What this does is allow the Department of Corrections to house other rehabilitative programs in the Arkansas Health Center in Benton. I'll give you an example of that, and an example is boot camp. Right now, because of the legislation we have in place, we are prohibited from housing a boot camp type of program in that facility. It allows us to efficiently program each of the beds within the prison system
and make sure that we're using each of those effectively. We also have some unused buildings on that campus, and we want to make sure that we don't have any arbitrary limits on that. So we're going to give the Board of Corrections the authority to make decisions as to the maximum number of inmates that could

Thank you, Mr. Speaker. And it's not so much that I'm against the bill. I want you to understand that. But the economic impact of this has not been delineated. And if I'm not mistaken, this will have adverse impact eventually, if not now, upon the sending counties. are counties. And if it's in the Delta, that means you'll be taking money out and, of course,
jobs out and sending them to a more secure place, which, of course, is in the Saline County area. And as we make those kinds of moves, even though they look like they're good moves, we should be mindful of the economic impact, especially looking at the census and we see what's happening. We should not do things that will adversely impact the Delta. I don't represent the Delta, but I do think it's important for us to keep the balance of the economy equal as much as possible where state resources are involved.
So while I say I speak against it, I just want us to be mindful that all these things have economic impact and that we should not hurt Lincoln County or Jefferson County anymore and at the same time send things either to northwest Arkansas or to the more prosperous parts of Arkansas in the

The purpose of this bill is to exempt certain persons and criteria from Arkansas Health Department regulations which were adopted to define and control food service establishments, such as restaurants, wholesale or retail or vendors, and it does not change any regulations pertaining to taxes or permits.
Therefore, it has no physical impact. As with most laws, as time goes on, original intent of these regulations defines themselves in the everyday application of enforcing them to comply with the original purpose. Often this means very different interpretation of the same guidelines. In order to clarify which products and producers must work from state-certified kitchens, bill specifically exempts or deregulates certain small producers from the current law as written.
We have defined cottage food producers as those who produce foods such as fresh farm produce, jams, jellies, honey, sorghum, certain bakery products, and foods not deemed as potentially harmful to consumers and produced at home. These can be sold only in small quantities from the place they are produced, one's home, a farmer's market, or for short periods of time at a county fair, a weekend festival, or other special event. This encourages farmer's markets
and supports the right of volunteer fire departments, ball teams, and other such groups such as 4-H to continue to use bake sales as a means of fundraising without unnecessary interference by an overly zealous health department county employee. It allows our newly established Amish families to sell a few jars of jelly or homemade loaf of bread baked at home. It defines specifically what foods are not potentially hazardous. This bill was written in conjunction with the Arkansas Department of Health. It does
include labeling to easily distinguish between locally grown items and those not produced in Arkansas. It passed Public Health unanimously and is a good common-sense bill I appreciate a good vote representative Benedict has explained

1385 does one thing. one thing. It requires new construction for builders to install carbon monoxide detectors in new homes. In 2008, according to the State Health Department, we had 14 carbon monoxide
poison. In 2009, we had 23. In 2008, we also had 13 deaths. In 2009, we had 19. And these were gas and vapor deaths. One of the things that we do time and time again, we wait until something catastrophic happens. And then we'll introduce a bill and name that bill after
the person that's deceased. Last year we had the Hobbs bill. Everybody know that situation. And those, when we can't get a bill passed, what we'll do, we'll come up with a resolution or a citation and we'll look to the Speaker and we'll say, Mr. Speaker, will you have the clerk to read the citation in its entirety or the resolution in its entirety. And we should do that. And we'll have the family standing right up there. And after they get
through reading, the family will leave here sad, and we'll leave here sad too, thinking that we should have done something. And today we have a chance. Just last week, Representative Mayberry came down to the well and talked about how some audio impaired communication equipment saved his father's life. Representative Woods talked about a bill last week that deals with the registered sex offenders
over the internet and Representative Donna Hutchison had a bill just a week ago talking about how it's wrong to file a lien, an unlawful lien against someone. All of those are good bills, and this is a good bill, too, and I appreciate a good vote. Representative Smith, what purpose? I have a question.

County the permanent location for the Northeast Arkansas District Fair. There are five district fairs. The other four all have a permanent location. In 1983, the district fair had been held in Mississippi County. Due to location, fairground facilities, and things like that, it was moved, and it was moved by a law that was passed and it made and developed a district fair board that would vote
each year as to the location of the district fair. That board has never met. Craighead County has been the host for the county fair for the last 27, for the district fair, I'm sorry, for the last 27 years. There's never been a security problem. There's never been a problem in any way with any kind of books or anything. They are looking at locating a new fairgrounds. Before they want to make that major investment in the buildings and facilities, they wanted to know that they would be the permanent location. Some have asked why it should be a permanent
location. The other four district fairs have a permanent location. And again, before they expend the extra money to handle the larger crowds and the number of exhibits, they want who have a at least a reasonably long-term contract this could be changed again by an additional law in two years if Craighead County did not fulfill their obligations or if there was some kind of a problem with this this bill passed out of committee unanimously all the other representatives in my
district or that are in this district fairground area have been contacted with no opposition I believe that would be correct there is no physical impact it the state one dime at all and this would be in the best interest i believe of all the people in our district area to be served by this i would appreciate a good vote thank you representative

Two years ago, we voted to change some of the provisions of the Economic Development Corporations Act. And this is one of those bills that we looked at after the session was over. And we looked at one section. We said, why did we do that?
And I've talked to the person who was the sponsor of this bill last session. I talked to the Chamber of Commerce, which was actually my Chamber of Commerce, which worked on the bill last session, and everybody agreed that this probably was an oversight. What we want to do with this bill is to put back in the paragraph that gives oversight to the elected officials in whatever the town or the municipality is. We think that oversight is a good thing. We wish we hadn't taken it out last time we did, so I would appreciate a good vote.

If you will give me your undivided attention, I will read it. Arkansas has received the new redistricting data from the United States Census Bureau. The software utilized to draw maps, auto-bound, did not anticipate changes in the provisions of the new data, and the codes do not match. We had no way of knowing this until the new data was actually received.
We are informed that the software company revised the software over this past weekend and is in the process of creating and providing our customers, us, with a new work and revision. After we receive this revised software, the new census numbers must be converted to work within the newly revised software structure. This process will take a number of days to complete. As soon as the software, data, and equipment are all correctly working together,
we will announce the redistricting maps can be drawn. Thank you, Mr. Speaker.
