I've had the opportunity to be with you here with some consistency at the beginning, but I know there are other pastors who would like the honor to come and pray with you and for you. First of all, I want to say thank you so much for the city, county, and local that asked me so many pointed questions the other day, and I thank you for going through it thoroughly. House Bill 1025 will enable a levy district in more than two counties to assess taxpayers in a fair and equitable manner, and that's the way it should be.

I do rise to speak against House Bill 1025 for a number of technical and equitable reasons. First of all, there are some unfairness, as Representative McElroy has just mentioned. For example, if you have a $100,000 house inside the city limits, it's assessed at a different value for levy tax purposes than a house outside the city limits. That is a tacking nail problem. This bill hits that tacking nail with a sledgehammer rather than a tacking problem. For example, do you remember the song from Sunday School, The Wise Man Built His House Upon the Rock? I know you've all sung it, and we won't sing it today, but this is the point. There's something called benefit analysis in a levy district. In the case of a levy, it benefits the land that lies lower, that's closer to the river, whereas the land and improvements that are built on higher areas, of course, receive less benefit from a levy. There are different assessed values according to benefit that is already in our statutes. Section, the section is actually 14-124, beginning at 101 and following. In our current law, we appoint a group of assessors. They go out and they assess property based on rural versus city versus improved versus unimproved versus timber versus cultivated. And they assess the benefits on those values and impose a tax. The levy board of commissioners, which actually governs that levy district, serves as a board of equalization in order to equalize or make adjustments in tax assessments. This bill does away with the board of assessment and puts all of the authority into the levy board. It also makes assessments based on fair market value or assessed value, just like your school taxes are, rather than a benefit analysis. Let me use an example. A timber company owns a tract of land. They are in the levee district. Their tract of land is located between the levee and the river. They get absolutely no benefit from the district, and consequently their benefit analysis is going to be somewhere close to zero. However, under this law, they will be assessed on the fair market value of that timber. Their taxes are going up. Also, under current law, there's a very, very low rate assessed on farmland. Many pieces of, many times farmland, it doesn't make any difference whether it floods or not, especially if it's duck land or low productive farmland. It's assessed at a very low rate, something like 25 to 30 cents an acre. However, that also, the way this current statute reads, that applies to the improvements to that same farmland. That is an unfairness and should be addressed by our legislature. But to go across and willy-nilly assess the fair market value of farmland now under this bill, you will be voting to raise taxes on farmers if you vote for this bill. That is clear. Their taxes will go up. Now, there are a couple of technical problems with this bill. On page two, you will find that the board, the levy boards can assess property based on the assessed value of that property, whether it's in town or out of town. Yet you go to page three, it shows that if you're not happy with that assessment by the tax commissioner, excuse me, by the levy board of commissioners, then you go to circuit court. This law also has a repealing charge, whereas before you had assessors that came in and assessed the benefit. If you didn't like your assessment or you thought it was too high or too low, you could go to the levy board and they would act as a board of equalization, same thing as we do with our property taxes in this county. This is now removed. That protection for all people has been removed, and you must hire a lawyer, go to circuit court, who then makes the determination not on the assessed value, but on the benefit. So there is a legal inconsistency you'll find on pages 2 and pages 3. On the one hand, the board assesses value based on value of the property, and on page 3 you find where the court uses a benefit analysis. What that means in real life, rich farmers, rich companies that can afford to go to court and get their assessments lowered will do so. So poorer people will not have that opportunity. When that levy breaks, my house floods just like the one in town. Everybody in town, the guy in town that's got a $200,000 home pays $200 worth of levy taxes. Now, is that fair? No, it's not fair. And I don't care. I'm raising my own taxes. But if you lived in town and a guy lived right out to the city limits, you wouldn't want to pay that. I pay 27 cents. And yeah, my farm ground is worth $4,000 an acre. And when that levee breaks and the Mississippi River strolls about 10 foot of sand on it, it won't grow anything for the next 10 years. You can ask the people over in the Red River that. I don't like taxes. I know y'all don't either. But fair is fair. Everybody ought to pay their fair share. And this is to affect this one county. The counties in our area we were trying to affect. And we weren't trying to force this on anybody. And it's up to the levee district. Right now, back last year, or the year before last, when that river got so high and it looked like it was going to break, I assure you we found out how important that levy district was because they're the ones that maintain that levy. recognized to explain your bill. Thank you, Mr. Speaker. Well, I've got good news for you all today. I've got an opportunity for you. You've heard that before, right? This is an opportunity to go back to your districts, to your constituents, and say, hey, I helped pass something that made government a little bit better today. This is good news here is that this is not a mandate for anybody to do anything. Nobody has to change anything about the way they do business if they don't want to. What it does do, under current Arkansas law, counties are required to physically mail via U.S. Postal Service tax statements. And as you know, our society, we're moving into an age where a lot of folks like to do everything electronically, and they would prefer to get their tax statements via email. However, the counties do not have that as an option because of state law to be able to offer that to people who would like that as an option. That's what this law does. It provides the counties that want to do this to be able to offer to their taxpaying citizens who want to do this the ability to receive their tax statements via email. It's about efficiency in government. It's about saving some postage costs. It's about allowing people to do business the way they want to do business. Again, this is strictly a local option for the counties. The origin of this idea, I had seen some comments from my local county tax collector, Joy Ballard, who had said, you know, we'd love to be able to offer this. We know that there are people out there who want this. I called up the Association of Counties to talk to Chris Velines, see what they thought about it, and he said, well, we think it's a great idea. That's why we're already drafting it. Deborah Buckner in Pulaski County had come to them with the idea as well. The Association of Counties is behind this. The Collectors Association supports it fully. This, I appreciate Representative Howes, he, again, thoroughly vetted my bill as well before it came before the committee. We worked out some issues there. The Land Commissioner's Office offered a suggestion to clarify some language in there. We adopted that into the bill. It's been through the rounds. Senator Uvalde Lindsey is going to carry it on the Senate end, assuming you all pass it today. And for those of you who have served in the chamber with Mr. Lindsey in the past, you know that he is not one to take lightly his name going on something. He makes sure that the T's are crossed and the I's are dotted first. Happy to take any questions if there are.

Thank you, Mr. Speaker. Senate Bill 4 is a bill that comes to us from the Senate. It deals with the way millages funds are collected for certain colleges in the state two-year colleges. This bill affects Representative Westerman and Cozart and my National Park Community College. It will also affect Northwest Arkansas Community College, North Arkansas, I believe at Harrison, and Rich Mountain Community College over in the MENA area. What this does is it clarifies the language on a millage election that allows colleges to – these colleges will be allowed to use those funds collected to construct, reconstruct, expand, and repair facilities. The way the law is written now, it's only that that millage money that's collected can only be used for capital – for operation expenses. And all this does is clarify that language so that these colleges are treated like every other community college in the state. With that, as we said, it's been vetted in this past in the Senate, been vetted in committee here, and I would appreciate a favorable vote. Representative Vines has explained the bill.
