. You're recognized didn't do you know whether other states that have similar types of legislation in place there's that are surrounding states anywhere else if you look at other examples of legislation that might be similar to this I have not I don't know and what if any other states have taken action like this. Thank you Mr unless a somewhere else in the statute does this necessarily preclude a three year contract or it just affects how much is the buyout would be that's correct it just it it just affects how much the buyout could be I mean they can still the three year rolling contracts and have any terms and conditions they want in the contract and that it just says you know a buyout can exceed more than twelve years twelve months and a state funds okay thank you. Representatives you have another question good represent Lowery of the question. You don't have to I know I know I don't have to yeah I'm I'm still you know kind of concerned about the and and I understand the intent and I've actually supported But it is someone who's you know dead pretty deep into looking at the numbers on finances and school districts in seeing the huge amounts of of net fund balance that out there you know I think it's up to between that and construction fund balance up to like two point two billion dollars. I think that there's significant work arounds to this bill and I and I think that that's unfortunate you know the go well okay I don't need to state funding will just use that fund balance to help these contracts and gosh you know I wish that were the case but I just think that there really some some major loopholes in this to try and reach this and to this very good intent that you have in the legislation I wish to we had time to really tighten that up The do you. What I would say that you know you can't just it in schools you can't just and spend money from whatever part you want to spend it from there there's a lot of different finds you spend I mean yeah there's the three month is right but like you're you know you can spend money out of just specific funds and so I wouldn't say that I think that they have free reign to to spend it wherever they want and if they want to work around and violate the intent of the law and say well we'll just still pay you know buy out your three year contract and for you not doing your job well then. They have I guess a year and a half to do it until they come into session next time if this passes but and that's up to them to violate that intent if they so choose but I would think if it if the school board and is terminating the superintendent then they would obviously I think have good reasons to do so that are written into the contract and and wouldn't just be looking to hand out a couple hundred thousand dollars. Right okay thank you thank you Mr so if a superintendent is in place and contracts due in June end of June that's what estate would be up and they fireman April or letting go on April is the only going to get compensation for may and June yes that's correct okay that was my question. Good morning committee thank you chairman names my commander's executive director of the Arkansas association of educational administrators we did want to come in and speak a little bit about our concerns related to this bill obviously as senator Davis made some remarks that this bill is patterned after or after higher education bill most of you know I know some of you then school board members are current school board members that you know college presidents and University structures when they have foundations and tuition funds that are available are a completely different animal from public school districts I'll be the first to say you know I I I I get very frustrated and agitated when I see buyouts across our state you know that that's something that when when there's a relationship entered into by school board and the district are district superintendent you know you hope that that's going to work well and and they're not be issues that sometimes on the side of the superintendent sometimes on school part of the school board You know that I understand that there was a conversation had with with higher education officials in crafting that bill we wish we were afforded that same opportunity to be able to to find out a good path forward that made sense you know with this bill what we see is that. Just the first section of a related to items that have to be identified there are some items that were struck that seem to take away the ability for specifics about how why reason specifically for the fiscal distress that that something that you know could be a Reason why district superintendent would be removed it adds language that seems to be that it has to be very specific written in the contract what those standards are reasons are for calls and removing the superintendent and so in a way you know it may seem that it's adding a layer of protection which it sounds on the income to speak in favor that are opposed to that but you know it could in my opinion if if if if there were certain factors that were listed in that contract and and I did not commit one of those is the district's superintendent you know therefore I wouldn't be able to be let go and so that you know there could be an increase in buyouts and I think represent Lowery reference some of the language that was related to workarounds it does say state funds and so you know that that's very vague term in terms of how that is can will be applied so I just think there are a lot of issues with the bill I think it's something that may be a worthy to explore Bend and definitely willing to be engaged in that conversation so I appreciate you. You have a question represent Bragg. Recognized thank you I'm not familiar with these contracts are buyouts included up front in contractors is something that's negotiated at the time of dismissal or so I I know that how all all go round about if your question apologize for for going this direction but I know the term gets thrown out that everybody's in a three year rolling contract that's not the case you know the the school boards and and different from college educate college people you know typically those are appointed boards these are these are elected boards that have the choice to enter into an agreement for one to three year contracts and so in that contractor number of things the school board association puts out a model contract and several national organizations put out model contract sometimes it's just contracts that are repeated but typically there's there's reasons that are stipulated for costs and so districts can do this already and so you know for us it just seems very I don't know what it is when you first take a job you know that that should be very excited when I go when I become a segment of the district can help but I don't know if I ever do that again possible anything's possible but that's a joyous occasion for the hopefully for the board and that superintendent and so the first thing it seems like with this bills or off the bat you're stipulating. What are all the reasons I can be bought out for what are all the reasons we can be terminated for and you know I don't know that that really lends to the culture of of what we're hoping to have happened there you know if if if if obviously if the Super does not doing a good job there value waited annually typically if they're not me that evaluation that's cause enough for termination so. Thank you Mr chair and committee members Dan Jordan Arkansas school board association I will be brief I certainly support to everything things that we're sure but order and as and we really simply think and I've share this with the the sponsor sometime back we're just concerned that it should this bill pass a yes it is permissible to continue of one or two or three year contract with superintendents but if this bill passes there's there's gonna be some districts that I will no longer offer the multi year contract And if that were to happen then that would in turn possibly has been mentioned earlier today that it would drive up the amount of the supertech contract for the one year contract which would in turn be a rising cost to districts and that that's really a genuine concern that we have should should this go forward and that's there's some other things I would share with they basically already been covered thank you. I wish we state your name and who you're with again please my name is Diane Robinson with the Conway school board and its the thing I'd like to to speak against this bill simply as because recruiting a superintendent is it's a national effort it is not something that we just look in Arkansas we are looking at a national pool superintendents we want to be able to recruit the very best people to do so if our if our contracts are not similar to other places in the nation unfortunately does impact our ability to recruit so that's one issue and I also share the concern about having to lay out the contract things that we would be able to to let us to pretend go off of that would tie our hands actually lead to more more buyouts I've never been part of a buyout I'd hate by helps don't want to be a part of one hope that we never have to do that but I'm concerned about that that line particularly says we have to include that information the contract so thank you thank you any questions thank you ma'am. I won't refute any of the points we've kind of talked about some of them I don't think that it's gonna and drive up when your contracts that by any means but I will say that I and I've agreed with if you do have raise the point that and this the intent is good but the language could be better it could be clearer and and I totally agree and so I think because and I think probably committee members are supportive of the attack intent that want to seek good pieces of policy pass through especially here at the end of session when we're rushing seventy things three and I will not ask the committee to vote on it today I'll go ahead and pull it down and and work on it to have better language and in two years from now we're out of time because I I do think that's important to make sure what we're doing and it states in the right way and meets the intent of what we're trying to do so I appreciate your feedback good move so you're going to pull the staff yes Sir thank thank you like Commission we have one role members in a room with us today.
