thank you mister speaker members i wanted to take the opportunity to honor our house chaplain, Dr. Rex Horn. I just wanted to say a few words in appreciation of Dr. Horn. A few years back, my church in El Dorado was without a pastor and I had the, I guess, the pleasure of serving on the pulpit supply committee and so we were looking for an interim pastor during that time. And as I visited with different members to the Baptist church around the state, someone suggested, well, you should ask Dr. Horn. Dr. Horn was wrapping up his time as president of Ouachita Baptist University, my alma mater, but I thought surely Dr. Horn had better things to do, and as someone who has pastored very large churches, small churches, has been an advisor to a president and others, that there was probably no way he would care to spend his Sundays in Eldorado, but I called him, and he accepted and spent the better part of probably a year to a year and a half, a couple Sundays a month in Eldorado, and so I got to know him even better, and then on top of that, when I had the opportunity to ask for a house chaplain, I thought again of Dr. Horn, and I very much appreciate his prayers throughout the session. I told him the other day he's probably detected how the session has changed because the first several days that he was here he would come back and we would visit my office for a little while and lately it's just been kind of given a little wave from the rostrum as he left as he leaves the room. So but I wanted to take this opportunity to present him a certificate of appreciation and as this is if everything goes as planned this would be his last day to pray for us during the regular session, but I also would ask that you join me in showing our appreciation

Today, I have the privilege of recognizing one of my residents, one of my constituents, Ms. Hazel Bullock, and she is turning 100 today, and she's in the gallery. You probably can't see her, but let me read. Yes, thank you for waving and acknowledging her. Hazel Bullock was an educator for 50 years in various historically black colleges throughout the state. Later at Central High, she became one of the first advanced placement teachers at Central High School. She is widely acknowledged for her craft and for her teaching, for helping to nurture nearly a thousand students at Central High AP program and through special tutorial efforts which she engaged on her own time. Her good deeds as a teacher reflect themselves. Many of her mentees throughout the work now work in education and various professions throughout the United States. She was a grandmother figure to me, mother figure to others in Alpha Kappa Alpha Sorority Incorporated, and her impact has widely extended beyond the community. I am proud to know her and support this recognition in her honor and celebrate her on her 100th birthday today. I ask that you join me in recognizing and celebrating this big accomplishment that I think is a big accomplishment, and I'm asking the clerk to please read the resolution. was born in Calumet, Arkansas on April 9, 1919 to Lily and Clarence Sutton, and whereas Ms. Bullock graduated from Paul Lawrence Dunbar High School in Little Rock, Arkansas in 1937, received her Bachelor of Arts degree in English in 1941 from Philander Smith College, and completed her education at the University of Arkansas with a master's degree in education in 1955, whereas Ms. Bullock served as an educator in Arkansas for 47 years, and whereas during those 47 years, Ms. Bullock had the wonderful experience of teaching high school and college students all across our state, including teaching students for five years at Pine Street School and Conway, six years at Bradley County High School in Warren, Arkansas, 10 years at Lincoln High School in Fort Smith, Arkansas, 15 years at Central High School in Little Rock, six years at Shorter College in North Little Rock, and five years at Arkansas Baptist College in Little Rock. And whereas Ms. Bullock was a proud member of the Miles Memorial Methodist Church and the National Alumni Association for Flandersmith College, is a life member of the Alpha Kappa Alpha Sorority Incorporated and was initiated in Gamma Alpha Chapter, is a diamond member of the Alpha Kappa Alpha Sorority Incorporated with more than 75 years of membership and is a current member of the Alpha Kappa Alpha Incorporated Beta Pi Omega chapter and whereas Miss Bullock is predeceased by her husband Mr. S. you, Mr. Speaker. Thank you, colleagues. This is the last item I'm going to bring before you this session. I thought I'd bring one that was kind of fun and lighthearted. But before I do, I'm going to ask my dad, who's over here in the East Gallery, if he would please stand. He's going to shoot me for this after a session. But my dad has attended all but about five days. So he's been through every session with us, all sorts of committee meetings. So if we had an endurance award for a member of the citizenry, he would be on that short list. So I appreciate him being here today. But the reason why I wanted to introduce him to you is because when I was seven years old, my dad took me outside and let me look at the moon through a telescope. And as you all know, it sparked a lifelong love of the stars. Since that time, I've seen every planet in the solar system, including Pluto back when it was a planet. I've seen galaxies, nebulous star clusters. And also, I had a friend who was a director at a news station, so I had the opportunity to attend about two dozen space shuttle launches for at the Kennedy Space Center. Got to meet a lot of the astronauts, was a producer at a local planetarium. And so a couple years ago, I purchased a portable planetarium system, and now my dad and I travel the state and do portable planetarium programs, hoping to create that same spark that my dad created in me in the next generation of Arkansans. And so when one of the lobbyists came to me and approached me with this idea of commemorating the 50th anniversary of the Apollo moon landing. I thought that was a wonderful idea because it can be argued that this is probably the greatest achievement of the greatest generation. The first people were launched into space in 1961 and less than eight years later they were landing people on the moon. Less than eight years. And as of today the Saturn V rocket that they used to do this is still the largest rocket that has ever been created. And just out of irony this morning. The new NASA administrator said it is their goal to put the next human on the moon in the next five years. So I think that is awesome. And as part of this, one of the things I thought that y'all might find interesting was I wanted to see, were there any astronauts, anybody from Arkansas that had actually been into space? Because there have been over 300 people launched into space so far. And I was afraid the number was going to be zero, but I was encouraged to find it's not. There are actually two people that were born here in Arkansas that have actually been into space. One of them that I want to point out in particular, Richard Covey, he was the one who was talking to the Challenger crew the morning of their fateful flight. He was the one that told them to throttle up the engines that eventually, we know the outcome there. And so he made it his goal to be on the next shuttle flight. So when Discovery returned to flight two years later, he was the pilot on that mission, and he went on to be a commander of future shuttle missions. So I wanted to acknowledge that we do have some Arkansas heroes that have been involved in the space program. And whereas, however, on July 20, 1969, Lieutenant Neil Armstrong and Colonel Buzz Aldrin completed the goal of making the United States the first and only country to land a human on the moon as of 2019. and whereas there have been six Apollo missions to the moon and 12 Americans have walked on its surface and whereas two individuals born in Arkansas have served in space, Space Shuttle Commander Richard Covey from Fayetteville, Arkansas and Space Shuttle Astronaut Scott Parzinski from Little Rock, Arkansas and whereas when the American spirit is unleashed we can accomplish what once was thought impossible. Now therefore be it resolved by the House of Representatives of the 92nd General Assembly of the State of Arkansas that the House of Representatives joined the National Aeronautics and Space Administration in commemorating the 50th anniversary of the first humans landing on the moon and calling for the first United Nations to establish the Apollo 11 landing site as a World Heritage Site to support the ongoing work of the National Aeronautics and Space Administration to return astronauts to the moon and to make America the first country to land a person on Mars and believing that through those efforts, one of our citizens who is a student today could be the first Arkansan to walk on the moon and perhaps even

The reason that's important is a lot of people are taking advantage of that, and it puts people with a service animal at disadvantage. So it just makes that illegal and puts a fine on there. all right Senate bill 520 we started this in the hat in this in the Senate this time, and it's been down there for, I guess, about three weeks. Sorry, I'm out of breath. I ran back into the chamber. It's been down there for about three weeks during that time. So I guess you could say I was the mean one here. I let Senator Hammer work out all the kinks with the bill before it came to our end this time around. So we've amended this bill multiple times. I believe we've had three amendments on it to get this bill to where it is today. So let me tell you what it does, and then I'll tell you what it does not do so that everyone's more comfortable with it. We passed legislation in 2015, which is what we call the MAC law or Act 900. It was the first time that I had dealt with this since I'd been here. It was my first session. Then we had special session last year where we enacted some regulation through the insurance department. They're just now getting that up and running. I think we're just a couple months into their regulation. What we're doing here is we're closing some loopholes with the previous MAC law from 2015, and we were changing the definition of the maximum allowable cost to include all drugs and not just generic drugs. Let's kind of skip down here. One of the other things we're saying is that there's a prohibition of reimbursement to a pharmacy on ingredient cost of a drug below a national average of drug purchase price, and pharmacists call that NADAC, NADAC pricing, so what we're saying is you have to, used to, we kind of said with the MAC law, you had to pay at least what the MAC reimbursement rate is. Now we're saying you have to pay at least what the NADAC reimbursement rate is. So as things change, we have to update our statute to reflect that as well. With that NADAC pricing, NADAC pricing only updates itself. It's a national pricing index that everyone can see. It updates about every 17 days. So we currently, in current statute, we say that the PBMs have to, on appeal, they have seven days to respond and make it right. So because NADAC only updates every 17 days, we've changed the appeal process to 30 days, and that allows the PBMs more time for that NADAC pricing to update. We just had to match those up. One of the other things we're doing is rebate transparency. So we had one little sentence, if I remember correctly, in the bill from a special session that essentially gave the insurance commissioner the ability to promulgate rules around rebates, but we weren't very specific or prescriptive with that, and so what we're doing in this bill is making that more prescriptive so that the insurance commissioner kind of knows what to do with that. Interestingly enough, today the U.S. Senate Finance Committee is holding hearings with PBMs, and one of the things they're going over is rebate transparency so that the Senate Committee on Finance can get a better understanding of how the rebates factor into the pricing of medication. So it's interesting or kind of coincidental that they're working on the same thing today in their committee. This information for right now, and that's one of the questions I got in committee, is what's going to happen with this information when it goes to the insurance commissioner? So I tell you right now, the answer is I'm not sure. We don't know what that data looks like. We don't have that rebate information. It's not going to be foiable. It's considered proprietary information, but we won't know what to do with that information, or the insurance commissioner does not know what to do with that information until they get it. So that's something we may end up having to follow back up on in future sessions just to deal with the rebates. We're prohibiting spread pricing by PBMs. So if you have a PBM that pays a pharmacy $100, then they turn around and they charge the health plan because you've got to remember they're in the middle. So you've got your pharmacy, your PBM, and then your insurance carrier. We'll just say Blue Cross, for example. So they pay the pharmacy $100. They turn around and charge the insurance company $200. They keep $100 for themselves. So we're prohibiting that spread pricing model. That's one of the things that they were also looking at in the U.S. Senate Finance Committee today was talking about the spread pricing. I've been told that Arkansas Works does not use spread pricing anymore after the law we passed in special session. I'm not aware that the passes are using spread pricing. I know I think at least one or two are using more of just a third-party administrator where they have a straight processing fee. So this would affect, would have loved to have had this on the books in 2015, but we didn't back then. So essentially what this is doing, I don't think that anyone's currently using it, but it will keep them from doing that practice in the future. And then also, So, and to me, this is one of the most important things, and this is what's hitting pharmacies the hardest right now, is we're closing up a loophole with retroactive payment reductions. So, we call our, in the pharmacy, I say we, I'm not a pharmacist, but in the pharmacy world, we call them clawbacks. So, a pharmacy has the right, if a prescription comes back, so let's say they pay $20 for it, and they're going to get reimbursed $5. They're like, well, we're going to take a $15 loss, which usually they would go ahead and fill it on a loss that small, but we'll take a $15 loss. We're not going to fill that prescription. We gave them the right to do that in 2015. So what's been happening since we passed that law is the PBM will go ahead and reimburse them $25, so it's a $5, I'm going to say profit, but $5 for operating costs. They go ahead and fill it, then three months later, and so I think they do it either quarterly or yearly, they'll come back and they'll loop back around and claw money back from that prescription. So then technically they sold it at a loss, but they didn't know it three months earlier when they actually filled the prescription. And one of the biggest issues with that is when they do the clawbacks, they're not clawing back on a per-prescription basis. They're clawing back in aggregate. So the pharmacists have no idea what medications they got clawed back on. There's no methodology, and the PBMs won't share that information as to how they came to those numbers, and so when I'm talking about clawbacks, it's not, we're not talking $500 or $1,000. I've seen invoices for $60,000, $80,000. They're clawing back in a quarter. These are large amounts of money, and these are my hometown, smaller pharmacies. I can't imagine what the larger pharmacies are getting in clawbacks, and so just to clarify, this bill will address the, and it clearly, there was some confusion as to whether or not the law we passed and 17 affected the passes. So this clarifies that it does. That was our intent then. And that's what we stated. I think I stated that from the well. So this does cover the passes. It covers Arkansas Works and other fully insured plans, which is commercial plans. It does not touch ERISA plans. We cannot touch those self-insured employer plans. One of the things that we did, we took out of the bill, there was a 5% on specialty. We took that out of the bill. And then there was a lot of contention around the dispensing fee. I know some people wanted it in there, and some people did not want it in there, and my biggest issue was it was going to, it more than likely was going to cost the state quite a bit of money budget-wise, but also I was not comfortable charging a $10.50 dispensing fee per prescription on the commercial fully insured plans, the ones that weren't state funded, because that would have essentially been a mandate to business owners and private individuals and I was not comfortable with that so that was my amendment that I asked to be put on the bill.
