Thank you. Colleagues to be Frank with you this is a really big deal I wouldn't just recognized just any accomplishment from my district because frankly we have so many winners in my district that would I be here every day so you know this is a really big deal. It's a big deal so Eden blaze parts is known as Ziggy and our community and she is now famous she's fifteen years old and she's a world champion she recently won the Mike and Sherilyn Johnson toughest junior bail racing World Championship Ziggy was introduced about racing by our parents Josh and Mona parks and she's been riding horses and competing since age three years old she won the World Championship in Las Vegas recently. However before she did that she had to go to Tulsa and compete in it and a large core finals just to go to Las Vegas where she won in Tulsa then went to Las Vegas there were ninety three competitors in Las Vegas and she came out the champion she's fifteen years old this is for bill racers nineteen and under she won twenty one thousand dollars saddles a championship ring to the winner and we're just so proud of her but what I want to say is the competitions for anyone under fifteen and she's already said he's going to go back and she's gonna win again so let's recognize the. Mr Speaker can you please have the Clerk read the resolution. Mr Clark please read the resolution in its entirety. Where is the parks is a student across the Todd river high school and where is the park has been built racing since she was two years old and her goal is to one day compete in the national finals rodeo and whereas the park's was one of nine hundred forty five contestants competing at the twenty twenty one Mike and Sherilyn Johnson biggest toughest junior world championships which is held on the first week in of the NASA national finals rodeo in Las Vegas Nevada and whereas in twenty twenty one the parks was selected as the biggest toughest junior world barrel racer champion for the nineteen and under group now therefore be it resolved by the house of representatives of the ninety third General Assembly of the State of Arkansas the house of representatives could gradually even believes is a U. parks for her outstanding achievements. President Vaught has explain the resolution would anyone like to speak against the resolution. Would anyone like to speak for the resolution. Represent Vaught is closed for the resolution the question before the House is the adoption of house resolution ten thirty two all in favor say aye. Any opposed resolution is adopted. Mr Clark please read House resolution ten thirty five. House resolution to thirty five a representative Pilkington took it in the actions of the Russian federation federation taken against the sovereign nation of Ukraine into a call for action for the United States to penalize the Russian federal federation and deterrence similar conduct from other nations. President Pilkington you're recognized explained resolution. Thank you Mr Speaker during the session I wish I would have been addressing on something a little more cheery than this but I'm sure like me has you watched on the news that late night the Russian invasion of the Ukraine completely unprovoked you are horrified by what you saw. And that night me and my wife prayed for the people of Ukraine we pray for what was all going on the world and my wife said what else can we do and the one thing I thought I could do was pass the resolution showing people in my district and in my state that we stand with the people of Ukraine against Russian aggression and we also tell other nations that if they choose to be aggressive like we've seen the Russians be that we will stand with those people who they aim to a press. And one of those things that we need to do to make sure that we're not beholden to authoritarian regimes like Russia to make sure there were energy independent and I think that's something we can all get behind I remember one of my earliest political memories was back in two thousand eight watching the debates and single Democrats Republicans talk about I need to become energy independent because as a national security issue today we see that that is true all those years ago. So with this you can read the resolution I'm not trying to put blame on anyone anyone party I think it's Americans we can all stand together as one group and say that what we see going on the crane needs to be condemned and that we need to work better to help make America energy independent and so with that answer good votes please pray for the people of Ukraine they needed now more than ever. Representive Pilkington is explain the resolution when he would like to speak against the resolution would anyone like to speak for the resolution represent Richmond you're recognized speak for the resolution. Thank you Mr Speaker in thank you represent Pilkington for bringing this resolution. Thank you colleagues I beg just a few minutes of your time here because I'd like to remind you just at the beginning. Of this session we had a delegation of sponsored delegation recurring ins here visiting with us. Today I have no idea where those people are I don't know if they're still here in this country. Hopefully they are safe but we're their families. We don't know one of the things I asked them. When I was up there so it is Russia going to attack will invade. Their answer was they already have. And that was absolutely true so there should not be any surprise because the best indicator of future behavior is past behavior you look at two thousand eight what did Russia do they invaded Georgia. We were able to fly supplies and basically at that time daring them to shoot down one of our aircraft. Two thousand fourteen they invaded Ukraine. They were unable to complete the task at that time. But they did not give up and why is that because with Ukraine. Russia is empire. Without you crane Russia is just another country. We have seen them fight in the streets we have seen mothers. We've even seen miss Ukraine. And I'm highly impressed with mission trying. Pick up weapons and say I'm going to defend my country. And it really puts in perspective our freedom here and how we generally take it for granted. We don't have the Russians burning our streets and sometimes we have our own citizens do it and that's too bad because they really need to take a look at what real. Charity is actually like. You don't have to look any further than the streets are you crying right now. You don't have to look any further than the five year old little girl that they couldn't resuscitate at the artillery strike. The bravery of the Ukrainians is incredible. The fact that they want their freedom they are fighting for their freedom they are dying for the freedom. Despite the onslaught of the Russians I don't think the Russians are done or finished or anything as a bring up Verimatrix weapons warheads now barometric House kill you. It kills you with over pressurization basically it turns your internal organs into much. And why is this so devastating is because it can reach into the foxholes. It can reach into the trenches they can reach into the bill that you don't have to get struck with fret no. You just have to be within the council ranger that over pressurization and it will kill you. They bring these up because it will leave quite a bit of the structure still in place. Not the fragmentation damage that you would get otherwise have the use this so far I don't know. But I one thing I know about the Russians that they have it they're not afraid to use it. And it's such a shame here in this country course the great debate is let's don't get involved. Nor should we. We are not obligated to defend Ukrainians with our military. There is no obligation for that. Too often we have fought wars of choice in this country instead of wars in the session fee and we don't need to get involved in anymore we never need to allow a war of necessity to turn into a war choice which is happened time after time. And yet we still fail to learn that lesson is that you cannot nation build. In a country whose people don't care if they have a nation. Doesn't matter how much treasure or blood you sacrifice. With the U. Kerr is a show to something here. They care about their nation. And what we do not have a military obligation we do have a moral obligation to help them any way that we can. Why. Nineteen ninety four the Musonda cord you crane fully surrendered all their nuclear weapons they were the third largest nuclear arsenal in the world. And we talk them into giving them up they gave me to their good friends the Russians and we help them do that. December fifth nineteen ninety four United States Great Britain Ukraine and Russia. Sign the Budapest memorandum guaranteeing their security against invasions. Or against political. Influence from outside nations overthrowing their government. How it changed as soon as they got an independent president who is not just a public. Uprooting the Mad Dog that he is. They immediately disregarded the very agreement that they signed. That was reaffirmed again in two thousand nine those security agreement so why we do not have as a nation any military obligations. And nor do I advocate putting one of military moves in Ukraine. We should do all the other things that we can to help them. I thank representative Pilkington blinded out pretty well. In his resolution. I would simply add that we also need to reach out to those Russians who are pro testing. And make sure their messages worldwide even though they go out in the streets knowing full well that they're going to be arrested and they have been arrested but they know what Putin is doing their president. Thank god that has so much blood on his hands. That he doesn't even know what the color is hands are supposed to be. They know that what the invading Ukraine is a term H. herbal atrocity. And they go out there I would ask our government to give them any way possible means that we may have to amplify their voices within their own country and let the world see that not every Russian agrees with genocide. And that's why the premises so afraid because if you look back after nineteen seventeen ram nineteen twenty two is so forth when the Soviet Union actually took control of Ukraine. That cost Ukrainians four to five million lives. Yes Sturch. Replace them. What is changed. I thank. Putting. Is a power lusting individual who we know when it comes to charity if you're a tyrant. Every time you succeed you're never satisfied it only stimulate your appetite for more success and more aggression. And that's what's happening here in so what's next you must ask yourself if we do not draw a line here and say you're going to pay a price as high as we can make it. What about the Baltic states that used to be part of Russian there's Russian speaking people up there the same excuses that Hitler used. When he expanded the greater Germany which eventually when he miscalculated led to World War two and when putting this calculator we miscalculate we could end up in the same situation as well. Make it hurt Mr president making hurt make it hurt as much as you can make it hurt because the people of Ukraine have proven. That they deserve. Any pain that we can inflict on putting. And his. Grupa Banshees who are out of control. Thank you. President Richmond spoken for the resolution would anyone like to speak against the resolution. Would anyone like to speak for the resolution represent very recognized speak for the resolution. Thank you Mr Speaker and colleagues of young adults me just for for two minutes from a guy that has seen. The horrors of war. In death and destruction. On a number of continents I mean I've seen. The blood and the guts into the deaths that happens in a. Entry dealing with war. And that's why I come before you and this is the darkest hour of my lifetime for a military servicemen and definitely the darkest hour in the world in or in Europe since World War two but as representative Richmond mention less than two weeks ago. A delegation from Ukraine stood in the gallery gallery a bit above me. They stood there with their hands over their hearts as we pledge allegiance to our country. The least that we can do is to pledge allegiance to them in prayer. As a free and democratic nation we must concern ourselves with the senseless unprovoked invasion. Of the crane by ego maniacal dictator whose goal was to take what is not his. An invasion my friends of helpless homeless and of a sovereign nation by a crazed madman whose name does not should not even be mentioned in this chamber. The leader of Russia he is on a mission to rebuild the former USSR. And he will not stop until the accomplishes that goal he has taken Crimea is in the process of taking you crying next will it be Estonia Latvia Lithuania Poland Sweden or Finland today it's Ukrainian blood. Whose blood is going to be tomorrow. Lehzen gentleman we cannot stand arm in arm with the people of Ukraine. We can't stand with them in prayer. The people of Ukraine have tasted freedom and democracy and they understand thanks certain human aspirations of freedom. Of democracy and liberty are actually worth giving a man's life in pursuit of the pending those aspirations. I pray for those ladies and gentleman who sleep and a cold dark musty basement in the filthy subway in the middle in the middle of keep. During the murder of their families the raping of the women and children and the genocide of their country. Pray for the children recurring. Who live in fear as their mothers and fathers their grandmothers and the grandfathers take up arms into go fight the Russian empire. And pray for the leaders of our nation. And the leaders of other nations that they will strive to promote peace throughout the crane in the world. Finally I submit to you ladies and gentleman. Just as the ambassador of Ukraine state last week in the U. N. security council. There is no purgatory for war criminals they go straight to hell and I hope that happens sooner than later thank you. President very spoken for the resolution would anyone like to speak against the resolution. Would anyone like to speak for the resolution. Represent Pilkington. You're recognized to close for the resolution. I don't know how I can follow those two speeches thank you for your support I just and I would love to close I just want to recognize the Ukrainians in the audience here today with us and give them a round of applause. President fighters explain the resolution would anyone like to speak against the resolution. Would anyone like to speak for the rest. Absence Springer recognized before the resolution. Good afternoon and thank you all so very much for being here the first day of our women's history month I just wanted to make sure that you all understand that I do not support any woman or man who support segregation and anti civil rights so I just wanna make it clear that I support women that want to serve in positions normally held by many in however I do not support persons who support segregation and anti civil rights thank you so much president Springer spoke before the resolution would anyone like to speak against the resolution would anyone like to speak for the resolution represent fight is close for the resolution the question before the House is the adoption of house resolution ten thirty seven all in favor say aye. Any opposed the resolution is adopted. Morning hour is indeed represent Payton for what purpose. Motion. Let's hear your motion Mister Speaker by authority a house rule seventy one I move I move we remove House resolution ten twelve from committee and place it on the supplemental calendar for consideration by the full house. That's proper motion it is debatable representative great purpose. Let's hear your motion make a substitute motion that we lay House bet House resolution ten twelve on the table. President great parliamentarian is advised that it is not in fact and substitute motion but it is a motion that has higher precedence it is not debatable. The question before the House is to lay House resolution ten twelve of the. Question before the House is to lay the motion. Welcome back to lay the motion to remove House resolution ten twelve from committee to lay that motion on the table. President Payton for what purpose and that is non debatable. Parliamentarian inquired. Can I have an enquiring. Parliamentarian advises that it's not debatable. Okay so I have a question of apartment area you're recognized for a question if a motion of this sort is laid on the table. Can another member follow by making the motion again. And then again and then again. Parliamentarian advises that that would be dilatory and would not be in proper order. Thank you. Dotson for what purpose in query you're recognized is this a I thought the bill was in committee it's not on the floor to be laid on the table I am confused by that. The motion is to lay the motion to remove the bill from from the resolution from committee on the table. Send makes for what purpose and I just question I have to I I guess my question is can you make a motion to lay a motion on the table I thought that you could only do that for a bill. Parliamentarian advises that it is an incidental main motion and it can be laid on the table. Right. Represent Miller for what purpose. Question you're recognized where is the table. All right any other representative Lowery for purpose in query you're recognized what is the vote threshold on tabling a motion. A majority of a quorum okay and I have a father in query you're recognized. If I if we were to ask for a formal ruling I mean I know we've already done this formal ruling of whether a motion can be table can that. that the determination by the parliamentarian and and us by you be appealed. Sure well I appeal the decision of the chair that you can table a motion. Just a moment. Right members represent Lowery has a pool appealed the ruling of the chair in lieu of sending the appeal to the rules committee we and ultimately if this in one way or the other it ultimately could be appealed to the full body in the interest of bringing it directly the full body we will allow the full body to weigh in on that ruling so the ruling of the chair represent Lowery is appealed the ruling of the chair the question before the House will be to sustain the ruling of the chair it is a debatable question. I will I first will speak in favor of the ruling. So members you have heard you have heard the motion and this and the motion that was made I've conferred with the parliamentarian as to the propriety of these motions. The parliamentarian advises that a motion can be laid on the table we have had other motions to lay actions on the table before that is not debatable motion and thus I rule that represent grace motion was proper. Beyond that there's that's you've heard and I've given explanation for exactly what is happening here in the US that is why I made the ruling that I did. We would like to speak against the ruling. Represent Payton you're recognized to speak against the ruling. Thank you Mr Speaker. College for going to great news links. To try to keep from hearing something. Try to squash each other's motions and squash cheese each other's bills. And wallet may be. Legal or or in the rules are within parliamentary procedure to make a substitute motion to block my motion. To hear a resolution to allow us to file a bill. We all talk about activist judges that. Take an action just to keep from hearing. The case before them. And folks we have a we have a case before us and rather than plugging our ears and refusing to hear it. I ask you to take the measures needed to hear the merits. Of the resolution. To hear the barrier to the bill. Today. You're the judge. And your the jury. And appropriate that many of you are wearing black because you're everyone ought to have a black for a loan you've got to decide. Are you going to. Close your ears to the debate and use the stay and the lady motion. That's what the judges do they put a stay on something and then they delay. Until somebody else makes the decision so they don't have to hear the case. Well you're the judge. Are you going to stay in the lay on this are we going to get to the merits thank you. Represent Payton is spoken against the ruling would anyone like to speak for the ruling. Representative gene you're recognized speak for the ruling. Thank you thank you Mr Speaker. Colleagues we have turned down other bills in this session before the session started. I always thought this need to be a special session vote and I still do and I told members from time to time that if you want to get a letter I think we could get sixty seven votes to put this on a call for a special election and we could it hasn't been tried. Okay this is about politics make no doubt about it is about the next election. And I won't I'll I'll put my pro life voting record against anybody here I'm just as good I'm sorry. But this really needs to be handled in a special session. And if the members are that passionate about it and we can do it in a couple weeks I'll help of get the sixty seven signatures. That we need to support a special session. Now we go down this hour we're going to go down some others why not my bill why not my bill I think we need to uphold this. And if they really want to get this fixed let's have a special session and not worry about the next election. Tim Jean is spoken in favour the ruling would anyone like to speak against the ruling represent Lowery you're recognized speak against the ruling. Colleague colleagues there comes a point. When we're not just talking about the issue whether it's pro life for guns are sanctuary cities but it's about freedom it's about transparency. We heard a prayer today for the people of Ukraine we heard a resolution supporting the people of record you crane and what their standing force freedom from tearing. And if we don't allow conversation if we don't allow debate if we don't allow discussion on whatever the issue is that we're going right down that same road. Of tearing. Of not allowing debate. This is the delivered of body. And we shouldn't be afraid of hearing the arguments both pro and con on this issue and that's really what this motion is about it so what what this appeal is about it's not about whether you're pro life or not the issue is should we hear the evidence. And the evidence is this there really is another story that can be told about the issues represent gray for what purpose objection Hey what's your objection he's not speaking to the appeal. The proper projection represent Lowery please direct your comments to the appeal I am speaking to the appeal I'm speaking to the reasons why we should appeal this decision why we should hear this resolution and it's because there is additional evidence that you've not heard. Has all of this is been bottled up in another committee and this body has not been allowed the opportunity to hear the counter evidence that is out there to all the arguments that you've heard from the family counsel from other entity so for those reasons I ask that you would appeal this decision that you would allow us to be able to X. a X. X. bring from committee of the resolution. Represent Lowery has spoken against the ruling would anyone like to speak for the ruling represent very you're recognized speak for the ruling. Ladies and gentlemen I'm a hundred percent agreement with representative lane and this has absolutely nothing to do with Ukraine this has to do with politics nothing more. Please I consider you and my colleagues Lane Jean hit the nail right on the head thank. Represent berry has spoken for the ruling would anyone like to speak against the ruling. President Bentley you're recognized speak against ruling. I would just like to briefly remind this body that we were here for special session on December ninth and I stood right here in this very podium and asked you guys at that point to hear this very bill during a special session and that was denied we're here we have time we just want you guys to hear both sides and I would look at proverbs eighteen where it talks senses when you hear one side of the issue you think that's the truth and to hear the other side simply wanted to have this bill heard and have heard both sides heard and make a good logical choice and that I would just appeal this decision thank you. President Bentley spoken against the ruling when he would like to speak for the ruling. Represent Wardlaw you're recognized for a question a question for you Mr Speaker. Can you tell us a vote yes would mean and a vote no would mean on this particular question of the call of the chair so that the membership understands the vote. I will I will go through it again before the vote I think we just we were at represent Bentley had spoken against the ruling representative would anyone like to speak for the ruling represent Dotson you're recognized speak for the ruling. Members I just went through the rule book and the ruling of the chair is proper in my opinion based on the rules I would encourage you to vote to uphold the ruling of the chair if you disagree with the motion to table it vote against that. That's a simple majority a simple majority of a quorum present and then if that is struck down we can debate representatives Payton's motion which is a two thirds majority so if you get two thirds pulled out of committee surely we got enough to to support not laying it on the table in considering this further but for this particular question I think this one is proper in order and encourage you to vote to uphold the ruling of the chair. President Dotson has spoken. In favor of the ruling when he would like to speak against the ruling. Would anyone like to speak in favor the ruling. Okay so I think I've gone back and forth we would like to speak against the ruling. We would like to speak for the ruling. So I get the option to close for this ruling and that members of. Parliamentarian reminds me that the ruling ultimately the power in the house resides with the House I made a ruling that I believe is correct. Just as every ruling that I've ever made here I'd make the ruling based on the information I have been based on the parliament parliamentarian's advice it's based on that advice that I made this ruling and the suggestion that there was. Did I not hear comparisons to tire any. The power resides with the House. If I don't think the membership wants to get into that situation where the Speaker can pick and choose which parts of the rule book to follow or which parts not to we had a motion and represent Payton asked that this be placed on the calendar. And I placed it on the calendar and I believe I've done everything that he is asking terms of bringing this to the floor. Represent grace stood up and made a motion I heard the motion I conferred with the parliamentarian and I made a ruling. And now. There's been an objection that represent Lowery is made and the membership gets to weigh in on that. And just so there's no there's no. Miss construction of anything here I certainly believe my ruling is proper but ultimately each one needs to vote their own conscience on this issue on the ruling and or any subsequent bill or motion that may be out there. But I think the any suggestion that when we're working through a parliamentary process and taking up votes and allowing the membership to weigh in on this decision to suggest in any way to bring up the idea of tire any particularly in light of what's going on around the world is. Beyond the pale in my opinion. And so the question before the House will be to sustain the ruling of the chair. A yes vote sustains my ruling. And finds that the motion to lay the motion on the table is proper a no vote is to go against the ruling and to find that the motion to lay the motion on the table is improper. That clear. A yes vote is in favor of my ruling a no vote would be in favor of represent Lowry's objection. Represent brown for what purpose you're recognized in regard to what representative Dotson just said. If we vote if the if the vote is. In. It in your favorite to. Gree with the chair. Then. What he was saying was that we have the opportunity to vote on. Representative Payton's motion so if if if the if the. If the if if my if my ruling is sustained then we would move to the motion of representative great and that is not a debatable motion. If represent Lowry's objection is sustained. Then representative grace motion would be determined be out of order we would move back to the motion to remove from committee house resolution ten twelve. Thank you. President Payton about is that clear I mean in my good since you had the underlying motion I wanna make sure I'm not misconstruing anything here. If that's an opportunity for me to respond I really appreciate the way you've explained it. And I did not imply in any of my comments that you're ruling was unjust I took advantage of an opportunity to speak towards motion thank you. All right represent flowers for purpose thank you Mr Speaker out just clarification you're recognized thank you so if five vote yes for this then we go to representative craze motion to lay. It on the table and then I vote yes for that and then we lay on the table and it is not extracted from committee correct that's correct if it is a majority of a quorum on the ruling and then a majority of a quorum on the motion and then ultimately if we came back to the underlying motion it's two thirds of the. Two thirds of the membership. But but it wouldn't go back if it was a yes majority of a quorum votes. Yes now and and yes representive grey's motion then that would be the end of it thank you. All right. Any other questions. All right so the question before the House again is to sustain. Tell the decision of the chair standards the judgment the House a yes vote is to sustain my decision yes voters in favor of my decision a no vote is to in favor of overruling my decision would a no vote would be in favor represent Lowery subjection okay any other questions all right. Shall the decision of the to the question before the houses shall the decision the chair standards the judgment the House all in favor say aye. Any opposed. The ayes have it. Members we now move to represent grace motion. All right so represent grace motion is to postpone the the proper terminology is to postpone temporarily. The motion. To remove from committee house resolution ten twelve. A yes vote is to lay that much to lay represent Payton's motion on the table to postpone temporarily a no vote would be against represent grace motion a no vote would be in favor of taking up represent Payton's motion. Okay any questions. All right. Question before the House is the motion to postpone temporarily the motion to remove from committee house resolution ten twelve all in favor say aye. Any opposed. You guys have. C. five hands. Per machine Mr Clerk. As everyone voted. Has everyone voted. Cast about Mr Clark by a vote of fifty one yeas forty three days the motion has. As passed. I don't see five hands. Okay members we're gonna sound the ballot gonna call the yeas and the nays because it's a majority of the it's a majority of the court. Allen. Barker. Very. Bragg. Cavenaugh. Clowney. Coleman. Collins. Cozart. Dalby. Deffenbaugh. Eaves. Represent Vives. Strike representatives members also in sounding the ballot you don't have you don't have you can't respond but you don't have to respond the the issue is whether a member raises a strike. Just for clarity. Continue in it. Eubanks. Ferguson Deborah Ferguson. Ken Ferguson. Charlene Fite. Lanny Fite. Flowers. Fortner. Garner. Godfrey. Gray. Hillman. Hodges. Holcomb. Hollowell. Hudson. Jean. Jett. Love. Lynch. Thank you. Mayberry. McCollum. McNair. Nicks. Mary. Richardson. Richmond. God. Slave. Speak hold. Straightness Richmond. Richmond. Scott. Slate. Speaks. Springer to let. By. Wardlaw. Warren. Watson. Whitaker wing. Okay with forty nine and given that the forty nine is still in excess of the forty three there's no point now to calling the nay votes so the. Motion has passed. Represent Lowery for what purpose in query recognized for an increase okay I just want to you to explain the quorum because did we not established in the roll call that there were a hundred present. Would that not be the quorum. The parliamentarian advises that the quorum for each vote is established by the votes on that particular question. Thank you. Any other questions.
