against any bill thank you thank you madam chair and committee I've got a very simple bill I call it a housekeeping
bill for cities that have city administrative forms of government currently there's only three cities in the state that's Fort Smith Arkansas Salem Springs and Barley Arkansas and basically what we want to do is it's changed the filing period to give our city clerk ample time to file the documents that she needs to certify and basically and I'll just read this as any person design to become a candidate for mayor or directorship file with the city
clerk not less than 75 days we want to change that to 75 days currently 70 days and the requirement for the city clerk is to complete all of her documents so on occasion someone may foul at the last minute which puts a burden on our city clerks to the extent that she may have only three or four hours to complete her work so what we want to do is give her a five-day period to certify that that information

are you're sitting at the table thanks madam chair members of the committee the house bill 1235 basically repeals the the obsolete requirements for reporting and maintaining the records
of stolen and recovered vehicles to the Department of Arkansas State Police this method is no longer needed there's with modern technology everything is reported back to a state database at the ACIC and this is just deleting this this statute basically cleaning it up questions from the committee I notice we have the director of
Speaker 7
6:31

would you like to go ahead and present your next one yes madam chair house bill 1236 is another issue brought up by the state police basically clean up some language to repeal certain positions that no longer exist in the state police and they're deleting the manager division investigation unit and drug diversion investigator no these positions are no longer used there's nobody that were that was in these positions that would be have to be
grandfathered in or anything basically they've delegated their duties out to other positions and now they just want to get rid of these positions and delete those two I have a question that's interesting why
Speaker 1
7:53
do we need to do that by statute why would that not just be done internally I have the
Representative Wes Wagner

8:04
major J.R. Hankins here might be able to answer that a little better than I could
Speaker 7
8:12
well yeah I'm just you know it's just a curiosity that you know if if they're not there does it affect your standing with OPM does it affect I mean I'm just curious why it would have to be done by statute rather than
Speaker 51
8:31
for the record a major J.R. Hankins I'm the highway patrol divisional commander for state of Arkansas thank you and I really don't know the answer to that question I wonder the same thing myself but we were
asked to bring that over and present it by our legal
Speaker 7
8:45
section okay well they probably know something we don't then this is my guess any other questions pardon me representative bill madam
chair I guess it's just a general inquiry in inquiries I'm sitting here looking at the bill they are in currently in statute so I guess to get rid of them we have to take them out of statute I'm not sure why they're in there to start with but they're
Speaker 14
9:05
clearly there will it affect the number of personnel you're allowed through OPM that
Speaker 33
9:11
that's fine you don't have to answer that I don't think there's
Representative Over

9:16
anybody in those positions and likes from from the research I was able to do they've delegated their their duties out to the other positions so like representative Bell said with it being in the statute they have to do this to get it out it sounds good representative Kerr

the representative of District 11, and I have with me the Director of Emergency Services, Mr. David Maxwell. And I'm glad to see that you're in a good mood this morning because the last committee I was before had a few pit bulldogs in it.
So I appreciate your good spirit, and I hope that continues. There are no guarantees. I will say this. I've heard people say this is a simple little bill. I found out since I've been here this week that there's no simple little bill. So this one, though, is an act to amend the law concerning the declaration of emergencies under the Arkansas Emergency Services Act to declare an emergency and for other purposes. And this is to actually clarify some issues.
I was county judge for 20 years, and one of our main concerns was the safety of our people. And as we had a flood a couple years ago, I had to decide when to evacuate the people if it would come to that point. And it really is not clear whether we or the governor had that charge to do that. And, you know, it's just sometimes in a tornado or something like that, you have to contact the governor to declare an emergency.
And, you know, if the levy was to break at any time in some emergency like that, the local officials really need to be able to say, look, it's time to go. So with that, I'm going to defer to my professional to my right, Mr. David Maxwell.
Speaker 38
12:16
Welcome, Mr. Maxwell. Thank you. And this
Speaker 62
12:20
is another one of those pieces of legislation to try to clean up some things and to clarify. It was always implied in the legislation, the authorities of the chief elected official of a jurisdiction.
This fully clarifies, and it gives them the authorities, once they've declared, to implement all of the functions of emergency management. And there's another little part of the bill that changes some statute to for our what we call ADAT, which are temporary employees that we use during disasters. In the legislation, it called for them to be used for no more than 60 days a year.
and that it's in conflict somewhat with personnel management's temporary hires which allow 1,000 hours a year so we're just pulling it into alignment with the
Speaker 63
13:19
office of personnel management committee do you have any questions representative bill
madam chair specifically the first section there that you're adding the additional
language to initiate emergency management functions under this sub chapter what is that just a blanket catch-all piece of language there because as I'm reading the language is currently there to activate the response and recovery aspects of any and all applicable local or inter jurisdictional disaster emergency plans and authorize the furnishing of aid and assistance what what else would you
Speaker 62
14:04
be needing to do this clarifies it refers back to the definitions and the definitions of the emergency management functions which
include specifically things like evacuation and that sort of thing sheltering okay so there's the this is actually referring
to a section that we don't have yes they're provided in the bill okay just one more question madam Sure. As it relates to the language that we're striking out regarding the 60- and 90-day limit, you indicated that OPM, that that's their current policy and that this is just aligning with their current policy?
Speaker 62
14:46
Their current policy is 1,000 hours, and we felt like this locks in a certain period of time As personnel makes changes to their policies, this would allow some flexibility there to make sure we're always in alignment with what personnel management is saying. In the era of term limits, obviously we're missing some
institutional knowledge here. Do you have any idea why that time and date limit was put in statute originally?
Speaker 62
15:20
I was in the agency at the time, but I think it was just a figure pulled out of the air that somebody thought would be plenty of time to be able to do the job. And as we found in 2011, well, the last five or six years, we've had back-to-back-to-back-to-back disasters, and the 60 days really hasn't been adequate to rotate. we've got very few of these people that we've trained and being able to have
some continuity through the full 1,000 hours will be helpful to us thank you appreciate your answers representative Catlett did you
Speaker 69
16:03
have a question okay any other questions from the committee is there anyone in
Speaker 7
16:12
