you, Mr. Speaker. The Speaker, may I have a special privilege to have the Jefferson County Delegates to join me here in the well? Of course. Colleagues, today, the Jefferson County delegates stand before you to celebrate the 100th anniversary of our state flag
and also to honor the designer of our state flag, Mrs. Willie Kavanaugh-Kirk. better known as Ms. Willie May. As you all may know, if you all have visited the Secretary of State Office, you will see an original copy of that particular design. Willie May was born in Madison County, Kentucky in 1865, and she later, at an early age, and her family moved to Jefferson County,
and they located to the Pine Bluff area and the Wapasika area. Mrs. Hook was also an educator, and she taught school for more than 34 years in that particular area. In late 1912, the Secretary of State, the Honorable Earl Hodge, initiated a contest in order to design the state flag. There were more than 65 entries that were judged at that particular time.
So on February the 26th, 1913, there was a committee that selected her flag as the winner for the state flag. So this particular delegation stands before you today not only to celebrate the 100th birthday of the Arkansas state flag, but also to honor her as a designer of the flag. So at this time, Mr. Speaker, if you will have the resolution ready in the entirety, we will appreciate it. Mr. Clerk,

Whereas Willie Cavanaugh Hawker was born on July 21, 1862, in Madison County, Kentucky, moved with her family to Arkansas in 1870, taught school in Pine Bluff and Wabaseka for 34 years and established residences in both cities, was a published poet and a short story author, best known for her poems Arkansas and Ozark Mountaineer, and died in her home in Wabaseka on February 6, 1944. And, whereas Willie Hawker represented Arkansas at the National Federation of Business and Professional Women's Club's pageant
of famous women of the United States in 1929, was a longtime member of the Daughters of the American Revolution, and on October 14, 1938, the respected educator was honored by the Wabaseka School Board's dedication of the first modern brick building in Jefferson County, a newly built high school in her honor. And whereas in the early 1900s the USS Arkansas was a newly commissioned Navy battleship and the roots of the official state flag which originated in Jefferson County
can be traced to 1912 when the Pine Bluff chapter of the Daughters of the American Revolution resolved to present a naval battalion ensign and a state flag for the new ship. And whereas at the chapter's urging, Secretary of State Earl W. Hodges initiated a contest seeking potential designs for the flag and agreed to chair a legislative committee to select the winning design. And whereas in 1913, the committee chose a red, white, and blue design submitted by Willie Hawker of Wabaseka, Arkansas, from among 65 entries.
And Willie Hawker is one of only two women in the United States to have her design adopted as an official state flag. and whereas the design featured a rectangular red field upon which centered a white rhombus diamond bordered by 25 white stars on a blue band. Three stars centered on the flag's horizontal axis on a white field within the rhombus completing the plan. And the three stars in the center field bore several meanings. First, that Arkansas had successively belonged to the three countries of France, Spain, and the United States before statehood.
Second, that 1803 was the year of the Louisiana Purchase, which included present-day Arkansas. And third, that Arkansas was the third state created from the Louisiana Purchase. and whereas the design's 25 white stars symbolized that Arkansas was the 25th state admitted to the Union and the diamond marked Arkansas's status as the nation's only diamond-producing state, and whereas the committee decreed that the flag ought to bear the state's name,
designer of the flag ascended and suggested that the three blue stars be arranged with one above the name and two below. On February 26, 1913, the General Assembly adopted a design as the state's official flag. The design remained unchanged until 1923, when the General Assembly added a fourth star to the central diamond to represent Arkansas's membership in the Confederate States of America. At first, the stars were arranged with two above and two below the state's name,
But the second extraordinary session in 1924 placed three stars below and one above, with the lower stars arranged in an inverted triangle, and a new element of symbolism was added by the twin stars immediately below the state's name, suggesting the twin relationship of Arkansas and Michigan, which were admitted to the Union within approximately seven months of each other, maintaining the balance between free and slave states in Congress. and whereas the Arkansas state flag has flown over thousands of governmental and private locations throughout the state
and the state of Arkansas is proud to observe the 100th anniversary of the adoption of the official state flag now therefore be it resolved by the House of Representatives of the 89th General Assembly of the state of Arkansas that the House of Representatives honors the memory and accomplishments of Willie Cavanaugh Hawker as the mother of the Arkansas state flag and salutes the 100th anniversary of the flag. Be it further resolved that the House of Representatives declares February 26, 2013 as Willie Cavanaugh Hawker Day and supports and encourages the establishment of a memorial
in her hometown, Wabaseka, Arkansas, honoring Willie Cavanaugh Hawker and the

going to be one of those bills that once I explain it, you're going to go, huh, that's a pretty good idea.
I hope. All right, this bill came out of Teachers of Retirement. The situation is that Teachers of Retirement pays survivor benefits to minor children of active Teacher of Retirement members and T-drop participants who die before retiring. The survivor benefits is 20% of the member's best one-year salary or current contract if it's higher.
A member earning $50,000 would have a $10,000 benefit to each minor child with a 3% COLA up to three children. Teacher retirement currently pays over $8 million a year to 627 survivors. This is an average benefit of $12,500 a year or just over $1,000 a month. The benefit is paid until the child reaches 23 years of age, if in school full-time.
Arkansas law requires any payment over $10,000 for a minor must be paid through a guardianship. Now, this is the current law to ensure the money is used for the benefit of the minor. The problem is that even if the guardian is a parent, he has to apply, he or she, excuse me, has to apply for guardianship or has to apply for survivor benefits.
In other words, he's got to go get an attorney, have that account set up, and go through all those hoops, even if that person is the guardian, the parent, or the person that's responsible for that child. SB 195 will allow an exception for the requirement of a guardianship for teacher retirement survivor benefits. The exception allows a payment within a guardianship if the payment's made to the minor beneficiary's parent, legal guardian, or trust company.
The value of the survivor benefit does not exceed $20,000 per year. Arkansas Teacher Retirement won't be liable for any misuse of the funds paid to the minor's parent, legal guardian, or legal custodian. The intent of the bill is to eliminate the cost of a guardianship that a family of a teacher retirement member must currently spend to establish a guardianship to eliminate court supervision. In other words, they have to apply for this court supervision even though they are the parent.

I've sat in on the Retirement Committee when this bill was presented, and many of the questions that Representative Steele has already verbalized were discussed at length, as Mr. Kerr has already indicated. The only thing I add to his presentation of this bill is that it is designed to simplify for small amounts of money to avoid the prospect of having to hire an attorney that will basically eat up the benefit that the child would be due.
This is a simple housekeeping matter. It allows the child to be the direct payee, even when the person responsible is a natural person, such as a mother, father, or custodial grandparent. This is a good bill. I urge your support. Thank you. Does anyone wish to speak against the bill? for

Back in late summer, a constituent approached me and said they had been pulled over by a police officer who would not accept their proof of insurance on an app on their phone. They contacted me, and I contacted my insurance agent, Chris Lamberson, Nationwide, Russell, Arkansas, Main Street. And that was a shout-out, Chris. You got it. And asked him if he had experienced that at all. Yes, he had.
And he asked me if I could do something about it. So I contacted the Attorney General's office and asked them for an Attorney General's opinion as to if that would be considered proof of insurance in your vehicle. They said as the current law stood, it would not. So I got BLR and the AG's office together and got them to write this bill up. It was vetted in the Transportation Department, pardon me, Transportation Committee.
